WRITTEN STATEMENT
Homart Community Centers and Alameda County Surplus Property Authority ("Applicants") are
requesting that the City of Dublin rezone a 75+ acre portion of the 951 acre Santa Rita property in
Eastern Dublin to permit general commerciaVretail uses.
Presently, the site is zoned "Planned Development - Business Park/lndustrial (low coverage)" as defined
in Zoning Ordinance 25-85. Under this ordinance, all projects within this District must be processed as
a new Planned Development rezoning, complying with the 1985 General Plan designation.
The Dublin General Plan (pages 1-5) states that the existing zoning classification is "intended to provide
a campus-like setting with open plazas and landscaped pedestrian amenities for the Primary Planning area
(research, limited manufacturing and distribution activities, and administrative offices that do not involve
heavy trucking or generate nuisances) and to allow retail uses to serve business and residents (emphasis
added). Maximum floor area ratio, to be determined by zoning regulations, should be between .25 and
.37".
In May, 1993, the Dublin City Council approved the Eastern Dublin Specific Plan, which was upheld by
a citywide referendum in November, 1993. The Eastern Dublin Specific Plan designates this site for
General Commercial (.20 to .60 FAR). According to the Specific Plan, this designation "accommodates
a range of regional and community-serving retail, service, and office uses."

Consistent with both the 1985 General Plan designation and the newly adopted Eastern Dublin Specific
Plan, and as required by current zoning, the applicants are requesting that this 75 acre site be rezoned
to a PD (Planned Development General Commercial) District to provide a dynamic
retail/office/entertainment environment to serve businesses and residents.
The Alameda County Surplus Property Authority is seeking to sell this 75 + acre site to Homart
Community Centers for general commercial uses, while retaining full control over the remaining portion
of the 951 acre Santa Rita property. On May 2, 1994 the Dublin Planning Commission found that this
proposed sale is consistent with the General Plan and Eastern Dublin Specific Plan.
The Authority and Homart Community Centers will seek subsequent Site Development Review from the
City for commercial projects, following leasing of the site. All structures, circulation, parking, landscaping
and signage is subject to site development review and the development standards set forth herein. A
parcel map is required to be completed in accordance with City of Dublin standards and recorded prior
to issuance of a building permit.
The Santa Rita Rehabilitation Center, of which this site is a part, is an ASPIS listed site, requiring "low
priority preliminary endangerment assessment" by the Department of Toxic Substance Control (DTSC)
Office. A Phase 1 Environmental Assessment Report was completed in January, 1994. Several
underground storage tanks have been removed and are currently under review by regulators for closure.
PROJECT BENEFITS
This rezoning will have the following benefits to the City of Dublin:
1. It will replace an existing unsightly vacant property with a vibrant retail environment to
serve Dublin businesses and residents.
2. It will provide much needed space for existing Dublin retail businesses to expand, while still
remaining within the City of Dublin.
3. It will provide increased tax revenue to the City through increased retail sales tax.
4. It will provide job opportunities to City residents.
5. It will provide a source of funds to pay for the recently completed Hacienda DrivelDublin
Boulevard extension.

III. Site Development Review
Any structure, circulation, parking, landscaping and signage shall be subject to Site
Development Review (pursuant to Section 8-95): unless zoning approval is granted upon
the determination that the construction constitutes a minor project and that the Building
Permit plans are in accord with the intent and objectives of the Site Development Review
procedures.
IV. Setbacks and Yards
A.
Minimum Setbacks: The minimum setbacks for buildings, accessory structures,
parking areas, driveways and loading areas shall be as follows:

