Additional permits covering the site have been requested and approved for
Christmas Tree lots (AC - 3490, PA 82-030, and PA 83-072) and for a sign
proposal (PA 82-036, returned to applicant without action).

APPLICABLE REGULATIONS:
Section 8-49.2 establishes as a Conditional Use in an C-2, General
Commercial District, the use of an automobile, camper, boat, and trailer
sales, storage, or rental lot.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions.
ENVIRONMENTAL REVIEW:
Categorically exempt.
NOTIFICATION: Public Notice of the October 20, 1986, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings.
ANALYSIS:
The subject request involves a proposal to construct a 200'+ x 200'~
paved parking area for use as a new parking - storage area for the six acre
Shamrock Ford Car Dealership. The area to be paved constitutes approximately
one-sixth of the overall holding and is located in the northeast corner of the
facility. The one acre ~ parking area will abut the ACFC & WCD - Zone 7
channel and service road which runs along the east side of the property
between the Dealership and the 1-680 right-of-way. The travel lanes of the
adjoining Freeway are elevated above the subject property and have a direct
view down into this portion of the Car Dealership site.
Staff supports a conditional approval of the proposed expansion of the
Car Dealership. Special conditions recommended by Staff to be applied to this
proposed expansion fall into three general categories:
1. Review of physical improvements related to construction of the proposed
parking lot.
To allow a review of grading and drainage of the proposed lot. (See
Draft Conditions #4, #5, #6, #10, #11 and #12.)
_ To allow a review of landscaping to be installed for the proposed
parking lot. (See Draft Conditions #13 - #16. Of particular note is
Condition #15 which calls for provision of raised landscape planters
with an area totaling a minimum of 5% of the interior area of the
proposed parking lot.)
_ To allow a review of area lighting. (See Draft Condition #17.)
2. Minor site work ancillary to construction of the proposed parking lot.
_ To provide "finish" work to newly installed perimeter fencing and
remove non-functional fence posts. (See Draft Condition #21.)
_ To provide renovation of the trash enclosure adjoining the southeast
corner of the proposed parking lot. (See Draft Condition #22.)
_ To verify work done/proposed is not in conflict with the adjacent ACFC
& WCD - Zone 7 easement. (See Draft Condition #23.)

3. Review of the overall operation of the Car Dealership facility as it
relates to the construction of a new car parking/storage area.
To allow a review of a master striping plan for the northern portion
of the facility. (See Draft Condition #24.)
_ To allow a review of an up-to-date on-site parking assignment plan to
allow review of location, number and adequacy of employee and customer
parking. (See Draft Condition #25.)

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 86-107 CONDITIONAL USE PERMIT REQUEST
FOR THE SHAMROCK FORD CAR DEALERSHIP AT 7499 DUBLIN BOULEVARD
WHEREAS, Marvin E. Collins, on behalf of Shamrock Ford, filed a
Conditional Use Permit request for a proposed expansion of the area utilized
for exterior car storage by the Shamrock Ford Auto Dealership by the creation
of a new 200'+ x 200'+ paved parking area; and

WHEREAS, the adopted City of Dublin Zoning Ordinance provides in
part for the establishment of an automobile, camper, boat and trailer sales,
storage lot as a Conditional Use; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on October 20, 1986; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
provlSlons of the California Environmental Quality Act and determined to be
categorically exempt; and
WHEREAS, the Staff Report was submitted recommending that the
Conditional Use Permit application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth; and
WHEREAS, the proposed land use, if conditionally approved, is
appropriate for the subject property in terms of being compatible to existing
land uses in the area and will not overburden public services;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
finds:
a) Construction of the new 200'~ x 200'~ paved vehicle storage lot serves the
public need by providing for the expansion of an existing automobile
dealership facility.
b) The us~s will be properly related to other land uses, and transportation
and service facilities in the vicinity, as the proposed uses will be
compatible to said land uses, and transportation and services facilities
in the i~mediate vicinity.
c) The uses will not materially adversely affect the health or safety of
persons residing or working the vicinity, or be materially detrimental to
the public welfare or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met.
d) The uses will not be contrary to the specific intent clauses or performance
standards established for the district in which they are to be located.
e) The approval of the project as conditioned is in the best interest of the
public health, safety and general welfare.
f) General site considerations, including site layout, orientation, vehicular
access, circulation and parking, have been designed to provide a desirable
environment for the development.

