ZONING HISTORY:
A Site Development Review request was approved on
February 26, 1985, by the Planning Director,
allowing the development of an ll-building -
192,600~ square foot industrial business park over
the 13 acre property. That facility has been
constructed and is approximately one-half occupied,
The PD, Planned Development District was applied to
the Sierra Trinity Business Park following approval
of PA 85-032 by the Dublin City Council on July 22,
1985.
APPLICABLE REGULATIONS:
As indicated above, City Council Resolution No. 85-71 established the
Findings and General Provisions for the Sierra Trinity Business Park PD, Planned
Development District. The Findings and General Provisions establish that all uses
in the Business Park are to be consistent with the intent of the Commerical/
Industrial - Business Park/Industrial designation specified in the adopted General
Plan (Condition #1), and shall also be consistent with the intent of the M-l
Zoning District as specified in Section 8-51.0 of the Zoning Ordinance. Condition
#8 of the Findings and General Provisions establishes the Conditional Use Permit
process as the manner to consider additional uses that could possibly meet the
intent of the PD District, but for which the Zoning Administrator is unable to
make the required findings.
Use of the Conditional Use Permit process for the proposed Exercise Studio
is consistent with Section 8-51.3 (e) of the Zoning Ordinance, which lists
recreational facilities, in an enclosed building, as a Conditional Use in an M-l,
Light Industrial District.
Section 8-94.0 states that conditional uses must be analyzed to determine:
1) whether or not the use is required by the public need; 2) whether or not the
use will be properly related to other land uses, transportation and service
facilities in the vicinity; 3) whether or not the use will materially affect the
health or safety of persons residing or working in the vicinity; and 4) whether or
not the use will be contrary to the specific intent clauses or performance
standards established for the district in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be valid
only for a specified term, and may be made contingent upon the acceptance and
observance of specified conditions, including but not limited to the following
matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed use
brought into existence, failing which, the approval shall lapse and be void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW: A Negative Declaration of Environmental Significance has
been prepared for this project pursuant to the provisions of CEQA, The
project will not have a significant effect on the environment.
NOTIFICATION: Public Notice of the April 6, 1986, hearing was published in The
Herald, mailed to adjacent property owners, and posted in public buildings,
ANALYSIS:
As noted above, the Planning Department previously approved a Site
Development Review allowing the construction of an ll-building - 192,600~ square
foot business park complex.

In the M-l Light Industrial District (the zoning designation for the bulk of
the Sierra Court, Sierra Lane and Trinity Court area), only those uses classified
as manufacturing, processing, assembly, research, wholesale storage or utility use
when conducted within a building are listed as permitted uses. A wide range of
specific additional uses (offices, car dealerships, outdoor storage, recreational
facilities) may be considered through the Conditional Use Permit process.
Bedford Properties anticipated occupancy in the Sierra Trinity Business Park
by tenants who may not have fallen within the definition of permitted uses in the
M-l, Light Industrial District. Rather than processing a large number of tenants
on a Conditional Use permit-by-Conditional Use Permit basis, Bedford submitted and
secured a PD, Planned Development District Rezoning which expanded the permitted
uses on this site. (See City Council Resolution No. 85-71, Attachment #6.)
When the PD, Planned Development District Rezoning was processed, Bedford
Properties argued that the M-l, Light Industrial District does not take into
account all the changes many of the recent industrial business park projects. The
M-l, Light Industrial District has a format establishing as permitted uses those
uses more closely associated with manufacturing and assemblying. New industrial
business parks in the Tri-Valley area, including Bedford's, have higher design
standards, extensive landscaping, and attract uses which typically require more
office space.
The proposed location of the Exercise Studio, as relates generally to the
one million ~ square foot Sierra Court, Sierra Lane and Trinity Court Business
Park - Light Industrial area, and as specifically relates to the site plan layout
of the Sierra Trinity Business Park, is considered appropriate by Staff. Adequate
parking will be available at the site, and the location (opposite the Pot Belly
Deli and along the principal project frontage) mitigates any potential problems of
mixing this type of use with existing or future land use activities of a heavier,
more industrial nature.
Adjustments to the size of the assembly area will be necessary to avoid
costly tenant improvements required by the Building Code for occupancies of over
300 people (based on one person for every 15 square feet of floor area). It would
appear that the proposed open workout area would have to be reduced in size by
approximately 750 square feet to get below an area of 4,500 square feet.