· Along Dublin Boulevard: 20 feet from right-of-way.
· Along Tassajara Creek: A minimum 100 foot setback from the top of bank
will be maintained along Tassajara Creek.
The setback zones shall be fully landscaped with both hardscape (private sidewalks and
other hard surfaced areas) and softscape (trees, shrubs, ground cover, etc.).
Exceptions to the above setback requirements are the following:
1. Architectural projections (such as eaves, columns, balconies,
arcades, awnings, steps and decks) which may encroach up to
a maximum of to feet into a required setback, with a minimum
setback of to feet from a street right-of-way.
2. Freestanding signage: As permitted in the Master Sign
Program.
B. Minimum Yards: The required setback for all yards is 0 feet.
V. Maximum Building Heights
Buildings and other structures will be limited to a maximum height of 75 feet in this
District.
VI. Maximum Floor Area Ratio (FAR)
The overall maximum floor area ratio for this district will be .25% permitting a total of
approximately 800,000 square feet of Gross Leasable Area (GLA) on 75 acres.
VII. Parking and Loading
A. Parking and Loading Spaces. There shall be provided and maintained in
accordance with these standards, off-street automobile parking and loading
spaces for every building and use. No building or structure shall be erected
or use established and no existing building shall be structurally altered, unless
there be already in existence, or unless provision therefore is made
concurrently with such erection or structural alteration or new use, the

number of parking spaces and loading spaces necessary to meet the minimum
requirements hereinafter set forth.
B. Continuing Character of Obligation. The maintenance of the parking and
loading spaces required shall be a continuing obligation of the owner of the
real estate upon which the building or structure is located as long as the
building or structure exists and the use requiring such space continues. It shall
be unlawful for an owner of a building or structure affected by these
requirements to discontinue, change or dispense with or to cause the
discontinuance, sale or transfer of such building or structure, without
establishing alternative spaces which conform to those requirements; or for
any person, firm, or corporation to use such building or structure without
providing such required parking or loading spaces, in compliance with these
standards.
C. Parking Spaces: Accessibility. These standards are intended to provide off-
street spaces for the parking of the automobiles of tenants of the premises
and for clients, customers, employees, and callers. They are required to be
kept accessible for the purposes continuously, and the use of any such
required space or spaces, uses other than these specified, shall constitute
discontinuance thereof in violation of Section 8-63.1.
D. Parking Spaces: Size and Location. A standard parking stall shall be a
minimum of nine (9) feet wide by a minimum of eighteen (18) feet in length.
Compact stalls shall be a minimum of eight (8) feet wide by a minimum of
seventeen (17) feet in length. Compact parking spaces may comprise up to
25% of the required parking spaces. Where parking spaces abut sidewalks or
landscape areas the length of parking stall may be reduced by two feet. -
E. Loading Spaces: Size and Location. Required loading space at buildings
aggregate floor area less than forty-thousand (40,000) s.f. shall be not less
than ten (to) feet in width and twenty (20) feet in length. Required loading
spaces at buildings with an aggregate floor area over forty-thousand (40,000)
s.f. shall be not less than ten (to) feet in width and sixty (60) feet in length.
Every required loading space shall be clear to height of not less than fourteen
(14) feet. Every required loading space shall be on the same lot as the
structure it serves or on an abutting lot and shall be continuously accessible
from the street. No loading space shall occupy any part of a required parking
space, or any required street side yard or a corner lot.

F. Parking and Loading Spaces: Approval of Plan. A site plan showing the
location of the existing and proposed building or buildings and other
improvements, the location of all required parking and loading spaces, and all
provisions for maneuvering space and access thereto from a public right-of-
way including proposed curb cuts, shall be submitted and approved as being
convenient and functional prior to the issuance of Building Permit. No
approval of occupancy shall be issued upon completion of a building or
structural alteration of a building or for any land use when no buildings are
erected or altered, unless and until all such spaces as required and as shown
upon approved plans and made a part of the Building Permit are in place and
ready for use.
G. Parking and Loading Spaces: Maintenance. All parking and loading spaces,
access driveways, and maneuvering areas required shall be graded and well
drained and shall be maintained with all weather dust-free surfacing. Lighting
of parking and loading spaces shall be so arranged as to be directed
downward and away from any residential area.
H. Collective Action Permitted. Nothing in this chapter shall be construed to
prevent the joint use of parking or loading space for two (2) or more
buildings or uses if the total of such spaces provided is not less than the sum
of the requirements for the individual uses computed separately in accordance
with these standards.
I. Number of Spaces Required. The number of parking and/or loading spaces
required shall be calculated based on gross floor area for retail and office
uses, and customer service area for restaurant uses. When the calculation
results in a fractional number, any fraction up to and including one-half (112)
shall be disregarded and any fraction over one-half (112) shall be adjusted to
the next higher whole number.
J. Parking Spaces Required: The number of parking spaces required shall be
not less than specified in the following table:

