ZONING HISTORY: C-3550: On March 28, 1979, the Alameda County Zoning Administrator approved a Conditional Use Permit allowing administrative offices in an M-1, Light Industrial District. PA82-004: On September 2, 1982, the Dublin Zoning Administrator approved a one year Conditional Use Permit to allow Pacific Telephone to store outdoor equipment and vehicles. PA83-053: On October 3, 1983, the Planning Commission approved a Conditional Use Permit extension to allow continued outdoor storage of Pacific Telephone equipment, supplies and vehicles. PA90-041: On July 2, 1990, the Dublin Planning Commission approved a Site Development Review and Conditional Use Permit request to allow the establishment of an automobile auction business on a leased portion of the 13.43 acre site. PA92-074: On November 20, 1992, the Dublin Planning Director approved a Site Development Review request to allow the installation of an ice storage air conditioning system along the western side of the existing Chevron Records Center building and minor parking modifications. APPLICABLE REGULATIONS: Section 8-51.3 states that other uses found by the Planning Commission to meet the intent of the district and the requirements of Section 8-51.8, Performance Standards in the M-1 District, such as automobile auctions, may be approved as conditional uses. City Council Ordinance No. 5-87 establishes regulations for auctioneers within the City of Dublin. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-95.010 Site Development Review Intent/Purpose of the Zoning Ordinance states that Site Development Review is a discretionary review process intended to promote orderly, attractive and harmonious site and structural development compatible with individual site environmental constraints and compatible with surrounding properties and neighborhoods; to resolve major project-related issues including, but not limited to, building location, architectural and landscape design and theme, vehicular and pedestrian access and on-site circulation, parking and traffic impacts; to ensure compliance with development standards and general requirements established for Zoning and Planned Development Districts, including, but not limited to, setbacks, heights, parking, -2- PAGE 2- OF )..:? fences, accessory structures and signage; to stabilize property values; and to promote the general welfare. ENVIRONMENTAL REVIEW: The project has been found to be Categorically Exempt from CEQA under Section 15301, Class l(a) of the California Environmental Quality Act guidelines. This use consists of an operation on an existing improved lot involving negligible expansion of uses beyond that previously existing. The area utilized for the auction facility, as well as the number of vehicles to be auctioned, will both increase, however, the annual number of auction events will decrease. NOTIFICATION: Public Notice of the March 15, 1993 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant, Adel Saadeh, representing Alameda County Auction, is requesting approval of a Conditional Use Permit and Site Development Review for the modification and expansion of the pre-existing automotive auction establishment located on the northern portion of the Chevron Industries, Inc. Record Retention Warehouse site, at 6438 Sierra Court. The proposed auction operation will be expanded to utilize approximately 86,000 square feet of leased space accommodating up to 130 vehicles available for auction. The original approval allowed the use of !54,OOO square feet of leased area accommodating 60 vehicles. Although this represents an increase in both the size of the auction facility, as well as the number of vehicles to be auctioned, the maximum number of auction events which may be held throughout the year will decrease from 24 to 18. The Applicant proposes to hold one auction per month. On special occasions, however, a second auction may be held within a one month period. All auctions will be held on Saturday (proposed for the third of each month). Preview days, which allow the public to view the vehicles stored on site, will occur on the Friday preceding the auction. A minimum of 10 portable toilets will be located on-site on auction days. These toilets will be serviced on the Monday following the auction event. The Applicant is proposing to relocate the existing 20' X 60' office trailer towards the front of the lot (see Exhibit A). An additional chain link fence with gate will be installed approximately 25 feet west of the trailer. This will allow the Applicant to conduct business during non-auction days while restricting public access to the storage yard. The Applicant will have 3 to 4 employees on-site during non-auction days, and up to 20 employees during auction days. As with the previous approval, all vehicles will be stored at the rear, west end of the leased space, behind the screened fence. A minimum 20 foot unobstructed roadway will need to be maintained through the storage area to allow adequate emergency vehicle access. No automotive repair work is permitted on-site. The actual auction will occur at the front, or east portion of the lot. During the auction event, the Applicant will have trained drivers bring the vehicles from the storage area into the viewing and bidding area, which will be roped or coned off. -3- PAGE.2.