DESCRIPTION: The uniform model construction codes are adopted and published by
the California Building Standards Commission and by the California Department of Housing and ~,
Community Development on a three-year cycle. The provisions of this ordinance shall take effect on
January 1, 1996 pursuant to Government Code section 36937 as an urgency ordinance. The urgency is
based on the fact that the State published and adopted the 1994 editions of the model codes on July 1,
1995. A 4/5 vote is required to adopt the ordinance as an urgency ordinance.
The uniform codes must be adopted by the City as published unless the City Council adopts a resolution
finding that changes or modifications are necessary due to local climatic; geological or topographical
conditions. A number of such changes or modifications were made by the Council when it adopted the
1991 uniform codes.

The proposed ordinance adopting the 1994 model codes contains most of the same changes which were .
included in the City's adoption of the 1991 codes, except as noted in the following paragraphs. Some f
previous changes have been eliminated because the 1994 codes have incorporated these changes. For
example, current State law (1994 codes) now requires all new roofs, including re-roofmg, to be a
minimum Class C fire-retardant roof. Therefore, the City's prior change requiring Class C roofs is no
longer required.

The proposed ordinance will streamline Chapters 7.28, 7.32, 7.40, 7.44 and 7.48 of the Dublin Municipal
Code which has many benefits for the City which include the following:
1. To ensure consistency with neighboring jurisdictions and the Bay Area.
2. To provide internally consistent, coherent and easier to use codes for City Staff.
3. To make it clearer for the public to review and to understand the uniform code
requirements.
The Rroposed ordinance does not adopt the Administration Chapters of the uniform codes which include
the permit fee tables, thus maintaining the City's current permit fees.
The provisions of the 1994 edition of the Uniform Building, Mechanical, Plumbing and Housing Code
have been reformatted into a "common code" format. The new format establishes a common format of
chapter designations for the three model codes published in the United States. A number of minor
changes to the Dublin Municipal Code are required as a result of the reformatting.

There are 2 sections of the Municipal Code that would be an referenced to an incorrect section of
the uniform code.
There are 12 sections of the Municipal Code that are in the new 1994 uniform code. These
Municipal Code sections are therefore no longer necessary.
There are 5 sections of the Municipal Code that would adopt the new uniform codes.
There is one section that coincides with State Law.
There are 13 new proposed changes to be added to the Dublin Municipal Code which are in
addition to changes carried over from 1991 (discussed in more detail below).

SUMMARY OF PROPOSED CHANGES TO THE DUBLIN MUNICIPAL CODE:
1. Section 22 (Section 7.32.260 of the Dublin Municipal Code) is modified to require an automatic
fIre-extinguishing system when of Type V construction (which is construction consisting of the
lowest degree of fire resistance, in other words, buildings constructed of wood frame
construction). and when floor area exceeds 3,000 square feet in all occupancies except Group R,
Division 1 and 3 (which are single-family residences and multi-family residences).
The potential impact to buildings within the City of Dublin would total five (5) existing buildings.
The existing Dublin Municipal Code requires automatic fire-extinguishing systems in buildings
having areas in excess of 5,000 square feet. This requirement would only be triggered in existing e-.
buildings where square footage is added to the building. All proposed new buildings with areas
greater than 3,000 square feet would be required to have an automatic fire-extinguishing system.

Section 23 (Section 7.32.260 of the Dublin Municipal Code) modifies the Uniform Building Code
to require an automatic fire-sprinkler system when any building except (private garages and utility
buildings) are located more than 1 'is miles from a fire station. This is an existing requirement of
the Dublin Municipal Code.
Section 25 (Section 7.32.270 of the Dublin Municipal Code) adds a requirement of a minimum of
one 1/2" diameter top and bottom reinforcement in all continuous foundations. This amendment is
necessary because the City of Dublin is within a very active seismic area (Seismic Zone 4) and
local soil conditions can be highly expansive clay soils. The Northridge earthquake provided
hundreds of examples of damage to plain concrete footings. This type of damage is extremely
expensive to repair, in contrast to the small expense of providing nominal footing reinforcement.
Footing reinforcement is also necessary to prevent damage due to pumping action caused by local
expansive soils which shrink and swell during seasonal drying and wetting conditions.

Section 26 (Section 7.32.271 of the Dublin Municipal Code) modifies the Uniform Building Code
to require slab reinforcement. This modification is necessary due to the expansive soil conditions
and this is a typical minimum requirement by soil engineers in the City of Dublin in order to avoid
damage due to soil expansion and shrinkage.

Section 27 (Section 7.32.272 of the Dublin Municipal Code) deletes the use of gypsum board for
lateral bracing. This deletion is necessary because the City of Dublin is located in Seismic Zone 4.
Gypsum wall~oard has performed poorly during recent California seismic events.

Section 28 (Section 7.32.273 of the Dublin Municipal Code) limits the use of portland cement
plaster for lateral bracing to single story residential. This limitation is necessary because the City
of Dublin is located in Seismic Zone 4. Exterior portland cement plaster has performed poorly
during recent California seismic events.
Section 29 (Section 7.32.274 of the Dublin'Municipal Code) adds a new paragraph to require
upgrade of suspended ceiling systems for alteration and repair projects. This amendment is
necessary to mitigate a known seismic hazard in existing buildings due to the City of Dublin's
proximity to local active faults.

Section 44 (Section 7.36.030 of the Dublin Municipal Code) limits the use ofNM and NMC
cables. The City of Dublin is located in the highly active seismic zone 4. Nonmetallic-sheathed
cable is not afforded the same protection from damage as wiring in a protective outer coating.
Damage to Nonmetallic-sheathed cable could occur in a seismic event which increases the
potential for a fire.
Section 50 (Section 7.40.105 of the Dublin Municipal Code) eliminates water piping in or under
concrete floor slabs within a building. This amendment is necessary for the following reasons:
1. Most of the surface soils in the City of Dublin are relatively young and unconsolidated
materials. The varying chemical composition, degree of weathering, and the relatively acid
environment have created soils of varying types, which are particularly corrosive in nature.
2. Much of the surface soil in the City of Dublin is highly expansive (i.e., shrink - swell behavior).
3. The local climate is characterized by markedly delineated rainy and dry seasons, which tend to
maximize the expansive characteristics of soil.
e' 4. Some parts of the City of Dublin have hard water, which is corrosive to ferrous pipe.
5. The groundwater table is unusually high in many places.
6. The City of Dublin is a highly active seismic area.

Section 51 (Section 7.40.110 of the Dublin Municipal Code) requires backflow protection if
drainage piping serving fixtures is less than 12 inches above the next upstream manhole. This
requirements is necessary due to the fact that the City of Dublin topography includes mountainous
and foothill areas with intermittent steep slopes. Also, the City of Dublin is located'in a
seismically active area, which increases the likelihood of breakage of building sewers and laterals,
leading to an above average potential of sewage back-up into buildings without adequate
protection.

11. Section 52 (Section 7.40.115 of the Dublin Municipal Code) adds a subsection regarding location
and termination of cleanouts. This subsection is necessary because the City of Dublin soils are
expansive in nature. These expansive soils create unstable conditions which increase the potential
_ of breaks in sewer laterals. To maintain health and sanitary services, it is necessary to gain access,
to periodically maintained public sanitary laterals. This is accomplished by the additional cleanout
as required above.
12. Section 53 (Section 7.40.120 of the Dublin Municipal Code) details cooling coil and comfort
cooling disposal and drain sizing. This amendment is required because the waste treatment
facilities serving the City of Dublin is operating at or near maximum capacity. The discharge of
treated waste water into San Francisco Bay is detrimental to its sensitive ecosystem.
Cooling coil and comfort cooling equipment condensate waste discharge does not contain
pollutants which require treatment before being discharged into storm sewers or the ground.
13.
Section 59 (Section 7.44.080 of the Dublin Municipal Code) amends the code to comply with
local sanitation district requirements regarding disposal for condensate for HV AC systems. The
waste water treatment facilities serving the City of Dublin is operating at or near maximum
capacity. The discharge of treated waste water into San Francisco Bay is detrimental to its
sensitive ecosystem.

