(V-1i737), has filed vlith the 1\liJn:eda County Planning Com1nission an application for a Variance to construct un addition to the rear of a ' dwelling so as to reduce rear yard from the required 20' to 15' in an R-l (SinSjlc Far'1ily Residence) District, located at 71+23 Lir.12rick !\Venue, north side, 280' '\i2St of the intersection with Chatem Street, Dublin Area, PleDsanton Township, as shown on a plot plan on fi Ie vlith this CO''''11i5sion; and \1HEREAS this Commission did hold a public hearing on said application clt the hour of 1:30 p.m. on the 19th dily of t\arch, 1969. in the County of f\lame:da Public \!orks Building, 399 E1rnhurst Street, Hay\'wrd, California; and WHEREAS it satisfactorily appears from affidavits on file that newspaper notice of said public hearing was given in all respects as required by law; and WHEREAS this Commission does find that: (a) There are special circumstances applicable to the property which deprive the property of privileges enjoyed by other property in the vicinity under the identic~l zoning classification; (b) The granting of the application vii 11 not constitute a grant of spetial privileges inconsistent with the limitation upon other properties in the: vicinity and zone; (c) The use will not be'detrimental to persohs or property in the neighborhood or to the public welfare: Now Therefore BE IT RESOLVED that this Com11ission does hereby approve said application as sho','Jn on a plot plan labelled "Exhibit A" on file with this Comr.lission subject to the following condition: Said Variance shall become null and void if a building permit is not secured by I-larch 19, 1970. Except as spetifically stated above, the land and use of this property shall comply with all the provisions of the County zoning Ordinance. Said Variance shall be subject to revocation for cause by the Planning Commission after seven (7) days notice and a hearing by said Co',,~lis5ion. ADOPTED BY THE FOLLOWING VOTE: AYES: Commissioners DeBernardi, Gardella, Carpenter, Enos, Vaug~ns and Chairman Kauffman. NOES: None. ABSENT: None. EXCUSED: Commissioner Spencer, ABSTAINED: None.
