FINANCIAL STATEMENT: The City of Dublin may be able to secure up to $84,000 from a grant that may be used by the City for construction or acquisition of capital assets that benefit the community. DESCRIPTION: In May 2006, the State of California, Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) for a Workforce Housing Rewards Grant Program. The grant provides financial incentives to cities and counties that issue building permits for new housing affordable to very low or low-income households. Grant amounts are based on the number of bedrooms in units restricted for very-low and low-income households for housing units with building permits issued during the 12-month reporting period. Qualifying rental units must be rent-restricted for at least 55 years. Ownership units must be initially sold to qualifying households at an affordable cost. Any public funds used to achieve affordability in ownership units must be recovered on resale and reused for affordable housing for at least 20 years. Grant amounts for very-low income units are greater than grant amounts for low-income units. Very-low income is defined as households not over 50 percent of the area median income, adjusted for family size. Low-income is defined as households not over 80 percent of the area median income, adjusted for family size. COPIES TO: In House Distribution ITEM NO. If: Z Page 1 of2 K:\Housing Grants\Workforce Housing Reward Grant\WHHRP 2007\Agenda Statement 3-6.doc Eligibility criteria requires that cities and counties, by the end of the 12-month period for which the application is made, have adopted Housing Elements that HCD has found to be in substantial compliance with housing element law. In addition, applicants must have submitted to HCD the Annual Housing Element Progress Report required by Section 65400 of the Government Code within the preceding 12 months. The City of Dublin submitted the Progress Report in October 2006. Grants are eligible for construction or acquisition of capital assets such as traffic improvements, neighborhood parks, bike paths, libraries, school facilities, play areas, community centers, police, or fire stations. A wards The City of Dublin is a past recipient of the Workforce Housing Rewards Grant Program. Dublin received $679,921 in 2005 and $363,955 in 2006 for a total of $1,043,876. Grant funds have been set aside to be used for the renovation of the Shannon Community Center. As mentioned earlier in this report, funds are awarded based on the number of proj ects with affordable units for both ownership and rental. Application In December 2006, the application packet was made available for the grant. Staff is collecting all required documentation and will be submitting the application packet to the State of California, Department of Housing and Community Development (HCD) by the required March 21, 2007 deadline. Staff has determined that Dublin complies with the terms of the award application. These terms include that the final land use approval and building permits be issued for developments that include affordable units and that this can be demonstrated by providing verifying documents. Qualifying projects include Silvera Ranch - the Villas (25) and Tralee (15) for a total of very low- and low-income unit counts of25 homes. The number of units and the bedroom counts for all units listed entitles the City of Dublin to apply for a grant amount of $84,000. The State may award an additional Regional Housing Needs Allocation Bonus Award that the State will determine based on eligibility and calculations of building permit information obtained from the Construction Industry Research Board (CIRB) and/or the Department of Finance. In addition, the passage of this Resolution and submittal to the State Department of Housing and Community Development is the final document required of the City of Dublin to provide a complete application packet. The awards for the Workforce Housing Rewards Program Grants are anticipated to be announced by HCD in June 2007. RECOMMENDATION: Staff recommends that the City Council: 1) Receive the Staff Report; and 2) Adopt the Resolution authorizing Application for Workforce Housing Reward Grant and authorizing the City Manager to execute the Application. Page 2 of2 RESOLUTION NO. - 07 \Db~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* AUTHORIZING APPLICATION FOR WORKFORCE HOUSING REWARD GRANT WHEREAS, the State of California, Department of Housing and Community Development (the "Department") has issued a Notice of Funding Availability dated May, 2006 (the "NOFA"), under its Workforce Housing Reward (WFH) Program; and WHEREAS, the City of Dublin ("Applicant") desires to apply for a WFH grant and submit the Application Package released December 2006 by the Department for the WFH Program; and WHEREAS, the Department is authorized to approve funding allocations for the WFH Program, subject to the terms and conditions of the NOFA, Program Guidelines, Application Package, and Standard Agreement. NOW, THEREFORE, BE IT IS RESOLVED that the City of Dublin City Council does hereby find that: A. Applicant is hereby authorized and directed to apply for and submit to the Department the WFH Application Package released December 2006 for the 2006 Program Year. If the application is approved, the Applicant is hereby authorized and directed to enter into, execute, and deliver a State of California Standard Agreement (the "Standard Agreement"), and any and all other documents required or deemed necessary or appropriate to secure the WFH Grant from the Department, and all amendments thereto (collectively, the "WFH Grant Documents"). B. Applicant shall be subject to the terms and conditions as specified in the Standard Agreement. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. Applicant hereby agrees to use the funds for eligible capital asset(s) in the manner presented in the application as approved by the Department and in accordance with the NOF A and Program Guidelines and Application Package. C. That the City Manager and his or her designee (The Community Development Director) are authorized to execute in the name of Applicant the Application Package and the WFH Grant Documents as required by the Department for participation in the WFH Program.