AN ORDINANCE OF THE CITY OF DUBLIN AMENDING CHAPTERS 7.28, 7.32,
7.40, 7.44, and 7.48 OF THE DUBLIN MUNICIPAL CODE AND ADOPTING BY
REFERENCE THE 1994 UNIFORM BillLDING CODE, UNIFORM PLUMBING CODE,
UNIFORM MECHANICAL CODE, UNIFORM HOUSING CODE AND THE
1993 NATIONAL ELECTRICAL CODE AND DECLARING THIS ORDINANCE
TO BE AN URGENCY ORDINANCE TO TAKE EFFECT JANUARY 1, 1996
The City Council of the City of Dublin does ordain as follows:
SECTION 1
Section 7.28.120 of the Dublin Municipal Code is amended to read:
- Section 7.28.120 Existing Buildings, Structures, or Installations.
A. Except as required by Section ~ 310.9.1 of the Building Code, and Sections 7.32.280 and
7.40.130, buildings or structures, electrical, plumbing or mechanical installations in existence at the time
of the adoption of this chapter may have their existing use or occupancy continued if such use or
occupancy was legal at the time of adoption of the ordinance codified in this chapter and provided such
continued use is not dangerous or substandard and does not menace health, life or property.
B. Electrical, plumbing and mechanical systems installed in apartments, hotels and dwelling and
in existence prior to January I, 1975, shall be deemed to have conformed to applicable law in effect at
the time of installation and to have been maintained in good condition of currently in good and safe
condition and working properly.
KEASON: Municipal Code has been reformatted to a new section number.
SECTION 2
Section 7.28.170 of the Dublin Municipal Code is amended to read:
Section 7.28.170 Appeals.
A. Any person aggrieved with any decision of the Building Official in connection with the
application or interpretation of the provisions of this chapter or in the approval of alternate materials or
methods of construction may appeal to the City Council. Such appeal shall be in writing and filed
within ten (10) days.
B. The City Council may after hearing, interpret any provision of this chapter.
C. The City Council may after hearing vary the application of this chapter in any specific case
when in its opinion the enforcement thereof would be contrary to the spirit and purpose of this chapter or
public interest. The City Council in granting a variance may impose requirements or conditions to
mitigate any adverse effects that may result from granting a variance.
D. In making any such interpretation or granting any variance the City Council shall make the
following findings:
1. That the interpretation or variance is consistent with the purpose of this chapter;
2. That the interpretation or variance will not lessen the protection to the people of the city and
the property situated therein.

E. The City Council may approve alternate materials or methods of construction as set forth in
Section -H-:-W 7.28.140 by overruling the decision of the Building Official. In approval any alternate
materials or methods of construction the City Council shall make findings that the material, method or .. :',__'
work proposed is for the purpose intended, at least the equivalent of that prescribed by this chapter in
quality, strength, effectiveness, fire resistance, durability, dimensional stability and safety.
F. The City Council may appoint a Board of Appeals to hear any specific appeal. The Board of
Appeals shall consist of five (5) members qualified by training and experience to pass on matters
pertaining to the subject matter of the appeal and to serve until the disposition of the appeal. The Board
of Appeals shall have the same authority and duties as the City Council in interpreting this chapter,
granting variances, or approving alternate materials or methods of construction. The Building Official
shall be an ex officio member of the Board of Appeals and shall act as secretary to the board. The board
of appeals shall adopt reasonable rules and regulations for conducting its hearings and investigations.
The decision of the Board of Appeals shall be fmal.

SECTION 3
Section 7.28.290, of the Dublin Municipal Code is amended to read:
Section 7.28.290 Exceptions.
A. No permit shall be required for the following; however, permits shall be required for
electrical, plumbing and mechanical installations in any building or structure listed in subsections Al
through A18 of this section, and permits shall be required for all new construction and substantial
improvements that are located within an area of special flood hazard in which case a permit shall be
required as set forth in Chapter 7.24:

1. Open wire fences not more than sixteen (16) feet in height, masonry fences not more than six
(6) in height, and all other type fences not more than eight (8) feet in height;
2. Retaining walls which do not retain more than three (3) feet of earth when the earth retained is
level or where there is no surcharge load, and retaining walls which do not retain more than two
(2) feet of earth when the earth retained is sloping or which supports surcharge loads. See
Section 2516( c) 2317.11 of the Uniform Building Code for requirements for treatment of wood
used for retaining walls;
3. One-story detached accessory buildings used as tool and storage sheds, playhouses and
similar uses, provided the projected roof area does not exceed one hundred twenty (120) square
feet;
4. One-story buildings not more than four hundred (400) square feet in area used exclusively for
housing animals, poultry, livestock and similar animals and the storage of necessary food, hay or
grain for the animals housed therein;
5. ,Agricultural buildings as defined in Section ~ 202 of the Uniform Building Code on lots
exceeding twenty (20) acres in area which are located in an A zoning district and where the
principal use of the land is agriculture; ,
6. Lath houses and similar sun shade structure with roofs which do not shed water, which are not
more than ten (10) feet in height and one thousand (1,000) square feet in area;
7. Awnings over doors and windows of a Group R-3 or Group M!l:l Occupancy which are
entirely supported by the building and do not project more than fifty-four (54) inches;

8. Temporary construction offices, and storage sheds which are used on a site where there is a
valid building permit, grading permit, or which are used in connection with a construction
project where no building permit or grading permit is required; however, this provision shall not
apply to such building remaining on the site 30 days after the completion of construction;
9. Temporary construction offices and storage sheds when stored in a contractor's equipment
yard; however, this provisions shall not apply if such buildings are used for any purpose
whatsoever;
10. Raised decks which are less than thirty (30) inches above the ground at any point;
11. Treehouses or other structures which are designed to be used by children for play;
12. Flag poles, radio or TV antennas and towers, less than thirty-five (35) feet in height when
not attached to a building and less than twenty (20) feet in height when attached to a building,
except permits are required for dish type antennas more than four (4) feet in diameter;
13. Swimming, bathing, and wading pools, and fish ponds not exceeding twenty-four (24)
inches in depth;
14. Prefabricated swimming pools, spas, or hot tubs not exceeding four (4) feet in depth if
resting on the surface of the ground or a concrete slab on the ground;
15. Painting, papering and similar finish work;
16. Moveable cases, counters, and partitions not over five (5) feet nine (9) inches high;
17. Water tanks supported directly upon grade if the capacity does not exceed five thousand
(5,000) gallons and the ratio of height to diameter or width does not exceed two to one;
18. Water storage tanks of any size ifresting on the surface of the ground or on a concrete slab
on the ground when used only for watering livestock or irrigation;
19. The replacement of lamps or the connection of portable electrical appliances to suitable
receptacles which have been permanently installed;
20. Nonelectrical, signs less than eight (8) feet in height, nonelectrical signs which do not
exceed three (3) pounds per square foot nor four (4) inches in thickness when fastened flat
against the wall of any building and provided further that the sign does not extend above the top
of the wall of the building.
21. Clearing stoppages or repairing leaks in pipes, valves, fittings or fixtures when such repairs
do not involve the replacement or rearrangement of pipes, valves, fittings or fixtures;
22. Buildings and structures owned by a sanitary district used exclusively for storage, collection,
conveying and treating sewage;
23. A permit shall not be required for demolition or exploration work that may be necessary in
order to determine conditions in connection with a proposed addition or alteration to an existing
building if an application for a permit is on file and prior approval for the demolition or
exploration work is obtained from the Building Official;
24. A permit shall not be required for small or unimportant work when approved by the Building
Official;

B. Exemption from the requirement of a permit shall not be deemed to be permissible to viol~te
any provision of this chapter or any other law, ordinance, rule or regulation.
C. Although permits are not required by this section, any person may obtain inspection services . '
by applying for a permit for such work and paying the applicable fee.
REASON: This Municipal Code section has been reformatted to new section numbers, also the
occupancy groups have been revised.
SECTION 4
Section 7.28.410 of the Dublin Municipal Code is amended to read:
Section 7.28.410 Building Official - Authority to Deny Permit.
The Building Official may refuse to issue any permit where it cannot be demonstrated that:
A. The hazards of land slippage, erosion or settlement will be eliminated;
2. The proposed work will not be located on a trace of an active fault;
3. The proposed work will conform to Chapters 7.20 and 7.24;
4. The placement of existing fills has not been subject to continuous inspection by a special
inspector as required by Section ~ 1701.5.13 of the Uniform Building Code;
5. The private water supply will conform to Section WQ..l...6..Q.L.Q of the Uniform Plumbing
Code.
6. The private sewage disposal system required by Section 713.0 of the Plumbing Code will
conform to Section 7.10.110 7.40.140;
7. Whenever a licensed contractor has failed to make corrections as specified in Section .. ':
7.28.540 through 7.28.580.
REASON: This Municipal Code section has been reformatted to new section numbers. The
referenced Municipal Code section was incorrectly referenced.
SECTION 5
Section 7.28.590 of the Dublin Municipal Code is amended to read:
Section 7.28.590 Special Inspections.
.^>.. In addition to the inspection required to be made pursuant to Sections 7.28.540 through
~2g.580, the owner shall employ a special inspector who shall be present at all times during
construction of the follo'.ving 'Node:
A. In addition to the inspections required by sections 7.28.540 through 7.28.580. Special
Inspections shall be provided in accordance with Chapter 17 of the Uniform Building Code.
1. Dur.ng the placing of reinforced concrete and taking of test specimens when the structural
desigR is based on a fe in excess oftvlO thousand fi'le hundred (2,500) pounds per square inch;
2. Ductile moment resisting concrete frame. .^>.s required by Section 26250) of the Uniform

6. Structural masonry: during preparation of masonry wall prisms, sampling and placing of all
masonry units, placement of reinforcement, inspection of grout space, immediately prior to dosing of
deanouts and during all grouting operations,
Exception: special inspection will not be required for structures designed in accordance '.villi the
':alues in appropriate tables for noncontinuous inspection;

