ZONING HISTORY: A Site Development Review permit was approved by the
Planning Director on July 5, 1983 (PA 83-023) which provided for the construc-
tion of the 36,OOO~ square foot light industrial/warehouse structure which
currently occupies the site.
APPLICABLE REGULATIONS:
Section 8-87.10 k) of the City of Dublin Zoning Ordinance defines a Low
Profile Sign as a Business Sign that serves to identify a business complex,
including the range of the businesses within the complex, and may also serve
as a Directory Sign identifying a minimum of four and a maximum of ten tenants
located in said complex.
Section 8-87.10 y) defines a Time/Temperature Sign as a Business Sign
intended primarily to promote items of general interest to the community such
as time, temperature and/or date.
Section 8-87.66 e) indicates that Time/Temperature Signs may be located
in required yards, subject to approval of a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to deter-
mine: 1) whether or not the use is required by the public need; 2) whether or
not the use will be properly related to other land uses, transportation and
service facilities in the vicinity; 3) whether or not the use will materially
affect the health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific intent clauses
or peformance standards established for the district in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.

ANALYSIS:
The Applicant is requesting approval of Conditional Use Permit and Site
Development Review requests for a Low Profile - Time/Temperature Sign with
tenant directory information. The Applicant proposes to situate the sign
along the property's Sierra Court frontage, roughly centered between the two
driveways extending from Sierra Court.
The proposed height of the sign is 7 feet, 4 inches; the length is
proposed at 5 feet, 0 inches, for a proposed double-faced aggregate area of
65~ square feet. The Ordinance restricts the height of Low Profile Signs to a
maximum of 6 feet,O inches, and the total sign area to a maximum of 24 square
feet for Low Profile Signs. The Applicant's proposal exceeds these
requirements.

The proposed Low Profile - Time/Temperature Sign is intended to identify
the four existing tenants in the Trinity IV facility, including: Federal Sign
(the Applicant), Davidson Supply Company, Pacific Cyber/Metrix, Inc., and
Western French Imports, Inc. A total of 23.75 square feet of the 32.5 square
foot area of each face of the proposed sign is to be devoted to identification
of tenants and the building complex. An area of 3.75 square feet is proposed
to be devoted to indicate the address range of the complex and a total of 5.0
square feet is to be devoted to the panel for the time and temperature
readout. The Applicant proposes to locate the sign approximately 5 feet from
the western property line.
The information proposed to be included on this sign is consistent with
the sign copy restrictions in the Zoning Ordinance relating to Low Profile -
Time/Temperature Signs. To be consistent with the dimensional requirements
established for Low Profile Signs, the sign copy identifying tenants in the
complex and the name of the complex would have to be restricted to a maximum
of 24 square feet. The area for the sign copy indicating the address range
for the complex and the area devoted to the time/temperature readout would not
be assessed against this area calculation. Additionally, the height of the
sign, exclusive of the height of the concrete base, would have to be reduced
from 6'-6" to 6'-0" to conform with the Low Profile Sign dimensional
requirements.
Staff recommends the Planning Commission conditionally approve the
Applicant's request for a Low Profile - Time/Temperature Sign, conditioned on
the maximum area of this sign devoted to tenant or complex identification
being reduced to 24 square feet and the height of the sign reduced to a
maximum of 6'-0". If modified in this manner, the Sign will be consistent
with the size restrictions for Low Profile Signs and will provide attractive
and effective signage.

WHEREAS, the Planning Commission held a Public Hearing on said
application on February 17, 1987; and
WHEREAS, proper notice of said Public Hearing was given in all
respects as required by law; and
WHEREAS, this application has been reviewed in accordance with the
prov~s~ons of the California Environmental Quality Act and has been found to be
categorically exempt; and
WHEREAS, a Staff Analysis was submitted recommending conditional
approval of the application (recommending a reduction of the sign's maximum
height and it aggregate copy area); and
WHEREAS, at said Public Hearing the Planning Commission considered
all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a)
identifies the
public service
The use is required to serve a public need in that the sign
businesses within the Trinity IV project, while also providing
information by providing time readout.
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity in that it is commen-
surate with properties in the neighborhood.
c) The use, under all circumstances and conditions of this
particular case, will not materially affect adversely the health or safety of
persons residing or working in the vicinity, or be materially detrimental to
the public welfare or injurious to property or improvements in the neighbor-
hood, in that all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses
or performance standards established for the District in which it is to be
located in that the sign location is consistent with provisions of the Zoning
Ordinance.
e) The approval of the use permit will be consistent with the
policies set forth within the Dublin General Plan.
f) All provisions of Section 8-95.8 Site Development Review, of
the Zoning Ordinance, are complied with.

NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby conditionally approve PA 87.011.1 and .2 as generally depicted by
materials from the February 17, 1987, Planning Commission Staff Report, labeled
Exhibit B, on file with the Dublin Planning Department subject to the following
Conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to issuance of a building permit or establishment of proposed land use
activity and shall be subiect to Planning Department review and approval.
1. The sign cabinet for the subject Low Profile - Time/Temperature Sign shall
be modified to generally comply with the following design criteria:
a) Maximum sign area - as generally depicted on the Sign Elevation
Plans submitted with the application and dated received January 28,
1987, with a maximum of 24 square feet of the sign area devoted to
tenant or complex identification (sign shall be a south-facing
single-faced sign with only project address information allowed to
be placed on the north-facing sign elevation)
b) Maximum sign cabinet height - 6 feet
c) Maximum sign cabinet width - 5 feet
d) Copy size - 3 to 6 inch white vinyl letters.
e) Sign location - as generally shown on the Site Plan submitted with
the application and dated received January 28, 1987 (observing a
minimum setback of 5 feet).
2. Building permits for this structure shall be secured and construction
commenced within six (6) months after approval of this application or said
approval shall be void.
3. The existing tenant Freestanding Sign (1 1/2'~ x 2'~ Davidson Supply Co.
sign) along the Sierra Court frontage shall be removed prior to
installation of the Low Profile - Time/Temperature Sign.
4. If a new Tenant Sign Program (Wall and/or Window Signs) is proposed for
this project, said program shall be subject to review and approval by the
Planning Director. All current tenants shall observe the present Tenant
Sign Program, utilizing individual white letters on the store front glazing
to indicate tenant business name.
5. The use and manner of lighting, either internal or external, of the new
Freestanding Sign shall be subject to review and approval by the Planning
Director prior to installation.
6. The material used for any proposed base for the new Freestanding Sign shall
be of a high architectural quality, exposed aggregate or equivalent so as
to compliment the design of the principle structure.
7. Signage used on this site to indicate space available for lease shall not
exceed a maximum area of 24 square feet or a maximum height of 6 feet, and
shall observe a minimum setback of 10 feet from the perimeter streets and
any adjoining driveway of on-site parking areas.
8. The readout of time and temperature information shall be a constant
display, with display changes (i.e., from time to temperature and vice
versa) occurring no more frequently than every five seconds, or as
determined acceptable to the Planning Director. Upon installation of the
sign, the frequency of the time and temperature display changes shall be
subject to review and modification by the Planning Director.
9. Chipped sidewalk along the subject property's street frontages shall be
repaired, as required by the City Engineer.

10. Low areas at the back of the property sidewalk shall be filled to sidewalk
level as required by the City Engineer.
11. This permit shall be revocable for cause in accordance with Section 9-90.3
of the Dublin Zoning Ordinance.
