(may be double faced) and a maximum height of 12 ft.; said signs are conditional uses in any district. Section 8-94.0 states that conditional uses Imlst be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified tem, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period wi thin which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt (Class 4) NOTIFICATION: Public Notice of the August 4, 1986, hearing was published in The Herald, mailed to adj acent property owners, and posted in public buildings ANALYSIS: The two Directional Tract Signs proposed for use will provide directional information to visitors to the 129-unit Kaufman & Broad California Vista Project which is in the initial stages of development. The locations proposed appear appropriate and functional for the use desired. The two sites proposed for use were previously utilized for Kaufman & Broad's, 83-Lot, Silvergate Highlands Single Family Residential Project. RECOMMENDATION: FORMAT: 1) 2) 3) 4) 5) Open public hearing. Hear Staff presentation. Hear Applicant and public presentations. Close public hearing. (CMNERS) mNDITIONAL USE PERMIT REX:lUEST FOR D:ma:TIONAL TRl\CT SIGNS WHEREAS, Sign Technology, Inc. filed an application for a Conditional Use permit to allow use of two Directional Tract Signs for the Kaufman & Broad California Vista Project (Tract 5410); and WHEREAS, the Planning Ccmnission did hold public hearing on said application on August 4, 1986; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the request is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted reccmnending the application be conditionally approved; and WHEREAS, the Planning Corrmission did hear and consider all said reports, reccmnendations and testimony hereinabove set forth; ~, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby find: a. The use is required by the public need to provide di~ectional information for a new housing development to the general public. b. The use would be properly related to other land uses and transportation and service facilities in the vicinity. c. The use, if permitted under all circumstances and conditions of this particular case will not materially affect adversely the health, safety or persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improverrents in the area, as all applicable regulations will be rret. d. The use will not be contrary to the specific intent clause or performance standards establishd for the district in which it is to be located. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby approve said application as shown on Exhibit "A" on file with the Dublin Planning Department and subject to the following conditions: 1) The signs shall have a respective maximum single-faced area of 32 sq. ft. (a double-faced sign with a maximum area of 32 sq. ft. on each side may be used) and a maximum height of 12 I . 2) The Directional Tract Signs shall not obstruct the visibility of motorists, pedestrians and cyclists. The precise location of the signs shall be subject to review and approval by the Planning Department. 3) The signs currently in place at the two subject locations shall be removed within 15 days of the effective date of this permit and shall not be re-established at said locations until after the framing inspection approval of the model complex. 4) This approval shall remain in effect untxl August 15, 1988, or until the last townhouse is sold, whichever occurs first. The applicant shall remove said signs and support upon expiration of this Conditional Use Permit. j)r:J -5t EXHIBIT X7iQ~:L~. ,"T"; 5) The Applicant shall post a letter-of-credit with the City of Dublin in the amount of $500.00 to secure the faithful performance of Condition #4 (removal of sign). Said letter-of-credit shall guarantee that these funds will be available and that the instrument of credit will remain effective until October 14, 1988. An alternate instrument of_credit may be used subject to review and approval by the City Attorney. 6) This approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. This application is for a conditional use permit for temporary off-site directional signs for a condominium project. These signs will greatly benefit the potential home buyer in finding the developme~t. These signs are very attractive and will give the City of Dublin the look they strive for. The signs I am proposing will not only direct but will reassure the homebuyer that they are heading in the correct direction. The City will benefit greatly because it will bring many potential taxpayers to the area. The cost to the City will be zero.