7. Reinforced gypsum concrete: '.vhen cast in place Class B gypsum concrete is being mixed
and placed;
8. Insulating concrete fill: during the application of insulating concrete fill when used as part of
a structural system;
9. Applying spray on fire roofing;
10. Pile driving;
11. Shotcrete: during the taking of test specimens and placing of all shotcrete and as required by
Section 26210) and (k) of the Uniform Building Code.
Exception: shotcrete work fully supported on earth, minor repairs and when, in opinion of the
Building Official, on special hazard exists;
12. Preparation of the site for the placement of fills, and installation of subsurface drainage
facilities, and the placement offill as required by Section 2903 of the Uniform Building Code;
13. V/hen required by the Building Official for special construction or work im'olYing unusual
hazards, new construction methods, special testing, or \vhich requires constant inspection.
.' '. B. Prior to the issuance of a permit, the o','lner shall submit a complete description of the testing
, and inspection program for .:ipproyal by the Building Official. '

C. The special inspector shall be a qualified person who has demonstrated his competence to the
satisfaction of the Building Official f-or inspection of the particular type of construction or operation -
requiring spedal inspection. Documentary evidence of such competence shall be submitted to the .' ,
Building Official for approval.
D. Inspection and testing agencies perf-orming special inspection for concrete and steel 'Nork
shall conform to the requirements of ,^..STM E329 (Recommended Practice for Inspection and Testing
Agencies for Concrete and Steels as Used in Construction);
E. The special inspector shall file a report that from personallmov:ledge the work performed
dur..ng the period covered by the report has been performed and that the materials used and installed are
in accordance with the plans and specifications. The term "personal knowledge" means the actual
detailed knowledge acquired by the special inspector dur..ng Bis personal eontinumg observation of
construction work at the construction site in all states of progress.
F. Vlhene':er the special[ inspector is aware that work that does not comply v:ith this chapter is
proceeding, the inspector shall immediately notify the Building Official. The special inspector or testing
af;ency shall immediately notify the Building Official when materials tested do not meet the strength
specified.
REASON: The Special Inspections are incorporated in the Uniform Building Code.
SECTION 6
Section 7.32.030 oftlte Dublin Municipal Code is amended to read:
Section 7.32.030 Adoption.
Certain documents, a copy of which is on file in the office of the City Clerk, being marked as "Uniform
Building Code," 199M Edition, Volumes 1.2 and 3 including Appendix Chapters 11, 12, Division II and
Division 111,23 Division II and 111,32,35, 19 and 55, and "Uniform Building Code Standards," 1991
Edition, 3 Division II. 4 Division I. 12 Division II. 15. 18. 31 Division III and 33 published by the
International Conference of Building Officials is hereby adopted by reference as the building code of the
city pursuant to the provision of Section 50022.1 et seq. of the Government Code of the state of
California except as hereinafter modified in Section 7.32.110 through 7.32.420 this chapter.
REASON: This Municipal Code section adopts the 1994 edition of the Uniform Building Code.

Section 7.32.110 oftlte Dublin Municipal Code is amended to read:
Section 7.32.110 Chapter 1, ~, Administration - Deleted.
Part 1, including Chapters 1,2 and 3 are is deleted.
REASON: This Municipal Code Administration section addresses Chapter 1 of the 1994 Uniform
Building Code. '

Section 7.32.120 Section 502, Chapter 5, Part III, 3405~ Chapter 34, Change in Use-
Deleted.
.. Section ~ 3405 is amended by deleting the third paragraph.
REASON: This Municipal Code section has been reformatted to reference a new section number
of uniform code.
SECTION 9

forth in Section 13113 of the Health and Safety Code are prohibited from using area separation walls in
lieu of automatic fire-sprinkler protection.

(d) Containment Deyiees. Each spring shall be equipped \'1ith an approved deyice capable of
restraining the spring or any part thereof in the event it brealcs.
(e) Identifieation. Springs shall be permanently identified as to manufacturer and also to .','
indioate maximum recommended stretch. Both springs and containment devices shall bear information
stating that they ha'le been manufactured in accordance with requirements of the California Department
of Housing and Community Development.
(t). Installation. Installation of springs, containment devices and hard'.vare shall be in
accordance '.'lith the manufacturer's installation instructions. Instructions shall be provided by the
manufacturer and shall specify the approved method of restraint and maximum recommended stretch.
Unless otherwise permitted by the manufacturer's installation instructions, the hardware and springs
shall be mounted to nominal 2 by 6 framing members which shall be of a species identified as Group I or
II in the Uniform Building Code Standards, Table No 25 17 J.
REASON: This Municipal Code section occurs in its entirety in the new uniform code.

operable window or door approved for emergency escape or rescue which sha:ll open directly into a

public street, public alley, yard or exit 0000. The units shall be operable from the inside to provide afull
clear opening without the use of separate tools.

All escape or rescue vnndows shall haye a minimum net clear openable area of 517 square feet. The
minimum net clear openable height dimension shall be 21 inches. The minimum net clear openable
width dimension shall be 20 inches. When vnndows are provided as a means of escape or rescue they
saall have a fmished sill height not more than 11 inches above the floor.
Bars, grilles, grates or similar devices may be installed on emergency escape or rescue vnndows or any
required exit door, proyided:
1. The devices are equipped \vith appro'led release mechanisms which are openable from the
inside vnthout the use of a key or special knowledge or effort; and
2. The building is equipped with smoke detectors installed in accordance '.vith Section 1210.
Such pars, grilles, grates or similar devices shall be equipped \vith an approyed release device for use by
the fire department only, on the exterior side for the purpose offire depar-..ment emergency access, when
required by the authority haYing jurisdiction.
REASON: This Municipal Code section occurs in its entirety in the new uniform code.

Section 6731 of the Business and Prof-essions Code of the State ofCaJifomia shall be prepared by a soil
engineer who is a civil engineer registered by the State of CaJifornia. Those portions of the investigation
that involve the practiee of geology as defined by Section 7802 of the Business and Prof~ssions Code of
the State of California shall be prepared by an engineering geologist registered and certified by the State
of California.
The investigation shall be based on observation and tests of the materials disclosed by borings or
excavations made in appropriate locations. f...dditional studies may be necessary to evaluate soil
strength, the effect of moisture variation on soil, bearing capacity, compressibility and expansiveness.
(d) Reports. The soil and geologic in':estigation report shall contain all of the information
requirements set forth in Chapter 7.16 us they may be applicable to the particular site and any
recommendations contained therein shall be su-bj ect to the approval of the Building Official.
The site development and all buildings and structures shall be designed and constructed in accordance
with the recommendations contained in the soil and geologic investigation reports.
(e) Final Report. Upon completion of rough grading '.york and prior to the approval of the
foundation for any proposed building or structure, a final grading report as set forth in Chapter 7.16 and
as built grading plan prepared by a registered civil engineer including original ground surface elevatiofi5;
as graded ground surface elevations, lot drainage and location of all surface and subsurface drainage
facilities.
REASON: The requirements for foundation investigations are outlined in Section 1804 of the
new Uniform Building Code.

': Except for Group R, Division 3 and Group M 11 Occupancies, an automatic sprinkler system shall be

1. In every story or basement of all buildings when the floor area exceeds 1,500 square feet
(139.4m~) and there is not provided at least 20 square feet (1.86m~) of opening entirely above the
adjoining ground level in each 50 lineal (15 240m) or fraction thereof of exterior wall in the story or
basement on at least one side of the building. Openings shall have a minimum dimension of not less
than 30 inches (762mm). Such openings shall be accessible to the frre department from the exterior and
shall not be obstructed in a manner that firefighting or rescue cannot be accomplished from the exterior.
When openings in a story are provided on only one side and the opposite wall of such story is
more than 75 feet (22860mm) from such openings, the story shall be provided with an approved
automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an
exterior wall of the story.
If any portion of a basement is located more than 75 feet (22 860mm) from openings required in
this section, the basement shall be provided with an approved automatic sprinkler system.
2. At the top of rubbish and linen chutes and in their terminal rooms. Chutes extending through
three or more floors shall have additional sprinkler heads installed within such chutes at alternate floors.
Sprinkler heads shall be accessible for servicing.
3. In rooms where nitrate film is stored or handled.
. 4. In protected combustible fiber storage vaults as defmed in the Fire Code.
. '.-~ 5. Throughout all buildings with a floor level with an occupant load of30 or more that is located

all Group A Occupancies (except of Type V construction) where the floor area exceeds 5,000 square feet

feet. Group A occupancies that are of Type V construction where the floor area exceeds 3.000 square
feet.

