APPLICABLE REGULATIONS:
Section 8-49.2 (Conditional uses: C-2 District) permits auto sales and
services subject to approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW:
Categorically exempt, Class 1.
NOTIFICATION: Public Notice of the November 3, 1986, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings

ANALYSIS:
On July 21, 1986, the Planning Commission approved PA 86-057, a
Conditional Use Permit to allow the operation of an auto dealership at 6451
Scarlett Court. At that time the Applicant indicated an addition to the
existing structure was anticipated in the near future. In an effort to
expedite the Permit process due to the Applicant's need to quickly occupy the
site, the Commission approved the Conditional Use Permit for a limited three
month period. This Conditional Use Permit expired November 1, 1986 and the
Applicant (Chrysler Realty Corporation) is now requesting approval of a new
Conditional Use Permit and Site Development Review to continue operation of
the auto dealership (Curtiss Dodge) and for a 300 square foot locker
room/bathroom addition located in the rear of the existing facility at 6451
Scarlett Court.
The auto dealership will consist of approximately 1,600 square feet of
floor area for indoor auto display, 2,800 square feet of office and Sales area
and 5,750 square feet for parts, service shop, and locker room/bathroom.
Additionally, the Applicant proposes the following number of parking spaces:
Car display 76
Customer 12
Service 8
Employee 13
The numerical parking proposed by the Applicant is consistent with the
City's parking standards.
The site plan provided by the Appliant represents an "as built" parking
and landscaping plan and does not indicate any improvements.
As a temporary or interim situation, the existing parking and
landscaping plan was adequate. However, now that the Applicant is requesting
a longer term Conditional Use Permit, it is necessary for the landscaping,
parking, and circulation plans to be upgraded to current City standards.
Conditions have been included in the Resolution of approval relating to
Staff's concern with the landscaping and parking.
In particular, the recommended conditions require the Applicant to
submit revised parking and circulation and landscape plans indicating raised
landscape planters within the parking area providing a clear separation
between the ends of parking rows and drive aisles. Recommended modifications
to the parking layout include: 1) straighten the angled landscape finger
adjacent to the driveway entrance; 2) eliminate the paved "dead space" area in
the southeast corner by providing as an additional landscape area; 3) modify
the western drive aisle to clearly distinguish the parking areas from the
drive aisle; 4) re-locate customer parking area as generally depicted on
attached Staff study. Additionally, the front landscape area should be
upgraded. The Applicant should provide revised landscape & irrigation plans
indicating proposed supplemental landscaping, showing in detail typical
planting, double staking, plant pallet including a description of the type of
plant, rate of growth, and container size, and the replacement of damaged,
diseased or dead plants.
In revising the parking plan, the Applicant may consider revising
display parking to increase the possible number of spaces.
As indicated in prior Conditional Use Permit approval, the City is
currently studying various alternatives for the alignment of the Dublin
Boulevard extension. Although the specific alternative has not been selected,
the future Dublin Boulevard extension is likely to affect a portion of the
Applicant's property.

APPROVING PA 86-089 CHRYSLER CORPORATION CONDITIONAL USE PERMIT TO OPERATE AN
AUTO DEALERSHIP INCLUDING AUTOMOTIVE SALES AND SERVICE, AUTOMOTIVE PAI~T AND
REPAIR AND SALE OF MERCHANDISE SUCH AS AUTO PARTS AT 6451 SCARLETT COURT
WHEREAS, the Applicant, Chrysler Corporation, filed an application
for a Conditional Use Permit and Site Development Review to operate an
automotive dealership and construct a 300 square foot addition at 6451 Scarlett
Court; and
WHEREAS, the City of Dublin Zoning Ordinance provides in part for
the establishment of an automobile, camper, boat and trailer sales, storage lot
as a Conditional Use; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on November 3, 1986; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
prov~s~ons of the California Environmental Quality Act and has been foun~ to be
categorically exempt; and
WHEREAS, the City is currently studying various alternative~ for
the alignment of Dublin Boulevard extension. Although the specific alte~native
has not been selected, the future Dublin Boulevard extension is likely t~
affect a portion of the property at 6451 Scarlett Court (APN 941-550-12-7); and
WHEREAS, a Staff Report was submitted recommending that the-
Conditional Use Permit application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use is required by the public need in that the use offers
the Dublin consumer a specific auto dealer sales and services otherwise not
available within the City;
b) The use will be properly related to other land uses and ~
transportation and service facilities in the vicinity in that the project will
be commensurate with the present use of surrounding properties within the
neighborhood;
c) The use, under all the circumstances and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity or be materially detrimental to the
public welfare or injurious to property or improvements in the neighborhood as
all applicable regulations will be met;
d) The use will not be contrary to the specific intent clauses or
performance standards established for the district in which it is to be -
located, in that the auto dealership is consistent with the character of the
surrounding Commercial and Industrial District.

CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
within 30 days from approval and shall be sub;ect td Planning Department review
and approval.
1. The auto dealership shall be limited to automotive sales and se~ices,
automotive painting and repair and sales of auto merchandise, such as auto
parts.

