Cirelli, Senior Planner PREPARED BY: SUBJECT: PA 93-028 Burger King Restaurant CUP/SDR (Informational Item Only) The Planning Commission approved PA 93-028 Burger King Conditional Use Permit (CUP)/Site Development Review (SDR) on August 16, 1993. The project is currently in the latter stages of the building permit review process. The Applicant, Matthew Schoenberg, is requesting Planning and Public Works approval for minor changes in the Dublin Boulevard right turn lane configuration and the phasing and construction of Dublin Boulevard frontage improvements (see Attachments 1 and 2). The Burger King project engineer and Public Works Staff discovered during the project design stage that the full Dublin Boulevard frontage widening as shown on the approved site plan would create vehicle weaving and safety problems on Dublin Boulevard. The project engineer modified the sidewalk and right turn configuration to facilitate and channelize traffic turning right from Regional Street onto Dublin Boulevard. With this configuration, traffic from Regional Street will not conflict with traffic going eastbound on Dublin Boulevard and turning right into the Burger King site and/or the Orchard Supply Hardware shopping center. The Public Works Staff and Applicant agreed that the Dublin Boulevard widening frontage improvements construction should be done in two phases, and that the Applicant should construct the first phase frontage improvements and contribute funds for the second phase construction. The first phase will be constructed with the construction of the Burger King site and the second phase will be constructed with the overall Dublin Boulevard Widening project. The Applicant will pay the City an additional $15,000 - $20,000 traffic improvement fund to construct the second phase of the Dublin Boulevard frontage improvements. There are several reasons for delaying the second phase construction and having the City construct the ultimate Dublin ITEM NO.~ COPIES TO: Applicant Property Owner Address File P~f\t -L OF -2 Boulevard improvements instead of the Applicant. First, if the ultimate Dublin Boulevard improvements are only done at the corner of Regional Street and Dublin Boulevard and not extended further east, vehicle weaving problems would result in Dublin Boulevard's right lane. Only portions of the right lane would be widened, which would confuse drivers and cause them to weave within the lane. Second, constructing the ultimate Dublin Boulevard frontage improvements would delay the Burger King Restaurant's construction and opening date (i.e. utility improvements would need to be relocated, etc.). Lastly, there is a cost savings to the Applicant with no additional cost to the City. The existing Wheels bus stop is located just west of the shopping center driveway. Since this location will conflict with the proposed right turn lane frontage improvements and in order to further facilitate traffic movement on Dublin Boulevard, Planning and Public Works Staff will be working with Wheels to relocate this bus stop further east. There will be a minor site plan modification with the proposed Dublin Boulevard revision. Additional landscaping will be provided at the northwest corner of the project site, such as lawn, annual flowers, and jasmine ground cover (see Attachment 2, page 2). No other site or building modifications are being proposed. The revised plans show a different freestanding sign location than what was originally approved. The freestanding sign must be located on private property. The sign cannot be located within the public right-of-way, or be located on land that has been dedicated to the City for future public right-of-way purposes. The Applicant must comply with the Planning Commission's prior August 16, 1993 freestanding sign location approval and all other conditions of approval. Because the Applicant is not requesting any significant changes to the approved PA 93-028 Burger King CUP/SDR project, Staff recommends that the Applicant submit a request for a minor CUP and SDR amendment. If the Planning Commission objects to the Applicant's proposed Dublin Boulevard changes, Staff will bring the project before the Planning Commission as a major revision to the approved PA 93-028 CUP/SDR and the project will be re-noticed as a public hearing item. - 2 - ;t "\ Pl1m=_OF_ ~ GF&A CIVIL ENGINEEJUNC & SURVEYINC D.H. The Curb return radius will remain at 40 ft. as shown on the site plan. During preparation of the improvement plans for the right turn lane it has become apparent that construction of the frontage improvements should be done in two phases. We are proposing that the first phase be constructed now with the construction of the Burger King site and that the second phase be constructed with' the ove~all DUblin Blvd. widening project. Attached are sketches of the street and right turn lane for both phases. The sidewalk and right turn configuration shown for phase 2 is a slight modification from that shown on the preliminary site plan previously approved. This configuration provides for better channelization of traffic turning right from Regional street onto Dublin Blvd. and eliminates weaving conflicts within the right turn lane into the shopping center. Phase 1 will include less construction ot the city'S proposed widening than previously contemplated. The voluntary contribu. tion to the Traffic Impftct Fee is proposed to increase by $15,202 to $36,080. A cost Estimate itemizing the increase is attached. 1 Attachn8Jt ( PAGE.-.1 OF J '.