g) General project landscaping provlslons for irrigation, maintenance and
protection of landscaped areas and similar elements have been considered to
insure visual relief to complement existing buildings and structures and to
provide an attractive environment to the public.
h) The project is consistent with the policies contained in the City's General
Plan.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve Conditional Use Permit application PA 86-107 as shown by
materials labeled Exhibit B, on file with the Dublin Planning Department,
subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to issuance of grading permits and shall be sub;ect to Planning
Department review and approval.
1. Development of the 200'+ x 200'~ paved vehicular storage area shall
generally conform with the plans prepared by James R. Stedman &
Associates, Inc., and dated received by the City Planning Department
October 3, 1986. Development of the exterior vehicle storage area shall
reflect the changes called for in these Conditions of Approval. Approval
for the Conditional Use Permit shall be until October 31, 1989. The
approval period for the Conditional Use Permit may be extended two
additional years (Applicant must submit a written request for the
extension prior to the expiration date of the Conditional Use Permit) by
the Planning Director upon his determination that the Conditions of
Approval remain adequate to assure that the above stated Findings will
continue to be met. If construction has not commenced by October 31,
1987, this approval shall be null and void. Development shall be subject
to the Conditions listed below.
2. Comply with the City of Dublin Site Development Review Standard Conditions.
ARCHAEOLOGY
3. If, during grading activities, archaeological remains are encountered,
construction in the vicinity shall be halted, an archaeologist consulted,
and the City Planning Department notified. If, in the opinion of the
archaeologist, the remains are significant, measures, as may be required by
the Planning Director, shall be taken to protect them.
DRAINAGE
4. A grading drainage plan shall be prepared and shall be submitted for review
and approval by the City Engineer. Calculations (hydraulic) shall be
prepared by the Developer for review by the City Engineer to determine the
sizing of the drainage lines. The minimum and maximum gradients of the new
parking area should be subject to review and approval by the City Engineer.
5. Concentrated drainage shall not be directed onto adjacent properties,
sidewalks and driveways.
6. Where storm water flows against a curb, a curb with gutter shall be used.
The flow line of all asphalt paved areas carrying waters shall be slurry
sealed at least three feet on either side of the center of the swale.
DEBRIS/DUST/CONSTRUCTION ACTIVITY
7. Measures shall be taken to contain all trash, construction debris, and
materials on-site until disposal off-site can be arranged. The Developer
shall keep adjoining public streets free and clean of project dirt, mud,
and materials during the construction period. The Developer shall be
responsible for corrective measures at no expense to the City of Dublin.
Areas undergoing grading, and all other construction activities, shall be
watered, or other dust-palliative measures used, to prevent dust, as
conditions warrant.

EASEMENTS
8. The Developer shall acquire easements, and/or obtain rights-of-entry from
the adjacent property owners for improvements or construction activity
required outside of the subject properties. Copies of the easements and/or
rights-of-entry shall be in written form and shall be furnished to the City
Engineer.
FIRE PROTECTION
9. Prior to issurance of building permits, the Developer shall supply written
confirmation that the requirements of the Dublin San Ramon Services
District Fire Department have been, or will be, met.
GRADING AND PAVING
10. A grading permit shall be obtained from the Public Works Department.
11. The parking and driveway surfacing shall be asphalt concrete paving. The
City Engineer shall retain review authority of the project's structural
pavement design. The Developer shall, at his sole expense, make tests of
the soil over which the surfacing and base is to be constructed and furnish
the test reports to the City Engineer.
12. An encroachment permit shall be secured from the City Engineer for any work
done within the public right-of-way.
LANDSCAPING AND IRRIGATION PLANS
13. A detailed Landscape and Irrigation Plan (at 1 inch = 20 feet or larger),
along with a cost estimate of the work and materials proposed, shall be
submitted for review and approval by the Planning Director.
14. The Developer/Owner shall sign and submit a copy of the City of Dublin
Landscape Maintenance Agreement.
15. Landscaping installed along both the north and east property boundaries of
the new parking area shall include IS-gallon sized trees (with a minimum
planting ratio of one tree @ 17 linear feet) and shall also include clumped
plantings of shrubs (with a minimum planting ratio of one shrub @ 5 linear
feet).
16. Additional landscaping (shrubs and ornamental trees) shall be provided
within the new 200'+ x 200'+ vehicle storage area as generally shown on the
Staff Study Landscape Plan dated October, 1986. An alternate layout may be
utilized provided the landscaping installed is established in a minimum of
eight planter areas totaling a minimum of 1880 square feet (5% of parking
area exclusive of perimeter planting along the north and east property
boundaries).
LIGHTING
17. Exterior lighting shall be of a design and placement so as not to cause
glare onto adjoining properties. Lighting used after daylight hours shall
be adequate to provide for security needs. Photometrics for area lighting
shall be submitted to the Planning Department and the Dublin Police
Services for review and approval prior to the issuance of a grading permit.
STORAGE AND EXTERIOR ACTIVITIES
.18. With the exception of storage of vehicles, no exterior demonstrations,
displays, services, or other activities shall occur in the new 200'+ x
200'+ vehicle storage area.
MISCELLANEOUS
19. The Developer shall be responsible for correction of deficiencies, to the
satisfaction of the City Engineer, in the existing frontage improvements
along Amador Plaza Road.

