SURROUNDING LAND USE AND ZONING: North: Single Family Residential, R-l South: Single Family Residential, R-l East: Single Family Residential, R-l West: Single Family Residential, R-l I / ZONING HISTORY: No previous zoning actions on this site have been taken by the City; Alameda County records do not indicate any zoning actions. APPLICABLE REGULATIONS: Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. ~----------------------------------------------------------------- .. ENVIRONMENTAL REVIEW: states the only for a acceptance approval of a Conditional Use specified term, and may be made and observance of specified Categorically exempt NOTIFICATION: Public Notice of the 7/1/85, hearing was published in the Tri-Valley Herald, mailed to adjacent property owners, and posted in public buildings ANALYSIS: Murray School District is requesting a Conditional Use Permit to relocate four portable classrooms from the Donlon School site in Pleasanton and the Cronin School site in Dublin to the Wells Intermediate school site. The four classrooms are proposed to be located behind four existing portable classrooms, directly west of the multi-purpose room. The School District indicates there is a need for the portable classrooms because of an increase in enrollment from 644 in 1984-85 to 745 in 1985-86. This increase in enrollment is a result of the closing of Fredericksen School. Staff does not have a problem with this request, provided landscaping is installed to soften and screen the portable classrooms and the mechanical equipment is screened from view. Staff believes these improvements are necessary since the portable classrooms are proposed to be located wi thin 33' of the rear property lines on Lancaster Road. The School District has indicated they will install four planter boxes between the portable classrooms and homes on Lancaster Road. However, staff believes it is necessary to plant 15 gallon trees between the portables and homes to adequately screen and soften the appearance of the portables. Further, staff believes it is appropriate to screen the mechanical equipment. RECOMMENDATION FORMAT: 1) Open public hearing and hear staff presentation 2 ) Take testimony from applicant and the public 3 ) Question staff, applicant and the public 4 ) Close public hearing and deliberate 5 ) Adopt Resolution regarding the Conditional Use Permit ACTION: Staff recommends the Planning Commission adopt a Resolution (Exhibit "A") which approves Murray School District's request to locate four portable classrooms at Wells Intermediate School. ) ATTACHMENTS Exhibit "A" Draft Resolution approving Conditional Use Permit Background Attachments: 1) Letter from Murray School District dated 6/17/85 2) Site Plan COPIES TO Applicant Building Inspection Department ~ -2- RESOLUTION NO. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 85-051, MURRAY SCHOOL DISTRICT CONDITIONAL USE PERMIT TO LOCATE FOUR PORTABLE CLASSROOMS AT WELLS INTERMEDIATE SCHOOL, 6800 PENN DRIVE WHEREAS, Stanley Maleski, representing Murray School District, filed an application for a Conditional Use Permit to locate four portable classrooms at Wells Intermediate School; and WHEREAS, the Planning Commission did hold public hearing on said application on July 1, 1985, and; WHEREAS, proper notice of said public hearing was given in all respects as required by law, and; WHEREAS, the request is categorically exempt in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a Staff Report was submitted recommending the application be conditionally approved, and; WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby find: a. The use is required by the public need to provide classroom space for the general public. b. The use would be properly related to other land uses and transportation and service facilities in the vicinity. c. The use, if permitted under all circumstances and conditions of this particular case will not materially affect adversely the health, safety or persons residing or working in the vicinity or be materially detrimental to the public welfare or injurious to property or improvements in the area, as all applicable regulations will be met. d. The use will not be contrary to the specific intent clause or performance standards established for the district in which it is to be located. e. The approval of the use permit will be consistent with the policies in the Dublin General Plan. BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby approve said application as shown on Exhibit A on file with the Dublin Planning Department and subject to the following conditions: Unless otherwise specified, all conditions shall be complied with prior to operation of the portables. -1- r~~~l. l"B}T It Ll '>~ .1.. ~ ~ J:1---- 1) A Landscape Plan shall be approved by the Planning Department for the area between the new portable classrooms and the homes on Lancaster Drive. Said plan shall include, but not be limited to, 15 gallon trees planted 20' on center. 2) The mechanical equipment on top of the classrooms shall be screened from view. 3) This Conditional Use Permit is valid until 7/1/88 and shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Box 2340 Dublin, CA 94568 Dear Sir: The Murray Elementary School District is applying for a conditional use permit to relocate four portable classrooms from our Donlon School site in Pleasanton to the Wells Intermediate School site at 6800 Penn Drive, Dublin. The portable classrooms are needed to accommodate the increase in enrollment at the school from 644 in 1984/85 to 745 in 1985/86. The enrollment increase is the result of the closing of Frederiksen School as an intermediate school within the District. The action to close Frederiksen School was taken by the Board of Trustees after hearing from a Citizens' Advisory Committee as set forth in the California Education Code, and was taken to better meet the educational needs of the students as well as increased fiscal economy within the District. The four portable classrooms will be located behind four classrooms that currently exist at the school site. The entire area around the portable classrooms will be paved and planter boxes will be installed to provide seating, shade and to soften the visual appearance of the portable class- rooms.