Exception: Where an attested copy of a contract between the parties
concerned is filed with the Application for Building Permit, which contract
sets forth a valid agreement for joint use of parking spaces for the life of the
buildings or uses concerned and a parking study has been approved by the
Zoning Administrator demonstrating that a lesser number of parking spaces
would be appropriate for the proposed used, through shared use of parking,
then the number of required parking spaces shall be reduced in accordance
with the number indicated in the approved parking study.
K. Loading Spaces Required: Every allowable use which has an aggregate gross
floor area of fifteen-thousand (15,000) square feet or more, shall provide
loading spaces in accordance with the following:

L. Minimum Aisles Widths: Parking aisles with two-way traffic shall have a
minimum width of twenty-two (22) feet for parking angles of 0, 30, 45 and 60
degrees. Parking aisles with two-way traffic shall have a minimum width of
24 feet for 90 degree parking angle.
Parking aisles with one-way traffic shall have minimum widths as follows:
a) 15 feet for parking angles of 0, 30, and 45 degrees.
b) 18 feet for a parking angle of 60 degrees.
c) 24 feet for a parking angle of 90 degrees.
M. Bicycle Facilities: Bicycle parking facilities shall be provided, at the
minimum, at a ration of one space per 150 required automobile spaces.
These facilities, which would provide for convenient parking and locking of
bicycles shall be located adjacent the fronts of buildings and dispersed
throughout the shopping center.

IX. Signage:
The Master Sign Program will be submitted for review with the Site Development Reveiw
package.
X. Landscape:
A minimum ratio of twenty (20%) percent of the gross land area will be provided in open
space, which shall include landscape, entry, plaza and sidewalk areas. The minimum ratio
of landscape to gross land area shall be as follows:

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
RESOLUTION APPROVING NEGATIVE DECLARATION AND
MAKING FINDINGS REGARDING ENVIRONMENTAL IMPACTS
CONCERNING THE SANTA RITA COMMERCIAL CENTER
WHEREAS, the Eastern Dublin General Plan Amendment ("GPA")
and Specific Plan ("SP") were adopted by the City in i993: and
WHEREAS, the GPA outlines future land uses for approximately
4176 acres within the City'S eastern sphere of influence
including approximately 13,906 dwelling units and 9.737 million
square feet of commercial, office, and industrial development:
and
WHEREAS, the SP provides more specific and detailed goals,
policies and action programs for approximately 3313 acres within
the GPA area nearest to the City: and
WHEREAS, the GPA and SP areas ("Eastern Dublin") are shown
on the Land Use Map contained in the GPA (attached hereto as
Exhibit A) and exclude the area shown on the Land Use Map as
"Future Study Area/Agriculturell; and
WHEREAS, a Program Environmental Impact Report (IIProgram
EIR") was prepared for the GPA and SP (SCH No. 91103604) and
certified by the Council on May 10, 1993 by Resolution No. 51-

93, and two Addenda dated May 4, 1993 and August 22, 1994
("Addenda") have been prepared and considered by the Council; and
WHEREAS, on May 10, 1993, the Council also adopted
Resolution No. 53-93, adopting the GPA and SP, making findings as
to the environmental impacts and mitigation measures relating to
the GPA and SP, and adopting a Mitigation Monitoring Program
(lIprogram MMplI) for the GPA and SP; and
WHEREAS, Homart Community Centers (IIHomart") and the Surplus
Property Authority of the County of Alameda ("Countyll) have
proposed development of the Santa Rita Commercial Center (lithe
Project") on approximately 75 acres within Eastern Dublin, in the
location shown on the map attached hereto as Exhibit B; and
WHEREAS, the Project consists of development of an
approximately 800,000 square root commercial center to include
retail shops, offices, movie theatres, restaurants, and/or
similar commercial uses; and
WHEREAS, development of the Project will require certain
discretionary implementary actions by the City, including
rezoning approximately 75 acres from Planned Development --
Business Park/Industrial (low coverage) to a standard Planned
Development consistent with the GPA and SP ("Rezoning"), approval
of a Development Agreement with Homart and the County
("Development Agreement"), approval of a Tentative Parcel Map,
and Site Development Review; and
WHEREAS, in November, 1994, the City prepared an Initial
Study for the Project, as designed, which consisted of a project
description, and environmental checklist with supporting