20. All improvements shall be installed as per the approved landscaping and
irrigation plans and the drainage and grading plans prior to use of the
proposed vehicle storage area.
21. Proper "tie-downs" of newly installed cyclone fencing at the north and east
perimeters of the new parking areas shall be supplied. If the new vehicle
storage area is completely enclosed by fencing, then keyed access to the
site shall be provided to the appropriate emergency service agencies (e.g.,
Police, Fire, etc.). Fencing in disrepair shall be repaired or replaced.
Fence posts at the west side of the new parking area shall be removed.
22. The existing trash enclosure area at the southeast corner of the proposed
vehicle storage area shall be renovated, with said improvements subject to
review and approval by the Livermore-Dublin Disposal Service and Planning
Department prior to the issuance of a grading permit.
23. Prior to the issuance of a grading permit, the Developer shall supply
written documentation from ACFC & WCD - Zone 7 as to what work, if any, the
District will require by the Developer in conjunction with the installation
of fill material along the north side of the new parking area which
encroaches into the adjoining 35-foot width flood control easement on APN
941-305-026.
24. A Master Striping Plan for the proposed vehicle storage area and adjoining
parking and driveway areas shall be prepared and submitted by the Developer
for review and approval by the Planning Director. This plan shall detail
all striping and driveway aisle locations north of the existing "Body-Shop"
building.
25. A parking plan for the entire six acre car dealership facility shall be
prepared and submitted by the Developer detailing the number and location
of the following assigned parking areas: car dealership customer parking,
employee parking, service customer parking, and vendor/visitor parking.
26. Approval from ACFC & WCD - Zone 7 shall be secured by the Developer for
connection into their storm drainage system.
27. Existing on-site light standards shall be fitted with light shields as
necessary to mitigate/minimize existing glare spillover onto 1-680. Said
light shields shall be installed by October, 1987.
28. Except as specifically altered by the above Conditions of Approval,
development shall comply with the conditions established for PA 84-048.2
and .3, PA 83-047 and S-474.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 84-048, A REQUEST BY SHAMROCK FORD FOR A SITE
DEVELOPMENT REVIEW TO CONSTRUCT A NEW OFFICE AND
SHOWROOM AT 7499 DUBLIN BOULEVARD
WHEREAS, Rich Robbins representing Shamrock Ford, filed
an application for a Site Development Review for a new office,
showroom and related parking and display areas at 7499 Dublin
Boulevard; and
WHEREAS, the Planning Commission did hold a public
hearing ~n said application on September 17, 1984; and
WHEREAS, proper notice of said public hearing was given
in all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with provisions of the California Environmental Quality
Act and found to be categorically exempt; and
WHEREAS, a Staff Report was submitted recommending the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony as hereinabove set
forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
1) All provisions of Section 8-95.0 through 8-95.8 Site
Development Review, of the Dublin Zoning Ordinance are complied
with.
2) The approval of the application as conditioned is in the best
interest of the public health, safety and general welfare.
3) General site considerations including site layout, open space
topography, orientation and the location of buildings, vehicular
access, circulation, parking setbacks, height, walls, fences,
public safety and similar elements have been designed to provide a
desirable environment for the development.
4) The use of a new and used car dealership will be consistent
with preliminary policies contained in the Revised Draft General
Plan, specifically as follows:
a) The area is designated for Retail Office and Automotive
,use.
b) Guiding Policy 2.2.2 states "Keep automobile dealers in
Dublin".
5) There is little or no probability that the use will be
detrimental to or interfere with the future General Plan, should
the use ultimately be inconsistent with the future General Plan

