Section 8-51.31 1) of the Zoning Ordinance authorizes the Planning
Commission to approve Conditional Use Permits for uses not specifically
permitted in the M-l District, provided the use meets the intent of the
district.

Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need; 2)
whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.

mailed to adjacent property owners, and posted in public
ANALYSIS:
The Applicant is requesting approval of a Conditional Use Permit to
allow automotive servicing and auto sales/rental and storage. The Applicant
proposes to divide the existing 9,480 square foot building into three tenant
spaces. Two of the tenant spaces (totaling 5,082~ square feet of floor area)
will be auto service oriented uses, including van conversion, sun roof
installation, and truck and automobile repair.
The Applicant proposes to occupy the third tenant space (4,398 square
feet of floor area) with a used car annex - display and sales office - for Lew
Doty Cadillac/Saab, Additionally, the Applicant proposes approximately 39
parking spaces on the site to store used cars and new cars as overflow vehicle
storage for the Lew Doty Cadillac/Saab Dealership.
Hours of operation for the proposed uses will be Monday through Sunday,
7:00 a.m. to 7:00 p,m. To accommodate the proposed uses, the following
parking spaces are proposed on site:

Handicapped: 2
Employee: 9
Service: 4
Based upon the proposed uses, 14 on-site parking spaces are required.
The proposed parking is in compliance with the Zoning Ordinance and Conditions
of Approval for PA 86-073 Site Development Review with the exception of the
location of the handicapped parking spaces, which must be located adjacent to
the building as specified in Condition #14 of the Conditions of Approval for
PA 86-073. The City's Zoning Ordinance does not specifically address the use
of compact parking spaces; however, in practice the City has permitted the use
of compact spaces (up to 35% of total spaces) approved on a case by case

basis. The Applicant proposes approximately 33% of the total on-site parking
spaces as compact spaces (20 compact parking spaces); however, the entire
customer parking is proposed as compact parking spaces. Staff recommends the
Applicant increase the size of the customer parking spaces to conform with the
City's standard parking space dimensions.
In conjunction with the used car dealership use, the Applicant has
indicated vehicles will be washedfhosed down (without detergents) outside of
the existing structure. If detergents are utilized, the vehicle washing must
occur within an enclosed building with appropriate drainage including a grease
and sand trap subject to DSRSD approval and fees,
As previously noted, the Zoning Ordinance does not specifically permit
auto dealerships and auto repair and servicing in the M-l District. The
Zoning Ordinance does, however, authorize the Planning Commission to permit
other uses subject to approval of a Conditional Use Permit and upon determina-
tion that the use meets the intent of the district. The Commission has
previously found that auto dealerships and related service uses do meet the
intent of the M-l District.
The proposed auto/vehicle repair and service uses are commensurate with
existing surrounding uses in the M-l District, Additionally, wholesale
businesses are a permitted use in the M-l District and do not require a
Conditional Use Permit.
The used car dealership (annex), is not commensurate with other auto
dealerships approved by the City with respect to the building location and
building appearance. The building which is not directly visible from Scarlett
Court is situated on a flag-shaped parcel set back approximately 260 feet from
the street, and is not designed as an auto display or showroom. An auto
dealership at 5787 Scarlett Court - although not the most ideal location due
to the lack of frontage and street visibility - is not likely to adversely
impact surrounding uses and would potentially meet the intent of the district.
However, the site (previously approved for auto and truck repair, through a
Conditional Use Permit and Site Development Review) is not currently developed
or designed to accommodate retail sales of automobiles or an auto display or
showroom. Modifications to the site improvements and structure would be
necessary to insure compatibility between the auto/truck repair and servicing
uses and the auto display and retail sales use. Staff recommends that the
retail auto sales and display use not be included with this current
application, and that the Applicant apply for a separate Conditional Use
Permit and Site Development Review. Additionally, Staff recommends the
Applicant submit for review and approval a signing and striping plan providing
direction to the public for vehicle access, parking and pedestrian walkways on
site.
The Applicant's proposal has been reviewed by the applicable public
agencies, and Conditions of Approval are included in the draft Resolution.

On May 7. 1987 our conditional use permit for the above subject
property expires. The existing conditional use allows for light
servicing. new vehicle inspections. pre-delivery inspections and for
detailing of our new and used vehicles for the Lew Doty Cadillac
dealership. Under the new conditional use permit we would like to
expand the proposed use to automotive sales, servicing and car
rentals.
There will be no cost to the City of Dublin. The City of Dublin will
benifit from the salee; tax and city tax revenues.

Lew Doty Use Permit
Dear Maureen:
Enclosed find 10 sets of the revised site plan and floor
designating a portion of the space to be used as used car
sales. Lew Doty Cadillac/Saab plans to use a portion of the
site and building as a used car annex from the Lew Doty
Cadillac/Saab dealership. Steve Doty estimates that he will
store 10 to 15 new Cadillacs/Saabs for overflow from the main
dealership and will store 20 to 30 used cars for
wholesale/retail sale. A portion of the space for the used car

sales will be used for an office occupied by two sales people
and the remainder of the space shall be for used car display.

