APPLICABLE REGULATIONS:
Section 8-48.2 q) Conditional Uses: C-l Districts allow "recycling
centers when operated in conjunction with a Permitted use on the same
premises" subject to approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to deter-
mine: 1) whether or not the use is required by the public need; 2) whether or
not the use will be properly related to other land uses, transportation and
service facilities in the vicinity; 3) whether or not the use will materially
affect the health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific intent clauses
or peformance standards established for the district in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions.
ENVIRONMENTAL REVIEW:
Categorically Exempt, Class 4 (e)
NOTIFICATION: Public Notice of the January 5, 1987, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings.
ANALYSIS:
The Applicant is requesting approval of a Conditional Use Permit to
allow a Goodwill Donation Station in the Mervyn's parking lot southwest of the
Store building, facing Dublin Boulevard. The Donation Station consists of a
blue and white truck trailer, 24 feet long and 7 feet wide. The truck trailer
will occupy approximately 4 parking spaces. The proposed hours of operation
for the station are between 10:00 a.m. and 5:30 p.m. A Goodwill employee will
be present at the trailer during operating hours. The purpose of the station
is to receive donations of items used to provide vocational training services
for the handicapped.
The City Zoning Ordinance does not list a specific category for this
use; however, the use is considered similar to a recycling center which
requires a Conditional Use Permit approval.
The proposed use appears appropriate for the property; however, Staff
recommends that the Applicant relocate the trailer to the parking area between
Montgomery Ward and Mervyn's. That portion of the parking lot is used less
often than the area proposed by the Applicant.
Additionally, the location of the truck trailer in the parking area
between Mervyn's and Ward's is visible from Dublin Boulevard yet is less
obtrusive in that location as opposed to the location proposed.

Dear r-tr. Tong,
On behalf of the Board of Directors, staff and clients of Goodwill
Industries of the Greater East Bay, I respectfully request the City of
Dublin to approve the placement of a Goodwill Donation Station in the
Mervyn's parking lot at 7117 Regional Street in Dublin.
Mr. James Daugherty, the store director at Mervyn's, has approved
this placement, knowing that we expect about 20 donors per day at the
24-foot-long, seven-foot-wide trailer which will occupy four parking
spaces.
As you may know, Goodwill derives most of its financial support for
vocational training programs from the revenue generated from selling
donated goods in our retail stores. The Donation Stations allow this
agency to operate on earned income rather than on public support, as
well as offer employment to approximately 220 persons each day.
Our attractive blue and white trailer will be open seven days a week
from 10 a.m. to 5:30 p.m. A Goodwill employee will be at the trailer
during operating hours to assist with donations and give tax receipts
to donors.
The placement of the Donation Station trailer will result in six to
eight jobs for individuals who have difficulty competing in the regular
labor market. It also serves as a symbol of community service.
It is our hope e1at the City of Dublin will support Goodwill's
efforts to provide vocational training and services to handicapped and
disadvantaged citizens by approving this request.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 86-130 GOODWILL INDUSTRIES DONATION STATION -
CONDITIONAL USE PERMIT REQUEST FOR A 24 FOOT LONG TRUCK TRAILER LOCATED
IN THE MERVYN'S PARKING LOT AT 7117 REGIONAL STREET
WHEREAS, Ronald Turnbow, representing Goodwill Industries, filed
an application for a Conditional Use Permit to locate a 24-foot long truck
trailer for a Donation Station in the Mervyn's parking lot at 7117 Regional
Street; and
WHEREAS, the Planning Commission held a public hearing on said
application on January 5, 1987; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the request is categorically exempt in accordance with the
provisions of the California Environmental Quality Act; and
WHEREAS, a Staff Report was submitted recommending the application
be conditionally approved; and
WHEREAS, the Planning Commission heard and considered all said
reports, recommendations and testimony hereinabove set forth;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find:
a. The use is required by the public need in that it provides a location for
the general public to drop off reusable items.
b, The use would be properly related to other land uses and transportation
and service facilities in the vicinity.
c. The use, if permitted under all circumstances and conditions of this
particular case, will not materially affect adversely the health or
safety of persons residing or working in the vicinity, or be materially
detrimental to the public welfare, or injurious to property or
improvements in the area, as all applicable regulations will be met.
d. The use will not be contrary to the specific intent clause or performance
standards established for the district in which it is to be located in
that conditions have been applied to insure conformance with the Zoning
Regulations.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby approve said application as shown on Exhibit "A" on file with the Dublin
Planning Department and subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to issuance of building permit or establishment of proposed land use
activity and shall be subiect to Planning Department review and approval.
1. The Donation Station truck trailer shall be located in Mervyn's parking
lot area between Mervyn's and Ward's, as generally depicted in Exhibit A.
2. The Donation Station shall not interfere with or obstruct vehicular
access or movement within the parking lot.

3. The Applicant shall be responsible for maintaining the Donation Station
(including the parking lot surrounding the truck trailer) in a clean and
orderly manner. No items shall be left outside the truck trailer for
longer than 24 hours at a time.
4. The Applicant shall provide on-site signage indicating hours of
operation, drop-off instructions for after hours and a telephone number
for use, in case of emergency. Said signage shall be limited to two
signs with maximum 24 square feet sign area.
5. This permit shall expire January 15, 1988, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