BE IT FURTHER RESOLVED that the Dublin Planning
Commission does hereby conditionally approve said application,
subject to materials labeled Exhibit "C" on file in the Dublin
Planning Department and subject to the following conditions:
Unless otherwise specified the following conditions shall be
complied with prior to issuance of the building permits. Each
item is subject to review and approval by the Planning Department
unless otherwise specified.
1) The landscaping strip behind the sidewalk on Amador Plaza
Road shall be increased to 15' for only that portion north of
of the proposed showroom
2) Additional landscaping shall be incorporated within the
parking areas in locations determined by the Planning
Department
3) A final landscape and irrigation plan shall be approved by
the Planning Department.
4) comply with the Standard site Development Review and
Commercial Security Requirements (attached).
5) The existing freestanding sign shall be reduced to a
maximum of 15' in height and a proportionate area reduction,
when legally feasible. If it is shown to be legally
infeasible to reduce the sign at this time, the sign shall
be reduced when legally feasible.
6) The wall sign on the rear building elevation of the new
showroom and the proposed freestanding sign is not allowed.
7) The wall sign on the front elevation of the new showroom
shall be reduced in length to 42'6" maximum, with a maximum
size of the letters to be 28".
8) The gas pumps in front of the new offices shall be screened
from view.
9) Fencing and trash enclosure details shall be approved by
the Planning Department.
10) A lighting plan with footcandle details shall be approved
by the Planning Department.
11) A Colors and material pallet for the new office and showroom
addition shall be approved by the Planning Department.
12) A grading and drainage plan shall be approved by the
City Engineer and Planning Department.
13) Secure the appropriate permits from Zone 7 for working within
the drainage canal.
14) Finished floor elevations for the new buildings shall be
above the 100 year flood level. (333')
15) Sidewalk repairs shall be made along Dublin Boulevard and
Amador Plaza Road as directed by the City Engineer. The
applicant shall not be required to repair damage which
can be shown to have been caused by others.
16) Two street lights shall be installed along the Amador Plaza
Road frontage as directed by the City Engineer.
17) Street trees shall be installed along the Dublin Boulevard
and Amador Plaza Road frontage as directed by the City
Engineer.

18) Encroachment permits shall be secured for all work in the
public right-of-way.
19) Performance and warranty bonds to cover the costs of the
required public and private improvements shall be submitted
within 30 days.
20) This approval shall be valid until 9/17/86. Should
substantial construction not occur by that date, said Site
Development Review approval shall be void.

Final Action Letter - PA 83-047 Shamrock Ford Site Development Review
FINDINGS:
The plans for the Shamrock Ford Sales Office labelled "Exhibit A" (received
August 14, 1983), and on file with the Dublin Planning Department, are
approved, subject to the following conditions:
CONDITIONS:
1. Comply with:
a. Dublin Site Development Review Standard Conditions (attached);
b. Dublin Police Services Standard Commercial Security Requirements
(attached) ;
c. Other agency codes and requirements. In particular, compliance
with DSRSD Fire Department requirements will be required.
Evidence of compliance will be required prior to issuance of
building permits.
2. Exterior colors and materials shall be approved by the Dublin Planning
Department prior to issuance of building permits.
3. Five IS-gallon street trees, of an evergreen canopy species, as
acceptable to the Dublin Planning Department, shall be installed prior
to use of the proposed office.
4. Three IS-gallon canopy trees, of a species acceptable to the Dublin
Planning Department, shall be installed adjacent to the proposed
office, in either raised planters or in the ground, prior to use of the
office.
5. The flat roof shall be left flat, or the proposed chopped mansard roof
add-on shall be continued around the entire roof.
6. Any signing proposed to be located on the office, shall be approved by
the Dublin Planning'Department.
7. The office, and raised walkway, shall comply with City of Dublin
Building Department requirements. These include:
a. placing the office on a permanent foundation;
b. providing a handicapped ramp, in compliance with State of
Caifornia Title 24 requirements.
8. Electrical service to the office shall be undergrounded.
9.
The Dublin Plant Material, Irrigation and Maintenance Agreement
(attached) shall be signed and filed with the Dublin Planning
Department.