RESOLUTION NO, 87 -
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING PA 87-010 LEW DOTY CADILLAC CONDITIONAL USE PERMIT REQUEST
FOR VEHICLE SALES, STORAGE AND SERVICE IN THE M-l ZONING DISTRICT
AT 5787 SCARLETT COURT
WHEREAS, Steve Doty, representing Lew Doty Cadillac, filed an
application for a Conditional Use Permit to allow auto/truck repair and
servicing, auto sales and outdoor auto storage at 5787 Scarlett Court; and
WHEREAS, the Planning Commission held a public hearing on said
application on April 6, 1987; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the request is categorically exempt in accordance with
the provisions of the California Environmental Quality Act; and
WHEREAS, a Staff Report was submitted recommending the application
be conditionally approved; and
WHEREAS, the Planning Commission heard and considered all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission
does hereby find:
a. The use is required by the public need in that it provides auto sales
and repair to the general public.
b. The use would be properly related to other land uses and transportation
and service facilities in the vicinity, as activities will be
commensurate with existing use of properties in the M-l Zoning District.
c, The use, if permitted under all circumstances and conditions of this
particular case, will not materially affect adversely the health or
safety of persons residing or working in the vicinity or be materially
detrimental to the public welfare or injurious to property or
improvements in the area, as all applicable regulations will be met.
d. The use will not be contrary to the specific intent clause or perform-
ance standards established for the district in which it is to be
located, as auto/truck repair, servicing, storage of used and new cars,
and automobile sales are consistent with the character of the M-l
District,
BE IT FURTHER RESOLVED that the Dublin Planning Commission does
hereby conditionally approve PA 87-010 as generally depicted by materials
labeled Exhibit A on file with the Dublin Planning Department, subject to the
following conditions and Conditions of Approval for PA 86-073 Doty Site
Development Review:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the issuance of building permits or establishment of use, and shall
be sub;ect to Planning Department review and approval.
1. PA 87-010 Lew Doty Cadillac Conditional Use Permit shall be limited to the
following uses:
a. Outdoor storage of used and new automobiles.
b. Wholesale automobile sales. This Conditional Use Permit specifically
does not permit retail sale or display of automobiles.

c. Vehicle repair and servicing, including trucks and automobiles. Prior
to commencment of auto repair and servicing uses, the specific use
shall obtain Planning Department and Building Department approval.
d. Automobile rentals may be permitted subject to review and approval of
the Planning Director,
2. The Applicant shall maintain, designate, and keep available (for the
designated user group) at all times on a continuous basis, six customer
parking spaces, two handicapped parking spaces, nine employee parking
spaces, and four service parking spaces.
3. The Applicant shall increase the size of the customer parking spaces in
conformance with the City's minimum dimensions for standard size parking
spaces.
4. The Applicant shall locate the two handicapped parking spaces adjacent to
the building as specified in Condition #14, PA 86-073 Doty Auto Repair/
Service Site Development Review.
5. This Conditional Use Permit is subject to compliance with Conditions of
Approval for the related Site Development Review permit PA 86-073.
6. All signs are subject to Planning Director review and approval.
7, With the exception of storage of vehicles and minor vehicle preparation
work, no exterior demonstrations, displays, services, or other activities
shall occur outdoors, The washing of vehicles with any type of detergent
or cleaning agent other than water must occur within an enclosed area with
adequate drainage subject to approval by the City Building Department and
DSRSD.
8. The Applicant shall submit a signing and striping plan for vehicle access,
parking and pedestrian walkways on site for review and approval by the
City Engineer and Planning Director,
9. The Applicant shall comply with all applicable DSRSD Fire Department
requirements, including but not limited to:
a. A permit shall be obtained from the DSRSD Fire department for any
structure to be used for the purpose of repairing any motor vehicle.
b. Fire extinguishers shall be placed every 75 feet of travel distance.
Each extinguisher shall be of a 2A-10BC rating.
c. In rooms where flammable or combustible liquids are stored or handled,
there shall be an automatic fire protection sprinkler system.
d. Adequate exit doors are required in the proposed area labeled "Lew
Doty Cadillac Used Car Sales and Display Area".
e. In any area where combustible or flammable liquids are used, handled,
or stored, and in any area where combustible materials are stored or
handled, there shall be posted "NO SMOKING" signs,
f, Approved numbers and addresses shall be placed on the building in such
a position as to be plainly visible and legible from the road fronting
the property.
g. No parking shall be allowed in front of the site fire hydrant; this
area shall be posted and the curb painted red,
h. No parking signs shall be posted along the entrance road to the
building. This is to maintain adequate access to the building.
10. The Applicant shall comply with all applicable Alameda County Health Care
Services Agency regulations related to Hazardous Materials, particularly
those recommendations identified in a letter on file with the Dublin
Planning Department, dated received March 23, 1987, from the Alameda
County Health Care Services Agency,

11, If any work involving the undercoating and sealing of vehicles is
proposed, this work shall be done in an area that would contain spilled or
released material.
12, The proposed retail automobile sales and display is denied without
prejudice through this Conditional Use Permit application. The Applicant
may submit a separate Conditional Use Permit application and associated
Site Development Review for retail auto sales and display use. Said
application shall comply with the City's General Submittal Requirements,
and shall specifically include, but not be limited to, a revised site plan
addressing customer and service vehicular and pedestrian circulation and
compatibility of uses, and revised building elevation plans reflecting a
building design and frontage characteristic of an automobile display or
showroom.
13. This permit shall expire on April 16, 1990, and shall be revocable for
cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.

