A special meeting of the Dublin City Council was held on Wednesday, May 1, 2002, in
the Council Chambers of the Dublin Civic Center. The meeting was called to order at
8:02 a.m., by Mayor Lockhart.
ROLL CALL
PRESENT: Councilmembers McCormick, Oravetz, Sbranti, Zika, and Mayor Lockhart.
ABSENT: None.
PLEDGE OF ALLEGIANCE
Mayor Lockhart led the Council, Staff and those present in the pledge of allegiance to the
flag.
CLOSED SESSION
At 8:05 a.m., the Council recessed to a Closed Session to discuss:
1. CONFERENCE WITH LEGAL COUNSEL ~~ ANTICIPATED LITIGATION Significant
exposure to litigation pursuant to subdivision (b) (1) of GoVernment Code section
54056.9 (two potential cases) Facts and Circumstances: Government Code section
54956.0(b) (3)(B) East Dublin Properties Stage 1 Development Plan, Annexation and
Final Revised Supplemental Environmental Impact Report.
2. CONFERENCE WITH LEGAL COUNSEL :~ ANTICIPATED L!TIGAT!0N Significant
exposure to litigation pursuant to subdivision (b) (1) of Government Code section
54 956.9 (one potential case) Facts and Circumstances: Government Code section
54~56(b) (3)(D) [Livermore Area Park and Recreation District announcement of intent to
sue to challenge East Dublin Properties Final Revised Supplemental Environmental
Impact Report].

REPORT ON CLOSED SESSION ACTION
At 9:16 a.m., the Council returned from Closed Session. Mayor Lockhart announced that
there was no reportable action.
MEMORANDUM OF UNDERSTANDING BE~EEN
THE CITY OF DUBLIN AND THE CITY OF LIVERMORE
9:17 a.m. 8.1 (600-40)
City Manager Richard Ambrose advised that a couple of meetings had been held with the
Livermore Liaison Committee and staff to address concerns regarding land planning
issues in East Dublin. A Memorandum of Understanding had been prepared outlining
what the Liaison Committee came up with. In essence, Livermore has agreed to not
challenge our annexation.
City Attorney Elizabeth Silver reported that there were a few minor wording changes to
be made to the draft agreement.
Paragraph 6. Conservation Easements. The 4t~ sentence reads, ~In the specific plan
prepared for development in the project area outside of the Eastern Dublin Specific Plan,
Dublin agrees to include a policy that requires the City to use its best efforts to secure
conservation easements or similar instruments that would permanently restrict
development outside of a reasonable development envelope on the lands designated RRA."
This sentence was corrected to read, "Dublin agrees to adopt a policy that requires the
City to use its best efforts to secure conservation easements or similar instruments that
would permanently restrict development outside of a reasonable development envel°pe
on the lands designated RRA in the project area."
Paragraph 9. Regional Transportation Funding. The 3ra sentence reads, ~The Cities shall
form a transportation committee that meets at least quarterly..."
This sentence was corrected to read, ~The Cities shall form a transportation committee
that meets as necessary...
Paragraph 12. Central Parkway Alignment. The paragraph reads, '~Dublin has approved
a revised alignment for Central Parkway that merges Central Parkway with Dublin
Boulevard within the project area east of Fallon Road. See Exhibit C [h'xure 2~Kfrom
reused supplementall)£II~, attached hereto. The existing land use map in Dublin's

General Plan does not depict the revised alignment for Central Parkway. No later than
June 21, 2002, the Dublin City Council shall take action on the proposed GPA amending
the land use map of its General Plan to depict the revised alignment for Central
Parkway."
This paragraph was corrected to read, ~The Dublin General Plan includes a conceptual
alignment for Central Parkway that merges Central Parkway with Dublin Boulevard
within the project area east of Fallon Road. See Exhibit C [/?~7.tre 2~K£rom revised
supplemcntall~£IR], attached hereto. The existing land use map in Dublin's General
Plan does not depict the correct conceptual alignment for Central Parkway. No later than
June 21, 2002, the Dublin City Council shall take action on the proposed GPA amending
the land use map of its General Plan to depict the correct conceptual alignment for
Central Parkway."
Mayor Lockhart clarified that these changes were made with the Livermore people in
attendance and this was more of a computer glitch.
Cm. McCormick stated she was on the Liaison Committee and she felt all parties sat
together in a spirit of cooperation. Both sides wanted to come to agreement. This was a
refreshing way to work. She is pleased with the outcome.
Mayor Lockhart stated she also appreciates the attitude and spirit with which this was
put together by four Councilmembers and Staff of both cities. This is a new way of doing
business rather than filing a lawsuit.
On motion of Cm. Zika, seconded by Cm. Sbranti, and by unanimous vote, the Council
approved the Memorandum of Understanding between the City of Dublin and the City of
Livermore regarding Land~Use Planning Issues of Mutual Concern with the corrections
as discussed.
OTHER BUSINESS
9:20 a.m.
Mayor Lockhart announced that today, May 1 ~t, Mr. Ambrose celebrates his 20th
anniversary with the City of Dublin. She presented a handshake award and cookie and
congratulated him on reaching this milestone.
