FINANCIAL STATEMENT: Sierra Land Development Corporation, which handles construction
matters for the Lin Family, has provided a Maintenance Bond in the
amount of $325,000.00 (Bond No. 720002S-M) to replace the
Performance and Labor and Materials Bonds that guaranteed the
improvements. The Maintenance Bond will guarantee against
defects for one year. Once these improvements have been accepted,
the City will incur maintenance and street sweeping costs.
DESCRIPTION: Sierra Land Development Corporation, on behalf of the Un Family,
recently completed site improvements associated with the Tassajara Road Bridge widening, located on
Tassajara Road at Kobold Creek just north of Shadow Hill Drive. The improvements consisted of
constructing a new six-lane bridge required for the ultimate widening of Tassajara Road from two to six
lanes in conformance with Tassajara Road Precise Alignment Plan, and providing certain habitat
improvements to compensate for loss of wetlands within the Dublin Ranch area. The work was governed
by an Improvement Agreement executed on May 17,2005 via City Council Resolution No. 72-05.
The developer and the contractor have completed the work governed by the agreement. Since the
improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of.

the Public Works Director, it is appropriate for the improvements to now be accepted by the City for
permanent maintenance.
At the time the City and Sierra Land Development Corporation executed the Improvement Agreement, the
developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of
$200,000.00 for grading, and a Performance Bond and a Labor and Materials Bond, each in the amount of
$1,300,000.00 for bridge improvements. Now that the work is complete, the bonds may be released in
accordance with the authority contained in ~66499.7 of the Government Code, and replaced with a
Maintenance Bond in an amount necessary to guarantee the work for a one-year period following
acceptance. The developer has provided a Maintenance Bond in the amount of $325,000.00, which is
25% of the original Performance Bond, and which is sufficient t9 guarantee the improvements for a one-
year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements for Tassajara
Road Bridge.

ACCEPTANCE OF THE TASSAJARA ROAD BRIDGE IMPROVEMENTS
FOR DUBLIN RANCH OFFSITE MITIGATION
(LIN FAMILY AND SIERRA LAND DEVELOPMENT CORPORATION)
WHEREAS, the developer, Lin Family and Sierra Land Development Corporation, a California
Corporation, previously entered into an Improvement Agreement with the City of Dublin to install bridge
and associated roadway improvements on Tassajara Road just north of Shadowhill Drive, in accordance
with improvement plans and specifications on file with the Public Works Director, and
WHEREAS, the new bridge and improvements are in conformance with the ultimate right-of-way
line set by the Tassajara Road Precise Alignment adopted by the City Council on August 3, 2004, via
Ordinance No. 21-04; and
WHEREAS, the Improvements associated with the Tassajara Road Bridge are complete in
accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction
of the Public Works Director; and
WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the
Improvements can be released, in accordance with the authority contained in 966499.7 of the Government
Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work
for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tassajara Road Bridge are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by Developers Surety and Indemnity Company in
the amount of $200,000 (Bond No. 720001S) for Grading be released; and
3. The original Labor and Materials Bond issued by Developers Surety and Indemnity
Company in the amount of $200,000 (Bond No. 720001S) for Grading be released; and
4. The original Performance Bond issued by Developers Surety and Indemnity Company in
the amount of$I,300,000 (Bond No. 720002S) Bridge Improvements be released; and
5. The original Labor and Materials Bond issued by Developers Surety and Indemnity
Company in the amount of $1,300,000 (Bond No. 720002S) Bridge Improvements be
released; and

6. The submitted Maintenance Bond cash security issued by Developers Surety and Indemnity
Company in the amount of $325,000.00 (Bond No. 720002S-M) be accepted as security for
the aforesaid one-year maintenance period, said period to commence on this date and
terminate on the 17th day of July, 2008.
