and Conditional Use Permit requests to subdivide
14+ acres into 17 residential lots (4.0+ acres
total), a future neighborhood park (4.9i acres),
a site for future use as a City Senior
Recreation Center (0.3+ acres), and a site to be
retained for Administr~ive Office and
Corporation Yard use by the Murray School
District (4.9+ acres). The Conditional Use
Permit request covers the 4.9~ acre area to be
retained by the School District.
BACKGROUND INFORMATION:
This item was initially schednled for consideration at the Planning
Commission hearing of Angnst 18, 1986. Becanse neither a repreSentati,e of
the Mnrray School Distict (Owners) or the Project Engineer (Applicant) were
present at the meeting, the item was Continued to the Planning Commission
hearing of September 2, 1986.
The Project Engineer indicated on August 27, 1986, that the School
District desired a second Continnance be granted, mO'ing the item to the
September IS, ]986, Planning Commission hearing. The Continnance is being
requested to allow the Project Engineer, repreSentatives from the School
District and City Staff to meet and discnss Staff's recommendations on the
project prior to a full public hearing on the project being held.
Staff recommends the reqnest for continnance be granted and that the
Planning Commission Continne the item to the meeting of September IS, 1986.
If members of the andience in attendance at the September 2, 1986, meeting
indicate a desire to speak on this item, Staff recommends the Commission
provide an opportunity for them to present testimony.
Staff fnrther recOmmends that minor adjnstments be made to the Draft
Conditions for the project (prepared with the Angnst 18, 1986, Staff Report)
labeled as Exhibit B (regarding the Tentati,e Map) and Exhibit C (regarding
the Conditional Use Permit) to pro'ide elaboration regarding the project's
park dedication requirement.
The State Snbdi'ision Map Act re,nires the snbdivision to be consistent
With the General Plan. The General Plan calls for a five acre park on the
Fallon School site. To assnre that ownership of the proposed "-lot
residential portion of the project will not be transferred prior to the
transference of title to the City of the 5+ acre area proposed for fntnre
development as a park site and the 0.3+ area for fntnre nse as a City Senior
Recreation Center, Staff recommends that Condition #36 of the Draft Resolntion
for the Tentative Map be adjnsted to read as fOllows (new langnage shown as
item B.):

36.A. Park land shall be dedicated, or in-lieu fees shall be
paid, or a combination of both shall be provided prior
to the recordation of the Final Map. The preliminary
park dedication land required in conjunction with the
project has been calculated to be approximately 0.187
acres (0.011 acres/dwelling unit x 17 residential
lots). Final calculations shall be made by the City
Engineer at the approval of the Final Map.
B. In order to assure consistency with the Dublin General
Plan policy regarding neighborhood parks and
recreation, a Tentative Map shall be required prior to
any land conveyance by the Murray School District.
Prior to the conveyance by the Murray School District
of any real property which is the subject of this
Tentative Map, or within 60 days, whichever Occurs
first, the Murray School District shall convey to the
City by deed that approximately five (5) acre portion
of said real property determined by the City to satisfy
the parklands requirement of the Dublin General Plan.
In addition, prior to the conveyance by the Murray
School District of any real property which is the sub-
ject of this Tentative Map, or within 60 days, which-
ever OCcurs first, the Murray School District shall, by
deed or lease, provide the City with the right to
occupy and use the Fallon School Multi-purpose Room.
Inclusion of similar language within the Draft Resolution for the
Conditional Use Permit is also recommended. Staff recommends that no physical
changes, or establishment of new land use activities to the proposed
Administrative Office/Corporation Yard complex be allowed until fee title
transference to the City of Dublin is made of the lands planned for development
as the neighborhood park and Senior Recreation Center. Staff recommends that
Condition #34 of the Draft Resolution for the Conditional Use Permit be amended
to read as follows (new language shown as item B.):
34.A. If the land uses proposed for the Administrative
Office/Corporation Yard facility are established prior
to the recordation of the Final Map for Tentative Map
5616, establishment of those uses shall be Subject to
those Conditions of Approval established for Tentative
Map 5616, as deemed appropriate by the City Engineer.
B. The Murray School District shall, within 60 days, convey to the
City by deed that approximately five (5) acre portion of said real
property determined by the City to satisfy the parklands
requirement of the Dublin General Plan.
In addition, the Murray School District shall, within 60 days, by
deed or lease, provide the City with the right to occupy and use
the Fallon School Multi-purpose Room.
One final adjustment is proposed for consideration and involves the
addition of a new condition to the Draft Resolution for the Tentative Map to
reflect project requirements received from the Alameda County Flood Control and
Water Conservation District. Staff recommends the following be added as
Condition #67 to the Draft Resolution for the Tentative Map:

67. The Alameda County Flood Control and Water Conservation
District (ACFC & WCD) groundwater monitoring well
(2S/1W 36E3) on the south side of Brighton Drive,
approximately 80 feet east of the proposed "A" Street,
shall be preserved in a manner that will allow samples
and measures to be readily taken by ACFC and WCD.
Known water wells without a documented intent of future
use, filed with Zone 7, are to be destroyed prior to
any demolition or construction activity in accordance
with a well destruction permit obtained from Zone 7.
Other wells encountered prior to or during construction
are to be treated similarly.
RECOMMENDATION:
As indicated above, Staff recommends that the request for continuance to
the Planning Commission meeting of September 15, 1986, be granted. Staff
further recommends that any member of the audience present at the meeting of
September 2, 1986, be given an opportunity to provide public testimony on the
project.
