Thompson, Public Works Director ATTACHMENTS: 1) 2) 3) Resolution Grant Deed with Plat and Legal Description Location Map RECOMMENDATION: ~ ~opt Resolution FINANCIAL STATEMENT: The City will receive a total of$14,805 for the 705 square foot property. This is $21 per square foot, which is the same price that the purchaser paid for the adjacent development property. . DESCRIPTION: In July of 1998, the City Council declared a small (705 square foot) piece of San Ramon Road right of way as surplus and authorized Staff to negotiate with the adjacent property owner for sale of the property. Schuler Homes, the developer of the Starward property, is purchasing this area for inclusion in the rear-yard area of some of the proposed single-family lots. In accordance with Government Code Section 54222, Staffhas contacted housing authorities and park and recreation agencies in the area, who have declined interest in the property. In addition, the utility companies have verified that there are no existing utilities in this area; therefore, no easements need be reserved. : The City's Muncipal Code allows sale of public property to an adjacent property owner without formal solicitation of bids if the property is not large enough to be viable on its own. Sale of property in an amount over $5,000 requires City Council approval. The proposed purchase price is $21 per square foot, or a total of$14,805. This is commensurate with the purchase price for the adjacent Starward Drive property. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* APPROVING SALE OF REAL PROPERTY TO SCHULER HOMES (EXCESS SAN RAMON ROAD RIGHT OF WAY ADJACENT TO STARW ARD DRIVE DEVELOPMENT) WHEREAS, Schuler Homes has requested to purchase 705 square feet of excess San Ramon Road right of way; and WHEREAS, the Dublin City Council has declared the property surplus, and the property has been offered to housing authorities and park and recreation agencies in accordance with Government Code Section 54222; and WHEREAS, said housing authorities and park and recreation agencies have declined interest; and WHEREAS, utility companies have verified that there are no existing utilities within the parcel proposed to be purchased; and WHEREAS, the $14,805 purchase price has been negotiated and agreed to by the City and Schuler . Homes; NOW, TIffiREFORE, BE IT RESOLVED that the Dublin City Council approves sale of the subject right of way, as shown on the attached Exhibits, to Schuler Homes; BE IT FURTHER RESOLVED that the Mayor is authorized to execute the deed.
