for 12,040 square feet of Commercial retail.
April 1982 - Dublin Planning Commission approved
PA 86-013 conditional use permit to operate a
rental car lot at 7065 Village Parkway.
APPLICABLE REGULATIONS:
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or peformance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW:
Categorically exempt Class 1
NOTIFICATION: Public Notice of the October 6, 1986, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use Permit to allow
outdoor seating at the existing Deli at 7081 Village Parkway in The Village
Shopping Center. The existing Deli occupies approximately 1,000 square feet
of floor area within the Center.
Based upon the Deli's existing retail floor area square footage three parking
spaces are required for the use.
The Applicant is proposing to locate four tables and eight chairs outside the
Deli within the adjacent walkway, thereby prompting the need for a Conditional
Use Permit. The zoning ordinance requires one parking space per four seats.
The proposed eight seats requires two parkings spaces in addition to the 3
already required for the Deli use.
The primary issues associated with outdoor restaurant seating is parking and
pedestrian circulation.

The Center currently has 45 parking spaces, where 43 are required. The
addition of the outdoor seating area as proposed will not compromise the
Center's compliance with the City's required parking.
The Applicant proposes to locate the tables and chairs adjacent to the Deli
front door and planter area outside and will not interfere with pedestrian or
vehicle movement within the Shopping Center.
Staff recommmends approval of the Applicant's request for outdoor seating.

ACTION:
Staff recommends The Planning Commission adopt the attached
Resolution approving PA 86-084 Catania Italian Deli Conditional
Use Permit for outdoor seating.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 86-084 CATANIA ITALIAN DELI CONDITIONAL USE
PERMIT APPLICATION TO ALLOW OUTDOOR SEATING IN THE
C-2-B-40 GENERAL COMMERCIAL DISTRICT,
7081 VILLAGE PARKWAY
WHEREAS, Kathy Latora, Owner/Partner of Catania Italian Deli has
filed an application for a Conditional Use Permit (PA 86-084) to allow four
tables and eight chairs to be located outside the existing Deli at 7081 Village
Parkway; and
WHEREAS, The Planning Commission held a Public Hearing on said
application on October 6,1986; and
WHEREAS, proper notice of said Public Hearing was given in all
respects as required by law; and
WHEREAS, the request is categorically exempt in accordance with
provisions of the California Environmental Quality Act; and
WHEREAS, a Staff Analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a Public Hearing on
October 6, 1986, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required to serve a public need in that the use provides
an outdoor eating area.
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that daytime
activities will be commensurate with present use of properties in the
neighborhood.
c) The use, under all circumstances and conditions of this particular
case, will not materially affect adversely the health or safety of persons
residing or working in the vicinity, or be materially detrimental to the public
welfare or injurious to property or improvements in the neighborhood, in that
all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses or
performance standards established for the District in which it is to be located
in that the outdoor seating area is consistent with the character of the
commercial district.
BE IT FURTHER RESOLVED THAT the Planning Commission does hereby
conditionally approve PA 86-084 as generally depicted by materials labeled
Exhibit A and stamped approved on file with the Dublin Planning Department
subject to the following conditions:

4. The Applicant shall remove tables and chairs at the end of each
business day.
5. The Applicant shall provide outdoor trash containers and maintain
the site in a litter free condition.
6. This permit shall expire October 16, 1989, and shall be revocable
for cause in accordance with Section 8-90.3 of Dublin Zoning Ordinance.