904.2.3.1 Drinking e~tablishments. An automatic sprinkler system shall be installed in rooms
used by the occupants for the consumption of alcoholic beverages and unseparated accessory uses where
the total area of such unseparated rooms and assembly uses exceeds 5.000 square feet (465 m.) (except
of Type V construction). For uses to be considered as separated. the separation shall not be less than as
required for a one-hour occupancy separation. The area of other uses shall be included unless separated
by at least a one-hour occupancy separation. Drinkin~ establishments that are of Type V construction
where the floor area exceeds 3.000 square feet (279 m )
" 904.2.3.2 Basements. An automatic sprinkler system shall be installed in basements classified as
a Group A Occupancy when the basement is larger than 1,500 square feet (139 m~) in floor area.
904.2.3.3 Exhibition and display rooms. An automatic sprinkler system shall be installed in
Group A Occupancies which have more than 12.000 square feet (112 m~) of floor area which can be
used for exhibition or display purposes.
904.2.3.4 Stairs. An automatic sprinkler system shall be installed in enclosed usable space below
or over a stairway in Group A. Divisions 2. 2.1. 3 and 4 Occupancies. See Section 1009.6.
904.2.3.5 Multitheater complexes. An automatic sprinkler system shall be installed in every
building containing a multi theater complex.

904.2.3.6 Amusement buildings. An automatic sprinkler system shall be installed in all
amusement buildings. The main water-flow switch shall be electrically supervised. The sprinkler main
cutoff valve shall be supervised. When the amusement building is tempora:r:y. the sprinkler water-supply
system may be of an approved tempora:r:y type.
EXCEPTION: An automatic sprinkler system need not be provided when the floor area
of a tempora:r:y amusement building is less than 1,000 square feet (92.9 m~) and the exit travel
distance from any point is less than 50 feet (15 240 mm).

Dublin has a dry period of at least five months each year. Additionally, the area is subject to
occasional drought. Because of dryness. a rapidly burning grass fire or exterior building fire can

FINDING: This section adds a requirement of a minimum of one 1/2" diameter top and bottom
reinforcement in all continuous foundations. This amendment is necessary because The City of
Dublin is within a very active seismic area (Seismic Zone 4) and local soil conditions can be highly
expansive (clay soil). The Northridge earthquake provided hundreds of examples of damage to
plain concrete footings. This type of damage is extremely expensive to repair, in contrast to the
. small expense of providing nominal footing reinforcement. Footing reinforcement is also
. ... necessary to prevent damage due to pumping action caused by local expansive soils which shrink
. and swell during seasonal drying and wetting conditions.

modification is necessary due to the expansive soil conditions and this is a typical minimum
requirement by soil engineers in the City of Dublin in order to avoid damage due to soil expansion
and shrinkage.

(a) Exterior doors. All exterior wood doors shall be of solid wood construction, no less than 1-
3/4 inches thick or hollow metal doors. Except for sliding glass doors, exterior doors hall not have
glazing larger than 2" unless glazing is 1/4" tempered glass.

<' (b) Locking devices. Exterior swinging doors shall have a lock on the latching device and an
auxiliary cylinder dead bolt. The dead bolt shall be hardened steel and have a I" throw. If the cylinder
of the lock protrudes from the face of the door it shall be fitted with a cylinder ring guard so it cannot De
gripped with pliers or other wrenching devices. Double doors shall have the inactive leaf secured with
flush bolts at top and bottom. The bolts shall be hardened steel 1/4" minimum in diameter and shall
engage a metal strike plate to a minimum depth of 3/8".
(c) Strike plates. Strike plates for wood jambs shall be the high security type and shall be
secured with a minimum of two wood screws 3" long which shall engage the door studs.
(d) Jambs. Inswinging doors with wood jambs shall have rabittedjambs. The jambs on the
strike side shall have continuous solid shims above and below the strike plates and the opposite jamb
shall have solid shims at the level of the strike plate. Both door studs shall be reinforced with horizontal
solid blocking at the approximate height of strike.
(e) Hinges. Exterior hinges and hinges of outswinging doors from the garage to the dwelling
shall have non-removable pins.
(f) Sliding glass doors. Sliding glass doors shall comply with Chapter M 24. Sliding glass
doors shall be fitted with a l"cking device that shall engage the strike sufficiently to prevent its being
disengaged by any possible movement of the door within the space or clearances provided for
installation and operation. The bolt and strike shall be reinforced by hardened material so as to prevent
their separation by pulling, prying or similar attack. An auxiliary locking device shall be installed on the
door which may be a pin, lock, or similar device of not less than 1/4 inch diameter. The pin shall be of a
hardened material and engage the metal portion of the sliding door. Doors with two sliding panels shall
be locked at the meeting rails and shall have an auxiliary locking device as described above.

(g) Entry vision. All main or front entry doors shall be fitted with a viewing device having a
field of view of not less than 180 degrees.

(h) Windows. All accessible dwelling windows shall be secure as follows:
1. Sliding glass windows shall be secured on the inside with a locking device capable of .',..
withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding
window that prevents movement in the sliding track.
2. Louvered windows shall not be used within eight feet of ground level, adjacent
structures, or fire escapes.
3. Casement type windows shall be secured with a metal to metal locking device
contacting both frames of the window at the meeting edge. Auxiliary locks such as a pin
that penetrates both frame structures shall be installed on casement and double hung
windows.
4. Windows fitted with a crank type gear opening device shall be fitted with a positive
window lock that engages metal to metal.
Windows shall not be located within 40 inches of the locking device of any door unless
protected by a steel grill with 1/4" minimum diameter bars not more than 2" on center or
by a screen with 1/8" diameter wire mesh more than 2" on center mounted on the inside
or glazed with 1/4" tempered glass.
(i) Garage doors. Vehicle garage doors shall be secured with a metal to metal locking device
that prevents the door from being pulled or pried up from the outside. No electric garage door openers
shall be permitted that will automatically activate when the door is forced open. Garage doors fitted
with automatic openers shall be permitted with an alternative form of locking device activated from the
interior of the garage. Other garage doors shall comply with all of the provisions of this section.
G) Storage areas. Any exterior storage area attached to a dwelling, apartment or condominium
and enclosed by a door shall comply with this section or have a minimum 3/8" diameter hardened
padlock hasp.
Section ~ 1024 Non Residential Security Requirements
(a) Doors. Exterior doors which are located at the rear or side or away from the primary
entrance shall be solid doors with no glazing and shall be installed in metal frames. Exterior wood doors
shall be solid wood construction 1-3/4 inches thick or hollow metal doors.

(b) Locking device. Exterior swinging doors which are exit doors as set forth in Chapter ~ 10
shall have cylinder dead-bolt locks which shall be openable without he use of key, special effort, or
knowledge. In Group B occupancies, a double cylinder dead-bolt lock may be used on the main exit
door if there is a readily visible, durable sign on, or adjacent, to the door stating, "this door to remain
unlocked during business hours." The sign shall be in letters not less than I inch high on contrasting
background. When unlocked the single door and both leaves of a pair of doors shall be free to swing
without operation of any latching device. Doors which are not exit doors shall have a double-keyed
cylinder dead-bolt. Double doors that are not exit doors shall have the inactive leaf secured with flush-
bolts at the top and bottoms. The bolts shall be hardened steel1/4" minimum diameter and shall engage
a metal strike plate to, a minimum depth of 3/8 inch.
The dead bolts shall be hardened steel and shall have a minimum of eRe 1-1/2 inch throw. If the
cylinder of the lock protrudes from the face of the door it shall be fitted with cylinder ring geared so that

(i) Roof openings. All skylights on the roof of a non-residential building shall be protected by:
1. Iron bars 1/2" minimum diameter not more than 8" on center or;
2. A screen with 1/8" diameter wire mesh not more than 2" on center. All roof access
hatches of a non-residential building shall be protected as follows:
(1). If the hatchway is of wooden material, it shall be covered on the inside with at
least 16 gauge steel or its equivalent attached with screws at 6";
(2). The hatchway shall be secured from the inside with a slide bar or slide bolts;
(3). Outside hinges on all hatchway openings shall be provided with non
removable pins when using pine-type hinges.
All air duct or air vent openings exceeding 8" x 12" on the roof or exterior walls of any
building or premise used for business purposes shall be secured by covering the same
with either of the following:

1. Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no more than 8"
apart and securely fastened.

FINDING: This section limits the use ofNM and NMC cables. The City of Dublin is located in a
highly active Seismic Zone 4. Nonmetallic-sheathed cable is not afforded the same protection from
damage as wiring raceways. Damage to Nonmetallic-sheathed cable could occur in a seismic event
which increases the potential for a fire.

Section 609.3. First paragraph. is amended by replacing it to read:
Section 609.3 Water piping shall not be installed in or under a concrete floor slab within a
building without prior approval of the Building Official. When approved. such piping shall be installed
in accordance with the following requirements:
FINDING: This section eliminates water piping in or under concrete floor slabs within a building.
This amendment is necessary for the following reasons:
1. Most ofthe surface soils in the City of Dublin are relatively young and unconsolidated
sedimentary materials formed from a wide variety of parent materials. The varying
chemical composition, degree of weathering and the relatively acid environment have
created soils of varying types, which are particularly corrosive in nature.
2. Much ofthe surface soil in the City of Dublin is highly expansive (i.e., shrink-swell
behavior) and have low bearing strength.
There are two types of expansive soils in the area:
a. the organic silty clays which are the recent bay muds; and
b. the plastic silty clays which weather from the shale found in the hills surrounding
the City of Dublin.
3. The local climate is characterized by markedly delineated rainy and dry seasons, which
tend to maximize the expansive characteristics of soil.
4. Some parts of the City of Dublin have hard water. which is corrosive to ferrous pipe.