Exhibit E to the January 23, 1995, City Council Agenda Report;

WHEREAS, the Planning Commission held public hearings on the
Project, particularly on the Rezoning on December 19, 1994, and
January 3 and 17, 1995, and on the Development Agreement on
January 17, 1995, and adopted Resolution No. 95-01 recommending
that the City Council approve the Negative Declaration,
Resolution No. 95-02 recommending that the City Council adopt the
Rezoning, and Resolution No. 95-03 recommending that the City
Council approve the Development Agreement; and
WHEREAS, on January 23, 1995, the City Council held a duly
noticed public hearing on the Project, during which it considered
the Agenda Statement, the General Plan, the GPA, the SP, the
Program EIR, the Addenda, the Negative Declaration, the three
letters of comment on the Negative Declaration and the City's
written responses thereto, all related correspondence received
and the testimony received at the hearing, the recommendation of
the Planning Commission, and other items in the administrative
record;
NOW THEREFORE, the City Council of the City of Dublin does
RESOLVE as follows:

Section 1. The City Council finds that the foregoing
Recitals are true and correct and are incorporated herein as a
part of this resolution.
Section 2. Pursuant to section 21083.3, subdivisions (b)
and (e), of the Public Resources Code and pursuant to section
15168 of the State CEQA Guidelines, the City Council finds that
the Project is within the scope of the SP and the GPA, that the
Project and all of its potentially significant environmental
impacts were adequately described and analyzed in the EIR, that
the Project incorporates all applicable mitigation measures
identified in the Program EIR, and that all of the Project's
potentially significant environmental impacts will be mitigated
to a level of insignificance with the imposition of the
mitigation measures identified in the Program MMP and the site-
specific traffic mitigation measures identified in the Traffic
Impact Analysis.
Section 3. Pursuant to section 21166 and section 21083.3,
subdivisions (b) and (e), of the Public Resources Code, and
pursuant to sections 15162 and 15168 of the State CEQA
Guidelines, the City Council finds:
(1) that the Project does not constitute a change from
the program (i.e. the GPA and the SP) analyzed in the Program EIR
which would require major revisions in the Program EIR,
(2) that there are no substantial changes in the
surrounding circumstances under which the Project is being
undertaken from those circumstances which existed when the City

certified the Program EIR which would require major revisions in
the Program EIR, and
(3) that there is no new information of substantial
importance to the GPA, the SP, or the Project which, despite the
exercise of reasonable diligence, could not have been known when
the Program EIR was certified and which shows either (i) that the
Project will have significant environmental effects not discussed
or substantially underestimated in the Program EIR or, (ii) that
there are mitigation measures or alternatives not identified as
feasible in the Program EIR and not included as part of the
Project which would reduce or avoid any significant environmental
impacts.
Section 4. Pursuant to section 21080, subdivision (c), of
the Public Resources Code and pursuant to section 15074,
subdivision (b), of the State CEQA Guidelines, the City Council
(1) certifies that it has considered the Negative Declaration,
along with the three letters or comment received and the City's
responses thereto; (2) finds that there is no substantial
evidence in light of the whole record that the Project will have
a significant effect on the environment; and (3) hereby approves
the Negative Declaration.
Section 5. The City Council does hereby adopt the project-
specific Mitigation Monitoring Program (a copy of which is
attached as Exhibit F to the January 23, 1995, City Council
Agenda Report) as the reporting and monitoring program required
by Public Resources Code section 21081.6 for the Project, as a
supplement to the Program MMP.

Section 6. Pursuant to Public Resources Code section
21081.6, subdivision (a) (2), the City Council specifies that the
documents which constitute the record of proceedings upon which
its findings and decision herein are based shall be located at
City Hall, and their custodians shall be the City Clerk, the
Planning Director and the Public Works Director of the City.

