March 23, 1982: A Site Development Review application was approved for a 9,800~ square foot office. February 6, 1984: A Conditional Use Permit to establish two car dealerships (Datsun/Nissan and Buick Dealerships) was approved by the Dublin Planning Commission (PA 84-001). ITEM NO. g ,).. October 4, 1985: Planning Director approved PA 85-084 Valley Nissan Administrative Conditional Use Permit for temporary promotional advertising. March 3, 1986: Planning Commission approved PA 86-002 Valley Volvo Auto Dealership Conditional Use Permit/Site Development Review. July 25, 1986: Planning Director approved PA 86-077 Valley Nissan Administrative Conditional Use Permit for temporary promotional advertising. APPLICABLE REGULATIONS: Section 8-87.33 Wall Signs and Projecting Signs establishes maximum height, width and area permitted for wall signs and makes provision for increases in these limitations through the Site Development Review process. Section 8-87.34 (c) of the City's Zoning Ordinance provides an exception to the 20-foot maximum sign height requirement whereby single use parcels one and one-half (1 1/2) acres or greater may utilize a sign up to 35 feet subject to approval of a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions. ENVIRONMENTAL REVIEW: Categorically Exempt, Class 11 (a) NOTIFICATION: Public Notice of the January 5, 1987, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting approval of a Conditional Use Permit and Site Development Review for two wall mounted signs and a 35-foot tall freestanding sign at Valley Volvo, 6015 Scarlett Court. The proposed double-faced freestanding sign is set back approximately 54 feet from the front property line and 10 feet from the side property line. The proposed sign face is 12 feet by 5.5 feet (132 square feet double-faced sign area or 66 square feet for each single-faced side). The Applicant is proposing an interior illuminated pole measuring 29.5 feet by 2.08 feet. This pole area must be included as sign area in that the Ordinance specifically indicates that structures "which depart from standard architectural procedures in an attempt to attract attention to the premises by reason of color scheme, building shape or unusual architectural features shall be considered sign area. . ." The pole area totals 122.7 square feet double-faced. -2- A freestanding sign may utilize allowable sign area from the primary building frontage and/or secondary building frontage. The proposed free- standing sign is in compliance with the Sign Ordinance regulations based on setback, height and maximum allowable sign area. The sign does not comply with the proportion formula outlined in the Sign Ordinance (.3 ht. x .5 ht.). However, the Sign Ordinance allows adjustments to the proportion through the Site Development Review approval. The Applicant proposes two wall mounted signs on the primary building frontage. A 6 foot by 3 foot (18 square feet) service and parts sign and a 40 foot by 2.5 foot (100 square feet) Valley Volvo Dealership sign. Both signs exceed the maximum sign height, sign width and sign area permitted; however, the signs do comply with the maximums permitted under the Site Development Review process. Under the Site Development Review process the primary building frontage is permitted up to a maximum 155.7 square feet of sign area and 58 feet sign width. Individual letter height and sign height may also be increased with the Site Development Review. The proposed wall mounted signs are consistent with other signs approved through the Site Development Review process. Through the Site Development Review process the maximum allowable sign area for the Valley Volvo Dealership is approximately 409.75 square feet. The Applicant proposes a total of 372 square feet of sign area which is consistent with the Ordinance. The primary issue associated with the Applicant's proposal is that of aesthetics. Should the pole be illuminated? Consistent with the Sign Ordinance, the illuminated pole area is included within the total sign area for the building. If the illumination of the pole is eliminated, the pole area would not be included as sign area, and the Applicant may choose to increase the sign area of the freestanding sign. A condition has been included in the Resolution which requires Planning Department approval of any modification to the sign. Staff recommends approval of the Site Development Review and Conditional Use Permit for the proposed freestanding sign and wall mounted signs. M -;:=r - lN~ .~ ,._"..,..... ::~.-- ,: P.I~ I-:~ '. -, - \ ; ---- ----. _________ __t .. .. --------_. . . ------------ ) . t.. . ..- .....~ ,.... . .- I ' i : ----I ,: ' RESOLUTION NO. 87- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 86-131 VALLEY VOLVO CONDITIONAL USE PERMIT REQUEST FOR A 35-FOOT TALL FREESTANDING SIGN LOCATED APPROXIMATELY 54 FEET FROM THE FRONT PROPERTY LINE AT 6015 SCARLETT COURT WHEREAS, Wade McClure, representing Koenig Von Stark Investments, filed an application for a Conditional Use Permit to locate a 35 foot tall free- standing business identification sign, located approximately 54 feet from the front property line at 6015 Scarlett Court; and WHEREAS, the Planning Commission held a public hearing on said application on January 5, 1987; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the request is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission heard and considered all said reports, recommendations and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: a, The use is required by the public need in that it provides visible identif- ication to the general public for the Valley Volvo Auto Dealership. b, The use would be properly related to other land uses and transportation and service facilities in the vicinity. c, The use, if permitted under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare, or injurious to property or improvements in the area, as all applicable regulations will be met. d. The use will not be contrary to the specific intent clause or performance standards established for the district in which it is to be located, in that conditions have been applied to insure conformance with the Zoning Regulations. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve said application as shown on Exhibit "A" on file with the Dublin Planning Department and subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to issuance of building permit or the establishment of the proposed land use activity and shall be sub;ect to Planning Department review and approval. 1. The freestanding sign shall not exceed a maximum height of 35 feet and shall not exceed a total maximum sign area of 254 square feet (double-faced including the illuminated pole), and shall be for the purpose of business identification. -1- r'1!. Any modifications to said sign shall be subject to review and approval of the Dublin Planning Department. 3. The Applicant shall comply with all applicable Building Code requirements. 4. Building permits for the proposed sign shall be secured and construction commenced within six months after the effective date of this permit, 5. This permit shall expire on February 6, 1989, to correspond with the expiration of PA 86-002 Volvo Auto Dealership Conditional Use Permit, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
