ZONING HISTORY: C-3550: On March 28, 1979, the Alameda County zoning Administrator approved a Conditional Use Permit allowing administrative offices in an M-1, Light Industrial District. PA82-004: On September 2, 1982, the Dublin zoning Administrator approved a one year Conditional Use Permit to allow Pacific Telephone to store outdoor equipment and vehicles. PA83-053: On October 3, 1983, the Planning commission approved a Conditional Use Permit extension to allow continued outdoor storage of Pacific Telephone equipment, supplies and vehicles. PA90-041: On July 2, 1990, the Dublin Planning Commission approved a site Development Review and Conditional Use Permit request to allow the establishment of an automobile auction business on a leased portion of the 13.43 acre site. PA92-074: On November 20, 1992, the Dublin Planning Director approved a site Development Review request to allow the installation of an ice storage air conditioning system along the western side of the existing Chevron Records Center building and minor parking modifications. PA92-088: On March 15, 1993, the Planning Commission approved a Conditional Use Permit and site Development Review request for the modification and expansion of the pre-existing automotive auction establishment located on the northern portion of the site. APPLICABLE REGULATIONS: section 8-51.3.A.1 states that the establishment of a contractors or other outdoor storage yard for equipment, if conducted within an area enclosed by a solid wall or fence, requires approval of a Conditional Use Permit by the Planning commission. section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. section 8-95.010 site Development Review Intent/Purpose of the zoning Ordinance states that site Development Review is a discretionary review process intended to promote orderly, attractive and harmonious site and structural development compatible with individual site environmental constraints and compatible with surrounding properties and neighborhoods; to resolve major project-related issues including, but not limited to, building location, architectural and landscape design and theme, vehicular and pedestrian access and on-site circulation, parking -2- PAGE 1- OF ,1 and traffic impacts; to ensure compliance with development standards and general requirements established for zoning and Planned Development Districts, including, but not limited to, setbacks, heights, parking, fences, accessory structures and signage; to stabilize property values; and to promote the general welfare. ENVIRONMENTAL REVIEW: The project has been found to be categorically Exempt from CEQA under section 15301, Class 1(a) of the California Environmental Quality Act guidelines. The proposed outdoor storage yard consists of the minor alteration of an existing private facility involving negligible expansion of uses beyond that previously existing. NOTIFICATION: Public Notice of the September 20, 1993 hearing was published in the local newspaper, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant, Jeff Ryan, representing Gettler-Ryan, Inc., is requesting approval of a Conditional Use Permit and site Development Review to allow the establishment of an outdoor storage yard within the southern portion of the existing Chevron Records Retention Facility parking lot, at 6400 Sierra Court. The Gettler-Ryan company constructs, renovates and maintains service stations for major oil companies. Their technical and administrative offices will be located at 6747-J Sierra Court, within the Sierra Trinity Office Park. The company has found it essential to locate their offices in the same area as their corporation yard. The Sierra Trinity Office Park does not possess the physical characteristics to permit the location of an on-site storage yard. The Gettler-Ryan company is requesting approval to locate their outdoor storage yard on the neighboring Chevron site. The proposed I36,250 square foot (145' x 250') outdoor storage yard will be used to store: dump trucks; service trucks/pickups; trailer mounted equipment (air compressors, etc.); construction tractors; construction material (lumber, steel forms, sidewalk boxes, temporary fencing panels, sand and concrete sacks); fiberglass/PVC pipe, skid tanks and drums and a trash container. Hazardous wastes will not be allowed to be handled, transported to or stored within the storage area, with the exception of cement. The Public Works Department has indicated that cement contains substances which are considered hazardous. If cement is to be stored on site, it must be within a container which would, in the case of upset or accident, prevent discharge within the storm drain system. The Applicant will be required to submit to annual inspections by the Public Works Department to ensure compliance with this condition. The storage yard will be completely enclosed by a chain link fence with redwood or vinyl slats to provide screening. Two gates will be utilized at the front and rear of the storage area to provide ingress and egress. A minimum 20 foot wide unobstructed roadway will be maintained through the storage area to allow adequate emergency vehicle access. -3- PAGE~Or " Office space will not be maintained within the outdoor storage yard. Employees will be based out of the off-site office. Field crews will drive to the storage yard in the morning, load up their trucks with equipment and supplies and head to the job site. In the evening, the trucks and equipment are unloaded and returned to their designated spot within the storage area. No automotive repair work, including the washing of vehicles, is permitted within the storage area. The Public Works Department has reviewed