ZONING HISTORY:
August 23, 1969 - The Alameda County Board of Supervisors approved the
852nd Zoning Unit, rezoning both subject properties from an R-S-D-25 to a C-l,
Retail Business District.
April 10, 1971 ' The Alameda County Zoning Administrator approved
Conditional Use Permit C-2267 and Variance V-5325, allowing the construction
of the Dublin Iceland commercial recreational facility.
July 25, 1983 - The Dublin City Council adopted the San Ramon Road
Specific Plan, placing the subject property into Area 3 of the Plan,
June II, 1984 - The Dublin City Council approved the PD, Planned
Development and Site Develpoment Review requests for the 52,100~ square foot
Dublin Town & Country Shopping Center PA 83,042).
On November 28, 1983, and again on June 23, 1986, the Dublin City
Council amended the San Ramon Road Specific Plan as it applied to the Dublin
Town & Country Shopping Center site to adjust the percentages of occupancy in
the Center by Financial, Office and Personal Service Uses,
APPLICABLE REGULATIONS:
A, Zoning Ordinance
Section 8-48,2 of the Zoning Ordinance establishes, in part, storage lot
uses as conditional uses in the C-I, Retail Business District,
Section 8-94,0 states that conditional uses must be analyzed to deter-
mine: I) whether or not the use is required by the public need; 2) whether or
not the use will be properly related to other land uses, transportation and
service facilities in the vicinity; 3) whether or not the use will materially
affect the health or safety of persons residing or working in the vicinity;
and 4) whether or not the use will be contrary to the specific intent clauses
or peformance standards established for the district in which it is located,
Section 8-94,4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the accept-
ance and observance of specified conditions, including but not limited to the
following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government,

B, San Ramon Road Specific Plan
The subject property is located within Area 3 of the Specific Plan,
Development in Area 3 is envisioned to generally be for Retail Shopper Uses,
Previous Specific Plan Amendments covering the Dublin Town & Country Shopping
Center have expanded the range of allowable uses to include Office, Financial
and Personal Service Uses in addition to Retail Shopper Uses, The Specific
Plan (Appendix A) defines "Personal Service" Uses as uses providing services
of a personal convenience nature or related primarily to individual needs,
The Specific Plan includes General Development Criteria to guide project
development within the Plan,
The General Development Criteria establishes that parking facilities
required for any parcel may be used jointly with parking facilities for other
uses or parcels when operations are not normally conducted during the same
hours, or when hours of peak use vary. The use of shared parking is subject
to approval of the Director of Planning, and must meet specific conditions
outlined within the Specific Plan, including: I) requires demonstration that
no conflicts in peak hours of demand exist, 2) establishes restriction on the
maximum parking credit allowable, 3) requires parking to be within 250' from
the structure served, and 4) requires execution of written agreement
formalizing the parking arrangement,
ENVIRONMENTAL REVIEW: The City proposes to adopt a Negative Declaration of
Environmental Significance which finds the proposed project will not
have a significant impact on the environment,

mailed to adjacent property owners, and posted in public
ANALYSIS:
The Applicant is requesting approval of a Conditional Use Permit request
to allow the establishment of a car rental facility operating out of a 1,IOO~
square foot tenant rental space in the Dublin Town & Country Shopping Center
and a portion (the northernmost 15 spaces) of the parking area in the
adjoining Dublin Iceland Ice Rink parking lot,
The Applicant has indicated that a maximum of four employees would be
involved with the car rental operation with a maximum of 15 rental cars at the
site at anyone time,
A review of the two subject properties revealed that, while considered
desirable by Staff, a vehicular interconnection between the two sites would
not appear feasible to establish because of a 3'~ grade change present between
the two, A ramped pedestrian/customer interconnection should be established
between the two sites and should be supplied with pedestrian site lighting for
safety considerations.
The installation of wheel stops and landscape border boards should be
required at the end of the 15 parking spaces proposed for use by the car
rental facility. Landscaping at the northeasternmost on-site landscape
"finger" within the Dublin Iceland parking lot should be supplemented by the
planting of additional shrubs, Landscaping between San Ramon Road and the
bike path will be installed in conjunction with the San Ramon Road Widening
Assessment District (mounded turf with 15 gallon trees),
To approve the subject application, the Commission will have to make an
affirmative determination that the car rental facility proposed within the
Dublin Town & Country Shopping Center is consistent with the definition of
Personal Service Uses contained within the San Ramon Road Specific Plan,
Additionally, the Commission will have to make the findings outlined in
Section 8-94.0 regarding the car storage upon the Dublin Iceland site, There
is apparently more than adequate parking at the Dublin Iceland facility to
allow 15 spaces to be assigned to the car rental operation.