PA 87-042.

FOR A COMMERCIAL RECREATIONAL FACILITY (EXERCISE STUDIO) -
CONDITIONAL USE PERMIT REQUEST - 6735 SIERRA COURT.
WHEREAS, Sharon Slater, on behalf of Bedford Properties filed a
Conditional Use Permit request to allow a commercial recreational facility
(Gold's Gym Exercise Studio) within the Sierra Trinity Business Park PD,
Planned Development District; and
WHEREAS, the California Environmental Quality Act (CEQA), as
amended together with the State's Administrative Guidelines for Implementation
of the California Environmental Quality Act and City Environmental Regulations,
requires that certain projects be reviewed for environmental impact and that
environmental documents be prepared; and
WHEREAS, a Negative Declaration of Environmental Significance has
been prepared for PA 87-042; and
WHEREAS, THE Planning Commission did review the Negative
Declaration of Environmental Significance and considered it at a public hearing
on April 6, 1987; and
WHEREAS, the City Planning Commission determined that the project,
PA 87-042, will not have any significant environmental impacts;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
finds that the Negative Declaration of Environmental Significance has been
prepared and processed in accordance with State and Local Environmental Law and
Guideline Regulations, and that it is adequate and complete.

FOR A COMMERCIAL RECREATIONAL FACILITY (EXERCISE STUDIO)
CONDITIONAL USE PERMIT REQUEST. 6735 SIERRA COURT
WHEREAS. Sharon Slater, on behalf of Bedford Properties, filed a
Conditional Use Permit request to allow a commercial recreational facility
(Gold's Gym - Exercise Studio) within the Sierra Trinity Business Park, PD,
Planned Development District; and
WHEREAS. the City of Dublin Ordinance 17-85 and Resolution
No. 85-71 provide, in part, for the establishment of commercial recreational
facility uses in the Sierra Trinity Business Park PD, Planned Development
District as Conditional Uses; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on April 6, 1987; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS. this application has been reviewed in accordance with the
prov~s~ons of the California Environmental Quality Act and a Negative
Declaration of Environmental Significance has been adopted (Planned Commission
Resolution No. 87- ) for this project, as it will have no significant effect
on the environment; and
WHEREAS, the Staff Report was submitted recommending that the
Conditional Use Permit application be conditionally approved; and
WHEREAS. the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth; and
WHEREAS, the proposed land use, if conditionally approved, is
appropriate for the subject property in terms of being compatible to existing
land uses in the area and will not overburden public services;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
finds:
(a) The establishment of a commercial recreational facility (Gold's Gym -
Exercise Studio) serves the public need by providing, in part, for the
general physical health of members of the community.
(b) The uses will be properly related to other land uses, and transportation
and service facilities in the vicinity, as the proposed uses will be
compatible to said land uses, and transportation and service facilities
in the immediate vicinity.
(c) The uses will not materially adversely affect the health or safety of
persons residing or working in the vicinity, or be materially detrimental
to the public welfare or injurious to property or improvements in the
neighborhood, as all applicable regulations will be met and as the use is
operated within existing facilities that operates without detriment.
(d) The uses will not be contrary to the specific intent clauses or
performance standards established for the district in which they are to
be located as it is in conjunction with and is a valid conditional use in
the District.

