FINANCIAL STATEMENT:

It is anticipated that the cost to construct the roadway will be borne by the
County of Alameda and/or by the Eastern Dublin Traffic Impact Fee.
DESCRIPTION:
The proposed right-of-way is a portion of Dublin Boulevard as shown on the
General Plan and the East Dublin Specific Plan. Thei construction of this portion of
Dublin Boulevard is necessary to connect the developed area of the City of Dublin
with the approved Eastern Dublin Specific Plan. The establishment of this right-of-
way is required for the construction of this portion of Dublin Boulevard and is
governed by Chapter 7.68 of the Dublin Municipal Code. The location of the right-
of-way is as shown on a map showing the right-of-way study area (Exhibit 5), and
more specifically in the legal description (Exhibit 6) and the Street Cross Section
(Exhibit 7).
The area which makes up the right-of-way line is presently vacant and is
owned by Alameda County and the U.S. Army. Alameda County will dedicate the
portion of the Dublin Boulevard right-of-way east of Arnold Road. It is anticipated
that Alameda County will be able to construct the road west of Arnold Road
(through Camp Parks) by a right-of-entry agreement with the U.S. Army. It is .
estimated that the costs for design and improvement of the road will be
approximately $ 5.5 million.
The proposed project would consist of a roadway with a minimum right-of-
way of one hundred and forty-two (142) feet and a maximum right-of-way of one
hundred and forty-eight (148) feet. The minimum paved section would be eighty-
eight (88) feet and the maximum paved section would be one hundred thirteen
(113) feet. The roadway would have six (6) lanes with additional left and right turn
lanes as needed. The roadway and right-of-way would run from the eastern BART
access drive to Hacienda Drive. The site area consists of relatively flat land lying
north of the Eastern Dublin BART station. This roadway would be able to
accommodate approximately 50,000 average daily trips.
A Negative Declaration has been prepared pursuant to the California
Environmental Quality Act (CEQAl, State CEQA Guidelines and the City of Dublin
Environmental Guidelines. The proposed project will not have a significant effect
on the environment.
On July 25, 1995, with the recommendation of the Planning Commission
and Staff, the City Council adopted a Resolution of Intention (Exhibit 8) to establish
the right-of-way line. .

ESTABLISHING A RIGHT-OF-WAY LINE FOR DUBLIN BOULEVARD FROM
THE EASTERN BART ACCESS ROAD TO HACIENDA DRIVE
The City Council of the City of Dublin does ordain as follows:
WHEREAS, the City Council adopted a Resolution of Intention calling for a public
hearing to consider a future right-of-way line for Dublin Boulevard from the eastern BART
access drive to Hacienda Drive (Resolution 80-95) and set a public hearing for August 8.
1995. at 7:00 p.m. to hear objections to the establishment of said right-of-way line; and
WHEREAS. proper notice of said public hearing was duly given; and
WHEREAS. no protests were made either in writing or orally to the establishment of
said right-of-way line.
NOW. THEREFORE. the City Council finds and ordains that:
Section 1. A Right-of-Way line is hereby established for Dublin Boulevard from the
eastern BART access drive to Hacienda Drive as follows:

Chapter 7.68 of the Dublin Municipal Code.
Section 3. EFFECTIVE DATE AND POSTING OF ORDINANCE. This Ordinance shall
take effect and be in force thirty (30) days from and after the date of its passage. The City
Clerk of the City of Dublin shall cause this Ordinance to be recorded with the County
Recorder and posted in at least three (3) public places in the City of Dublin in accordance
with Section 36933 of the Government Code and the State of California.

FROM THE EASTERN BART ACCESS DRIVE TO HACIENDA DRIVE
PURSUANT TO CHAPTER 7.68 OF THE DUBLIN MUNICIPAL CODE
The project consists of a roadway with a minimum right-of-way of one hundred and forty-
two (142) feet and a maximum right-of-way of one hundred and forty-eight (148) feet.
The minimum paved section would be eighty-eight (88) feet and the maximum paved
section would be one hundred thirteen (113) feet. The roadway would have six (6) lanes
with additional left and right turn lanes as needed. The roadway and right-of-way would
run from the eastern BART access drive to Hacienda Drive. The site area consists of

CONCERNING THE ESTABLISHMENT OF A RIGHT-OF-WAY LINE FOR DUBLIN
BOULEVARD FROM THE EASTERN BART ACCESS DRIVE TO HACIENDA DRIVE
WHEREAS, the California Environmental Quality Act (CEQAI, as amended together
with the State's administrative guidelines for implementation of the California Environmental
Quality Act, requires that certain projects be reviewed for environmental impacts and that
environmental documents be prepared; and
WHEREAS, pursuant to Public Resources Code Section 21000 et seq. a Negative
Declaration of Environmental Significance has been prepared by the Dublin Planning
Department; and
WHEREAS, the Planning Commission determined that the project (establishment of
right-of-way line for Dublin Boulevard from the eastern BART access drive to Hacienda
Drivel will not result in the potential creation of any significant environmental impacts
identified in the Initial Study of Environmental Significance.
NOW, THEREFORE. BE IT RESOLVED that the City Council finds that the Negative
Declaration of Environmental Significance has been prepared and processed in accordance
with State and Local Environmental Law and Guideline Regulations, and that it is adequate
and complete and that the City Council hereby adopts the Negative Declaration.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ADOPTING A RESOLUTION OF INTENTION TO ESTABLISH A RIGHT-OF-WAY LINE FOR
DUBLIN BOULEVARD FROM THE EASTERN BART ACCESS DRIVE TO HACIENDA DRIVE
RECITALS
The City Council of the City of Dublin does resolve as follows:
The Council has received a report and recommendation from the Planning Commission
recommending the establishment of a right-of-way line for Dublin Boulevard from the eastern BART
access drive to Hacienda Drive. It is the intention of the City Council to establish a right-of-way line
for the abovesaid road.
Pursuant to the provisions of Sections 7.68.080 through 7.68.100 of the Dublin Municipal
Code, the City Council hereby calls a public hearing on August 8, 1995, at 7:00 p.m. in the City
Council Chambers, 100 Civic Plaza, Dublin, California, to hear protests and objections to the
establishment of the proposed right-of-way line hereinafter set forth:
Dublin Boulevard from the eastern BART access drive to Hacienda Drive
. All that certain real property situated in the City of Dublin, County of Alameda, State of
lifornia, described on Attachment 1.
A copy of this Resolution shall be posted in accordance with Section 7.68.070 of the Dublin
Municipal Code at least ten (10) days before the date of the hearing.
Any person having any interest in any land as described above upon which said right-of-way
lines are proposed to be established may file a written objection with the City Clerk at any time no
later than the hour set for hearing objections.
