FINANCIAL STATEMENT: This agreement provides that Jennifer Lin will pay the cost of the
project study report for the interchange improvements. The estimated cost breakdown for preparation of
the Project Study Report by Fiscal Year is:

Ms. Lin will receive a credit against payment of future Eastern Dublin Traffic Impact Fees in an amount
equal to funds advanced for this work. The Lins will also receive credit for the aerial topographic map
being supplied by MacKay and Somps through a direct contract with the Lins. Credit will only be given
after review and approval by the Public Works Director of the cost proposal/work produc~and evidence of
payment. The use ofthis credit is to be defined in the Development Agreement for the project and used
according to the established policy at the time of development. It is proposed to establish a new Capital
Improvement Project for this work, the cost of which is offset by new revenue.

DESCRIPTION: Improvement of the I-580/Fallon RoadlEl Charro Road interchange.
is a required mitigation for the Dublin Ranch development. This agreement with Jennifer Lin provides for
payment of costs related to preparation of a ProjeCt' Study Report for the interchange improvements.
Jennifer Un has contracted with the firm of MacKay and Somps to provide an aerial topographic survey of
the interchange, which will be used as part of the Project Study Report (PSR). A separate item on the
agenda provides for the City's agreement with ees Planning and Engineering for preparation of the
Concept Study Report that is preliminary to the PSR. The City Council previously approved an
agreement with George Homolka for project management and coordination services related to
improvement of several interchanges.
Staff recommends that the City Council approve the budget change and adopt the resolution approving the
agreement.

APPROVING AGREEMENT WITH JENNIFER LIN
REGARDING PROJECT STUDY REPORT
FOR I-580/FALLON ROADIEL CHARRO ROAD INTERCHANGE
WHEREAS, a part of the mitigation for the Dublin Ranch development requires improvement of
the I-580fFallon RoadlEl Charro Road interchange; and
WHEREAS, the eity and Jennifer Un have agreed to the preparation of certain preliminary reports
related to this interchange; and
WHEREAS, a credit against payment offuture Eastern Dublin Traffic Impact Fees will be provided
to offset Jennifer Lin's payment of costs related to the project study report;
NOW, THEREFORE, BE IT RESOL YED that the City Council approves the agreement with
Jennifer Lin regarding preparation of project study report for the I-580/Fallon RoadlEl Charro Road .
interchange;
BE IT FURTHER RESOL YED that the Mayor is authorized to execute the agreement.

AGREEMENT BETWEEN JENNIFER LIN
-m AND CITY OF DUBLIN REGARDING
PROJECT STUDY REPORT FOR
FALLON ROAD INTERCHANGE
THIS AGREEMENT is entered into this _ day of April_, 1998, between
the City of Dublin, a municipal cOlporation ("City") and Jennifer Un ("Un").
RECITALS
A. Un owns approximately 1227 aGes ofland located within the area
generally known as Eastern Dublin. Some of Lin's property is within the City of
Dublin and tl1e remainder of Lin's property is within the City's sphere of influence.
B. City has adopted a traffic impact fee (Eastern Dublin Traffic Impact
Fee) to pay for road improvements necessary in Eastern Dublin.
C. City's Eastern Dublin Specific Plan ("Specific Plan") designates land
uses for Lin's property. Lin '\vill be required to pay an Eastern Dublin Traffic Impact
Fee "vhen Lin develops her property.
D. The Specific Plan notes that improvements will be required to the 1-580
n:eev,ray interchange a~ Fallon Road. (Specific Plan, 5.2.12.)
E. A project study report. 6r'''PSR'' is required by Caltrans in connection ~
'\"ith improvements to the Fallon Road interchange. It is also desirable to prepare a
"preliminary" or "concept" PSR prior to the preparation of the fmal PSR.
F. Lin has agreed to advance funds to City for retention of a consultant to
prepare a "preliminary" project study report., as provided in this agreement and City
has agreed to provide Lin a o'edit against payment of future Eastern Dublin Traffic
Impact Fees in an amount equal to the funds advanced.
AGREEMENT
Now, therefore, City and Lin agree as follov:s:
1.

City '\vill retain a consultant to prepare a "preliminary" project study report for
the Fallon Road interchange City shall enter into an agreement with a consultant

2.
Deposit
Un will deposit $94,500 with City contemporaneous ,1I,rith execution of this
agreement to be used by City to cover City's costs of the "preliminary" PSR as set
forth in paragraph 1 above. Any funds remaining in such account shall be returned
to Lin following completion of the "preliminary" project study repOlt. Lin shall
deposit additional funds, ifnecessalY, when requested by City's Public Works
Director but not to exceed an additional $14, 1 75.
3. Credit Against TIF
City shall provide a credit to Un in the amount of the PSR cost, which shall be
the amount paid to the consultant (which shall not include a "mark-up") and the
City's administrative costs charged against the deposit plus amounts paid to MacKay
& Somps by Lin for metric aerial typographic mapping, as approved by the Public
Works Director. The amount of the credit shall not be increased for inflation nor
shall interest accrue on the amonnt of the credit. The credit shall be applied by Un
a gainst the "Section 1" portion of the Eastern Dublin Traffic Impact Fee for the
Dublin Ranch project in the manner and subject to the provisions of City's
administrative guidelines for use of such credits.

No Obligation to Appr~~ P~oject
This agreement shall not be construed as providing Lin with any assurance
that any application for a land use entitlement will be granted by City for Lin's
property.