ADOPTING A NEGATIVE DECLARATION FOR PA 87-070 ENTERPRISE RENT-A-CAR CO,
(APPLICANTS)/DUBLIN ICELAND AND DUBLIN TOWN & COUNTRY SHOPPING CENTER (OWNERS)
CONDITIONAL USE PERMIT APPLICATION TO ESTABLISH A RENTAL CAR FACILITY
WHEREAS, Robert Fitch, on behalf of Enterprise Rent-A-Car Co.,
filed an application for a Conditional Use Permit to establish a rental car
facility utilizing a tenant rental space in the Dublin Town & Country Shopping
Center and a portion of the parking area in the adjoining Dublin Iceland Ice
Rink parking lot; and
WHEREAS, the California Environmental Quality Act (CEQA), together
with the State Guidelines and City environmental regulations, require that
certain projects be reviewed for environmental impact and that environmental
documents be prepared; and
WHEREAS, an Initial Study of Environmental Significance was
conducted finding that the project, as proposed, would not have a significant
effect on the environment; and
WHEREAS, a Negative Declaration of Environmental Significance has
been prepared for this application; and
WHEREAS, public notice of the Negative Declaration of Environmental
Significance was given in all respects as required by State Law; and
WHEREAS, the Planning Commission did review and consider the
Negative Declaration of Environmental Significance at a public hearing on
June 15, 1987;
NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission
finds as follows:
I, That the project PA 87-070 Enterprise Rent-A-Car Co, Conditional
Use Permit will not have a significant effect on the environment.
2, That the Negative Declaration of Environmental Significance has
been prepared and processed in accordance with State and local environmental
laws and guideline regulations,
3, That the Negative Declaration of Environmental Significance is
complete and adequate,
BE IT FURTHER RESOLVED that the Dublin Planning Commission hereby adopts
the Negative Declaration of Environmental Significance for PA 87,070 Enterprise
Rent-A-Car Co, Conditional Use Permit application,

DUBLIN TOWN & COUNTRY SHOPPING CENTER (OWNERS) CONDITIONAL USE PERMIT
APPLICATION TO ESTABLISH A RENTAL CAR FACILITY
WHEREAS, Robert Fitch,on behalf of Enterprise Rent-A-Car Co" filed
an application for a Conditional Use Permit to establish a rental car facility
utilizing a tenant rental space in the Dublin Town & Country Shopping Center
and a portion of the parking area in the adjoining Dublin Iceland Ice Rink
parking lot; and
WHEREAS, this application has been reviewed in accordance with the
prOV1S10ns of the California Environmental Quality Act and a Negative
Declaration has been adopted (Planning Commission Resolution No, 87, ) for
this project as it will not have a significant effect on the environment; and
WHEREAS, notice of Public Hearing of the project was provided as
required by local Ordinance and in accordance with California State Law; and
WHEREAS, a Staff Report was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a public hearing on June 15,
1987, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
a) The use serves a public need in that the use provides a car rental
facility,
b) The use will be properly related to other land uses and transportation
and service facilities in the vicinity in that daytime activities will be
commensurate with present use of properties in the neighborhood,
c) The use, under all circumstances and conditions of this particular case,
will not materially affect adversely the health or safety of persons residing
or working in the vicinity, or be materially detrimental to the public welfare
or injurious to property or improvements in the neighborhood, in that all
applicable regulations will be met,
d) The use will not be contrary to the specific intent clauses or
performance standards established for the District in which it is to be located
in that the rental car business is consistent with the character of the
commercial district.
BE IT FURTHER RESOLVED that the Planning Commission does hereby
conditionally approve PA 87-070 as shown by materials from the June 15, 1987,
Planning Commission Staff Report labeled Exhibit C and Attachments #2 and #3,
on file with the Dublin Planning Department, subject to the following
conditions:
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied with
prior to the initiation of the requested land use activity, and shall be
subiect to Planning Department review and approval,
I. Development and operation of the rental car facility shall generally
conform to the plans submitted with the application prepared by Richard Haro
Drafting & Planning Service, consisting of one sheet and dated received by the
City of Dublin Planning Department May 8, 1987, and as further described in the
Applicant's Written Statement, also dated received May 8, 1987,

