FINANCIAL STATEMENT: Fire permit, inspection, plan review and service fees are charged to defray the City's costs of providing special fire services, including :fire permits, plan review and inspection. Most of these services are related to the :fire prevention function. These fees are projected to generate approximately $66,000 of revenue during the 1997.98 fiscal year. DESCRIPTION: Since 1988, the Dougherty Regional Fire Authority (DRF A) has provided :fire suppression, prevention and emergency response services to the City of Dublin. Under the fire prevention function, all fire permits, :fire plan review and inspection and other related fire services have been provided by DRF A. DRF A has charged fees to cover the reasonable cost of providing these fire prevention services, and, in addition, has established fees for other specified services, including weed abatement, incident response in certain circumstances and fees for copies of reports and photographs. On July 1, 1997,DRFA will be dissolved. Beginning on that date, the City of Dublin will provide fire suppression and prevention services through a contract with the Alameda' County Fire Department (ACFD). It is therefore necessary for the City of Dublin to establish a fee schedule to cover the reasonable costs of fire prevention and other specified services to be provided through ACFD. This fee schedule will be adopted as an amendment to the City's Master Fee Resolution and will be labeled Exhibit 9. ------------------------------------------------------------------- COPIES TO: Jim Ferdinand, ACFD ITEM NO. 6eS Fire Prevention Fees , ..' On May 20, 1997, the City Council adopted Ordinance 12-97, which adopted the Uniform Fire Code and..... prescribed regulations governing conditions hazardous to life and prope~ in the City of Dublin. These .' .:': standards and regulations are implemented and enforced by the Fire Department's fire prevention function through such mechanisms as fIre permits, plan review and inspection. Ordinance 12.97 provides that the City Council may, by resolution, establish fees to defray the City's reasonable costs for these fire prevention services, which are generally related to the use of property, special activities and/or the development of property. Fire permits are required for certain types of uses to insure that proper fire safety measures are in place. Fire permits are generally issued on an annual basis, and locations requiring :fire permits are inspected annually by :fire prevention staff. In addition, certain fire permits are issued on a per occurrence basis, such as permits for tank removal, parades, or :fireworks displays. Prior to issuing these permits, fire prevention staff conducts necessary inspections to insure that fire safety measures are in place. Fire plan review and inspection is required for new construction and tenant improvements. The Uniform Fire Code adopted' by the City Council establishes fire safety requirements that must be in place for different types of construction, including requirements for :fire alarm systems, fixed :fire protection systeins and sprinkler systems. In addition to these :fire prevention functions, ACFD will continue the successful self-inspection program. implemented by DRF A for all commercial occupancies not requiring special fire permits or inspections. This program operates on a three-year cycle, with the businesses conducting their own inspection for two years and a :fire inspector conducting the inspection for the third year of the cycle. I) The proposed fee schedule, which is attached to the proposed resolution as Exhibit 9, includes charges for all of the permits and services described above. The proposed fee rates are those that are currently in place for ACFD. In establishing the fee, ACFD determined! the hourly rate of fire prevention services, including all overhead and related consultant fees and then established the basic fee based on the average time reqUired to perform the specific service. The fee schedule provides that when permits or plan reviews require more than two field inspections or _ when extra costs are incurred due to certain circumstances, additional fees are charged at the established hourly rate. It is reasonable for Dublin to utilize the ACFD fee schedule, as under the terms of the contract for :fire services, the City will be compensating ACFD for all of these costs based on the actual time, materials and overhead required to perform these various services. For the self-inspection program, the proposed fee for the annual notice of inspection is the $11.00 fee that is currently in place for DRF A, as ACFD currently does not operate a similar program in its jurisdiction. .' This fee covers the administrative cost of the program. If a particular location requires a :fire permit or additional inspection, the $11.00 fee is credited against additional charges. Weed Abatement Fees On May 20, 1997, the City Council adopted Ordinance 13-97, which established the weed abatement ... program. for the City of Dublin. Under this program, property owners are required, after proper notice, to .:::. . abate their weeds. If such abatement does not occur, then the City is authorized to abate the weeds and charge the property owner for the cost of this service. The proposed fee schedule (attached Exhibit 9) provides that the fee for weed abatement shall include the direct cost of the weed abatement contractor as well as City inspection and administrative costs. . '.' . . 