(e) The project is consistent with the policies contained in the City's
General Plan.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve Conditional Use Permit application PA 87-042 as shown by
materials from the Planning Commission Staff Report dated April 6, 1987,
labeled Exhibit C and Background Attachments 2 and 3, on file with the Dublin
Planning Department, subject to the following conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the establishment of the proposed land use activity or the issuance of
building permits for tenant improvements related to that activity, and shall be
sub;ect to Planning Department review and approval.
1, Development and operation of the Gold's Gym - Exercise Studio shall be
substantially as shown on the Revised Floor Plan dated received by the
Dublin Planning Department on March 28, 1987, and as described by the
Applicant's Written Statement, dated received on March 16, 1987. Building
permits for the proposed tenant improvements shall be secured and
construction commenced within six months after approval of this
application or said approval shall be void.
2. Prior to the issuance of building permits for tenant improvements for the
subject use, detailed floor plans of the tenant space shall be prepared by
the Applicant and submitted for review and approval by the Planning
Director. The plans shall detail any space where retail sales auxillary
to the exercise studio operation are proposed to occur. The extent and
nature of retail sales shall be subject to review and approval by the
Planning Director prior to their its operation commencing.
3. Signage for this exercise studio facility shall be consistent with the
sign program depicted by House and House as approved through the PD,
Planned Development Rezoning covering this property (PA 85-032).
Temporary signs used for special events or enrollment drives shall be
subject to the process outlined in Sections 8-87.66 and 8-87.67 of the
Ordinance (Signs requiring Administrative Conditional Use Permit or
Conditional Use Permit approvals).
4. All activities associated with the exercise facilities shall be operated
and controlled so as not to create a nuisance to the adjoining existing
and future tenants in the Sierra Trinity Business Park.
5. Prior to the establishment of the proposed land use activity in the
subject tenant space, the Applicant shall submit verification that the
requirements of the DSRSD Fire Department have been satisfied.
6. Development shall comply with the City of Dublin Police Services Standard
Commercial Building Security Requirements.
7. Except as may be specifically altered by this approval, development shall
comply with the Conditions of Approval established for the Site
Development Review permit covering the Business Park (PA 84-058) and the
Findings and General Provisions established for the Sierra Trinity
Business Park PD, Planned Development District (PA 85-032).
8, The uses established under this Conditional Use Permit shall be subject to
review after the one-year anniversary of initial occupancy to determine
compliance with the above conditions or to determine what additional
requirements may be needed to assure that the Findings of Approval out-
lined above in this document, and for the Findings and General Provisions
established for the subject PD, Planned Development District will continue
to be met. The Planning Director may refer the matter back to the
Planning Commission for disposition.
9. This approval is valid until April 16, 1990, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.

Dear Kevin:
As you know, Gold's Gym is interested in opening a new facility in Sierra
Trinity Park at the above referenced address. We hope to proceed with a
lease agreement upon receiving Planning Department approval. We request that
this be handled by the Planning Department in light of the fact that it is a
use which is "typically associated with business park/industrial uses".
Further, it is consistent with permitted uses under the M-l zoning which
governs all of the properties surrounding Sierra Trinity Park.
The facility which is proposed for Sierra Trinity park consists of 7,165 SF
located in Building 8 (see enclosed site plan). We have chosen this location
next to the deli so that we have our "services" in the front of the park
where they are separated from other uses and where they can help support each
other. Gold's has found that this type of setting is ideal for their
operations because they draw their clients from the surrounding tenants, as
well as the rest of the community. They operate particularly well within
light industrial parks and office parks because of its hours of operation,
The bulk of the people who use the facilities come between the hours of 6
a.m. and 8 a.m. and between the hours of 5 p.m. and 9 p.m. in the evening,
Lunch draws a few local members. During the course of normal daytime
business hours, these facilities are used minimally. (Average of 10
clients) .
The success of Gold's Gym has been due primarily to the fact that it offers a
valuable service to members of the general public. This service is health.
These gyms are typified by an assortment of free weights, Nautilus machines,
and aerobic bicycle machines. Instruction is offered in all these
facilities. Each facility has a shower, locker room and sauna for its members
as well. Typical gold's facilities are represented in the enclosed
photographs. A floor plan of the proposed layout for Sierra Trinity Park is
also included.

Gold's Gym has been systematically locating itself in areas throughout the
United States where area demographics are appropriate. Appropriate
demographics include; population within a five mile radius of approximately
200,000 people, proximity to regional freeway systems, and proximity to
relatively busy area of commerce. Dublin is a perfect location, based on
these requirements. Golds will expect to draw from people living as far
north as San Ramon and as far south and east as Pleasanton and Livermore. It
expects to provide a service to the community that is not being filled
presently. Gold's does not compete with racquetball, aerobics, or other
offered health and recreational activities within the Pleasanton, Dublin
areas. Many of Gold's members are disillusioned members from other clubs.
In fact, proximity to these other differing types of clubs generally is a
benefit to a Gold's.
For the following reasons, we are convinced that Gold's Gym will be a good
tenant for Sierra Trinity Park and for Dublin:
1. As well as providing an amenity for the park, Gold's Gym will make
our general area more attractive for the light industrial users who
are considering locating in Dublin.
2. The majority of existing tenants at Sierra Trinity Park have
expressed a desire for such a facility, so it will be directly
serving the needs of the park.
3. A 3.8 per 1000 parking allotment will allow 27 parking spaces
between 8 a.m. and 5 p.m. This is more than enough during those
hours. Gold's main business is done during hours before and after
these hours.
4. Gold's is seeking an image that is compatible with that of Sierra
Trinity Park. We have already discussed signage, and they will
adapt their signage to conform to that which is allowed by the
City.
5. Proximity next to a Pot Belly Deli will add a second complementary
feature to an area of Dublin which is otherwise devoid of these
services.