2, The rental car lot shall be limited to a maximum of fifteen (15) rental
cars on site at anyone time,
3, Hours of operation for the car rental lot shall be limited to the hours
between 6:30 a.m. and 6:30 p,m" or as otherwise approved by the Planning
Director.
4, On site maintenance of rental vehicles shall be prohibited, including
cleaning or repair of vehicles,
5, The Applicant shall provide the Planning Director with a copy of the lease
establishing the car rental facility's right to store up to 15 cars on the
Dublin Iceland parking lot and indicating the length of the agreement,
6, Any new project signing or area lighting shall be subject to review and
approval by the Planning Director prior to installation,
7, With the exception of parking of rental cars in the Dublin Iceland Ice Rink
parking lot, all demonstrations, displays, services, and other activities
associated with the rental car facility shall be conducted entirely within an
enclosed structure, No loudspeakers or amplified music shall be permitted
outside the structure(s).
8, The Applicant shall be responsible for correction of deficiencies on the
existing frontage improvements to the satisfaction of the City Engineer,
9, Overhead security lighting shall be maintained during all hours of darkness
to light the area utilized for overnight parking of rental cars,
IQ, Handicap parking spaces within the Dublin Iceland Ice Rink parking lot
(three spaces minimum) shall be provided and shall conform to requirements for
Handicapped Accessibility outlined in the State Building Code,
II. This permit shall expire June 25, 1989, and shall be revocable for cause
in accordance with Section 8-90,3 of the Dublin Zoning Ordinance, The approval
period for the Conditional Use Permit may be extended three additional years
(Applicant must submit a written request for the extension prior to the
expiration date of the Conditional Use Permit) by the Planning Director upon
his determination that the Conditions of Approval remain adequate to assure the
above stated Findings of Approval will continue to be met, This permit shall
be invalidated if a redevelopment proposal for the ice rink facility is
authorized and pursued to the construction stage,
12, The Applicant shall work with the Dublin Iceland Ice Rink Property Owner
to provide for the installation of appropriate on-site signage to designate the
subject property as a "Private Property - Customer Parking Only" site, Signs
shall be subject to review and approval by the Police Services Department prior
to installation,
13, The Applicant shall install wheel stops and landscape border boards
(2" x 8" planking) at the end of the 15 parking spaces on the Dublin Iceland
site proposed for use by the car rental facility,
14. The Applicant shall supplement the existing landcaping within the north-
easternmost on-site landscape "finger" with a minimum of 10 five-gallon sized
fast-growing shrubs,
15, A ramped pedestrian/customer connection (meeting Building Code criteria)
shall be supplied between the two sites, The design and location of this ramp
shall be subject to review and approval by the Planning Department prior to
installation, The ramp width and remaining walkway connection between the
parking area on the Dublin Iceland site and the tenant lease space at Dublin
Town & Country shall be a minimum width of 4', Pedestrian lighting acceptable
to the Planning Department shall be supplied for this pedestrian/customer
interconnection. The existing wooden stairway shall either be removed or
upgraded with handrails and pedestrian lighting,
16, Development shall comply with the requirements of the DSRSD - Fire
Department.

17. Except as specifically altered by the above Conditions of Approval,
development and use of the Dublin Iceland Ice Rink shall comply with the
Conditions of Approval established for C-2267 and V-5325, and development and
use of the Dublin Town & Country Shopping Center shall comply with the
Conditions of Approval established for PA 83-042,
PASSED, APPROVED AND ADOPTED this 15th day of June, 1987.

We propose to relocate our existing auto rental business
from 6000 Dougherty Poad, to 7224 Pan Pamon Poao We will
keep an average of 15 cars on the parking lot of the
adjacent Iceland Skating Rink, located at 7212 San Ramon
Road. The intent is to keep as few cars on site as possible,
since we want to rent as many cars as possible.
Fxisting buildings will not be changed. We wish to continue
to meet the needs of the community for car rental.
The estimated hours of operation will remain the same as
approved for the Dougherty Road site. On this site, the
. cars will be parked and stored next door.
An employee will go and get a car when the customer arrives
to pick up his car, or is droped off at our office. The
parking needs of our employees are less than what would be
required for a retail business in this location.