2. The Applicant shall maintain, designate and keep available (for the
designated user group) at all times on a continuous basis a minimum 13
employee parking spaces, 12 customer parking spaces, and 8 service parking
spaces.
3. This Conditional Use Permit is subject to approval of the related Site
Development Review permit.
4. The Applicant shall remove all unauthorized signs including the sign
advertising the Tracy dealership located in the northwest corner ,of the
site.
5. All signs are subj ect to Planning Department review and approval..
6. With the exception of storage of vehicles and minor vehicle preparation
work, no exterior demonstrations, displays, services, or other activities
shall occur in the vehicle storage area. .
7. The Developer shall be responsible for correction of deficiencies, if any,
to the satisfaction of the City Engineer, in the existing frontage
improvements along Scarlett Court.
8. All improvements shall be installed as per the approved landscaping and
irrigation plans and the drainage within three months of this approval.
9. This permit shall expire on November 15, 1989, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.

WHEREA~, the Applicant, Chrysler Corporation, filed an application
for a Conditional Use Permit and Site Development Review to operate an
automotive dealership and construct a 300 square foot addition at 6451 Scarlett
Court; and

structures having qualities which~would not meet the specific intent clauses or
performance standards set forth in the Zoning Ordinance and which are not
properly related to their sites, surroundings, traffic circulation, or their
environmental setting;
c) The approval of the application as conditioned is in the best
interests of the public health, safety, and general welfare;
d) General site considerations, including site layout,
orientation, and the location of buildings, vehicular access, circulation and
parKing have been designed to provide a desirable environment for the
development;
e) General archit~ctural considerations, including the
character, scale, aI1.d quality of the design, the architectural relationship,
with the site and other buildings, building materials, colors, exterior
lighting, and similar elements have been incorporated in order to insure
compatibility of this development with its design concept and the character of
adj acent buildings;

type, size, color, texture, and coverage of plant materials, provisions for
irrigation, maintenance and protection of landscaped areas and similar elements

BE IT FURTHER RESOLVED that the Planning Commission does hereby
approve Site Development Review application PA 86-089 as shown by materials
labeled Exhibit A, on file with the Dublin Planning Department, subject to the
following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to issuance of building permits and shall be sub;ect to Planning
Department review and approval.
General Conditions:
1. Comply with the plans labeled 'Exhibit A' as may be amended by the related
Conditional Use Permit and these conditions.
2. Comply with all applicable Building Code requirements.
3. Comply with applicable Site Development Review standard conditions
(attached) .
4. Comply with applicable Dublin Police Services Standard Commercial Buildi~g
Security Requirements (attached).

5. Submit detailed landscape and irrigation plan (1 inch = 20 feet scale)
along with a cost estimate of works and materials subject to Planning
Department review and approval indicating: 1) raised landscaping planters
within the parking area; 2) proposed supplemental landscaping along front
perimeter of property including replacement of damaged, diseased, or dead
plants; 3) eliminate the paved "dead space" in 'the southeast corner of site
by providing additional landscaping. Landscape plans should indicate the

materials on site until disposal off-site can be arranged. The Developer
shall keep adjoining public streets free and clean of project dirt, mud,
and materials during the construction period. The Developer shall be
responsible for corrective measures at no expense to the City of Dublin.
Areas undergoing grading, and all other construction activities, shall be
watered, or other dust-palliative measures used, to prevent dust, as
conditions warrant.

Lighting
13. Exterior lighting shall be of a design and placement so as not to cause
glare onto adjoining properties. All subsequent exterior lighting shall
conform with this condition. '
Architectural
14. Exterior colors and materials for the building addition shall be subject to
final review and approval by the Planning Director and shall be consistent
with those of the existing structure. All duc~s, meters, air conditioning
equipment and other mechanical equipment on the enlarged structures shall
be effectively ~creened from view with materials architecturally compatible
with the main structure.
Miscellaneous

15. Development shall generally conform with the plans prepared by Engineering
West, consisting of five sheets 'labeled Exhibit "A", dated received by the
City Planning Department October 27, 1986, and the changes called for by
these Conditions of Approval.
16. Landscaping shall not obstruct the sight distance of motorists. Except for
tree trunks, the area between two feet and five feet above the ground
should be clear for visibility purposes.
17. Handicapped ramps and parking shall be provided as required by State of
California Titie 24.
18. All parking spaces shall be double 4-inch striped approximately two feet
apart between each space. Handicapped and compact car spaces shall be
appropriately identified on pavement.
19. An encroachment permit shall be secured from the City Engine~r for any work
done within the public right-of-way.
20. All signs are subject to Planning Department review and approval.
21. The Applicant shall repair on-site pavement; in particular, the pavement on
the rear western drive aisle.
22. The Applicant shall replace all-broken and missing wood slats on the
existing eastern fence.
23. Approval for the Site Development Review shall be valid until November 13,
1987. If construction has not commenced by that time, this approval shall
be null and void.
