GENERAL INFORMATION PROJECT: Jay & Veena Kinhal's request for a Conditional Use Permit to allow the continued operation of a Preschool at 7890 Oxbow Lane APPLICANT, REPRESENTATIVE AND PROPERTY OWNER: Jay & Veena Kinhal 7872 Oxbow Lane Dublin, California 94568 LOCATION: 7890 OxbO\v Lane Dublin, California 94568 ASSESSOR PARCEL NUMBER: 941-172-51 PARCEL SIZE: 6,600 sq. ft. EXISTING ZONING AND LAND USE: R-I-B-E (Single Family Combining District) single family house SURROUNDING LAND USE AND ZONING: North: South: Single Family residential, R-I-B-E Multi-family residential & office, C-O & R-S-D-20 Single Family residential, R-I-B-E Preschool Facility, R-l-B-E East: West: ZONING HISTORY: 1/28/73 - A Conditional Use Permit was approved to allow a preschool for 30 children. 6/18/75 - A Conditional Use Permit was approved to allow the continued operation of a preschool for 34 children. 10/29/80 - A Conditional Use Permit was approved to allow the continued operation of a preschool for 34 children; permit expires on 10/29/85. 1/3/84 - A Conditional Use Permit was approved to allow a daycare center on the adjacent property; this permit was never activated and has since expired. APPLICABLE REGULATIONS: Section 8-26.3 of the Zoning Ordinance requires that a Conditional Use Permit be obtained from the Planning Commission for the establishment or a Community Facility, which includes day-care centers when proposed within a single family zone. ----------------------------------------------------------------- :. ITEM NO. 1/ "~I Section 8-63.0, 8-63.4, 8-63.17 require that a single family home have two parking spaces; that thse spaces cannot occupy a front yard; and that the required parking shall be provided and maintained when a use is established and/or a building is structurally altered. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 Permit may be valid contingent upon the conditions. ENVIRONMENTAL REVIEW: states the only for a acceptance approval of a Conditional Use specified term, and may be made and observance of specified Categorically exempt NOTIFICATION: Public Notice of the 8/5/85, hearing was published in the Tri-Valley Herald, mailed to adjacent property owners, and posted in public buildings ANALYSIS: Mr. & Mrs. Kinhal are requesting an extension of their Conditional Use Permit to allow the continued operation of a preschool for 34 children at 7890 Oxbow Lane. The Conditional Use Permit was originally granted by Alameda County on 1/28/73 and was subsequently extended on 6/18/75 and 10/29/80. The Dublin Planning Commission approved a Condition Use Permit on 1/3/84 to allow a daycare center for 16 children at the adjacent home immediately to the east; this permit was never activated and has since expired. There appears to be a tremendous demand for preschool and daycare facilities in the Dublin area. Staff has previously supported these applications, provided potential problems were minimized or eliminated altogether. In this case, there have been no reported problems. Therefore, Staff recommends the application be approved. RECOMMENDATION FORMAT: 1 ) Open public hearing and hear staff presentation 2~ Take testimony from applicant and the public / 3) Question staff, applicant and the public 4) Close public hearing and deliberate 5) Adopt Resolution regarding the Conditional Use Permit ACTION: Staff recommends that the Planning Commission adopt the attached Resolution (Exhibit "A") approving Jay and Veena Kinhal's request for a Conditional Use Permit to allow the continued operation of a preschool at 7890 Oxbow Lane. ,~< / -2- ATTACHMENTS Exhibit A - Draft Resolution Exhibit B - Site Plan Background Attachments 1 - location Map COPIES TO Jay & Veena Kinhal -3-