INTRODUCTION
This Initial study has been prepared by the city of Dublin to assess
the potential environmental effects of the proposed Santa Rita
Commercial Center. The analysis is intended to setisfy the
requirements of the California Environmental Quality Act (CEQA)( and
provide the city with adequate information for project review.
The Eastern Dublin Specific Plan and General Plan Amendment Final EIR
(consisting of the DEIR dated August 28 ( 1992; Responses to Comments
Part I dated December 7, 1992; Responses to Comments Part II dated
December 21( 1992; Revisions to Part I of the Responses to Comments
relating to the Kit Fox; an p.ddendum to the DEIR dated Hay 4( 1993;
and a DKS A.'ssociates Traffic study dated December 15, 1992) (SCH
91103064); was adopted by the City Council on May 10, 1993. The FEIR
is available to the Public at the city of Dublin Planning Department
located at 100 Civic Plaza( Dublin( California. An Addendum to the
FEIR was approved by the City Council on August 22, 1994. The
environmental impact report that was prepared for the Eastern Dublin
General Plan Amendment and Specific Plan was a IIprogramll environmental
impact report. If a program environmental impact report is prepared,
subsequent environmental documents need to be prepared only if there
were addi tional environmental impacts not considered in the
preparation of the original environmental document (CEQp-. Guidelines
section 15168). The Santa Rita Commercial Center is proposed to be
located wi thin the boundaries of the Eastern Dublin Specific Plan.
Although the City of Dublin has determined that the project will not
have .s..D.Y additional environmental impacts that are not reduced to
insignificance by mitigation measures and corresponding conditions of
approval ( the city wants to ensure that the environmental review
process is set forth in a document and opened for public review.
Therefore( an Initial Study and Negative Declaration have been
prepared.
This Initial Study includes a project description, environmental
checklist( and discussion focused upon issues identified in the
checklist. The attachment to the Initial study is a Matrix which has
incorporated the Mitigation Measures and Action Programs of the
Eastern Dublin General Plan p..,i"nendment and Specific Plan which will
reduce the environmental impacts of the project to a level of
insignificance.
The Matrix has been designed for use in evaluating SpeC.lIlC project
proposals in Eastern Dublin for compliance with the Eastern Dublin
Final Environmental Impact Report and Mitigation Monitoring Program.
Please see the Legend which is the cover page to the Metrix for an
explanation of the headings and abbreviations within the Matrix. The
Mitigation Measures of the Eastern Dublin General Plan Ji..:uend:nent and
Specific Plan Final Environmental Impact Report (IIFEIRII) and the two
approved addenda thereto are referenced throughout this Initial Study.
Please refer to the Matrix to review the Mitigation Measures and/or
Action Programs.

In summarYr the Initial study concludes that the proje9t will not pose
any significant adverse effects that cannot be mitigated through
mitigation measures required through the Eastern Dublin Specific Plan
Final Environmental Impact Report and Mitigation Monitoring Program.
The project is in conformance with the General Plan and Eastern Dublin
Specific Plan Designations and conflicts will not be created with
established land uses on surrounding properties.
This study was prepared based upon the location of the project, staff
office review ( field review, comments from City ( County and special
Districts ( comments submitted by local agenciesj use of city Planning
documentsr the CEQA Law and Guidelines( City of Dublin CEQA
Guidelines, and previously certified Environmental Impact Reports.

PROJECT DESCRIPTION
Homart Community Centers of Denver, Colorado (the applicant) is
proposing a commercial project consisting of an 800rOOO ~ square
foot center on approximately 75 acres of land on the southeast
corner of Hacienda Boulevard and Dublin Boulevard. The site has
a General Plan Designation of General Commercial; a Specific Plan
Designation of General Commercialj and is in Plann~d Development
- Business Park/Industrial (low coverage) Zoning District. The
applicants propose as part of the project to rezone the site to
be consistent with the General Plan and Specific Plan to a
standard Planned Development. The Planned Development Tdould
allow general commercial type uses. As part of the project, they
will process a site Development Review approval and a Tentative
Parcel Map. The l>.pplicant plans to process the Rezone to a
Planned Development first, following shortly thereafter with the
site Development Review and Tentative Parcel Map applications.