5. The groundwater table is unusually high in many places.
6. The City of Dublin is a highly active seismic area.

Section 7.40.110 of the Dublin Municipal Code is added to read:

Section 710.1 is amended to read:
Section 710.1 Draina~e pipin~ servin~ fixtures which have flood level rims less than twelve (12)
inches (304.8mm) above the elevation of the next upstream manhole and/or flushin~ inlet cover at the
public or private sewer system servin~ such draina~e pipin~ shall be protected from backflow of sewa~e
by installin~ an approved type backwater valve. Fixtures above such elevation shall not dischar~e
throu~h the backwater valve. unless first approved by the Buildin~ Official.
FINDING: This section requires backflow protection if drainage piping serving fixtures is less
than 12 inches above the next upstream manhole. This requirement is necessary due to the fact
that the City of Dublin topography includes mountainous and foothill areas with intermittent
steep slopes. Also. the City of Dublin is located in a seismically active area, which increases the
likelihood of breakage of building sewers and laterals, leading to an above average potential of
sewage back-up into buildings without adequate protection.

Section 7.40.115 of the Dublin Municipal Code is added to read:
Section 7.40.115 Section 719.7. Chapter 7, Cleanouts.
Section 719.7 is amended by adding subsection 7 to read:
Section 719.7 Cleanouts shall be installed at the property line where the private sewer system
connects to the publicly-maintained sanitary sewer lateral. All such line cleanouts shall be extended to
grade with materials and accordin~ to specifications approved by the Buildin~ Official and terminate
within a concrete box.
FINDING: This section adds a subsection regarding location and termination of cleanouts. This
subsection is necessary because the City of Dublin soils are expansive in nature. These expansive
soils create unstable conditions which increase the potential of breaks in sewer laterals. To
maintain health and sanitary services, it is necessary to gain access, to periodically maintained
public sanitary laterals. This is accomplished by the additional clean out as required above.

be used for the storage or holding of food or drinks shall be collected and discharged to a storm sewer or
other approved points of disposal acceptable to the Building Official.
Termination of such drains shall be made by an air break. Condensate drain lines in sizes 11/4" and
larger shall be assembled using approved drainage pipe and fittings. Condensate waste water shall not
drain over or upon a public way. sidewalk. pedestrian ramp or the like. Condensate drains within the
interior of a building shall not be connected to the building roof drain or overflow piping systems. The
waste pipe shall have a slope of not less than 1/8 inch per foot and shall be of approved corrosion-
resistant material not smaller than the outlet size as required below for air-cooling coils or condensing
fuel-burning appliances. respectfully.
Condensate wastes pipes from air-cooling coils shall be sized in accordance with equipment capacity as

The size of condensate waste pipes mav be for one unit or a combination of units, or as recommended by
the manufacturer. The capacity of waste pipes assumes a 1/8 inch-per-foot slope. with the pipe running
three-quarters full.

Condensate drain sizing for other slopes or other conditions shall be approved by the Building Official.
FINDING: This section details condensate disposal and drain sizing. This amendment is required
because the waste treatment facilities serving the City of Dublin is operating at or near maximum
capacity. The discharge of treated water into San Francisco Bay is detrimental to its sensitive
ecosystem.
C'ooling coil and comfort cooling equipment condensate waste discharge does not contain
pollutants which require treatment before being discharged into storm sewers or the ground.

within ten (10) days.
B. The City Council may after hearing, interpret any provision of this chapter.
C. The City Council may after hearing vary the application of this chapter in any specific case
when in its opinion the enforcement thereof would be contrary to the spirit and purpose of this chapter or
public interest. The City Council in granting a variance may impose requirements or conditions to
mitigate any adverse effects that may result from granting a variance.
D. In making any such interpretation or granting any variance the City Council shall make the
following findings: .

1. That the interpretation or variance is consistent with the purpose of this chapter;
2. That the interpretation or variance will not lessen the protection to the people of the city and
the property situated therein. .
E. The City Council may approve alternate materials or methods of construction as set forth in
Section 7.28.140 by overruling the decision of the Building Official. In approval any alternate materials

or methods of construction the City Council shall make findings that the material, method or work
proposed is for the purpose intended, at least the equivalent of that prescribed by this chapter in quality,
strength, effectiveness, fire resistance, durability, dimensional stability and safety.

F. The City Council may appoint a Board of Appeals to hear any specific appeal. The Board of
Appeals shall consist of five (5) members qualified by training and experience to pass on matters
pertaining to the subject matter of the appeal and to serve until the disposition of the appeal. The Board
of Appeals shall have the same autpority and duties as the City Council in interpreting this chapter,
granting variances, or appro"ing alte:nate materials or methods of construction. The Building Official
shall be an ex officio member of th~ Board of Appeals and shall act as secretary to the board. The board
of appeals shall adopt reasonable rules and regulations for conducting its hearings and investigations.
The decision of the Board of Appeals shall be final.
SECTION 3
Section 7.28.290, of the Dublin i'lfu11.icipal Code is amended to read:
Section 7.28.290 Except;ons.
A. No permit shall be required for the following; however, permits shall be required for
electrical, plumbing and mechanical installations in any building or structure listed in subsections Al
through A 18 of this section, and pennits shall be required for all new construction and substantial
improvements that are located within an area of special flood hazard in which case a permit shall be
required as set forth in Chapter 7.24:
1. Open wire fences not more than sixteen (16) feet in height, masonry fences not more than six
(6) in height, and all othe!' type fences not more than eight (8) feet in height;
2. Retaining walls which do not retain more than three (3) feet of earth when the earth retained is
level or where there is no surcharge load, and retaining walls which do not retain more than two
(2) feet of earth when the earth retained is sloping or which supports surcharge loads. See
Section 2317.11 of the Unifmm Building Code for requirements for treatment of wood used for
retaining walls;

3. One-story detached accessory buildings used as tool and storage sheds, playhouses and
similar uses, provided the projected roof area does not exceed one hundred twenty (120) square
feet;
4. One-story buildings not r:lore than four hundred (400) square feet in area used exclusively for
housing animals, poultry, livestock and similar animals and the storage of necessary food, hay or
grain for the animals housed therein;
5. Agricultural buildings as defined in Section 202 of the Uniform Building Code on lots
exceeding twenty (20) acres in area which are located in an A zoning district and where the
principal use of the land is agriculture;
6. Lath houses and similar sun shade structure with roofs which do not shed water, which are not
more than ten (10) feet in height and one thousand (1,000) square feet in area;
7. Awnings ovei' doors c:nd windows of a Group R-3 or Group U-l Occupancy which are
entirely supported by the building and do not project more than fifty-four (54) inches;
8. Temporary construction offices, and storage sheds which are used on a site where there is a.":,
valid building permit, gradiag permit, or which are used in connection with a construction
project where no building p~rmit or grading permit is required; however, this provision shall not
apply to such building remaining on the site 30 days after the completion of construction;

9. Temporary construction offices and storage sheds when stored in a contractor's equipment
yard; however, this provisions shall not apply if such buildings are used for any purpose
whatsoever;
10. Raised decks which are less than thirty (30) inches above the ground at any point;
11. Treehouses or other structures which are designed to be used by children for play;
12. Flag poles, radio or TV antennas and towers, less than thirty-five (35) feet in height when
not attached to a building and less than twenty (20) feet in height when attached to a building,
except permits are required for dish type antennas more than four (4) feet in diameter;
13. Swimming, bathing, and wading pools, and fish ponds not exceeding twenty-four (24)
inches in depth;
14. Prefabricated swimming pools, spas, or hot tubs not exceeding four (4) feet in depth if
resting on the surface of the ground or a concrete slab on the ground;
15. Painting, papering and similar finish work;
16. Moveable cases, counters, and partitions not over five (5) feet nine (9) inches high;
17. Water tanks supported directly upon grade if the capacity does not exceed five thousand
(5,000) gallons and the ratio of height to diameter or width does not exceed two to one;
18. Water storage tanks of any size if resting on the surface of the ground or on a concrete slab
on the ground when used only for watering livestock or irrigation;
19. The replacement of lamps or the connection of portable electrical appliances to suitable
receptacles which have been permanently installed;
20. Nonelectrical, signs less than eight (8) feet in height, nonelectrical signs which do not
exceed three (3) pO'..lnds per square foot nor four (4) inches in thickness when fastened flat
against the wall of any builGing and provided further that the sign does not extend above the top
of the wall of the building.
21. Clearing stoppages or repairing leaks in pipes, valves, fittings or fixtures when such repairs
do not involve the replacement or rearrangement of pipes, valves, fittings or fixtures;
22. Buildings and structures owned by a sanitary district used exclusively for storage, collection,
conveying and treating sewage;
23. A permit shall not be required for demolition or exploration work that may be necessary in
order to determine conditions in connection with a proposed addition or alteration to an existing
building if an application for a permit is on file and prior approval for the demolition or
exploration work is obtained from the Building Official;
24. A permit shall not be required for small or unimportant work when approved by the Building
Official; ,
B. Exemption from the requirement of a permit shall not be deemed to be permissible to
violate any provision of this Chapter or any other law, ordinance, rule or regulation.
C. Although permits are not required by this section, any person may obtain inspection
services by applying for a permit for such work and paying the applicable fee.

