ZONING HISTORY:
June 1976 - The Alameda County Zoning Administrator approved a Variance
request for reduced front yard (20 ft.) and sideyard (10 ft.) setbacks. The
Alameda County Planning Department approved a Site Development Review for
12,040 sq. ft. commercial retail building.
APPLICABLE REGULATIONS:
Chapter 8-49 of the Dublin Zoning Ordinance establishes regulations for
the C-2 General Commercial District. An automobile rental lot is permitted in
this district subject to approval of a Conditional Use Permit (8-49.2 g).

Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW: A Negative Declaration has been prepared for this
project pursuant to the provisions of CEQA. The project will not have a
significant effect on the environment.
NOTIFICATION: Public Notice of the April 7, 1986, hearing was published in
The Herald, mailed to adjacent property owners, and posted in public buildings
ANALYSIS:
The applicant is requesting approval of a Conditional Use Permit to
operate a car rental lot in the existing Village Shopping Center. The
proposed auto rental lot is a satellite business with its main location in
Walnut Creek.
The applicant indicates only four parking spaces are needed for the
rental cars in that the cars arrive on site as needed for rental and are taken
to the main rental office in Walnut Creek once returned by the customer.
The applicant proposes to occupy a vacant shop within the center and no
new construction is proposed in conjunction with this Conditional Use Permit.
To date there are nine businesses located in the Village Shopping Center
and two vacant shops. Based upon the City's current parking requirements, 38
parking spaces are required for the Center.

The total existing parking spaces on site are 42, four spaces in excess
of the 38 required for existing parking and anticipated uses within the
Center. A condition of approval has been applied to this project, limiting
the number of rental cars on site at anyone time to four. An additional
condition of approval prohibits on site maintenance of these vehicles,
including cleaning and repair work.
The four parking spaces proposed for use by the applicant are located in
the rear of the Shopping Center and are not typically used for visitors to the
Center (see Background Attachment #3, Plot Plan). The use of these spaces for
the parking of rental cars is not anticipated to interfere with parking
convenience of the Center's customers. Two parking spaces in the rear of the
Shopping Center are currently overgrown with shrubs. A condition has been
applied, requiring the parking spaces to be maintained in an operable
condition.

ACTION: Staff recommends the Planning Commission adopt the attached
Resolution approving a Negative Declaration for PA 86-013, American West
Rent-A-Car, and a Resolution approving the Conditional Use Permit for PA 86-
013.

To the city of Dublin, California:
American West Rent-A-Car is applying for a conditional use permit to
operate a satellite daily rent-a-car business out of "The Village" shopping
center, which is located at 7065 Village Parkway, Dublin, California (\......
main location is in Walnut Creek.
American West Rent-A-Car is an independent company that specializes
in providing automobiles for the temporary replacement market. That is,
when someone's auto is disabled because of physical damage or mechanical
problems, we provide an auto at very reasonable rates. Our insurance
replacement rate is about half of the customary rate charged by the large
rent-a-car companies.
"The Village" shopping center has forty-seven parking places and is
only required by the city of Dublin to have forty. At the north west corner of
the shopping center is a separate parking lot with six parking places. This
parking lot is not used at this time because of its physical relationship to the
shopping center. The owner of the shopping center has given permission to us
to use this lot, in addition to the spaces we would be allowed to use in front
of the center allocated to the retail space of approximately one thousand we
hope to occupy. At our projection, for the size of our rent-a-car fleet, in the
Dublin area we should use a maximum of six parking places.
Our business generates very little traffic since we rent an average of
six vehicles per day and have six vehicles returned per day.
At this time there is only "Budget" rent-a-car within the Dublin city
limits and to the best of my knowledge they are not set up to handle the type
of cutomer needs that we specialize in.
The main benefit of our business to the community is the customer
service and reduced cost of our service that is provided to the community and
what ever financial benefits that are generated from sales tax revenue.

