APPLICABLE REGULATIONS:
Section 8-49.2(b) states that animal hospitals and kennels in a C-2
District requires a Conditional Use Permit.
Section 8-94.0 states that conditional uses must be analyzed to
determine: 1) whether or not the use is required by the public need;
2) transportation and service facilities in the vicinity; 3) whether or not
the use will materially affect the health or safety of persons residing or
working in the vicinity; and 4) whether or not the use will be contrary to the
specific intent clauses or performance standards established for the district
in which it is located.
Section 8-94.4 states the approval of a Conditional Use Permit may be
valid only for a specified term, and may be made contingent upon the
acceptance and observance of specified conditions, including but not limited
to the following matters:
a) substantial conformity to approved plans and drawings;
b) limitations on time of day for the conduct of specified activities;
c) time period within which the approval shall be exercised and the proposed
use brought into existence, failing which, the approval shall lapse and be
void;
d) guarantees as to compliance with the terms of the approval, including the
posting of bond;
e) compliance with requirements of other departments of the City/County
Government.
ENVIRONMENTAL REVIEW: This project has been found to be Categorically
Exempt from CEQA under Section 15301, Class 1, of the California
Environmental Quality Act Guidelines.
NOTIFICATION: Public Notice of the October 19, 1987, hearing was published
in The Herald, mailed to adjacent property owners, and posted in public
buildings.
ANALYSIS:
On September 12, 1979, the Alameda County Zoning Administrator approved a
Conditional Use Permit (C-3671) to establish the Hackler Veterinary Hospital
at 6612 Dublin Boulevard. This approval was effective until September 12,
1982 (see Exhibit B).
On September 15, 1982, the owner of the veterinary hospital filed an
application for a Conditional Use Permit requesting that he be allowed to
continue the veterinary hospital operation at the same location. On
November 4, 1982, the Planning Director/Zoning Administrator approved the
Conditional Use Permit (PA 82-012), extending the period of operation of the
veterinary hospital to September 12, 1987 (see Exhibit C).
On September 11, 1987 Margaret Roberts, D.M.V., the owner of the
veterinary hospital (which is now called "All Creatures") filed a new
Conditional Use Permit application with the City requesting that she be
allowed to continue the veterinary hospital operation for a period of 10 years
(see Attachment 1).
Attachment 2 provides a complete list of the activities carried out by
the veterinary hospital. Attachment 4 shows the complete floor plan of the
business.

Staff notes that this business is located in the same mall facility as
the City Offices, Numerous trips past both the front and rear of this
business as well as two drop-in visits indicates that it is professionally
operated, clean and virtually free of objectionable noises and odors, The
City has no record of zoning violations associated with the business, There
have not been any complaints filed with the City by other tenants in the
center, The application has been reviewed by the applicable public agencies
and City departments, and is in compliance with the City's Zoning Ordinance,
Staff recommends that this Conditional Use Permit be approved. This
approval would be valid for five (5) years, instead of ten (10) as requested
by the applicant, It would be valid until October 29, 1992. This would be
consistent with City policy typically allowing Conditional Use Permits for
three to five year durations,
RECOMMENDATION:
Format: 1) Open public hearing and hear Staff presentation,
2) Take testimony from Applicant and the public,
3) Question Staff, Applicant and the public.
4) Close public hearing and deliberate,
5) Adopt Resolution approving PA 87-125, or give Staff and/or the
Applicant direction and continue the item to the next regularly
scheduled Planning Commission meeting.
ACTION: Staff recommends the Planning Commission adopt Resolution approving
the Conditional Use Permit for All Creatures Veterinary Hospital,
PA 87-125.

APPROVING PA 87-125, ALL CREATURES VETERINARY HOSPITAL'S REQUEST FOR A
CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF A
VETERINARY HOSPITAL AT 6612 DUBLIN BOULEVARD
WHEREAS. the Applicant Margaret Roberts D,M,V., Owner of All
Creatures Veterinary Hospital filed a Conditional Use Permit Application to
allow the continued operation of a veterinary hospital; and
WHEREAS. this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act, and has been found to
be categorically exempt; and
WHEREAS. notice of public hearing was published in The Herald,
posted in public buildings, and mailed to property owners with 300 feet of
the project in accordance California State Law; and
WHEREAS. a Staff analysis was submitted recommending conditional
approval of the application; and
WHEREAS, the Planning Commission held a public hearing on
October 10, 1987, to consider all reports, recommendations, and testimony,
NOW, THEREFORE. BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find:
a) The use is required by the public need in that there are no
veterinary hospitals in the immediate vicinity.
b) The use will be properly related to other land uses and
transportation and service facilities in the vicinity as daytime activities
will be commensurate with the present use of properties in the neighborhood.
c) The use, if permitted, under all circumstances and conditions of
this particular case, will not materially affect adversely the health or
safety of persons residing or working in the vicinity, or be materially
detrimental to the public welfare or injurious to property or improvements in
the neighborhood, as all applicable regulations will be met,
d) The use will not be contrary to the specific intent clauses or
performance standards established for the District in which it is to be
located, as a veterinary hospital is consistent with the character of the
General Commercial District,
BE IT FURTHER RESOLVED THAT the Planning Commission does hereby
conditionally approve PA 87-125 as shown by materials in the Planning
Commission Staff Report dated October 19, 1987 on file with the Dublin
Planning Department and subject to the following conditions:
1. This approval is for the continued operation of a veterinary clinic on
the site containing an office/commercial center located at 6612 Dublin
Boulevard,
2. The owner of this business shall comply with all applicable regulations
established by Alameda County's Department of Environmental Health at all
times,