the proposed project and determined that the use would not result in a net increase in traffic. This determination is based on the fact that the I13.43 acre Chevron site is currently underutilized. The existing 204,800 square foot building was originally constructed and operated as a manufacturing plant, but has been used as a records retention warehouse for several years. A manufacturing use could be established within this building as a permitted use. The proposed storage yard will occupy an area equal to approximately 106 parking spaces. Thirty vehicles will be parked within the storage area. The Public Works Department has concluded that the trip generation rate for a storage area occupying the displaced 76 spaces is less than if the spaces remained available for site parking serving the existing building. It should be noted that if a manufacturing plant or other use occupies the existing building, parking on-site will need to comply with the provisions of the zoning Ordinance. This may require conversion of the outdoor storage yard and/or the existing automobile auction use back to parking which serves the building. sierra Court was constructed without sidewalks installed on either side of the street. The current General Plan policies encourage the development of pedestrian circulation routes. In an effort to fulfill this General Plan policy, the city requires the installation of sidewalks, by the private property owners, as a condition of development approval. Due to the limited amount of improvements associated with this application, it would not be equitable to require the Applicant to install sidewalks as a condition of approval. This will be accomplished when the entire site is redeveloped. The Applicant will be required to work with the police Department on an ongoing basis to maintain an effective security program. This application is in conformance with the provisions of the General Plan. This application has been reviewed by other City Departments and affected agencies and their comments have been incorporated into the draft resolutions. staff recommends approval of the Applicant's request for a Conditional Use Permit and site Development Review, subject to the conditions listed in the draft resolutions of approval, Exhibits Band C, respectively. IJ d ~fil'NNV'd Nnanl..& E 6L 8 - d3S' .0 AI303M ; GETTLER-RY AN 6400 SIERRA COURT DUBLIN, CALIFORNIA EXHIBIT A ~ Z- PAGE -=:L or _n RESOLUTION NO. 93- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN --------------------------------------------------------------------- APPROVING PA 93-050 GETTLER RYAN, INC., CONDITIONAL USE PERMIT REQUEST AT 6400 SIERRA COURT WHEREAS, Jeff Ryan, representing Gettler-Ryan, Inc., requests approval of a Conditional Use Permit and site Development Review to allow the establishment of an outdoor storage yard within the southern portion of the existing Chevron Records Retention Facility parking lot, at 6400 Sierra Court; and WHEREAS, Section 8-51.3 of the adopted City of Dublin Zoning Ordinance requires approval by the Planning commission of a Conditional Use Permit for the operation of a contractors storage yard finding that it is an appropriate use within the M-1, Light Industrial District; and WHEREAS, the Planning Commission held a public hearing on said application on September 20, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class l(a) of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning commission does hereby find that: A. The proposed contractors storage yard use provides for the public need by offering a range of services for the community. B. The proposed use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible when compared to the type and nature of operations typically found in light industrial district areas and the uses currently in operation in the immediate vicinity. C. The proposed use will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. The proposed use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located in that conditions have been applied to ensure conformance with the applicable zoning regulations, and the use is consistent with the character of the surrounding area as well as the retail business district. E. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 93-050 Gettler-Ryan, Inc., Conditional Use Permit application as generally depicted by materials labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related site Development Review and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise. all Conditions of Approval shall be complied with prior to the issuance of buildinq permits or establishment of use, and shall be subiect to Planninq Department review and approval. This approval shall generally conform with the plans prepared by Gettler-Ryan, Inc., consisting of 2 sheets, dated received by the Planning Department September 8, 1993, labeled Exhibit A, stamped approved and on file. [PL] 2. No hazardous waste shall be handled, transported to or stored within the outdoor storage yard, with the exception of cement. If cement is stored on site, it must be within a container which would, in the case of upset or accident, prevent discharge within the storm drain system, subject to review and approval of the Public Works Director. On an annual basis, this use shall be subject to Public Works Inspector review and determination that compliance with this condition is being met. [PW] 3. All outdoor related activities shall take place between the hours of 7:30 a.m. and 5:30 p.m., except as may be approved in advance in writing by the Planning Director. [PL] 4. On an annual basis, this Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. [PL] 10. