FINANCIAL STATEMENT: Costs for the study would be borne by the Applicant DESCRIPTION: Rite Aid is proposing to construct a:t 16,706 square foot drug store and a :t 1,500 square foot garden center at 7360 San Ramon Road at the northwest corner of San Ramon Road and Amador Valley Boulevard. The 1.86 acre site was formerly occupied by the True Value Hardware Store and Sleep Shop Ltd. store. ANALYSIS General Plan General Plan/Land Use The General Plan designation of this site is "'Retail/Office." This designation allows shopping centers, stores, restaurants, business and professional offices, motels, service stations, and the sale of automobile parts. A drug store and garden center are permitted by this designation. The proposed project has a Floor Area Ratio of .22 that is well within the .50 permitted by this designation ofthe General Plan. The proposed drug store and garden center facility would be located in Area 3 of the San Ramon Road Specific Plan. That area allows retail commercial shopper goods establishments such as general merchandise stores, shoe stores and home improvement stores. It also allows eating and drinking establishments and personal service establishments such as barber shops, photographers, laundries, and shoe repair. Other uses such as drive-through restaurants, public facilities and uses, and health facilities are permitted pursuant to a Conditional Use Permit. Prohibited uses in Area 3 include retail commercial uses/convenience stores such as grocery stores, drug stores and liquor stores. The proposed drug store use is therefore not consistent with the Specific Plan. The facility is proposed to be located at the site of the former True Value Hardware store and Sleep Shop Ltd. store on the northwest comer of the intersection of San Ramon Road and Amador Valley Road. This location is a valuable retail site at one ofthe busiest intersections in the City. Calaveras Fault setbacks Although the Calaveras Fault runs in front of the facility, it has not significantly constrained nearby retail sites such as Petco and Stroud's Plaza. This is because the fault is located at the eastern end of the relatively long lots fronting on San Ramon Road leaving sufficient acreage outside of the 50 foot fault trace setback for businesses to be established. . Existing Rite Aid Store Rite Aid intends to re-lease the site, where an existing Rite Aid store is located at 7201 Regional Street, when the new store is opened. It was indicated by a representative of Rite Aid that the company is in negotiations with potential tenants and that the space near Mervyn's should be relatively easy to re- lease. Reasons for approval of initiation of the Study: 1. The consolidation of three smaller parcels into a 1.86 acre parcel would provide a site that is physically appropriate for a drug store and garden center. 2. A retail commercial/convenience store such as a drug store and garden center use would be appropriate at one of the major intersections in the city. This location with its significant traffic volumes would be very advantageous to such a use. 3. The use would provide additional retail capacity within Dublin. Reasons for denial of initiation of the Study: 1. The project is not consistent with the Specific Plan which intends that the site be devoted to retail commercial shopper uses. . . . . 2. The project could negatively impact a very busy intersection at Amador Valley Boulevard and San Ramon Road. RECOMMENDATION Give staff direction and either approve or deny the applicant's request for a Specific Plan Amendment study. RESOLUTION NO. 98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN INITIATING THE RITE AID SPECIFIC PLAN AMENDMENT STUDY . WHEREAS, a Specific Plan Amendment request has been made by Kirk Smith of Retail Site Specialists on behalf of Rite Aid Drug Stores for a 16,706 square foot drug store plus a ] ,500 square foot garden center at the northwest corner of San Ramon Road and Amador Valley Boulevard. WHEREAS, the Specific Plan Amendment to Area 3 of the San Ramon Road Specific Plan would allow a drug store and garden center as a permitted use; and WHEREAS, the Applicant has stated that they would pay the processing costs for the Specific Plan Amendment Study; and WHEREAS, Section 65453 (a) of the State of California Government Code states that an amendment to a specific plan shall be in the same manner as a general plan; and WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines which consist of basic data collection, research, and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource; and WHEREAS, the consolidation of three smaller parcels into a 1.86 acre parcel would provide a site that is physically appropriate for a drug store and garden center; and . WHEREAS, a retail commercial/convenience store such as a drug store and garden center use would be appropriate at one of the major intersections in the city; and WHEREAS, this location with its significant traffic volumes would be very advantageous to such a use; and WHEREAS, the use would provide additional retail capacity within Dublin; and WHEREAS, the City Council did hear and consider all said reports, recommendations and testimony hereinabove set forth and is in support of a Specific Plan Amendment study to determine the appropriate land use and Specific Plan designation for the property before making a decision as to the merits of requested specific entitlements. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby initiate the Rite Aid Specific Plan Amendment Study; and the Staff is authorized to retain consultant services to complete necessary staff reports. BE IT FURTHER RESOLVED that the Applicant shall pay for all processing costs involved with the Specific Plan Amendment Study. PASSED, APPROVED, AND ADOPTED this 21st day of July, 1998. .
