RECOMMENDATION: Approve continuation of contracts with 4Leaf, Inc., Shums Coda, and Precision Inspection Company, Inc. for the City of Dublin in Fiscal Year 2007-2008; and Adopt the Resolution approving an Amendment to Exhibit B and corresponding fee amendment agreements and authorize the City Manager to sign on behalf of the City. FINANCIAL STATEMENT: In Fiscal Year 2007-2008, it is projected that 24,200 hours of inspection, plan check and specialized services will be required. Only those hours required will be billed. Based on these projected hours of service, the annual cost of these contracts will be $2,095,520. Funding for these costs will be included in the Fiscal Year 2007-2008 preliminary budget. DESCRIPTION: Since May 2001, the City of Dublin has contracted with the firm 4Leaf, Inc. for Building and Safety services. The City added the firms Precision Inspection Company, Inc. in June 2003 and Shums Coda in July 2006. Due to cyclical construction activity, the City has found that this type of contract arrangement best suits the needs of the City. Current Contract Staff Levels provided to the City by each company includes the following: • 4Leaf: 2 Commercial Inspectors, 7 Building Inspectors, 1 Assistant Building Inspector, and 2 Supervising Inspectors • Shums Coda: No on -site assigned Staff ------------------------------------------------------------------------------------------------------------- COPY TO: File Consultants 1 ITEM NO. 4 0 · Precision: No on-site assigned Staff The Consultants' work has been responsive to the City's needs. Customer requests on the phone and over the counter have been handled quickly and efficiently. In Fiscal Year 2007-2008, Staff projects that contract services will be required as follows: · One (1) full-time Plan Checker · Two (2) full time Supervising Inspectors · Two (2) full time Commercial Inspectors . Six (6) full time Building Inspectors · Additional off-site plan checking services will be performed for complicated projects The assumptions used in estimating these service needs are outlined in Attachment 2. 2007-2008 Proposed Rate Increase: Staff is recommending an increase in the hourly payment for Building and Safety Services as follows: · Building Inspector: From $75 to $79 per hour · Commercial Inspector: From $85 to $90 per hour · Plan Checking, on- or off-site: From $90 to $100 per hour · Supervising Inspector: From $87 to $95 per hour · Assistant Building Inspector: From $55 to $58 per hour The proposed rate increases reflect an average increase of 3.55% per year over the last two-year period for an overall total average increase of 7.1 % from the 2005-2006 rate adjustment. The average increase over the last 12 fiscal years is approximately 4.25% per year for each position. The proposed increase in hourly fees is necessary in order to retain the individuals who are currently performing work for the City. In June 2005, the increase granted by the City Council for Commercial and Building Inspectors was $5 and $7 for Plan Checkers. This is the first increase for Supervising and Assistant Inspectors. Attachment 2 provides a historical workload summary and proposed 2007-2008 fee schedule with the contract labor projections. XX - 07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********************************************* APPROVING AMENDMENTS TO AGREEMENTS WITH 4LEAF, INC, SHUMS CODA, AND PRECISION INSPECTION COMPANY, INC. RELATED TO BUILDING INSPECTION SERVICES WHEREAS, the City of Dublin (the "City") is experiencing significant increases in new development applications; and WHEREAS, with the acceleration of new development projects in both the Western and Eastern areas ofthe City, the need to retain outside consultant firms is necessary; and WHEREAS, Staffhas determined it necessary to hire technical support to provide expertise in plan checking and other construction issues when Staff is unable to complete projects in a timely fashion due to workloads; and WHEREAS, Staffhas determined it necessary to hire additional inspectors to provide inspection services including plan checks and field checks of new projects; and WHEREAS, the Planning Commission and City Council has directed Staffto move projects expeditiously and hire consultant firms when services are needed; and WHEREAS, the firms of 4Leaf, Inc., Shums Coda, and Precision Inspection Company, Inc. have demonstrated they have adequate ability to perform inspections, plan checks, and other services as required; and WHEREAS, consultants will only perform work on a time and material basis at the direction of the Community Development Director; and WHEREAS, all costs will be charged to the Community Development Department budget in accordance with costs associated with certain projects; and WHEREAS, the City and the firms of 4Leaf, Inc., Shums Coda, and Precision Inspection Company, Inc. (the "Consultants") have previously entered into agreements (the "Agreements") whereby the Consultants have agreed to provide certain building inspection services; and WHEREAS, the amendments to the Agreements implementing the rate increase for each of the Consultants (the "Amendments") have been reviewed and approved as to form by the City Attorney's Office. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does approve the fee amendments in Exhibit B of the standard consultant agreements for the following firms: 4Leaf, Inc., Shums Coda, and Precision Inspection Company, Inc. Collectively, the City and the Consultant are referred to as the "Parties." RECITALS WHEREAS, effective July 18, 2006, the Parties entered into a Consulting Services Agreement in which the Consultant agreed to provide Building Inspection and Plan Check services to City ("Agreement''); and WHEREAS, in Section B of Exhibit B to the Agreement, City agreed to pay Consultant. at the following hourly rates: $87 for Supervising Building Inspector; $85 for Commercial Inspector; $75 fot Building Inspector; and $95 for Off-site and On-site Plan Checking; and .