1"1 '.! . Other Fire Service Fees The proposed fee schedule also provides fees for duplication of reports and photographs. The proposed fees are consistent with those charged by the City of Dublin in other areas. In addition, the fee schedule provides that, in certain circumstances, the City may charge for the cost of fire incident response and investigation. Specified circumstances include intentionally caused fires, fires caused by negligence, vehicle incidents caused by driving under the influence of alcohol, and hazardous materials incidents. The proposed fee rate is the actual cost of labor, materials and equipment, including administrative overhead. Recommendation It is recommended that the City Council hold the public hearing and adopt the proposed resolution amending the City's Master Fee Resolution to include the schedule of fees for fire permits, plan review, inspection and other services (Exhibit 9 of the Master Fee Resolution). . .: .' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ******************** AMENDING RESOLUTION 96-84 ESTABLISHING FEES AND CHARGES FOR PUBLIC SERVICES BY ADDING EXHIBIT 9: FIRE PERMIT, PLAN REVIEW, INSPECTION AND SERVICE FEES WHEREAS, the City Council of the City of Dublin adopted Resolution 96-84, which establishes fees and charges for public services provided by the City of Dublin; and WHEREAS, effective July 1, 1997, the City of Dublin will provide fire protection, prevention and emergency response services, which services have previously been provided by the Dougherty Regional Fire Authority; and WHEREAS, the City of Dublin will provide all of these fire services through a contract with the Alameda County Fire Department (ACFD); and WHEREAS, on May 20, 1997, the City Council of the City of Dublin adopted Ordinance 12-97, which adopted the Uniform Fire Code and prescribed regulations governing conditions hazardous to life and property in the City of Dublin; and WHEREAS, Ordinance 12-97 provided that the City Council may, by resolution, establish fees to defray the City's reasonable costs for fire permits, plan review and inspection services; and WHEREAS, on May 20, 1997, the City Council of the City of Dublin adopted Ordinance 13-97, which established the weed abatement program, including the authority to charge private property owners for weed abatement if property owners do not, after proper notice, abate weeds themselves; and WHEREAS, the City Council may also establish fees to cover costs related to certain types of incident response, as well as duplication of fire reports and photographs and other fire related services; and WHEREAS, under the contract for fIre services with ACFD, the City will compensate ACFD for all costs related to the provision of fire suppression, prevention, and emergency response services in the City of Dublin; and WHEREAS, ACFD has established fees which cover the cost of providing services for fire permits, plan review and inspection and other fire related services; and WHEREAS, it is appropriate for the City of Dublin to implement the ACFD fee schedule for these services. · NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby adopt EXHIBIT 9 - FIRE PERMIT, PLAN REVIEW, INSPECTION AND SERVICE FEES, as attached hereto and by reference made a part hereof, which shall be incorporated with Resolution No. 96-84 as amended. Investigations .The permit fee is an estimate based on the cost of basic service, including, but not limited to, office reviews and two (2) field inspections. The actual amount charged is based on the actual time spent. The plan review and inspection fee covers the cost of basic services, including, but not limited to, review and approval of plans, two (2) field inspections and consultant fee for construction plan,sprinkler plan and calculation review. Extra cost incurred due to system failure, unusual circumstances, excessive time required, missed appointments and personnel expense shall be billed at the rate of $80 per hour in 1/2 hour increments in addition to the basic service fee. "Fire permits that are not covered by an annual permit shall submit application for permit required for each occurrence. In addition to the fire permit, fireworks displays must have one engine company on standby during the event at the perimitee's expense. Event time includes 1/2 hour before and 1/2 hour after the actual display. Page 3