Site Development Review
FINDINGS OF APPROVAL:
1. All provisions of Section 8-95.0 through 8-95.8, Site Development Review, of the
Zoning Ordinance are complied with.
2. Consistent with Section 8-95.0, this application, as modified by the Conditions of
Approval, will promote orderly, attractive and harmonious development, recognized
environmental limitations on development; stabilize land values and investments; and
promote the general welfare by preventing establishment of uses or erection of
structures having qualities which would not meet the specific intent clauses or
performance standards set forth in the Zoning Ordinance and which are not consistent
with their environmental setting.
3. The approval of the application as conditioned is in the best interests of the
public health, safety and general welfare.
4. General site considerations, including site layout, open space topography,
orientation and the location of buildings, vehicular access, circulation and
parking, setbacks, height, walls, fences, public safety and similar elements have
been designed to provide a desirable environment for the development.
5. General landscape considerations, including the locations, type, size, color,
texture and coverage of plant materials, provisions for irrigation, maintenance and
protection of landscaped areas and similar elements have been considered to insure
visual relief to complement buildings and structures and to provide an attractive
environment for the public.
6. The project will be consistent with the policies in the General Plan.
CONDITIONS OF APPROVAL:
Unless otherwise specified, the following conditions shall be complied with prior to
final inspection and occupancy of the buildings, and shall be sub;ect to the review and
approval of the Dublin Planning Department.
1) Development on the site shall generally conform to the plans prepared by Plummer &
Babbitt Civil Engineering, Inc., labeled Exhibit "A" on file in the Dublin Planning
Department, as modified by the following Conditions of Approval and those require-
ments of affected agencies, specifically the City Engineer and City Building
Official.
2) The Applicant shall comply with all applicable Police Services Standard Commercial
Building Security Requirements (Attachment 1).
3) The Applicant shall comply with all applicable Site Development Review Standard
Conditions (Attachment 2).
4) The Applicant shall complete and submit to the Dublin Planning Department the
Standard Plant Material, Irrigation and Maintenance Agreement (Attachment 3).

5) The Applicant shall submit grading, drainage, and improvement plans with drainage
calculations to the City Engineer for review and approval.
6) The Applicant shall comply with the requirements of Zone 7 of the Alameda County
Flood Control and Water Conservation District in regard to improvement of and
granting of easements for the existing drainage channel across the northwest corner
of this site.
7) The minimum parking lot slope shall be 1% and the maximum slope shall be 5%.
8) Where water drains along a curb, a gutter shall be provided.
9) Landscaping shall not obstruct the sight distance of motorists.
10) New sidewalk shall be extended from the existing sidewalk on the west to the
easterly property line of this site.
11) An encroachment permit shall be obtained from the Public Works Department for work
in the public right-of-way.
12) Prior to any construction work which may affect the Zone 7 water pipeline or
appurtenant structures located along the northeasterly property line, the Applicant
shall conduct a field investigation to determine if any relocations or grade
adjustments are needed. The Applicant shall obtain an encroachment permit from Zone
7 for any work affecting the pipeline or appurtenances.
13) Known water wells without a documented intent of future use are to be destroyed
prior to any demolition or construction activity in accordance with a well
destruction permit obtained from Zone 7 of the Alameda County Flood Control and
Water Conservation District. Other wells encountered prior to or during
construction are to be treated similarly.
14) Handicapped ramps and parking shall be provided as required by State of California
Title 24. Relocate handicapped space to area adjacent to the building.
15) All parking spaces shall be double striped. Handicapped and compact car spaces
shall be appropriately identified on pavement.
16) All mechanical equipment located on the ground shall be screened from view or be
painted out to match the building or adjacent landscaping.
17) Trash enclosures shall have minimum interior dimensions of 8 feet to 10 feet with a
minimum 10-foot wide gate opening. The concrete apron in front of the trash
enclosure shall maintain minimum 10-foot by 12-foot dimensions.
18) Final landscape and irrigation plans shall be subject to Planning Department review
and approval.
19) The Applicant shall correct and resubmit Sheet 1 to indicate current Planning
Application Number PA 86-073 and Sheet 6 (Floor Plans/Elevations) to reflect
proposed floor plan (i.e., removal of mezzanine and office area).

We are in receipt of the application referral for Lew Doty Cadillac, P A
87-010, and submit the following recommendations:
1. That all work done in the undercoating and sealing of
vehicles be done in an area that would contain any spilled
or released material.
2. All hazardous materials be stored as regulated by Title 22,
California Administrative Code.
3. That a business plan be submitted to this office as required
by Chapter 6.95, Health and Safety Code, updating the
changes in their operation.
4. There should be adequate measures installed for the protection
of the workers in accordance with Title 8, California Administra-
tive Code.
