DESCRIPTION: The California Integrated Waste Management Act was amended in 1992 (AB3001) to
require cities and counties to prepare a Non-Disposal Facility Element (NOPE) as part of the Countywide
Integrated Waste Management Plan (CoIWMP), which includes the City's Source Reduction and Recycling
Element (SRRE). Although the NDFE is part of the Countywide Plan, cities and counties are required to
prepare and individually adopt NDFEs. Emergency regulations recently signed into law (AB 440) require that
SRRE, Household Hazardous Waste Elements (HHWE) and NOFEs be submitted to the California Integrated
Waste Management Board on an accelerated schedule.
The purpose of the NDFE is to identify and describe existing and/ or planned Non-Disposal Facilities (NDFs)
to be utilized by the City of Dublin in attaining the waste reduction goals identified in the City's SRRE.
A Non-Disposal Facility is defined as any facility that requires a Solid Waste Facility Permit, except landfills
and transformation (waste to energy) facilities. NDFs include transfer and processing stations, including
material recovery facilities that receive unsorted waste, and composting facilities. Recycling facilities that
receive sorted materials and other facilities that do not require County Solid Waste Permits normally do not
fall under this definition of NDFs.
The City of Dublin has no existing or new NDFs planned within the jurisdiction. Therefore, the City's NOFE
consists of a list offacilities located outside the City of Dublin, which are currently used or proposed to be
used to implement SRRE programs. The City's franchised hauler transports source separated recyclables to
these - . , facilities.
Adoption of the NOPE
The City's NOPE was prepared and forwarded to the Alameda County Waste Management Authority Local
Task Force (LTF) for an advisory review, as required by State Law. After receiving comments from the LTF,
the City must hold at least one public hearing and then adopt its NOPE. Once adopted, the NOFE will be
submitted to the Alameda County Waste Management Authority for transmittal to the California Integrated
Waste Management Board (CIWMB).
The Integrated Waste Management Board has 120 days to approve or disapprove of the NDFE(s). If the
eIWMB has not approved or disapproved an NDPE within 120 days, the CIWMB shall deem to have
approved the NDFE.
Staff recommends the City Council adopts-the Non Disposal Facility Element as required by the Integrated
Waste Management Act and direct staff to send the NDFE to the Alamenda Waste Management Authority for
transmittal to the California Integrated Waste Management Board.

ADOPTING THE NON-DISPOSAL FACILITY ELEMENT AND
APPENDING IT TO THE SOURCE REDUCTION AND RECYCLING ELEMENT
WHEREAS, the State Legislature adopted AB 3001 (Cortese) requiring that local jurisdictions
append their Source Reduction and Recycling Element (SRRE) by adopting a Non-Disposal Facility
Element (NDFE); and
WHEREAS, the NDFE's purpose is for local jurisdictions to identify existing or proposed
facilities in order to implement local SRREs; and
WHEREAS, the City of Dublin has submitted a proposed NOFE to the Alameda Waste
Management Authority Local Task Force (LTF) for review and comment as required; and
WHEREAS, the LTF reviewed the City's NOPE on October 7,1993; and
WHEREAS, the City of Dublin held the required public hearing on January 10, 1994, regarding
the adoption of the NDFE.
NOW, THEREFORE, BE IT RESOLVED that the City eouncil of the City of Dublin hereby
adopts the Non-Disposal Facility Element that appends the City's Source Reduction and Recycling
element as required by State law.
