HomeMy WebLinkAboutOrd 12-83 Loitering ORDINANCE NO. 12 - 83 AN ORDINANCE OF THE CITY OF DUBLIN PROHIBITING LOITERING THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS: Section 1. PROHIBITED CONDUCT It is unlawful for any minor under the age of eighteen (18) years to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public .places and public buildings, places of amusement and eating places, vacant lots or any unsupervised place between the hours of 10:00 p.m. and daylight immediately following. Section 2. EXCEPTIONS The provisions of Section 1 do not apply when the minor is accompanied by his or her parents, guardian or other adult person having the care and custody of the minor, or when the minor is upon an errand directed by his or her parent or guardian or other adult person having the care and custody of the minor or when the minor is en route to or returning directly home from a meeting, entertainment, recreational activity, dance or on the way to or from employment. Section 3. VIOLATION OF THIS ORDINANCE Each violation of this Ordinance shall constitute a separate offense; and, persons violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction, shall be punished by a fine not to exceed $500.00 or by imprisonment in the county jail for a period not exceeding thirty (30) days, or both such fine and imprisonment. Section 4. POSTING OF ORDINANCE The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Sec%ion 36933 of the Government Code of the State of California. Section 5. SUPERSESSION OF COUNTY ORDINANCE It is the intention of the City Council of the City of Dublin that as of the effective date of this Ordinance, it shall supersede the effectiveness of Section 4-25.0 of the County of Alameda County Ordinance Code as implemented and adopted by Ordinance No. 1 of the City of Dublin. However, it is not intended that this Ordinance shall supersede any other portion of the Alameda County Ordinance Code, insofar as said provisions are consistent with this Ordinance.