Section 7.28.410 of the Dublin Municipal Code is amended to read:
Section 7.28.410 Building Official- Authority to Deny Permit.
The Building Official may refuse to issue any permit where it cannot be demonstrated that:
A. The hazards of land slippage, erosion or settlement will be eliminated;
2. The proposed work will not be located on a trace of an active fault;
3. The proposed work will conform to Chapters 7.20 and 7.24;
4. The placement of existing fills has not been subject to continuous inspection by a special
inspector as required by Section 1701.5.13 of the Uniform Building Code;
5. The private water supply will conform to Section 601.0 of the Uniform Plumbing
Code.
6. The private sewage disposal system required by Section 713.0 of the Plumbing Code will
conform to Section 7.40.140;
7. Whenever a licensed contractor has failed to make corrections as specified in Section
7.28.540 through 7.28.580.

housing R & U-l occupancies in Roofing Area 1 shall use roof covering material that conforms to Class

904.2.2 All Occupancies Except Group R, Division 3 and Group U Occupancies. Except for
Group R, Division 3 and Group U O.:cupancies, an automatic sprinkler system shall be installed:
1. In every story or basement of all buildings when the floor area exceeds 1,500 square feet
(139.4m2) and there is not provided at least 20 square feet (I.86m2) of opening entirely above the
adjoining ground level in each 50 lineal (15 240m) or fraction thereof of exterior wall in the story or
basement on at least one side of the building. Openings shall have a minimum dimension of not less
than 30 inches (762mm). Such openings shall be accessible to the fire department from the exterior and
shall not be obstructed in a manner that firefighting or rescue cannot be accomplished from the exterior.
When openings in a story are prcvided on only one side and the opposite wall of such story is
more than 75 feet (22 860m!:1) from such openings, the story shall be provided with an approved
automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an
exterior wall of the stcry. .
If any portion of a basement is located more than 75 feet (22 860mm) from openings required in
this section, the basement shall be pr 0vided with an approved automatic 'sprinkler system.
2. At the top of rubbish and linen chutes and in their terminal rooms. Chutes extending through
.'.. thr~e or more floors shall have .additional spt1nkler heads installed within such chutes at alternate floors.

904.2.3 Group A Occupancies. An automatic fire extinguishing system shall be installed in all
Group A Occupancies (except of Type V construction) where the floor area exceeds 5,000 square feet
and in all basements classified Group A Occupancy when the basement floor area exceeds 1,500 square
feet. Group A occupancies that are of Type V construction where the floor area exceeds 3,000 square
feet.
904.2.3.1 Drinking establishments. An automatic sprinkler system shall be installed in rooms
used by the occupants for the consumption of alcoholic beverages and unseparated accessory uses where
the total area of such unseparated rooms and assembly uses exceeds 5,000 square feet (465 m2) (except
of Type V construction). For uses to be considered as separated, the separation shall not be less than as
required for a one-hour occupancy separation. The area of other uses shall be included unless separated
by at least a one-hour occupancy separation. Drinkin~ establishments that are of Type V construction
where the floor area exceeds 3,000 square feet (279 m )
904.2.3.2 Basements. An automatic sprinkler system shall be installed in basements classified as
a Group A Occupancy when the basement is larger than 1,500 square feet (139 m2) in floor area.
904.2.3.3 Exhibition and display rooms. An automatic sprinkler system shall be installed in
Group A Occupancies which have more than 12,000 square feet (112 m2) of floor area which can be
used for exhibition or display purposes.
904.2.3.4 Stairs. An automatic sprinkler system shall be installed in enclosed usable space below
or over a stairway in Group A, Divisions 2, 2.1,3 and 4 Occupancies. See Section 1009.6.
904.2.3.5 Multitheater complexes. An automatic sprinkler system shall be installed in every
building containing a multi theater complex.

904.2.3.6 Amusement buildings. An automatic sprinkler system shall be installed in all
amusement buildings. The main water-flow switch shall be electrically supervised. The sprinkler main
cutoff valve shall be supervised. When the amusement building is temporary, the sprinkler water-supply
system may be of an approved temporary type.
EXCEPTION: An automatic sprinkler system need not be provided when the floor area
of a temporary amusement building is less than 1,000 square feet (92.9 m2) and the exit travel
distance from any point is less than 50 feet (15240 mm).
904.2.3.7 Stages. All stages shall be sprinklered. Such sprinklers shall be provided throughout
the stage and in dressing rooms, workshops, storerooms and other accessory spaces contiguous to such
stages.
EXCEPTIONS: 1. Sprinklers are not required for stages'l,OOO square feet (92.9 m2) or
less in area and 50 feet (1542 mm) or less in height where curtains, scenery or other combustible
hangings are not retractable vertically. Combustible hangings shall be limited to a single main curtain,
borders, legs and a single backdrop.
2. Under stage areas less than 4 feet (1219 mm) in clear height used exclusively for chair
or table storage and lined on the inside with 5/8-inch (16mm) Type X gypsum wallboard or an approved
equal.

904.2.3.8 Group B Occupancies.
An automatic fire-extinguishing system shall be installed in Group B occupancies (except Type
V construction) where the floor area exceeds 5,000 square feet (465 m2). An automatic sprinkler system
shall be installed in Group B, of Type V construction where the floor area exceeds 3,000 square feet
(279 m2).
904.2.4.1 Group E Occupancies. An automatic fIre-extinguishing shall be installed in all
Group E occupancies (except Type V construction) where the floor area exceeds 5,000 square feet.. An
automatic sprinkler system shall be installed in all Group E Occupancies of Type V construction where
the floor area exceeds 3,000 square feet.
904.2.4 Group E Occupancies.
904.2.4.1 General. An automatic fire sprinkle system shall be installed throughout all buildings
containing a Group E, Division 1 Occupancy.
EXCEPTION: 1. When each room used for instruction has at least one exit door directly to the
exterior at ground level and when rooms used for assembly purposes have at least one half of the
required exits directly to the exterior ground level, a sprinkler system need not be provided.

2. When area separation walls, or occupancy separations having a fire-resistive rating of not less
than two hours subdivide the building into separate compartments such that each compartment
contains an aggregate floor area not greater than 20,000 square feet (1858 m2), an automatic
sprinkler system need not be provided.
An automatic fire-extinguishing system shall be in Group E, Division 2 and 3 occupancies
(except Type V construction) where the floor area exceeds 5,000 square feet (465 m2). An automatic
sprinkler system shall be installed in Group E, Division 2 and 3 of Type V construction where the floor
area exceeds 3,000 square feet (279 m2).
904.2.4.2 Basements. An automatic sprinkler system shall be installed in basements classified as
Group E, Division I Occupancies.

Divisions 1, 2, 3 and 7 Occupancies.
904.2.5.2 Group H, Division 4 Occupancies. An automatic fire-extinguishing system shall be
in~talled in Group H, Division 4 Occupancies having a floor area of more than 3,000 square feet (219

904.2.5.3 Group H, Division 6 Occupancies. An automatic fire-extinguishing system shall be

904.2.6 Group I Occupancies. An automatic sprinkler system shall be installed in Group I
Occupancies.
EXCEPTION: In jails, prisons, and reformatories, the piping system may be dry, provided a
manually operated valve is installed in a continuously monitored location. Opening of the valve
'will cause the piping system to be charged. Sprinkler heads in such systems shall be equipped
with fusible elements or the system shall be designed as required for deluge systems in U.BC.
Standard No. 9-1.
904.2.7 Group M, and S Occupancies. An automatic sprinkler system shall be installed in
Group M and S occupa.lcies where the floor area exceeds 5,000 square feet (except Type.V
construction). An automatic fire sprinkler system shall be installed in all retail sales rooms classed A
Group M and S occupancies of Type V construction where the floor area exceeds 3,000 square feet.
904.2.8 Group R, Division I Occupancies. An automatic sprinkler system shall be installed
throughout every apartment house three or more stories in height or containing 16 or more dwelling
units in congregate residences three or more stories in height and having an occupant load of 50 or more .":':,,' I
and in hotels three or more stories in height or containing 20 or more guest rooms. Residential or quick
response standard sprinkler heads shall be used in the dwelling unit and guest room portions of the
building.
904.2.8.1 Group R, Division I and 3 Occupancies. An automatic frre-extinguishing system
shall be installed where the total area exceeds 5,000 square feet (465m2).
SECTION 23
Section 7.32.260 of the Dublin Municipal Code is amended to read:
904.2.9 All Group A, B, E, H, I, & R-1 & R-3 Occupancies. Automatic fire-extinguishing
systems shall be installed in all Groups A, B, E, H, I, & R -1 & R - 3 occupancies located more than 1 'is
miles from a fire station providing fire protection to that location. Said distance shall be measured in a
straight line. For R-3 occupancies the sprinkler system may be a residential sprinkler system. type
NFPA 13.
Buildings con~aining portions which are required to have an automatic frre extinguishing system
because of the number of stories shall have the automatic fire extinguishing system installed throughout
and area separation as set forth in Section 504.6 shall not be considered as creating separate buildings for
the purpose of this section. '
When the specific use of a building is not known at the time of design and installation of the automatic
fire-extinguishing system the design shall be based upon Ordinary Hazard Group 2 as set forth in UBC
Standard 9-1. '

Whenever an addition is made to an existing building automatic fire-extinguishing systems shall be
installed if the existing building plus the addition exceeds the area or height limitation set forth in this

section. Whenever the use of an existing building or portion thereof is changed in any manner so as to
require the installation of an automatic fire-extinguishing system, said system shall be installed in that
portion of the building housing the new use.

