(may be double-faced) and have a maximum height of 12 ft. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically Exempt NOTIFICATION: The Herald, buildings Public Notice of the May 4, 1987, hearing was published in mailed to adjacent property owners, and posted in public ANALYSIS: The two Directional Tract Signs proposed for use will provide directional information to visitors to the l45-unit Gregory Group - Ridgecreek Project, which is in the initial stages of development. The locations proposed appear appropriate and functional for the use desired. -2- RECOMMENDATION: FORMAT: 1) 2) 3) 4) 5) Open public hearing. Hear Staff presentation. Adopt Resolution regarding the Conditional Use Permit ACTION: Staff recommends that the Planning Commission adopt a Resolution, Exhibit "A" which approves the Conditional Use Permit application to allow the use of the two requested Directional Tract Signs. ATTACHMENTS: Exhibit "A" Draft Resolution Background Attachment 1 Zoning Maps Showing both Sign Locations 2 Submittal Information for Signs #A and #B (structural details and sign copy information) 3 City Engineer's Comments of April 28, 1987 -3- RESOLUTION NO. 87- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN - - - - - - - - - - - - - - - - - - - - -- ------ ------- -- - - - - - - - - - - - - - - - - - - - - - -- - ------- -- -- - - - - -- APPROVING PA 87-054 DIAMOND SIGNS, INC./GREGORY GROUP - CONDITIONAL USE PERMIT REQUEST FOR DIRECTIONAL TRACT SIGNS WHEREAS, Paula Fortier, on behalf of Diamond Signs, Inc., filed an application for a Conditional Use Permit to allow use of two Directional Tract Signs for the Gregory Group/Ridgecreek Project (Village VI, a portion of Tract 5511 Villages at Alamo Creek); and WHEREAS, the Planning Commission did hold a public hearing on said application on May 4, 1987; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the request is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby find: a. The use is required by the public need to provide directional information for a new housing development to the general public. b. The use would be properly related to other land uses and transportation and service facilities in the vicinity. c. The use, if permitted under all circumstances and conditions of this particular case will not materially affect adversely the health, safety or persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met. d. The use will not be contrary to the specific intent clause or performance standards establishd for the district in which it is to be located. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby approve said application as shown on Background Attachment #2 of the May 4, 1987, Planning Commission Staff Report, on file with the Dublin Planning Department and subject to the following conditions: 1) The signs shall have a respective maximum single-faced area of 32 sq. ft. (a double-faced sign with a maximum area of 32 sq. ft. on each side may be used at the Applicant's option) and a maximum height of 12'. 2) The Directional Tract Signs shall not obstruct the visibility of motorists, pedestrians and cyclists. The precise location of the signs shall be subject to review and approval by the Planning Department. 3) This approval shall remain in effect until May 14, 1988, or until the last unit in Village VI is sold, whichever occurs first. The applicant shall remove said signs and support upon expiration of this Conditional Use Permit. Said letter-of-credit shall guarantee that these funds will be available and that the instrument of credit will remain effective until May 14, 1988. An alternate instrument of credit may be used subject to review and approval by the City Attorney. 5) Comply with the City Engineer's comments contained within his memorandum dated April 28, 1987, regarding this project. 6) This approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. The proposed signs shall not be placed in public street right-of-ways. 2. The applicant shall submit to the City written permission from the property owners prior to installing the signs. 3. The signs shall observe a "sight distance triangle" setback with minimum 3D-foot legs along the two street frontages from the intersection of the property lines.