The following issues have been found not to be significant as is
indicated by a "No" response on the Environmental Checklist. The
development will not produce significant adverse impacts for the
following reasons:
1. Earth: The topography of the site is relatively level with
minor surface variation; only minor gradingr trenchingr and
compacting of soils is required to complete the building
foundationsr water mains, sewer linesr storm drains,-and
pavement. .No significant ground alteration will occur to produce
erosion or destruction of any unique features. No geologic
hazards are known or suspected to exist on the site or in
surrounding areas. Mitigation Measures of the Eastern Dublin
Specific Plan Final Environmental Impact Report that will be
applied to this project in relation to this topic include

2. Air: The Santa Rita Commercial Center project is a
commercial development ( dependent upon automobile traffic and
therefore( automobile emissions will be generated. The FEIR
developed mitigation measures to reduce mobile and stationery
source emissions. certain uses that might include stationary
source emissions or objectionable odors will be required to
obtain a Conditional Use Permit, which would require additional
environmental review. Since the project is a Commercial Center it
will not be creating or causing any climatic changes regionally
or locally. Additionally, uses within the Center will not be
discharging hazardous emissions. Mitigation Measures of the FEIR
that will be applied to this project in relation to this topic
include 03.11/02.0 - 03.11/4.0; 03.11/06.0; 03.11/07.0;
03.11/08.0; 03.11/09.0; and 03.11/13.0. Inclusion of these
mitigation measures and corresponding conditions of approval will
mitigate any impacts in this topic area to a level of
insignificance.
3. Water: The project site does not cross over any water ways.
Although the project is adjacent to Tassajara creekr it is set
back at least 100 feet from the top of the bank. A Master
Drainage Plan for the entire Santa Rita Area is required to be
prepared pursuant to the Specific Plan. Therefore, any changes
in drainage patterns and flooding will be fully evaluated in that
Plan to ensure there are no environmental impacts in this topic
area.. DSRSD has indicated that they have water to supply the
project. AdditionallYr the minor trenching necessary for
improvements and construction of water utilities will not
interrupt or disturb any ground water flow. The FEIR contained
several mitigation measures which will be applied to this project

to mitigate any impacts in this area to a level of
insignificance as follows 03.05/44.0 through 03.05/55.0. Action
Programs 9T and 9U of the Specific Plan also mitigate these
impacts. .
4. and 5. Plant and Animal Life: The project site is covered
primarily with annual grasses and does not provide unusual or
high quality habitat for any species of rare or endangered
species of ,plants or animals. According to the FEIR the site is
not in a biologically sensitive arear nor has the area been under
cultivation in the recent past. Although the FEIR did not
identify the site as having any endangered species of plants or
animal life( certain mitigation measures of the FEIR and Action
Programs of the Specific Plan have been included for this
project. These measures and corresponding conditions of approval
have been included to either protect any species that meY be
discovered prior to or during construction or to protect
adjoining areas. The mitigation measures are: 3.07/01.0;
3.07/02.0j 03.07/03.03.07/05.0; 03.07/06.0j 3.07/07.0;
03.07/08.0; 03/07/09.0; 3.07/11.0 through 3.07/14.0j 3.07/16.0j

6. Noise: The noise impacts of potential projects in the
Eastern Dublin Specific Plan area were analyzed in the Eestern
Dublin Final Environmental Impact Report (IIFEIR"). The proj ect
would result in increases in existing noise levels but would not
result in the exposure of people to severe noise levels.
Mitigation measures of the Eastern Dublin Specific plan that have
been applied to this project as conditions of approval in
relation to Noise include 3.10/05.0 and 3.10/07.0. These
mitigation measures would reduce any noise impacts of this
project to a level of insignificance.
7. LIGHT AND GLARE: The project will produce new light or
glare. These impacts will be reduced to a level of
insignificance by incorporating signage which conforms to the
Sign Ordinance of the City of Dublin and the design of the
project which will orient the main entrances of structuresr and
signage at those entrances ( inward toward the parking lot.
Parking and associated lighting will be located in the center of
the project and will not be directly visible off-site due to
screening by buildings and landscaping and by the use of
luminaires which reflect light downward and not off-site. These
measures will reduce the impacts of light and glare ~f this
project to a level of insignificance.
8. LAND USE. The project does not have an impact to Land Use
because it does not have the following impacts as described in
Guidelines Section 15002(g):