Gold's preferred site is Dublin, due to the demographics and location.,
Sierra Trinity Park is the only facility within Dublin which fits their
requirements. If they are unable to locate in Dublin, they have another
option available to them at Valley Business Park in Pleasanton. But, because
of the benefit to the general area as well as to Sierra Trinity Park, we hope
you will work with us to keep them in Dublin.

The State CEQA (California Environmental Quality Act) Guidelines
require the City to take an active role in preparing environ-
mental documents. This comprehensive Environmental Assessment

Conditional Use Permit):
1. Exit doors shall not be provided with a latch or lock unless
it is panic hardware.
2. Fire extinguishers shall be located every 75' of travel distance
and shall be of a 2A-IOBC type.
3. All exits shall be identified.
4. Exit signs shall be lighted and maintained at all times.
5. A maximum occupancy load sign shall be posted in every room
used for assembly or similar purpose.
6. A permit is required from this department for the operation of
this type of occupancy.

OF THE CITY OF DUBLIN

APPROVING AND ESTABLISHING FINDINGS AND GENERAL PROVISIONS FOR
A PLANNED DEVELOPMENT REZONING CONCERNING '
PA 85-032 BEDFORD PROPERTIES PLANNED
DEVELOPMENT REZONING
WHEREAS, Greg Erickson, representing Bedford
Properties, filed an application for a PD Rezoning to allow
industrial business park uses and a sign program at the northeast
corner of Sierra Court and Sierra Lane (APN 94l-205-l-46)
WHEREAS, the Planning Commission did hold a public
hearing on 5/20/85, 6/3/85 and 6/17/85; and
WHEREAS, the Planning Commission on 6/17/85
recommended the PO be approved; and
WHEREAS, the City Council did hold a public hearing on
said application on 7/22/85; and
WHEREAS, proper notice of said public hearings was
given in all respect as required by law; and
WHEREAS, a Staff report was submitted recommending
that the application be conditionally approved; and
WHEREAS, the City Council did hear and consider all
said reports, recommendations and testimony herein above
setforth; and
WHEREAS, the City Council finds the rezoning is
consistent with the General Plan.
WHEREAS, the City Council finds that the rezoning will
not have a significant environmental impact; and
WHEREAS, the rezoning is appropriate for the subject
property in terms of being compatible to eXisting land uses and
it will not overburden public services; and
WHEREAS, the rezoning will. not have a substantial
adverse affect on health or safety or be substantially
detrimental to the public welfare or be injurious to property or
public improvement;
NOW THEREFORE, be it resolved that the City Council
does hereby approve the Planned Development Rezoning request
subject to the following conditions and general provisions:
1. All uses shall be consistent with the intent of the Business
Park Industrial area as specified in the adopted General Plan for
the City of Dublin:
Business Park/Industrial. Uses are non-retail
businesses (research, limited manufacturing and
distribution activities, and administrative offices)
that do not involve heavy trucking or generate
nuisances due to emissions, noise, or open uses.
Residential uses are not permitted. Maximum attainable
ratios of floor area to site area (FAR) are controlled
by parking and landscaping requirements and typically
result in .35 to .40 FAR's. Examples: Clark Avenue;
Sierra Court.
2. All uses shall be consistent with the intent of the M-l
zoning Ordinance as specified in Section 8-51.0:

