A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
FINDINGS AS TO WHY AMENDMENTS
TO THE UNIFORM CODES ARE NECESSARY
WHEREAS, Section 17958 of the Health and Safety Code of
California requires the cities to adopt ordinance which impose the
same restrictions as contained in the Regulations in the State Building
Standards Code; and
WHEREAS, the 1982 Uniform Building Code, the 1982 Uniform
Plumbing Code, the 1982 Uniform Mechanical Code, the 1982 Uniform Housing
Code, and the 1981 National Electrical Code have been adopted in the State
Building Standards Code; and
WHEREAS, this City Council having before it an ordinance adopting
those codes set forth herein above with changes or modifications; and
WHEREAS, Section 17958.5 of the Health and Safety Code of the
State of California authorizes the cities to make changes or modifications
to the provisions of the State Building Standards Code as the City determines
are reasonably necessary because of local conditions; and
WHEREAS, this City Council has reviewed the reasons for those
changes and modifications;
NOW, THEREFORE, BE IT RESOLVED that this City Council does hereby
declare and express that said changes and modifications are necessary
because of local conditions and the reason therefore are set forth as
follows:
Chapter 1 Administration combines all the administrative provisions of ~he
Uniform Building Code, Uniform Plumbing Code, Uniform Mechanical Code, and
Uniform Housing Code in one location. It has been modified to accommodate
the unique elements of City of Dublin governmental structure.
Section 22.1, 22.2, 22.3, 22.7, 22.8 are modified to eliminate conflicts
with Title 24 California Administrative Code.
Section 22.5 is added to assure that the yards required by Section 506 of
the Uniform Building Code are permanently maintained. This is not a
substantive change.
Section 22.10 adds design load requirements for private bridges. The State
regulations have no requirement for private bridges. Attorney General
Opinion 55 OPS 1574-12-72 authorizes city to adopt additional requirements
which cover areas not regulated by State Building Standards Code.
Section 22.11, 22112, and .22.13~prescribe requirements for soil and geological
repOrts; standardsforl grading'~ ~nd' measures to mit~gate-.~the~effects of
expansive, soils. 'Section t7953, Ii79154~and 179.55 Health and Safety Code
requires the City to have an ordinance that addresses these problems.
Section 22.14 requires that lots be graded and drained in a safe manner.
The State regulations have no such provision. Attorney General Opinion
55' OPS 1574-12-72 authorizes c~ties to adopt additional requirements which
cover areas not regulated by the State Building Standard Code.
Section 22.17, 22.18, 22.19, 22.20, 22.21, 22.22, 22.23 and 22.24 deal with
the temporary and permanent use of public property. The use of City road
right-of-way is regulated by other city ordinances. These changes are
necessary to eliminate conflicting requirements.
Section 22.25 deletes Appendix Chapter'l of the Uniform Building Code.
Dublin is a new City. All existing buildings subject to this section were
built under code and comply with the provisions of this section. Therefore,
this section is not necessary.
Section 22.26 deletes requirements for re-roofing of existing buildings.
These requirements impose at least 2 additional inspections for re-roofing
work. Past experience indicates this is not necessary and therefore it is
deleted.
Section 22.29 prescribes requirements for private driveways. The state
regulations do not have regulations for driveways. Attorney General Opinion
55 0PS-1574-12-72 allows cities to adopt addihional requirements which
cover areas not regulated by the Department of Housing and Community
Development.
Section 42.5 has been ammended to include requirements for private water
supplies. The state regulations do not address private water supplies.

Sections 42.7 thru 42.18 deal with requirements for private sewage disposal
systems and are necessary to meet the standards of the Regional Water ~' ~
Quality Control Board;
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded
to the California Department of Housing and Community Development for
filing as required by Section 17958.7 of the Health and Safety Code of
the State of California.
