S-646: On April 7, 1978, the Alameda County Planning Director approved a Site Development Review request (Dublin Associates) to construct a two phase commercial shopping center. Phase two included the construction of the Montgomery Ward building (134,366 square feet) and the automotive parts and accessories sales and installation building (17,648 square feet). PA 87-063: On August 14, 1987, the Dublin Planning Director approved a Site Development Review request (CASCO Corp./Montgomery Ward) to allow wall signs for the Montgomery Ward Auto Express, the Montgomery Ward and Toys R Us buildings. PA 87-157: On November 9, 1987, the Dublin Planning Director approved a Site Development Review request (Montgomery Ward) to allow wall signage for the Montgomery Auto Express building and the Montgomery Ward building. This approval superseded the previous Site Development Review approval (PA 87-063) for wall signage. APPLICABLE REGULATIONS: Section 8-48.2A.12. states that a facility retailing auto parts and supplies which are installed and serviced on the site but does not include engine, transmission or differential rebuilding or body repair is a conditional use in the C-1, Retail Business District. -2- PAGE~OF \3 Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA) under Section 15301, Class 1 of the State CEQA Guidelines. The project consists of the establishment of a car rental agency with outdoor storage within an existing automotive parts sales and repair facility, involving a negligible expansion of the use beyond that previously existing. NOTIFICATION: Public Notice of the March 15, 1993 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting Conditional Use Permit approval to allow the operation of the Thrifty Car Rental agency with outdoor storage of rental vehicles as an accessory use to the existing Montgomery Ward Auto Express business, and to voluntarily contribute traffic improvement funds in the amount of $470.00. A facility that retails and installs auto parts and supplies is a conditional use in the C-1, Retail Business District. Since the Thrifty Car Rental agency is an expansion of the Montgomery Ward Auto Express business, a Conditional Use Permit is required. An 80 square foot office will be placed inside the Montgomery Ward Auto Express building and utilized as a car rental station. The Applicant also proposes to designate 15 parking spaces for the outdoor storage of rental vehicles (see Exhibit A). Thrifty Car Rental provides car rental services to individuals having their car repaired at the Ward auto facility, or other automotive repair facilities, or for other travel purposes. Thrifty Car Rental is considered an accessory use to the Montgomery Ward Auto Express business. The hours of operation will be Monday through Friday, 7:30 a.m. to 6:00 p.m. and Saturday and Sunday from 9:00 a.m. to 3:00 p.m. Thrifty Car Rental will eventually be open the same hours as the Montgomery Ward Auto Express business. The agency will start out with 1 employee and eventually increase this amount to 2 or 3 employees. Thrifty Car Rental will not wash the vehicles at the site and all vehicles will be maintained by the Montgomery Ward Auto Express facility or other local car repair facilities in the Dublin area. -3- ~GE~OF-L2 There is adequate employee and customer parking for Thrifty Car Rental and other commercial businesses located at the project site and the adjacent shopping center in compliance with the Zoning Ordinance. As part of the project, the Applicant is voluntarily contributing traffic improvement funds in the amount of $470.00. The Public Works Department has determined that this amount adequately covers the necessary roadway improvements for accommodating an increase in project generated traffic on Dublin Boulevard. This fund will be paid prior to establishment of use. The project has been reviewed by other City departments, including the City Attorney and their comments have been incorporated into the Draft Resolution Exhibit B as conditions of approval. The Police Department noted a security problem with the outdoor car rental storage location. This area has the highest auto burglary rate in the city. A condition has been included in Draft Resolution Exhibit B stating that the Applicant shall work with the Police Department prior to establishment of use and on an ongoing basis to establish an effective theft prevention and security program. The project is in compliance with the Zoning Ordinance, the General Plan and the Downtown Specific Plan. Staff recommends approval of the Conditional Use Permit request to allow the establishment of a car rental agency with outdoor storage as an accessory use to an existing automotive parts retail and repair facility, and to voluntarily contribute traffic improvement funds in the amount of $470.00, subject to the conditions specified in the Draft Resolution Exhibit B. RECOMMENDATIONS: FORMAT: 1) 2) 3 ) 4) 5) Open public hearing and hear Staff presentation. Take testimony from Applicant and the public. Question Staff, Applicant and the public. Close public hearing and deliberate. Adopt Draft Resolution approving PA 92-070 Thrifty Car Rental Conditional Use Permit (Exhibit B), or give Staff and Applicant direction and continue the matter. Staff recommends that the Planning Commission adopt Draft Resolution Exhibit B approving the Conditional Use Permit for PA 92-070 Thrifty Car Rental. "F~ T i -1 ~ ~, ~ -. ~,-:; C- <.JLl. kie~, CO + /VI c ~, ,} '9 n l"'- (J rj (e~<., ir ell P ) e d> ", cov,f- }--I,' I J Cc~ " JJR, INC. _~:~NTAL PAGEL OF