CONDITIONAL USE PERMIT, C-3888
Application for a CONDITIONAL USE PERMIT to allow continued operation of a community
facility (pre-school) in an "R-I-B-E" (Single Family Residence, 6500 Sq. Ft. Minimum
Building Site Area, 65' Median Lot Width, 20' Front Yard, 6' Side Yard) District, located
at 7890 Oxbow Lane, east side, at the southeast corner of the itnersection with Starward
Drive, Dublin, Assessor's No. 941-172-50.
PER TINENT FACTS:
History: January 28,1973, Conditional Use Permit (C-2567) was approved to permit
a nursery school for a maximum of 30 pre-school children subject to compliance with
applicable codes, provision of two conforming off-street parking places, and with expiration
January 24,1975.
June 18, 1975, Conditional Use Permit (C-2963) to allow continued operation of
a Community Facility (nursery school) was conditionally approved subject to:
I) Driveway opposite Oxbow Lane shall be used for employee parking at all times
the facility is in operation; 2) The maximum number of children shall be 34, permit
valid until June 16, 1980.
July 2, 1980, Conditional Use Permit (C-3819) to allow continued operation of community
facility (nursery shcooI) was conditionally approved subject to: I) Maximum number
of children shall be 34; 2) Permit is not transferable; 3) Permit shall be valid until
July 2, 1985.
Size of Parcel: Width 81', depth 108' area 8,748 square feet.
Physical Features: Property is a corner lot with an original single family residence
which has been converted to nursery school use. There are near minimum front and
side yards and a rear yard approximately 47' in depth.
Adjacent Area: A fenced flo6d c~ntrol channel crosses the property at the rear lot
line beyond which is a medical'dental office building. Other adjoining land use consists
of single family residences.
General Plan Designation: Low density residential.
Environmental Impact: Categorically exempt, class 5, example h.
PLANNING CONSIDERA nONS:
Applicant has purchased nursery school business from former permit holder. Previous
permit prohibited transfer. Applicant is attempting to secure use permit and
continue operation of school.
The residential use on the site has been discontinued. All facilities are devoted
to the nursery school use. Applicant has not indicated whether this condition will
remain.
Nursery school use has been operating on the property since January 28, 1973.
To date of this printing, no complaints have been received concerning this use
in the last 5 years.
FINDINGS REQUIRED:
1. Is the use required by the public need?
Yes. Public need is demonstrated by the successful operation of the nursery school.
2. Will the use be properly related to other land uses and transportation and service
facilities in the vicinity?
Yes. The nursery school is located adjacent to business uses and residential uses
in the area. Adequate automobile access occurs and necessary services and facilities
are available.