a. The project will not disrupt or divide the physical
arrangement of an established community as there is no
established community and as the project is consistent with
the Eastern Dublin General Plan Amendment and the Eastern
Dublin Specific Plan;

the project is consistent with the Eastern Dublin General

CEQA Guidelines: Appendix I calls for an evaluation of potential
environmental impacts if a project would result in the
"substantial alteration" of the present or planned land use of an
area. "Substantial land use al teration" r however J is not in
itself considered a significant environmental effect by C~QA.
9. NATURAL RESOURCES. The project will not result in en
increase in the rate of use of any natural resources or result in
the substantial depletion of any non-renewable natural resource
because no natural resources or renewable natural resources will
be removedr used or depleted by the project.
10. RISK OF UPSET. The project will not involve a risk of an
explos~on or the release of hazardous substances in the event of
an accident or upset conditions because: 1) no hazardous
substances will be stored or handled in the proposed project; 2)
the application of mitigation measures from the FEIR of the
Eastern Dublin General Plan p~endment and Specific Plan as
conditions of approval, and 3) the application of Action Programs
of the Specific Plan as conditions of approval. The mitigation
measures are 03.04/01.0; 03.04/02.0; 03.04/04.0 through
03.04/13.0; 03.06/15.0; 03.06/16.0; and the action prograEs are

interference with an emergency response plan or an emergency
evacuation plan because it does not physically impact either

11. POPULATION. The project will not alter the location,
distribution( density or growth rate of the human population of
an area because no humans inhabit the project site or will
inhabit the project site.
12. HOUSING. The project will not effect existing housingr or
create a demand for additional housing because no housing exists
on the project site or will exist on the project site and because
sufficient housing exists or will exist in the Dublin area for
employees ..of businesses within the project. The following
specific plan policies and action programs although not
applicable to this project because it is a commercial project and
not a residential project will encourage affordable housing:
policies 4-7 through 4-10 j and Programs 4F through 41. The
following specific plan policies and action programs will help
Dublin achieve and maintain a balance of jobs and housing:
policies 4-26 and 4-27 and Action Program 4K which will be a
condition of approval. These measures would reduce any impacts
to housing of this project to a level of insignificance.
13. TRANSPORTATION/CIRCULATION. The project without mitigation
would result in the generation of substantial additional
vehicular movementj demand for new parkingj modifications to
existing transportation and traffic systems and alterations to
present patterns of circulation or movement of people and/or
goods. These impacts are mitigated by measures incorporeted into
the attached Traffic Impact Analysis for the Regional Discount
Retail Center in Dublin California dated Novemberr 1994, and by
the following Mitigation Measures of the Eastern Dublin General
Plan Amendment and Specific Plan FEIR including an addendum to
the DEIR dated May 4, 1993 and an addendum to the FEIR dated
August 22, 1994j and Action Programs of the Specific Plan:
Mitigation Measures 03.03/01.0j 03.03/02.1 through 03.03/16.1
03.12/07.0j and Action Programs SA through 5D and 5G which are
incorporated as conditions of approval of the project. In
addition, a traffic Impact Study prepared for this project
addresses the specific impacts of the Santa Rita Commercial
Center. Mitigation measures of the Eastern Dublin General Plan
Amendment and Specific Plan FEIR and of the Traffic ,Impect study
are included as conditions of approval of the project and will
reduce impacts of the project to transportation/circulation to a
level of insignificance.
The project will not result in alterations to waterborne( rail or
air traffic because none of those facilities are near the
project. The project will not result in increases in traffic
hazards to motor vehiclesr bicyclists or pedestrians due to the
design of the project and incorporation of mitigation measures .

