'01el, COPIES TO: Applicant Owner File PA 106 September 11, 1984: PA 84-025.1, the Planning Director approved a Site Development Review request for 13.33' x 20' addition to the existing shopping center for car stereo installation at 7395 Village Parkway. APPLICABLE REGULATIONS: Section 8 - 48.2 states that drive-in businesses (which this stereo installation facility is) in a C-l District requires a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: This project has been found to be Categorically Exempt from CEQA under Section 15301, Class 1, of the California Environmental Quality Act Guidelines. NOTIFICATION: Public Notice of the October 5, 1987, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: On July 16, 1984, the Planning Commission approved a request from United Car Stereo for a Conditional Use Permit to allow car stereo installation at the location of this business in the Village Square Shopping Center. At the time of this approval, the car installation activities were being carried out in an illegally constructed enclosure which had not received Building Department or Planning Department approval. As a Condition of Approval of the Use Permit, the Applicant was required to remove the illegal structure. The Applicant complied with the condition by consequently removing the illegal structure from the site. On the following day after this approval, the owner of this business submitted an application for Site Development Review to the City for consideration of a 266 square foot addition to this shopping center, attached to the building, in the area directly behind the car stereo installation business's tenant occupancy. The new addition was to be used for the installation of car stereos. On September 11, 1984, the Planning Director approved the Site Development Review application. The addition to the building was consequently constructed and car stereo installation has been carried out from within this enclosure ever since. -2- One other Condition of Approval of the 1984 Use Permit was that the approval was valid until July 16, 1987. On July 24, 1987, the owner of this business submitted a Conditional Use Permit application to the City requesting that he be allowed to continue the car stereo installation activities on this site as a part of his business operations. The location and operation of the car stereo installation will continue to occur from within the 266 square foot installation bay located at the rear of this tenant's occupancy. It can only accommodate one automobile at a time. The retail sales operation will continue to operate in compliance with the standards of the Zoning Ordinance in that it is a commercial use within the C-l, Retail Business District. Staff notes that three visits to the site indicate that this business is run in a relatively clean fashion. In addition, Staff has not noticed lines of cars waiting for stereo installation in the area behind the building. The City has no record of any other zoning violations associated with this use, There have not been any complaints filed with the City by other tenants in the Shopping Center. The Application has been reviewed by the applicable public agencies and City departments, and is in compliance with the City's Zoning Ordinance. Staff recommends that this Conditional Use Permit be approved. This approval would be valid until October 5, 1992. RECOMMENDATION: FORMAT: 1) 2) 4) 5) Open public hearing and hear Staff presentation. Question Staff, Applicant and the public. Close public hearing and deliberate. Adopt Resolution approving PA 87-106, or give Staff and/or this Applicant direction and continue the item to the next regularly scheduled Planning Commission meeting. Staff recommends the Planning Commission adopt a Resolution approving the Conditional Use Permit for United Car Stereo, PA 87-106. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find: a) The use is required by the public need in that there are no car stereo installation businesses in the immediate vicinity. b) The use will be properly related to other land uses and transportation and service facilities in the vicinity as daytime activities will be commensurate with the present use of properties in the neighborhood. c) The use, if permitted, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. d) The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as a stereo installation facility is consistent with the character of the Commercial District. ENVIRONMENTAL REVIEW: Categorically exempt NOTIFICATION: Public published in the property owners, Notice of the July 16, 1984, hearing was Tri-Valley Herald, mailed to adjacent and posted in public buildings ANALYSIS: On February 15, 1984 the Building Inspector noticed an illegally constructed building addition behind United Car Stereo at 7395 Village Parkway. The addition had been constructed without any permits and did not meet the Building Code requirements. On February 23, 1984 the store owner, Mike Forney, was notified in writing that the structure should be removed within 10 days. Since the structure was not removed, an office hearing was held with the building official, applicant, applicant's attorney and planning staff on April 4, 1984. Staff informed the applicant that the installation of car stereos in a C-l, Retail Business District requires a Conditional Use Permit. It was also noted that if the Conditional Use Permit was approved, a Site Development Review would be required. Staff notified the applicant that the building addition would have to be enclosed and designed to be compatible with the existing shopping center. It was determined that to remodel the existing addition to conform with the Building Code would be tantamount to demolishing the structure and starting from the beginning. Staff does not have a problem with recommending approval of a Conditional Use Permit to allow the installation of car stereos adjacent to United Car Stereo. Staff cannot, however, support the applicant's request to install an overhang behind the building. Since the addition must be brought up to Building Code standards, the addition should be designed to be compatible with the existing shopping center. With the large number of shopping centers within the City, it is not appropriate to allow overhangs for business uses in the rear of shopping centers. If this type of structure is allowed, the potential would exist for a wide variety of marginal, unattractive structures to be constructed in the rear of shopping centers. This type of situation is not desirable and is contrary to the efforts taken by the City to upgrade the appearance of the commercial areas. In conclusion, it should be noted that the addition is required to be brought up to minimum standards by the Building Code. If the Planning Commission approves the Conditional Use Permit, the installation of car stereos cannot take place in the addition until it is brought into compliance with the Building Code. At the Planning Commission Meeting, slides will be shown of ". the building addition.
