Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, including but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categoricaly exempt, Class 1 NOTIFICATION: Public Notice of the October 5, 1987, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The Applicant is requesting approval of a Conditional Use Permit to continue operating an automobile sales/display lot and car rental facility. The Applicant indicates the car rental facility will consist of the storage of 15 cars and five customer parking spaces while the auto sales lot will display approximately 30 to 40 vehicles on site and provide five customer parking spaces. The Applicant indicates that serv~c~ng of vehicle does not and will not occur on site, in that Budget's rental cars are serviced in their Oakland or San Francisco facilities and new sales cars for the Crown-Isuzu dealership are delivered and serviced at the Crown-Chevrolet facility at 7544 Dublin Boulevard. The site consists of an existing 2600 square foot building, 25 designated parking spaces for Budget Rental car and customer parking, and a 25 foot wide clear drive aisle connecting the Dougherty driveway entrance/exit with the Scarlett Court driveway entrance/exit. There is no new construction or expansion of use proposed beyond that which is currently existing. However, the automobile rental facility was not specifically identified as a permitted use under the previously approved Conditional Use Permit for the site (C-3266). The auto sale/display and auto rental use is consistent with the Dublin General Plan land use designation for the site allowing retail sales and storage activities conducted outdoors. This Conditional Use Permit has been reviewed by the applicable public agencies and city departments and Conditions of Approval are included within the Draft Resolution. -2- RECOMMENDATION: FORMAT: 1) 2) 3) 4) 5) Open public hearing and hear Staff presentation. CROWN CHEV~O~ -'~~ ~~ PATRICK COSTELLO GENERAL MANAGER ~ '87 - 1 04 THE CROWN OF EXCELLENCE "".~, A " f~ S..,-...io.:t" ~-~",~ -~o~~ " ;.r. : ~ ~ .;,~ ,", RESOLUTION NO. 87- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ------------------------------------------------------------------------------ APPROVING PA 87-104 CROWN-ISUZU CONDITIONAL USE PERMIT TO CONTINUE OPERATION OF AN AUTO SALES/DISPLAY LOT AND CAR RENTAL FACILITY AT 5933 DOUGHERTY ROAD WHEREAS, the Applicant, Patrick Costello representing Crown-Isuzu, filed an application for a Conditional Use Permit to continue operation of an auto sales/display lot and auto rental facility at 5933 Dougherty Road; and WHEREAS, the City of Dublin Zoning Ordinance provides in part for the establishment of an automobile, camper, boat and trailer sales, storage and rental lot as a Conditional Use; and WHEREAS, the Planning Commission held a public hearing on said application on October 5, 1987; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the prov~s~ons of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the City is currently studying various alternatives for the alignment of the Dublin Boulevard extension. Although the specific alternative has not been selected, the future Dublin Boulevard extension is likely to affect a portion of the property at 5933 Dougherty Road (APN 941-550-9-15); and WHEREAS, a Staff Report was submitted recommending that the Conditional Use Permit application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: a) The use is required by the publc need in that the use offers the Dublin consumer specific auto sales and auto rental otherwise not available within the City; b) transportation located at the the present use The use will be properly related to other land uses and and service facilities in the vicinity in that the project intersection of two major streets and will be commensurate of surrounding properties within the neighborhood; is with c) The use, under all circumstances and conditions of this particular case, will not materially affect adversely the health or safety of persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood as all applicable regulations will be met; d) The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located, in that the auto dealership and auto rental facility is consistent with the character of the surrounding Commercial and Industrial District. 'Ai"7"/~'-~". ."&" BE IT FURTHER RESOLVED THAT THE Planning Commission does hereby conditionally approve PA 87-104 as generally depicted by materials labeled "Exhibit A" on file with the Dublin Planning Department subject to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with within 30 days from approval and shall be sub;ect to Planning Department Review and approval, 1) PA 87-104 Crown-Isuzu Conditional Use Permit shall supercede all previous Conditional Use Permit approvals for the site at 5933 Dougherty Road. 2) The following uses shall be permitted: a) Automobile sales and display facility and lot; b) Automobile rental lot facility. 3) The servicing of vehicles on site is not permitted. 4) The Applicant shall maintain, designate and keep available (for the designated user group) at all times on a continuous basis a m1n1umum of 10 customer parking spaces and 15 rental car storage parking spaces. 5) Designated parking spaces shall be double-striped in compliance with City of Dublin standards. 6) The Applicant shall maintain at all times a minimum 25 ft. wide clear and unobstructed drive aisle on-site connecting the Dougherty Road entrance/exit with the Scarlett Court entrance/exit. 7) The Applicant shall comply with all DSRSD Fire Department requirements, including: a) Provide and maintain at all times within the facility in operable condition a 2A-10BC fire extinguisher. b) Displays shall not hinder access into or around the building or lot, 8) The Applicant shall trim to the back of the sidewalk the ice plant growing over the sidewalk along Dougherty Road and Scarlett Court in front of the site. 9) The Applicant shall trim landscaping away from the catch basin located on the property line along Dougherty Road. 10) This permit shall expire on October 16, 1992, and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance.