-0F~ At the end of the auction, all purchased vehicles will be delivered to the front gate by a trained driver. To ensure the safety of the site, only trained personnel are authorized to drive vehicles on the site. The Applicant is proposing to have security personnel on-site every night of the week, during non-business hours. Additional lighting will be added around the perimeter of the lot. In addition, the Applicant is proposing to use guard dogs each night in the vehicle storage area. The guard dogs will either be stored at the rear of the site, or they will be removed by the security company at the start of each business day. During preview and auction days a minimum of three security personnel will be on-site. The Applicant has arranged for armored pick-up on auction days. The Dublin Police Services Department has reviewed the proposed security program and has determined it to be adequate. The Applicant will be required to work with the Police Department on an ongoing basis to maintain an effective security program. This application is in conformance with the provisions of the General Plan. This application has been reviewed by other City Departments and affected agencies and their comments have been incorporated into the draft resolutions. Staff recommends approval of the Applicant's request for a Conditional Use Permit and Site Development Review, subject to the conditions listed in the draft resolutions of approval, Exhibits Band C, respectively. Record Retention Warehouse site; and WHEREAS, Section 8-51.3 of the adopted City of Dublin Zoning Ordinance requires approval by the Planning Commission of a Conditional Use Permit for the operation of an auto auctioning business finding that it is an appropriate use within the M-1, Light Industrial District; and WHEREAS, the Planning Commission held a public hearing on said application on March 15, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class l(a) of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed auction use provides for the public need by offering a range of services for the community. B. The proposed use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible when compared to the type and nature of operations typically found in light industrial district areas and the uses currently in operation in the immediate vicinity. C. The proposed use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. The proposed use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located in that conditions have been applied to ensure conformance with the applicable zoning regulations, and the use is consistent with the character of the surrounding area as well as the retail business district. E. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 92-088 Alameda County Auction Conditional Use Permit application as generally depicted by materials labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related Site Development Review and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of buildinq permits or establishment of use, and shall be subject to Planninq Department review and approval. This approval is for an automotive auctioning business consisting of incidental office activity, the storage of vehicles, and the auctioning of cars and trucks as generally depicted on the plans labeled Exhibit A, dated received by the Planning Department December 29, 1992, stamped approved. 2. This Conditional Use Permit approval shall supersede all previous Conditional Use Permit approvals for the site. [PL] 3. This use shall be limited to a maximum of 18 auctions per year. [PL] 4. Each auction shall be limited to a maximum of 130 vehicles which may be bid upon. [PL] 5. All outdoor auction related activities shall take place between the hours of 7:30 a.m. and 5:30 p.m., except as may be approved in advance in writing by the Planning Director. [PL] 6 No amplified music shall be permitted outside the enclosed building. During the auctions, if a loudspeaker is to be used, it shall be directed away from, and kept at a low level so as not to create a nuisance to, the adjacent neighboring residential area to the west. [PL] 7. No automotive repair is permitted on site, including washing and detailing of vehicles. [PL, PO] - 2 - PAGE ~ OF ..ll 8. The Applicant shall maintain a minimum of three portable toilets during non-auction days and ten portable toilets on preview and auction days. The portable toilets shall be serviced a maximum of two days following the auction event. [PL] 9. The Applicant shall obtain the proper licenses and permits through the Department of Motor Vehicles and the State Board of Equalization prior to establishment of use. Said licenses and permits shall be displayed at all times during the operation of business. [PL, PO] 10. The Applicant shall work with the Dublin Police Services Department to establish and maintain an effective security program. A minimum of one (1) security guard, licensed by the State Department of Consumer Affairs, shall be present on-site during all non-business evening hours. [PL, PO] 11. The Applicant shall be responsible for clean-up and disposal of project related trash to maintain a clean, litter-free site. [PL] 12. The Applicant shall control activity so as not to create a public or private nuisance to the existing or surrounding businesses and residences. [PL, PO] 13. All signs shall be subject to the requirements of the Sign Regulations within the Zoning Ordinance. [PL] 14. On an annual basis, this Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. [PL] 15. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period. [PL] 16, This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Architectural considerations, including the character, scale with the site and other buildings, building materials and colors, screening of exterior appurtenances, exterior lighting, and similar elements have been incorporated into the project in order to insure compatibility of this development with the development's design concept or theme and the character of adjacent buildings and uses. Landscape considerations, including the locations, type, size, color, texture and coverage of plant materials, provisions and similar elements have been considered to insure visual relief and an attractive environment for the public.