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period. [PL] 11. [PL, PO, B) 3. The Applicant shall provide a 10' x 10' concrete pad to facilitate the Livermore-Dublin Disposal Service's mechanical pick-up service. The location of said pad shall be subject to Planning Director review and approval. [PL] 4. Exterior lighting around the outdoor storage area shall be of a design and placement so as not to cause glare onto adjoining properties or onto sierra Court. Lighting used after daylight hours shall be adequate to provide for security needs (1.5 foot candles). The Applicant shall provide photometrics and cut sheets subject to the review and approval of the Planning Director and Dublin Police Services Department. [PL, PO, B] 6. The Applicant shall comply with all applicable requirements of the Dougherty Regional Fire Authority, the Dublin San Ramon Services District and the Alameda County Department of Public Health. [F, DSR, CO] 7. The Applicant shall maintain a 20 foot wide unobstructed roadway through the storage area to allow for adequate emergency vehicle access. [F] 8. Parking on-site shall maintain compliance with the provisions of the zoning Ordinance at all times. Should a manufacturing plant or other use occupy the existing building, the outdoor storage yard may require conversion back to parking which serves the building. 9. All signs shall be subject to the requirements of the sign Regulations within the Zoning Ordinance. [PL] 10. Upon termination of the outdoor storage yard use, the pavement shall be restriped and returned to its original condition. 11. The permit shall be revocable for cause in accordance with section 8-90.3 of the Dublin Zoning Ordinance. [PL] 12. To apply for building permits, the Applicant shall submit two (2) sets of construction plans to the Building Department for plan check. Each set of plans shall have attached an annotated copy of these conditions of approval. The notations shall clearly indicate how all conditions of approval will be complied with. Construction plans will not be accepted without the annotated conditions attached to each set of plans. The Applicant will be responsible for obtaining the approvals of all participating non- city agencies prior to the issuance of building permits. This experience has enabled the company to build a solid reputation which is maintained today and is known throughout the industry for excellence. To better respond to the needs of our clients, we have expanded our services to include experienced and versatile staff of environmental scientists, construction service managers, and other technical personnel. Gettler-Ryan Inco's service capabilities offer clients a "turnkey" approach to solve their construction management, construction and environmental service needs. Gettler-Ryan Inco's staff includes construction managers and technicians, safety manager, geologists, hydrogeologists, environmental scientists with registered and certified professionals providing technical oversight and project management within their area of expertise. Gettler-Ryan Inco's goal for the past three years has been to relocate the facilities to the Dublin area. Geographically, this area is very attractive as it provides access to all the major corridors in the Bay Area. Also, . it is centrally located to our existing clients. Being centrally located to clients enables us to respond quickly to client needs. The infrastructure of Gettler-Ryan Inc. has been built around the fact that the yard and offices are located in the same area to provide the support needed to maintain the companies reputation of being responsive. The Gettler-Ryan Inc. technical and administrative offices are to be located at 6747 J Sierra Court, in the Sierra Trinity Office Park. This yard will be used to store our construction vehicles and equipment as well as miscellaneous construction materials and some customer owned equipment as per the attached inventory. We do not store large quantities of construction materials, as for the most part, we buy these materials, and take delivery at our job sites. The customer owned equipment that we store is equipment that our customers furnish for jobs and ship to our yard prior to installation at their facilities. It is important for us to have the office and yard facilities in close proximity for our operations to have good control of the use of appearance of the yard area. This is the only satisfactory location we have found existing in the Dublin area. Other than this facility, our only options would be to relocate in Livermore, which is not desirable to us. Gettler-Ryan Inco's services supply a very important need to the community. We concern ourselves with helping individuals to understand and work within the guidelines that the regulatory agencies enforce to protect the environment we all live in. The surrounding neighborhood will in no way be adversely affected by our use of this property. It is strictly used for storage of equipment and vehicles. The company does not transport, handle or store any hazardous wastes. The activity of this property will be primarily in the early mornings and evenings when vehicles are being driven off and onto the property. We generate a small amount of trash from our yard operations, which fills one 4' x 8' trash dumpster each week. We have listed a dumpster in our inventory for the removal of this trash. There would be no noise, dust, or odors that our use would create in the area. In fact, we are committed to improving the environment for all communities in the Northern California area and understand the responsibility that we have to the neighborhood and will maintain a professional presence.
