APPLICABLE REGULATIONS:
Section 8-48.9 states that all principal uses in a C-l District shall be
conducted within a building. Outside uses can only be considered with a
Conditional Use Permit.

Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the publc need;
2) whether or not the use will be properly related to other land uses,
transportation and service facilities in the vicinity; 3) whether or not the
use will materially affect the health or safety of persons residing or working
in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94,4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW:
This project has been found to be Categorically
Exempt from CEQA under Section 15301, Class 1, of
the California Environmental Quality Act
Guidelines.
NOTIFICATION: Public Notice of the August 17, 1987, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings.
ANALYSIS:
On July 16, 1984, the Planning Commission approved a request from Bagel
King, Inc., for a Conditional Use Permit to allow four tables and eight chairs
for outside eating directly in front of their tenant space (plese see Exhibit
B). This approval was valid until July 16, 1987. If Bagel King., Inc. would
like to continue outside seating for patrons, a new Conditional Use Permit
application was to be submitted to the City for consideration by the Planning
Commission,
On July 16, 1987, the Applicant submitted a Conditional Use Permit
application to the City requesting that he be allowed to continue having four
tables and eight chairs for outside eating directly in front of his tenant
space.
The location and operation of the Bagel King outlet has not changed from
the Applicant's previously approved Conditional Use Permit. The tables and
chairs will be located against the building so as not to interfere with
pedestrian traffic on the sidewalk. The tables and chairs are placed in front
of the Applicant tenant space at 6:15 a.m, and taken in at 5:45 p.m., Mondays
through Fridays. On Saturdays they are outside from 8:00 a.m. to 5:45 porn"
and on Sundays from 8:00 a.m. to 3:00 p.m.
Staff notes that the Applicant has occasionally used illegal A-frame,
sandwich board signs to advertise their business.
The City has no record of any other zoning violations associated with
this use. The application has been reviewed by the applicable public agencies
and City departments, and is in compliance with the City's Zoning Ordinance,
There have not been any complaints filed with the City by other tenants
in the shopping center. On the contrary, a petition has been signed by many
of the shopping center tenants in support of the application.

The use is consistent with the intent of the policies set forth in the
Dublin Downtown Specific Plan.
Conditions of Approval similar to those imposed in the original
Conditional Use Permit have been included in the draft Resolution of Approval,
including filing a new Conditional Use Permit application three years from the
date of approval.

APPROVING PA 87-102 BAGEL KING'S REQUEST FOR A CONDITIONAL USE PERMIT
TO ALLOW THE CONTINUANCE OF AN OUTSIDE EATING AREA IN FRONT OF THEIR STORE AT
7168 REGIONAL STREET, DUBLIN, CALIFORNIA
WHEREAS, the Applicant, Nathan Litvin, Owner of Bagel King, filed a
Conditional Use Permit application to allow the continued operation of an
outside eating area in front of the Bagel King Shop (4 tables, 8 chairs),
7168 Regional Street; and
WHEREAS, this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act, and has been found to
be categorically exempt; and
WHEREAS, notice of public hearing was published in The Herald, posted
in public buildings, and mailed to property owners within 300 feet of the
project in accordance California State Law; and
WHEREAS, a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a public hearing on August 17,
1987, to consider all reports, recommendations, and testimony;
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find:
a) The use is required by the public need in that there are no outside eating
areas in the immediate vicinity.
b) The use will be properly related to other land uses and transportation and
service facilities in the vicinity as daytime activities will be commensurate
with the present use of properties in the neighborhood.
c) The use, if permitted, under all circumstances and conditions of this
particular case. will not materially affect adversely the health or safety of
persons residing or working in the vicinity, or be materially detrimental to
the public welfare or injurious to property or improvements in the neighbor-
hood, as all applicable regulations will be met.
d) The use will not be contrary to the specific intent clauses or performance
standards established for the District in which it is to be located, as an
outside eating area is consistent with the character of the Commercial
District.
BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby
conditionally approve PA 87-102 as shown by materials labeled "Exhibit A" in
the Planning Commission Staff Report dated August 17, 1987, on file with the
Dublin Planning Department and subject to the following conditions:
1. This approval is for the continued use of outside patron seating for Bagel
King. There shall be no more than four tables and eight chairs located on
the site at anyone time. Individual tables shall be used and, along with
the chairs and trash receptacle, shall be limited to within two feet of
the store front. The tables and chairs shall be placed directly next to
the building in front of this tenant space.
2. The tables and chairs shall be removed from the sidewalk prior to the
close of each business day.
3. The tables and chairs shall be arranged so as not to block access to the
store or impede normal pedestrian traffic on the sidewalk.

4. A trash receptacle shall be located in front of the store; the location
and design of the receptacle shall be located where originally approved by
the Planning Department.
5. The sidewalk and parking area shall be kept clean of all debris resulting
from the outside eating area.
6, The Applicant shall comply with the Dublin Sign Ordinance, including but
not limited to the prohibition of the use of sandwich board type and A-
frame signs,
7. This approval shall remain in effect until August 17, 1990, and shall be
revocable for cause in accordance with Section 8-94.7 of the Dublin Zoning
Ordinance.

The applicant is now requesting a Conditiona~ Use Permit to
allow four tables and eight chairs to be located in front of '
. the Bagel King Shop for outside eating activities. The
applicant has submitted a petition signed by several '
tennants in the Orchard Center which supports his request.
In addition, another petition in support of the request
signed by approximately 450 Valley residents is on file in
the Planning Department.
The principal"issue here is whether there is adequate room
on the sidewalk for the tables and chairs and normal
pedestrian traffic. The distance between the shop buildings
and the curb face is 13 feet. However, the distance between
the shop building and the support posts where the typical
pedestrian traffic occurs is only 7 feet, 7 inches. ~he
other portion of the sidewalk is utilized for planters and
overhangs for automobiles. It becomes very difficult to
walk between the cars and the support posts; therefore,
most, if not all, pedestrian traffic is concentrated between
the shop building and support posts. "The applicant has
indicated that the tables are approximately 2 feet wide.
This will leave 5 feet, 7 inches between the tables and
support posts. staff would prefer to have approximately 6-7
feet between the shop building and support posts.
Nonetheless, there should be enough room for the tables and
chairs and normal pedestrian traffic. The applicant should
take every precaution possible to ensure that the tables and
chairs do not impede the normal pedestrian flow along the
sidewalk and that the sidewalk and parking area is kept
clean of all debris.
RECOMMENDATION
FORMAT:
1) Open public hearing and hear staff presentation.
2) Take testimony from applicant and the public.
3) Question staff, applicant and the public.
4) Close public hearing and deliberate.'
5) Adopt resolution regarding the Conditional Use
Permit. '