Section 7.32.270 of the Dublin Municipal Code is deleted.

(a) Exterior doc:-s. All exterior wood doors shall be of solid wood construction, no less than 1-
3/4 inches thick or hollow metal doors. Except for sliding glass doors, exterior doors hall not have
glazing larger than 2" unless glazing is 1/4" tempered glass.
(b) Locking devices. Exterior swinging doors shall have a lock on the latching device and an
auxiliary cylinder dead bolt. The dead bolt shall be hardened steel and have a I" throw. If the cylinder
of the lock protrudes from the face of the door it shall be fitted with a cylinder ring guard so it cannot be
gripped with pliers or other wrenching devices. Double doors shall have the inactive leaf secured with
flush bolts at top and bottom. The belts shall be hardened steel 1/4" minimum in diameter and shall
engage a metal strike plate to a minimum depth of 3/8".
(c) Strike plates. Strike plates for wood jambs shall be the high security type and shall be
secured with a minimum oftwo wood screws 3" long which shall engage the door studs.

(d) Jambs. Ins'winging doors with wood jambs shall have rabittedjambs. The jambs on the
strike side shall have continuous solid shims above and below the strike plates and the opposite jamb

(e) Hinges. Exterior hinges and hinges of outswinging doors from the garage to the dwelling
shall have non-removable pins.
(f) Sliding glass doors. Sliding glass doors shall comply with Chapter 24. Sliding glass doors
shall be fitted with a iocking device that shall engage the strike sufficiently to prevent its being
disengaged by any possible movement of the door within the space or clearances provided for
installation and operation. The bolt and strike shall be reinforced by hardened material so as to prevent
their separation by pulling, prying or similar attack. An auxiliary locking device shall be installed on the
door which may be a pin, lock, or similar device of not less than 1/4 inch diameter. The pin shall be of a
hardened material and engage the metal portion of the sliding door. Doors with two sliding panels shall .'.',,,,
be locked at the meeting rails and shall have an auxiliary locking device as described above.
(g) Entry vision. All main or fTont entry doors shall be fitted with a viewing device having a
field of view of not less than 180 degrees.

(h) Windows. All accessible dwelling windows shall be secure as follows:
I. Sliding glass windcws shall be secured on the inside with a locking device capable of
withstanding prying Oi" wrenching. An auxiliary lock shall be installed on each sliding
window that prevents movement in the sliding track.
2. Louvered windows shall not be used within eight feet of ground level, adjacent
structures, or fire escapes.
3. Casement type windows shall be secured with a metal to metal locking device
contacting both frames of the window at the meeting edge. Auxiliary locks such as a pin
that penetrates both frame structures shall be installed on casement and double hung
windows.
4. Windows fitted with a crank type gear opening device shall be fitted with a positive
window lock that engages metal to metal.
Windows shall not be located within 40 inches of the locking device of any door unless
protected by a steel grill with 1/4" minimum diameter bars not more than 2" on center or
by a screen with 1/8" diameter wire mesh more than 2" on center mounted on the inside
or glazed with 1/4" tempered glass.
(i) Garage doors. Vehicle garage doors shall be secured with a metal to metal locking device
that prevents the door from being pulied or pried up from the outside. No electric garage door openers
shall be permitted that will automatically activate when the door is forced 'open. Garage doors fitted
with automatic openers shall be permitted with an alternative form oflocking device activated from the
interior of the garage. Other garage doors shall comply with all of the provisions of this section.
CD Storage areas. Any exterior storage area attached to a dwelling, apartment or condominium
and enclosed by a door shall comply v/ith this section or have a minimum 3/8" diameter hardened
padlock hasp.
Section 1024 Non Residential Security Requirements
(a) Doors. Exterior doors which are located at the rear or side or away from the primary
entrance shall be solid doors with no glazing and shall be installed in metal frames. Exterior wood doors
shall be solid wood construction 1-3/4 inches thick or hollow metal doors.
(b) Locking device. Exterior swinging doors which are exit doors as set forth in Chapter 10
shall have cylinder dead-bolt locks which shall be openable without he use of key, special effort, or
knowledge. In Group B occupancies, a double cylinder dead-bolt lock may be used on the main exit
door if there is a readily visible, durable sign on, or adjacent, to the door stating, "this door to remain
unlocked during business hours." The sign shall be in letters not less than I inch high on contrasting
background. When unlocked the single door and both leaves of a pair of doors shall be free to swing
without operation of any latching deVIce. Doors which are not exit doors shall have a double-keyed
cylinder dead-bolt. Double doors that are not exit doors shall have the inactive leaf secured with flush-
bolts at the top and bottoms. The bolts shall be hardened steel 1/4" minimum diameter and shall engage
a metal strike plate to, a minimum depth of 3/8 inch.
The dead bolts shall be hardened steel and shall have a minimum of 1 'is inch throw. If the cylinder of
the lock protrudes from the face of the door it shall be fitted with cylinder ring geared so that it cannot
be griped with pliers or othe~ wrenching devices.
Vehicle doors, overhead doors, and sliding doors shall be secured with metal to metal locking devices
which prevent the door from opening.
e'. (c) Strike pJ~tes. Strike plates for wood jambs shall be the high security type and shall be
secured with a minimum of two wood screws 3" long which shall engage the door studs.

operable by a keyed or code lock inside. Doors with two sliding panels shall be locked at the meeting
rails and shall have an auxiliary locking device as prescribed above.
(g) Windows. All accessible windows which are not located at the front or main entrance side
of a non-residential building shall be made secure as follows:
1. Sliding glass windows shall be secured on the inside with a locking device capable of
withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding
window that prevents movement in the sliding track.
2. Louvered windows shall not be used within eight feet of grmmd level, adjacent
structures, or fire escapes.
3. Casement type windows shall be secured with a metal to metal locking device
contacting both frames of the window at the meeting edge. Auxiliary locks such as a pin

(h) Openable transoms. All exterior openable transoms exceeding 8" x 12" which are not
located on the front or main entrance side of a non-residential building shall be protected with a steel
grill with 1/4" minimum bars not more than 2" on center or by a screen with 1/8" diameter wire mesh
not more than 2" on center mounted on the inside.
(i) Roof openings. All skylights on the roof of a non-residential building shall be protected by:
1. Iron bars 1/2" minimum diameter not more than 8" on center or;
2. A screen with 1/8" diameter wire mesh not more than 2" on center. All roof access
hatches of a non-residential building shall be protected as follows:
(I). If the hatchway is of wooden material, it shall be covered on the inside with at
least 16 gauge steel or its equivalent attached with screws at 6";
(2). The hatchway shall be secured from the inside with a slide bar or slide bolts;
(3). Outside hinges on all hatchway openings shall be provided with non
removable pins when using pine-type hinges.
All air duct or air vent openings exceeding 8" x 12" on the roof or exterior walls of any
building or premise used for business purposes shall be secured by covering the same
with either of the following:
1. Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no more than 8"
apart and securely fastened. .
G) Exterior ladders. Exterior ladders to the roof are not permitted.

be used for the storage or holding of food or drinks shall be collected and discharged to a storm sewer or
other approved points of disposal acceptable to the Building Official.
Termination of such drains shall be made by an air break. Condensate drain lines in sizes 11/4" and
larger shall be assembled using approved drainage pipe and fittings. Condensate waste water shall not
drain over or upon a public way, sidewalk, pedestrian ramp or the like. Condensate drains within the
interior of a building shall not be connected to the building roof drain or overflow piping systems. The
waste pipe shall have a slope of not less than 1/8 inch per foot and shall be of approved corrosion-
resistant material not smaller than the outlet size as required below for air-cooling coils or condensing
fuel-burning appliances, respectfully.
Condensate wastes pipes from air-cooling coils shall be sized in accordance with equipment capacity as

Every building in which plumbing fixtures are installed and every premises having drainage
piping thereon shall have a connection to a public sewer. Except that where there is no available public
sewer within 200 feet, measured along streets, alleys, or public right-of-way upon which a lot abuts, and
when the size of the property is in excess of 40,000 square feet, drainage piping from any building or
works may be connected to an approved private sewage disposal system. All such sewage disposal
systems shall be designed, constructed, operated, and maintained in compliance with the Health
Officer's regulations.
Not withstanding the provisions of Section 320 and Section 11.8 of this Ordinance.
Whenever a public sewer is extended so as to become within 200 feet of any premises having a private
sewage disposal system, said private sewage disposal system shall be abandoned and the building sewer
shall be connect to the public sewer.
No permit shall be issued for the installation, alteration or repair of any private sewage disposal system
or part thereof of any premises for which a public sewer is within 200 feet.
On every lot or premises hereafter connected to a public sewer, all plumbing and drainage systems or
parts thereof on such lot or premises shall be connected to such public sewer.

be used for the storage or holding of food or cLrinks shall be collected and discharged to a storm sewer or
other approved points of disposal acceptable to the Building Official.
Termination of such drains shall be made by an air break. Condensate drain lines in sizes 1 1/4" and
larger shall be assembled using approved drainage pipe and fittings. Condensate waste water shall not
drain over or upon a public way, sidewalk, pedestrian ramp or the like. Condensate drains with
termination's within the interior of a building shall not be connected to the building roof drain or
overflow piping systems.

