APPLICABLE REGULATIONS:
Section 8-49.2 (Conditional uses: C-2 District) permits auto sales and
services subject to approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to
determine: I) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or peformance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified acti vi ties;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the tenns of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.

mailed to adjacent property owners, and posted in public
ANALYSIS:
The applicant, Chrysler Realty Corporation, is requesting approval of a
Conditional Use Permit to operate an automobile dealership at the existing
Nohr's RV Center, at 6451 Scarlett Court. The applicant indicates Curtiss
Dodge will be the sub-tenant.
The applicant proposes to utilize the RV center site as it currently exists,
with only minor modifications to the parking area proposed. These
modifications include removal of an existing propane tank, removal of a chain
link fence and restriping of the parking lot. No new construction is proposed
in conjunction with this application in that the applicant has indicated that
timing is essential as the tenant needs to begin operation on the site as soon
as possible. The applicant has indicated that an addition to the existing
structure will be proposed at a future date.

In order to accorrmodate the applicants need for quick occupancy of the site,
Staff has allowed the applicant to submit this Conditional Use Permit
application with the understanding that a more complete Conditional Use Permit
application will be filed in the near future.
The subsequent application will address proposed building additions and site
improvements including lighting, landscaping and the future alignment of
Dublin Boulevard. The City is currently studying various alignments for the
Dublin Boulevard Extension. As of this date, the City has not determined or
selected an alignment route. However, it is likely that a portion of this
site will be needed for the future extension. The City Council will consider
this matter within the next several months.
The auto dealership, as currently proposed, will consist of approximately
1,600 square feet of floor area for indoor auto display, 880 square feet of
office space, 7,000 square feet for parts and service shop. Additionally the
applicant proposed the following number of parking spaces:

The proposed auto dealership is consistent with the City's C-2 Zoning, the
General Plan designation and with the current trend along Scarlett Court.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 86-057 CHRYSLER CORPORATION CONDITIONAL USE PERMIT TO OPERATE AN
AUTO DEALERSHIP INCLUDING AUTOMOTIVE SALES AND SERVICE, AUTOMOTIVE PAINT AND
REPAIR AND SALE OF MERCHANDISE SUCH AS AUTO PARTS AT 6451 SCARLETT COURT
WHEREAS,
for a Conditional Use
Scarlett Court; and
the Applicant, Chrysler Corporation filed an application
Permit to operate an automotive dealership at 6451
WHEREAS, this application has ben reviewed in accordance with the
provlslons of the California Environmental Quality Act and has been found to be
categorically exempt; and
WHEREAS, notice of Public Hearing was published in The Herald,
posted in public buildings, and mailed to property owners within 300 feet of
the project in accordance with California State Law; and
WHEREAS, the City is currently studying various alternatives for
the alignment of Dublin Boulevard extension. Although the specific alternative
has not been selected, the future Dublin Boulevard extension is likely to
affect a portion of the property at 6451 Scarlett Court (APN 941-550-12-7); and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a Public Hearing on July 21,
1986, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required by the public need in that the use offers
the Dublin consumer a specific auto dealer sales and services currently not
available within the City;
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that the project will
be commensurate with the present use of surrounding properties within the
neighborhood;
c) The use, under all the circumstanmces and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in the neighborhood as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be
located, in that the auto dealership is consistent with the character of the
surrounding Commercial and Industrial District.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 86-057 as shown by materials labeled "Exhibit A" on
file with the Dublin Planning Department subject to the following conditions.
All said Conditions of Approval shall be met prior to occupancy.
1. The minimum dimension for compact parking stalls is 8 feet x'l7 feet.
Proposed parking stalls which do not meet this minimum requirement shall be
corrected or removed.

2. The following type and number of parking spaces shall be designated on
the parking lot pavement and shall be maintained and kept available on a
continuous basis for the designated user group:

3. The Applicant shall correct deficiencies in the existing frontage
improvements such as off-set sidewalk, subject to review and approval of the
City Engineer.

4. The Applicant shall maintain existing security lighting on the front of
the main building and increase security lighting for the eastern perimeter and
the rear portion of site, subject to review and approval by the Dublin Police
Department and City Engineer.
5. The Applicant shall install two street lights as previously required in
Planning Commission Resolution No. 84-36 (PA 84-029), the design and location
subject to review and approval of the City Engineer.
6. Prior to expiration of this permit the applicant shall obtain approval of
a more extensive Conditional Use Permit indicating building additions and site
improvements such as landscaping and lighting, and addressing the future Dublin
Boulevard extension alignment.
7. Subsequent site plans for this project shall be prepared by a licensed
architect.
8. This permit shall expire on November I, 1986, arm shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