ADOPTED AT THE HEARING OF SEPTEMBER 12, 1979, CONCERNING C-3671

WHEREAS J. Lange (Land Owner) and Russell Harkler (Lessee) has
filed an application for a COr-:DlTIONAL USE PERMIT, C-3671, to allow operation
of a veterinary hospital in an "C-2" (General Commercial) District, located at
6612 Dublin Boulevard, south side, 300' west of the intersection with Dougherty
Road, Dublin, Assessor's No. 941-205-5-3; and
WHEREAS it satisfactorily appears from affidavits on file that proper
notice of said public hearing was given in all respects as required by law; and
WHEREAS the Zoning Administrator did hold a public hearing on said
application at the hour of 1:30 p.m. on the 12th day of September, 1979, in the
Alameda County Public Works Building, 399 Elmhurst Street, Hayward, California;
and
WHEREAS this application has been reviewed in accordance with the
provisions of the California Environmental Quality Act and has been found to
be categorically exempt, class 5h; and
WHEREAS a Pre-Hearing Analysis was submitted recommending the
application be approved; and
WHEREAS the applicant appeared at said meeting and presented testimony
in support of the application; and
WHEREAS the Zoning Administrator did hear and consider all said
reports, recommendations and testimony as hereinabove set forth; Now Therefore
BE IT RESOLVED that the Zoning Administrator finds that:
(a) The use is required by the public need as number and distribution
of other animal hospitals in the Dublin area tends to substantiate
a finding of public need.
(b) The use will be properly related to other land uses and transpor-
tation and service facilities in the vicinity as the use is adequately
related to other land uses in the immediate area; parking and
service facilities would be appropriate.
(c) The use, if permitted, under all the circumstances and conditions
of this particular case, would not materially affect adversely
the health or safety of persons residing or working in the vicinity,
or be materially detrimental to the public welfare or injurious
to property or improvements in the neighborhood.
(d) The use is not contrary to the specific intent clauses or performance
standards established for the District in which it is to be located.
BE IT FURTHER RESOLVED that the Zoning Administrator does hereby
conditionally approve said application as shown by materials labelled Exhibit" A"
on file with the Alameda County Planning Department subject to the following
condition:
Three sets of architectural drawings shall be submitted to Alameda
County Health Department prior to final inspection showing
type of ceiling, walls, flooring and plumbing.
Said Conditional Use Permit shall be in effect until September 12, 1982, and during
the term of the Permit shall remain revocable for cause in accordance with Section
8-90.3 of the Alameda County Zoning Ordinance.

THE PURPOSE OF ALL CREATURES VETERINARY HOSPITAL (ACVH) IS TO
PROVIDE THE HIGHEST QUALITY HEALTH CARE FOR SMALL ANIMALS, BIRDS
AND EXOTICS AT AN AFFORDABLE PRICE TO OUR CLIENTS. IT IS ALSO TO
PROVIDE A NURTURING, CARING ENVIRONMENT FOR OUR CLIENTS AND THEIR

6. PROVIDE BOARDING FACILITIES FOR LIMITED NUMBER OF CLIENTS'
ANIMALS. WE DO NOT BOARD PETS FOR THE GENERAL PUBLIC.
OUR BOARDING IS LIMITED TO 1-2 DOGS AND/OR 3-6 CATS AT ANY
ONE TIME. WE DISPOSE OF THEIR EXCREMENT IN GARBAGE BAGS WHICH GO
INTO THE CITY DISPOSAL DUMPSITES. WE HAVE 2 DRAINS IN OUR LARGE
KENNEL AREA WHICH ARE USED TO HANDLE WATER AND DISINFECTANT FROM
DAILY CLEANING. WE ALSO MOP THE FLOORS OF THE RUNS AS NEEDED
DURING THE DAY.

7. WE HAVE A CONTRACT WITH ALLEN AND ALLEN JANITORIAL SERVICE
WHO COME IN 6 TIMES PER WEEK AT NIGHT TO MOP FLOORS, EMPTY GAR-
BAGE AND CLEAN WINDOWS AND SURFACES.
8. WE HAVE EMPLOYEES WHO COME IN BEFORE BUSINESS HOURS (8AM) AND
STAY AFTER HOURS (8PM) TO CARE AND CLEAN AFTER PATIENTS AND
BOARDERS. WE ALSO HAVE AN EMPLOYEE WHO COMES IN TWICE ON SUNDAYS
AND HOLIDAYS TO TREAT AND CLEAN AFTER PATIENTS AND BOARDERS.

NESS HOURS, OFTEN AT NO CHARGE OR MINIMAL CHARGE TO THE COUNTY.
OUR WILDLIFE WORK IS DONE IN COOPERATION AND CONJUNCTION WITH THE
LINDSAY MUSEUM IN WALNUT CREEK AND IS A DONATION TO THEM. OUR
WORK DONE ON STRAYS IS DONE AT MINIMAL COST TO THE COUNTY.
10. DR. ROBERTS IS AVAILABLE FOR LECTURES TO SCHOOL GROUPS,
SCOUT TROOPS, AND CLUBS AND DOES THIS ON A REGULAR BASIS. OUR
HOSPITAL HAS ALSO BEEN TOURED BY NUMEROUS SCOUT AND SCHOOL
GROUPS. WE REGULARLY HAVE STUDENT VOLUNTEERS FROM CAREER LINKS
AND CLIENTS WHO IN COME TO VOLUNTEER.
11. WE PARTICIPATE WITH THE VALLEY HUMANE SOCIETY IN THEIR
FOSTER PROGRAM AND LOW COST VACCINATION CLINICS AND REFER CLIENTS
TO THEM WHEN APPROPRIATE.
12. WE REFER OUR CLIENTS TO NUMEROUS OTHER BUSINESSES IN THE
AREA FOR THEIR PETS' NEEDS.
13. WE ARE A MEMBER OF THE DUBLIN CHAMBER OF COMMERCE.