Dear Maureen,
Originally when I submitted my request for a conditional
use permit to operate a rent-a-car company at Village Parkway
shopping center in Dublin. I thought there were six extra
parking places at the shopping center. When you checked the
parking lot, you discovered that the plans were incorrect and
that there were actually two less parking places than the plan
said.
I would like to amend my request for the six parking places
to four. Since four parking places are the maximum I would
need and the only reason for my original request was that I
thought there were six extra spaces.

OF THE CITY OF DUBLIN
ADOPTING A NEGATIVE DECLARATION FOR PA 86-013 AMERICAN WEST RENT-A-CAR
CONDITIONAL USE PERMIT APPLICATION TO OPERATE
A RENTAL CAR LOT AT 7065 VILLAGE PARKWAY
WHEREAS, American West Rent-A-Car filed an application for a
Conditional Use Permit to operate a rental car lot for a maximum of four rental
cars at 7065 Village Parkway; and
WHEREAS, The California Environmental Quality Act (CEQA), together
with the State Guidelines and City environmental regulations, require that
certain projects be reviewed for environmental impact and that environmental
documents be prepared; and
WHEREAS, an initial study was conducted finding that the project,
as proposed, would not have a significant effect on the environment; and
WHEREAS, a Negative Declaration has been prepared for this
application; and
WHEREAS, public notice of the Negative Declaration was given in all
respects as required by State Law; and
WHEREAS, the Planning Commission did review and consider the
Negative Declaration at a Public Hearing on April 7, 1986;
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission
finds as follows:
1. That the project PA 86-013 American West Rent-A-Car Conditional Use
Permit will not have a significant effect on the environment.
2. That the Negative Declaration has been prepared and processed in
accordance with State and local environmental laws and guideline regulations.
3. That the Negative Declaration is complete and adequate.
BE IT FURTIIER RESOLVED that the Dublin Planning Commission hereby adopts
the Negative Declaration for PA 86-013 American West Rent-A-Car Conditional Use
Permit application.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 86-013 AMERICAN WEST RENT-A-CAR
CONDITIONAL USE PERMIT APPLICATION TO OPERATE
A RENTAL CAR LOT IN THE C-2-B-40 GENERAL COMMERCIAL DISTRICT,
7065 VILLAGE PARKWAY
WHEREAS, American West Rent-A-Car has filed an application for a
Conditional Use Permit (PA 86-013) to allow the operation of a rental car lot
for a maximum of four cars in the C-2-B-40 (General Commercial) District at
7065 Village Parkway; and
WHEREAS, this application has been reviewed in accordance with the
provlslons of the California Environmental Quality Act and a Negative
Declaration has been adopted (Planning Commission Resolution No. ) for
this project as it will not have a significant effect on the environment; and
WHEREAS, notice of Public Hearing was published in The Herald,
posted in public buildings, and mailed to property owners within 300 feet of
the project in accordance with California State Law; and
WHEREAS, a Staff Analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a Public Hearing on April 7,
1986, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
a) The use is required to serve a public need in that the use provides
an automobile rental service.
b) The use will be properly related to other land uses and transpor-
tation and service facilities in the vicinity in that daytime activities will
be commensurate with present use of properties in the neighborhood.
c) The use, under all circumstances and conditions of this particular
case, will not materially affect adversely the health or safety of persons
residing or working in the vicinity, or be materially detrimental to the public
welfare or injurious to property or improvements in the neighborhood, in that
all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses or
performance standards established for the District in which it is to be located
in that the rental car business is consistent with the character of the
commercial district.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 86-013 as shown by materials labeled Exhibit A and
stamped approved on file with with the Dublin Planning Department, subject to
the following conditions:

1. The rental car lot shall be limited to a maximum of four rental
cars on site at anyone time.
2. Hours of operation for the car rental lot shall be limited to the
hours between 7:30 a.m. and 6:30 p.m.
3. On site maintenance of rental vehicles shall be prohibited,
including cleaning or repair of vehicles.
4. Landscaping adjacent to the rear parking area shall be maintained
in such a manner as to insure that all required parking spaces are accessible
and useable.
5. The applicant shall provide the Planning Director with a copy of
the lease indicating location of the four parking spaces reserved for the use
of the car rental lot.
6. This permit shall expire April 18, 1988, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
