Adopt Draft Resolution (Exhibit A), supporting the petition for
reorganization of school district property from the Livermore Valley
Joint Unified School District; or give Staff direction and continue
the matter.

DESCRIPTION:
The first Eastern Dublin annexation became effective October of 1995. This annexation encompassed
approximately 1,538 acres ofland, mostly east of Tassajara Road. The same land was also annexed into
the Dublin San Ramon Services District.
The Dublin Unified School District (DUSD) boundaries do not coincide with the new Eastern Dublin city
limits. Approximately 1,423 acres of the annexed property and 200 acres of the Alameda County Surplus
Authority's Santa Rita property are within the jurisdiction of the Livermore Valley Joint Unified School
District (L VJUSD). The remaining properties are within the jurisdiction of the DUSD (see Exhibit B).
The 1995 annexation approval included a plan for municipal services (police, fire, water and sewer, etc.).
However, school district services and property reorganizations are not part of the Alameda County Local
Agency Formation Commission's annexation review and approval process. School district property
reorganizations are processed through the County Board of Education.

Transferring school district property from the L VJUSD would be in the City of Dublin's best interest for a
variety of reasons. The Dublin General Plan and the Eastern Dublin Specific Plan clearly identify S(Hfle of...
these reasons.
First, Guiding Policy 4'-lF of the Dublin General Plan states that the DUSD should operate schools
located within the City. Second, the adopted Eastern Dublin Specific Plan recognizes both the Dublin .~.
community and the DUSD's desire to have their school district boundary coterminous with the Dublin
city limits for purposes of facilitating the financing of future services and infrastructure and being more
responsive to community needs and concerns. Additionally, an action program of the Specific Plan
(Program 8A) directs the City Staff to "work with the DUSD and the L VJUSD to resolve the
jurisdictional issue regarding which district(s) should serve the Eastern Dublin area; and determine the
service district arrangement that best serves the needs of planning area students and minimizes the fiscal
burden of the service providers."
Furthermore, without the transfer ofterritory, school housing costs would significantly ipcrease and
students would need to travel much farther to attend Livermore schools. The existing Dublin High School
can accommodate all of the high school students that the Eastern Dublin development will generate.
Without the transfer, the L VJUSD would need to construct a new high school facility that would
significantly increase school housing costs. Additionally, the DUSD has an existing facility to
accommodate the new junior high students on an interim basis. The Eastern Dublin Specific Plan shows a
junior high school site within the L VJUSD territory, but outside the recently annexed area.
No new schools will be constructed within the L VJUSD until enough students are generated to occupy
about 50% of each facility. In the interim, students would have to attend existing L VJUSD schools. The
nearest L VJUSD elementary school is 7 miles from the Eastern Dublin area on the opposite side of the 1-
580 freeway, the nearest L VJUSD junior high is 7.5 miles away, and the L VJUSD's Granada High School ..----...
is 8 miles away. Transportation to these L VJUSD schools would require use of the 1-580 freeway. ."
Dublin's nearest elementary school is slightly over 4 miles away and can be reached using surface streets.
The DUSD junior high is 4 miles away, and Dublin's high school is 4.5 miles away.
If the transfer of property is approved, students will ultimately attend new DUSD elementary andjunior
high schools within the Eastern Dublin planning area. An elementary school facility is already being
planned on the Alameda County Santa Rita property, west of Tassajara Road, and the Eastern Dublin
Specific Plan land use map shows a junior high school site west of Tassajara Road. In total, if the
property is successfully transferred to the DUSD, the District would need 4 elementary schools and one
junior high school.
On May 28, 1996, the City Council met jointly with the DUSD Board and indicated a desire for a
resolution supporting the reorganization of school district property from the L VJUSD for the reasons
stated above.
On October 15, 1996, the property owners of the recently annexed property and the Alameda County
Surplus Authority filed a petition for school district reorganization requesting that the property be
transferred from the L VJUSD to the DUSD. The attached draft resolution (Exhibit A) supports this
petition.
In conclusion, consistent with the policies and action programs of the Dublin General Plan and the Eastern .
Dublin Specific Plan, and City Council's direction, Staff recommends that the City Council approve the .... .
draft resolution, Exhibit A, supporting the petition for reorganization, or direct Staff and continue the
matter.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

SUPPORTING THE PETITION TO TRANSFER TERRITORY FROM THE LIVERMORE
VALLEY JOINT UNIFIED SCHOOL DISTRICT TO THE DUBLIN UNIFIED SCHOOL
DISTRICT
WHEREAS, on May 10, 1993, the City of Dublin adopted the Eastern Dublin Specific Plan, a
Plan which provides a framework for the future growth and development on the eastern edge of the City
of Dublin; and :
WHEREAS, on October 1, 1995, the City of Dublin annexed 1,538 acres of property within the
Eastern Dublin Specific Plan area, which property has now become part of the incorporated city limits of
the City of Dublin; and
WHEREAS, approximately 1,423 acres of annexed property and 200 acres of Alameda County
Surplus Authority property (Santa Rita) within the incorporated city limits of Dublin, are within the
jurisdiction of the Livermore Valley Joint Unified School District (L VJUSD) whereas all other property
in the incorporated city limits of the City of Dublin is under the jurisdiction of the Dublin Unified School
District (DUSD); and
WHEREAS, the Dublin General Plan Guiding Policy 4.1 F states that "Schools located within the
city should be operated by the Dublin Unified School District"; and
WHEREAS, the Eastern Dublin Specific Plan states in Section 8.1 that "There is a strong
sentiment within Dublin, including the Superintendent of the Dublin Unified School District and its Board
of Trustees, that the school district that serves the area should be coterminous with the community with
which it is identified in order to facilitate the financing of future services and infrastructure and be more
responsive to community concerns"; and
WHEREAS, the Eastern Dublin Specific Plan program 8A identifies an action program for the
City to work with the DUSD and the L VJUSD to resolve the jurisdictional issue regarding which District
should serve the Eastern Dublin planning area and determine the service district arrangement that best
serves the needs of planning area students and minimizes the fiscal burden of the service providers; and
WHEREAS, the existing Dublin High School would be able to accommodate all of the high
school students that the Eastern Dublin development will generate; and the L VJUSD would need to
construct a new high school for accommodating all of the new high school students that the Eastern
Dublin development will generate and, therefore, without the approval of this property transfer, there will
be a significant increase in school housing costs; and
WHEREAS, no new schools will be constructed in the L VJUSD until enough students are
generated to occupy about 50% of each facility and, therefore, in the interim, students will have to attend
existing L VJUSD schools, which are further away and which would require use of the 1-580 freeway; and

WHEREAS, if the transfer of property is approved, students would be closer to the Eastern Dublin
development area and would access schools using surface streets, and students will ultimately attend new
elementary and junior high schools within the Eastern Dublin Specific Plan area as a result of residential e.. ,.

WHEREAS, the property owners of the recently annexed property and the Alameda County
Surplus Authority with property within the L VJUSD have filed a Petition with the Alameda County
Office of Education requesting that the property be transferred from the L VruSD to the DUSD.
NOW, THEREFORE, BE IT RESOLVED that the City Council for the City of Dublin:
1. Supports the property transfer of recently annexed properties and the Alameda County Surplus
Authority property (Santa Rita) in the L VJUSD to the DUSD; t:
2. Will support the Petition for Reorganization submitted by the property owners to the Alameda
County Office of Education; and
3. Authorizes and directs staff to provide the Alameda County Office of Education with any
infonnation it requests related to the Petition.