l2.. ,..., '6~ RESOLUTION NO. 93- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 92-070 THRIFTY CAR RENTAL CONDITIONAL USE PERMIT REQUEST TO ALLOW THE ESTABLISHMENT OF A CAR RENTAL AGENCY WITH OUTDOOR STORAGE OF RENTAL VEHICLES AS AN ACCESSORY USE TO THE EXISTING MONTGOMERY WARD AUTO EXPRESS FACILITY, AND TO VOLUNTARILY CONTRIBUTE TRAFFIC IMPROVEMENT FUNDS IN THE AMOUNT OF $470.00, LOCATED AT 6900 AMADOR PLAZA ROAD WHEREAS, Rodney Henrikson, on behalf of JJR Inc. dba Thrifty Car Rental, filed a Conditional Use Permit application to allow the establishment of a car rental agency with outdoor storage of rental vehicles as an accessory use to the existing Montgomery Ward Auto Express facility, and to voluntarily contribute traffic improvement funds in the amount of $470.00, located at 6900 Amador Plaza Road; and WHEREAS, the Planning Commission held a public hearing on said application on March 15, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be categorically Exempt under Section 15301, Class 1 of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a car rental agency in the Dublin downtown area. B. The proposed use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible when compared to the type and nature of operations typically found in the neighborhood. C. The proposed use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The proposed use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. PAGE~OF~ E. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan and the Downtown Specific Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 92-070 Conditional Use Permit application as generally depicted on the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of buildinq permits or establishment of use, and shall be subject to Planninq Department review and approval. The followinq codes represent those departments/aqencies responsible for monitorinq compliance of the conditions of approval. This Conditional Use Permit approval for PA 92-070 is to allow the establishment of a car rental agency with the outdoor storage of rental vehicles (fifteen (15) parking spaces designated as outdoor storage) as an accessory use to the existing Montgomery Ward Auto Express facility, and to voluntarily contribute traffic improvement funds in the amount of $470.00, located at 6900 Amador Plaza Road. This approval shall generally conform to the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, and as modified by the following conditions of approval, consisting of a Site Plan, Floor Plan and Plan Elevations (4 sheets) dated received by the Planning Department September 4, 1992. The activities associated with the car rental facility shall consist of: [PL] a. administrative and management operations b. customer service c. rental vehicle pick-up and delivery d. fifteen (15) designated parking spaces serving as temporary outdoor storage of rental vehicles. 3. The storage and parking of rental vehicles shall occupy a maximum of fifteen (15) parking spaces located at the parking lot north of the Montgomery Ward Auto Express building in conformance with the Site Plan labeled Exhibit A. [PL] 4. The Applicant shall provide appropriate pavement markings and/or signage designating the fifteen (15) parking spaces reserved for Thrifty Car Rental vehicles. [PL, PW] 5. The Applicant/Property Owner shall be responsible for clean-up and disposal of project related trash to maintain a clean, litter-free site. [PL] 7. The Applicant's voluntary contribution of traffic improvement funds in the amount of $470.00 as identified in the Applicant's project description shall be paid by the Applicant prior to establishment of use. The Applicant shall work with the Dublin Police Services Department prior to establishment of use and on an ongoing basis to establish an effective theft prevention and security program. [PO] 11. Thrifty Car Rental, also automotive use, would like to place an 8' x 10' office inside the Montgomery Ward Auto Express store to be used as a rental station, and would use up to fifteen (15) parking spaces of an existing parking Jot, Our business is to rent cars and keep them out of the parking~ lot and in the customers possession. The site plan shows that there is adequate parking and access for this limited use of the existing facility. We would be providing substitute transportation for customers while their cars are at the Wards, or other automotive repair, facilities. We also provide a full line of cars from compact, to luxury, to mini-vans. Customers rent these units for loca\ travel, week-end trips, and when they need or want a different car. Thrifty Car Rental would be renting cars. We would start out with two (2) employees and would be open 7:30 a.m. to 6:00 p.m. Monday thru Friday, and open 9:00 a.m. to 3:00 p.m. Saturday and Sunday. Eventually we would like to be open the same hours as Montgomery Ward Auto Express. As far as our inquiries show, the other auto rental companies in the area are not open on Sundays. We have found, at our other locations, that there is a demand for picking up or returning rental cars on Sundays. We, at Thrifty Car Rental, feel this application should h(~ approved because we would use only an 0' x 10' section of an existing automotive use building, would only require up to 15 parking spaces in an existing parking lot, and we woUld~ be open more days per week to provide better service to the consumer. We would generate tax dollars for Dublin, provide two (2) more jobs for the Dublin area, and provide additional competition to give the consumer an additional choice.