505.8 Garbage Receptacles. An adequate number of appropriate receptacles with close fitting
covers for garbage and rubbish as may be considered necessary by the enforcing agency shall be
provided for the occupant of every dwelling unit by the owner or operator of every apartment house,
hotel, or combination thereof. Each receptacle shall be kept in a clean condition and good repair.
505.9 Bedding. In every apartment house or hotel every part of every bed, including the
mattress, sheets, blankets, and bedding shall be kept in a clean, dry and sanitary condition, free from
filth, urine, or other foul matter; and from infection of lice, bed-bugs, or other insects. The bed linen
shall be changed before a new guest occupies the dwelling unit.

505.10 Caretaker. ..... manager, janitor, housekeeper, or other responsible person shall reside
upon the premises and shall have charge of every apartment house in which there are sixteen (16) or
more apartments and of every hotel in which there are twelve (12) or more guest rooms, in the event that
the owner of any such apartment house or hotel does not reside upon said premises. If the owner does
not reside upon L.1e premises of any apartment house in which there are more than four (4) but less than
sixteen (16) apartments, a notice stating his name and address, or name and address of his agent in

SECTION 71
The provisions of this ordinance shall take effect on January 1, 1996 pursuant to Government
Code section 36937 as an urgency ordinance. The urgency is based on the fact that the State published
and adopted the 1994 editions of the model codes on July 1, 1995. Local jurisdictions must then adopt
these codes within 6 months, which is January 1, 1996. This City Clerk of the City of Dublin shall
cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance
with Section 36933 of the Government Code of the State of California.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

FINDINGS AS TO WHY AMENDMENTS TO THE UNIFORM CODES ARE NECESSARY
WHEREAS, Section 17958.7 and 18941.5 of the Health and Safety Code of the State of California
requires cities to adopt ordinances which impose the same restrictions as contained in the California
Building Standards Code; and
WHEREAS, the 1994 Edition of the Uniform Building Code, 1994 Edition of the Uniform
Plumbing Code, the 1994 Edition of the Uniform Mechanical Code, the 1994 Edition of the Uniform
Housing Code and the 1993 Edition of the National Electrical Code have been adopted in the California
Building Standards Code; and
WHEREAS, this City Council having before it an ordinance adopting those codes set forth herein
above with changes; and
WHEREAS, Section 17958.7 and 18941.5 of the Health and Safety Code of the State of California
authorizes cities to make changes or modifications to the provisions of the California Building Standards
Code as the City determines are reasonably necessary because of local climatic, geological or
t<.;pographical conditions; and
WHEREAS, this City Council has reviewed the reasons for the changes and modifications as set
forth in Exhibit "A".

NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby declare and
find that said changes or modifications to the provisions of the State Building Standards Code are
reasonably necessary because of local climatic, geologic or topographical conditions as set forth in
Exhibit "A".
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the California
Department of Housing and Community Development for filing as required by Section 17958.7 of the
Health and Safety Code of the State of California.

Section 22 modifies the Uniform Building Code to require an automatic fire-extinguishing system when
. of type V construction and the floor area exceeds 3,000 square feet in all occupancies, except R,

Section 23 modifies the Uniform Building Code to require an automatic fire-sprinkler system when Group
A, B, E, H, I and R-l and R-3 occupancies are located more than 1 'is miles from a fire station.
Section 24, adds a' requirement of a minimum of one 1/2" diameter top and bottom reinforcement in all .'~
continuous foundations. This amendment is necessary because the City of Dublin is within a very
active seismic area (Seismic Zone 4) and local soil conditions can be highly expansive clay soils.
The Northridge earthquake provided hundreds of examples of damage to plain concrete footings.
This type of damage is extremely expensive to repair, in contrast to the small expense of providing
nominal footing reinforcement. Footing reinforcement is also necessary to prevent damage due to
pumping action caused by local expansive soils which shrink and swell during seasonal drying and
wetting conditions.
Section 25, modifies the Uniform Building Code to require slab reinforcement. This modification is
necessary due to the expansive soil conditions and this is a typical minimum requirement by soil
engineers in the City of Dublin in order to avoid damage due to soil expansion and shrinkage.
Section 26, deletes the use of gypsum board for lateral bracing. This deletion is necessary because the
City of Dublin is located in Seismic Zone 4. Gypsum wallboard has performed poorly during
recent California seismic events. The shear values for gypsum wallboard contained in the code are
based on mono-directional testing. It is appropriate to limit the use of this product until cyclic
loading testing are performed and evaluated.
Section 27, limits the use of portland cement plaster for lateral bracing to single story residential. This
limitation is necessary because the City of Dublin is located in Seismic Zone 4. Exterior portland
cement plaster has performed poorly during recent California seismic events. The shear values for
portland cement stucco contained in the code are based on mono-directional testing. It is
appropriate to limit the use of this product until cyclic loading testing are performed and
evaluated.
Section 28, adds a new paragraph to require upgrade of suspended ceiling systems for alteration and repair
projects. This amendment is necessary to mitigate a known seismic hazard in existing buildings
due to the City of Dublin's proximity to local active faults.

Section 44, limits the use ofNM and NMC cables. The City of Dublin is located in the highly active
seismic zone 4. Nonmetallic-sheathed cable is not afforded the same protection from damage as
wiring in raceways. Damage to Nonmetallic-sheathed cable could occur in a seismic event which
increases the potential for a frre.

Section 49, eliminates water piping in or under concrete floor slabs within a building. This amendment is
necessary for the following reasons:
1. Most of the surface soils in the City of Dublin are relatively young and unconsolidated
sedimentary materials formed from a wide variety of parent materials. The varying chemical
composition, degree of weathering, and the relatively acid environment have created soils of
varying types, which are particularly corrosive in nature.
2. Much of the surface soil in the City of Dublin is highly expansive (i.e., shrink - swell behavior)
and have low bearing strength.
There are two types of expansive soils in the area:
a. the organic silty clays which are the recent bay muds; and
b. the plastic silty clays which weather from the shale found in the hills surrounding the
City of Dublin.
3. The local climate is characterized by markedly delineated rainy and dry seasons, which tend to
maximize the expansive characteristics of soil.

4. Some parts of the City of Dublin have hard water, which is corrosive to ferrous pipe.
5. The groundwater table is unusually high in many places.
6. The City of Dublin is a highly active seismic area.
Section 50, requires backflow protection if drainage piping serving fixtures is less than 12 inches above
the next upstream manhole. This requirements is necessary due to the fact that the City of Dublin
topography includes mountainous and foothill areas with intermittent steep slopes. Also, the City of
Dublin is located in a seismically active area, which increases the likelihood of breakage of building
sewers and laterals, leading to an above average potential of sewage back-up into buildings without
adequate protection.
Section 51, adds a subsection regarding location and termination of cleanouts. This subsection is
necessary because the City of Dublin soils are expansive in nature. These expansive soils create unstable
conditions which increase the potential of breaks in sewer laterals. To maintain health and sanitary
services, it is necessary to gain access, to periodically maintained public sanitary laterals. This is
accomplished by the additional cleanout as required above.
Section 52, details condensate disposal and drain sizing. This amendment is required because the waste
treatment facilities serving the City of Dublin is operating at or near maximum capacity. The discharge of
treated waste water into San Francisco Bay is detrimental to its sensitive ecosystem.
Cooling coil and comfort cooling equipment condensate waste discharge does not contain pollutants
which require treatment before being discharged into storm sewers or the ground.
.' Section 58, amends the code to comply with local sanitation district requirements regarding disposal for
.' ':.condensate for HV AC systems. The waste water treatment facilities serving the City of Dublin is
, operating at or near maximum capacity. The discharge of treated waste water into San Francisco Bay is
detrimental to its sensitive ecosystem.