14. Public Services: The Santa Rita Commercial Center will
require some of the improvements or service increases that were
planned for in the Eastern Dublin Specific Plan. Mitigation
measures of the FEIR required certain studies be performed to
determine service and improvement needs at the time of
development of projects. Therefore, service or improvements
relating to fire and police protection, schoolsr parks (
government services and facilities will be determined by these
studies. The studies are presently being performed and will be
completed prior to the City and Applicant entering into a
Development Agreement. Prior to any development occurring in the
Eastern Dublin Specific Plan Arear a Development Agreement is
required between the City and Applicant pursuant to the Eastern
Dublin Specific Plan. The Applicant's fair share of improvements
and increased service will be determined and contained in the
Development Agreement. Mitigation measures in the FEIR that will
be implemented as conditions of this project include: 03.12/05.0j
03.12/08.0j 03.04/02.0j ..03.04/04.0j 03.04/06.0 through
03.04/13.0j 03.04/16.0; 03.04/17.0; 03.04/18.0j 03.04/20.0;

area to a level of insignificance.
15. Energy: The development proposed is for a cOThuercial
center and wpuld not use substantial amounts of energy.
Mitigation measures 03.04/45.0 and 03.04/46.0 relate to
demonstration projects of cost effective energy conservation
techniques and the incorporation of energy conservation measures
into the design, construction( and operation of the development.
These mitigation measures and their corresponding conditions of
approval will mitigate any impacts in this topic area to e level
of insignificance.
16. utilities: The Eastern Dublin Specific Plan anticipeted and
planned for expansion of major utilities to the site. Although
expansion was plannedr as development occurs, the location of the
lines will have to be determined.
The Dublin San Ramon Services District (DSRSD) has been
developing plans to serve the Santa Rita Commercial Center with
potable water and wastewater services_ and has the wastewater
capacity to serve this project. Figure 3 is a copy of the
proposed alternative routes for these services. These routes are
generally consistent with schematic routes shown in the FEIR.
The alternatives would either locate lines within an area alreadY
disturbed by the BART construction project or replace existing -
lines within the public right of way. Although some of the
improvements are outside of the Specific Plan Arear they are in
areas that are not environmentally sensitive because they are

located in disturbed areas . Additionally r the improvements
located within the Specific Plan Area are not indicated as
biologically sensitive in the FEIR. DSRSD will be required to
adhere to mitigation measures located in the FEIR to ensure that
no significant environmental impacts occur. These Mitigation
Measures are referenced at the end of this section of the Initial
study and also within other sections of this Study.
The FEIR also considered solid waste, power and natural gasr
water, sewerr septic tanks and storm water drainage and developed
mitigation measures to ensure environmentally sensitive provlslon
of these services. The city's site Development Review procedure
coordinates review of the site with the various utilities. At
that time( locations of structures and utilities will be more
clearly defined. Mitigation Measures were included in the FEIR
to ensure that the extension of DSRSD and other services would
not create significant environmental impacts. Inclusion of the
following implementing actions( action programs and mitigation
measures from the FEIR, and corresponding conditions of approvalr
will mitigate any impacts to utilities to a level of
insignificance: Specific Plan Implementing Actions 11.2.10 and
11.3.3j Action Programs 6E through 6Ij 8H; 8Kj 8L; 9A through 9C;

17. Human Health: The project consists of primarily vacant land
that was previously developed with the Santa Rita Jail Facility.
In the southwest corner of the siter adjacent to Hacienda Drive
are the partial remains of the Madigan Building( which was a
portion of jail facility. A portion of the Madigan Building was
removed during the construction of Hacienda Drive. "However,
building surveys have indicated that the remaining portion of the
building contains asbestos. Removal of the building will be
completed prior to construction on the site. Standard building
demolition practices require that removal of asbestos be
undertaken in a manner that will not endanger either the general
public's health nor that of the construction workers.
The site also had two underground storage tanks that have been
removed. Alameda County Environmental Health monitors the site
for a period of time after the removal of the tanks. At the
present timer the monitoring period has not been completed. As
part of the site Development Review process, staff routinely
coordinates between the reviewing agencies to ensure that the
monitoring process is completed prior to issuing building permits
over the area. In general ( co~~ercial land use does not pose any
significant risk that substances and/or machinery stored will
create or expose people t~,health hazards. The list of permitted

and conditional uses has been designed so that there would not be
any impacts to human health from the development.