8-51.0 LIGHT INDUSTRIAL DISTRICTS: INTENT. Light
Industrial Districts, hereiriafter designated as M-l
Districts, are established to provide for and encourage
the development of light industrial, manufacturing and
processing uses in areas suitable for such uses, and to
promote a desirable and attractive working environment
with a minimum of detriment to surrounding properties.
3. All uses shall be consistent with the M-l Performance
Standards as specified in Section 8-50.0 of the Dublin Zoning
Ordinance and every other M-l zoning regulation unless said
regulation is specifically superseded by a provision of this
Planned Development Rezoning.
4. All uses shall be consistent with the Final Action Letter
for PA 84-058, Bedford Properties Site Development Review on file
with the Dublin Planning Department.
5. All uses shall be permitted only if they meet the intent of
the PD Rezoning.
6. The following uses shall be considered permitted uses:
a} Manufacturing, research assembly. Testing and
repair of components, devices, equipment and system and
parts, such as but not limited to the following
examples: Coils, tubes and semiconductors,
communication devices, data processing equipment and
systems, graphic, art equipment, metering and measuring
devices, optical devices, scientific and mechanical
instruments, testing equipment.
b} Manufacturing and/or assembly of the following or
similar products: Automobile and parts, electrical
appliances, heating and ventilating equipment,
machinery and machine tools, musical instruments,
optical goods, sheet metal products, shoes, sporting
goods, toys, trailers and trucks.
c} Industrial support and service facilities
including, but not limited to: repair and maintenance
of appliances or component parts; tooling; printers;
testing shops; copying; photo engraving; etc.
d} Uses primarily engaged in research activities,
including, but not limited to: research laboratories
and facilities, development laboratories, and
compatible light manufacturing related to the following
examples: bio-chemical, film and photography, medical
and dental, pharmaceutical and x-ray.
e) Warehousing and distribution-type industrial uses
(not including the storage of radioactive material,
fuel, flammable liquids or involving excessive traffic
in trailer-type trucks), including, but not limited to:
paper products, office supply, assembly components,
medical supplies, construction supplies, electronic
parts, etc.
f} Sales at wholesale or sales to the ultimate
consumer of products made on the premises, including,
but not limited to: machine tools, computer components,
robots, trucks, trailers, data processing equipment,
phone systems, communications systems, navigation
control, transmission equipment, control equipment,
systems guidance equipment.
g} Blue printing, photostating, photo engraving,
printing, publishing, book binding.
7. The following uses shall be permitted only after receiving
written zoning approval from the Dublin Planning Department:

a} Administrative, professional, and business offices
associated with an onsite permitted use (actually
located on premises) including, but not limited to:
business service offices, consultants, sales and
service, design profession, research and development,
scientific and analytical, any office used in
conjunction with any allowed general or specific use.
b} 'Cafeteria, cafe, restaurant or similar uses
accessory with or incidental to any of the permitted
uses.
c) Any other uses typically associated with business
park/industrial uses.
8. Any use that could possibly meet the intent of the PD
rezoning, but for which the Zoning Administrator is unable to
make the required findings, may be considered through the
Conditional Use Permit process.

9. The following specific uses shall not be permitted. This
list of prohibited uses' is not a comprehensive listing; other
uses which do not meet the intent of the PD Rezoning are also
prohibited:
a) Noxious or offensive trade, business or activity
shall be carried on, about or upon any lot nor shall
anything be done thereupon which may be or become an
annoyance or nuisance within the property including
without limitation distillation or bones, dumping,
disposal, incineration or reduction of garbage, sewage,
offal, dead animals, or refuse, fat rendering,
stockyard or slaughtering of animals, refinery of
petroleum or its products, or storage of petroleum
(other than for use on the premises).
b) Oil drilling, oil development, operations,
refining, mining operations shall be permitted upon or
in any of the lots nor shall oil wells, tanks, tunnels,
mineral operations, or shafts be permited upon or in
any lots.
f) Office uses normally and exclusively associated
with downtown office districts, including, but not
limited to, financial accounting, medical doctors,
attorneys, dentist and real estate sales/leasing.
10. The sign program depicted by House and House (labelled
Exhibit D on file in the Dublin Planning Department) is
established as the sign program for this development. All signs
shall be subject to review by the City to ensure adequate sight
visibility is maintained and the proper permits are secured.

11. This rezoning shall be subject to the PD District regulations
of the Zoning Ordinance, and, in particular, to Section 8-31.2
which provides for Planning Commission review within two years if
the PD is not implemented.
