DESCRIPTION: At the meeting on January 31, 1995, Mayor Houston requested
Staff to review and report on Senate Bill 2 (Kopp) regarding Local Government Term Limits.
This report is designed to provide information related to Senate Bill 2 (Kopp) and the potential
impacts on the City. .
Senate Bill 2 addresses existing law in both the Government Code and the Education Code.
The current law does not authorize the imposition of limitations on the number of terms that
individuals may serve on governing bodies of local government agencies.
The Bill would expressly authorize the governing bodies of county boards of education, school
districts, community college districts, other special districts, boards of supervisors, city council
or residents of those respective entities to submit a proposal to the electors to limit the number
of terms of a member of the governing body.
The California Constitution requires the State to reimburse local agencies and school districts
for certain costs mandated by the State. Since the bill would create additional duties for
election staff, the bill is considered a State mandated program. However, the bill provides that
no reimbursement shall be made from the State Mandates Claims Fund for these costs.
Senate Bill 2 only recognizes that local agencies may pursue available remedies to seek
reimbursement for these costs.
The League of Cities is neutral on this bill due to the fact that the bill only authorizes the ability
of an agency to establish term limits.
