FINANCIAL STATEMENT:
The Applicant/Property Owners will pay the
processing costs, which is consistent with
the Eastern Dublin Specific Plan financing
goals and policies.
DESCRIPTION:
Ted Fairfield, representing Jennifer Lin, and some of the other
property owners in the Eastern Dublin General Plan Amendment and
Specific Plan (specific Plan) project areas along Tassajara Road are
requesting the initiation of a zoning ordinance amendment study to
prezone 1,529 acres of land. The area is adjacent to the existing
City of Dublin boundaries and will soon be proposed for annexation
into the city of Dublin and the Dublin San Ramon Services District.
The Specific Plan requires that the planning area be placed into a
Planned Development (PO) District overlay zone.
The area proposed for annexation needs to be prezoned to a PO
District in conformity with the Specific Plan and the amended General
Plan pOlicies. Prezoning of the area must be accomplished before
annexation occurs. The benefits of prezoning an area before
annexation are twofold: it allows the City to have zoning in effect
immediately upon annexation; and it provides landowners prior
knowledge of land use regulations that would affect them should
annexation occur.

The zoning ordinance amendment study will identify the boundaries
of the zoning district, including land use designations within the
district, and land use regulations covering land use classifications,
densities, floor area ratios, permitted and conditional uses. staff
will need to work with all the property owners of the 1,529-acre
project area to prepare the study, a project description incorporating
zoning district regulations, and a land use map. staff will also need
to work closely with the property owners to identify and comply with
all applicable Eastern Dublin implementation programs.
currently, the Zoning Ordinance does not have all the land use
designations and categories that would be required to achieve the
development character, objectives and policies described in the
Specific Plan. The intent of the PO District overlay zone would be to
create land use provisions consistent with the specific Plan for
providing a balance of residential, commercial, employment,
recreational and social opportunities. This initial stage of
prezoning will include sufficiently detailed land use provisions in
order for the city to find that the prezoning is in conformance with
the applicable provisions of the amended Dublin General Plan and the
Eastern Dublin Specific Plan.
subsequent stages of prezoning or rezoning will occur when the
landowners/developers are ready to develop their properties. They
will be required to submit a Land Use and Development Plan, which is a
detailed, comprehensive plan of the proposed development. A Land Use
and Development Plan shall be subject to the review by the Planning
commission and adoption by the city council as a separate PO District
zoning ordinance amending the initial PO District zoning.
Staff recommends that the city council initiate a Zoning
Ordinance Amendment Study for prezoning a major portion of the Eastern
Dublin General Plan Amendment and Specific Plan areas (see Exhibit B)
to the PO District.

RESOLUTION NO. 94-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
INITIATING A ZONING ORDINANCE AMENDMENT STUDY FOR A PD (PLANNED
DEVELOPMENT DISTRICT) PREZONE FOR A PORTION OF THE EASTERN DUBLIN
PROJECT AREA
WHEREAS, the city of Dublin adopted the Eastern Dublin General
Plan Amendment and Specific Plan on May 10, 1993 and the Dublin voters
approved the Eastern Dublin General Plan Amendment and Specific Plan
on November 2, 1993; and
WHEREAS, the adopted Eastern Dublin Specific Plan contains an
implementation measure (Action Program 4C) that requires the planning
area to be placed into a PO District overlay zone; and
WHEREAS, Section 8-31.0 of the Dublin Zoning Ordinance regulates
the intent of the PO (Planned Development) Distri~ts; and
WHEREAS, section 8-31.16 of the Dublin zoning Ordinance allows
the separate processing of the PO District zoning, and a Land Use and
Development Plan, which is part of the PO District zoning process
containing provisions regulating use, improvement and maintenance of
property within boundaries of the plan; and
WHEREAS, section 8-31.16 of the Dublin Zoning Ordinance states
that an initial PO District prezone (a PO District zoning without a
Land Use and Development Plan) shall include land use provisions
sUfficiently detailed to be found consistent with the policies of the
Dublin General Plan; and .
WHEREAS, a zoning ordinance amendment study initiation request
has been made by some of the property owners within the Eastern Dublin
Specific Plan project area for prezoning their property to a PO
District overlay zone prior to annexation of their property into the
city of Dublin and the Dublin San Ramon Services District; and
WHEREAS, Section 8-103.1 of the Dublin Zoning Ordinance states
that the city council may initiate a zoning ordinance amendment by a
resolution; and
WHEREAS, the initiation request has been reviewed in accordance
with the provisions of the California Environmental Quality Act (CEQA)
and was found to be Categorically Exempt under section 15306, Class 6
of the state CEQA Guidelines; and
WHEREAS, the Staff Report was submitted recommending that the
city council initiate a zoning ordinance amendment study for an
initial PO District prezone of a portion of the Eastern Dublin project
area; and
WHEREAS, the city council did hear and consider all said reports,
recommendations and testimony hereinabove set forth.

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
initiate a zoning ordinance amendment study for initially prezoning a
portion of the Eastern Dublin project area to a PO District over,ly,
zone.

As a follow-up to your conversation yesterday with Bob Harris, I am forwarding this
letter to update you on the status of our discussions with the other property owners in
the 1,529 acre area which is being proposed as the first area to be annexed to the City
under the provisions of the Eastern Dublin Specific Plan.
As the representatives of Jennifer Lin, we are requesting that approximately 1,041
acres of her property be part of this first phase annexation. In order to comply with the
many requirements of LAFCO and the Eastern Dublin Specific Plan, and to avoid
creating islands and corridors as a result of the annexation, we are proposing that the
following additional properties be included:

We have had conversations with all of the major property owners about the proposed
annexation and the prezoning and we feel the majority of them are favorably inclined
toward the proposal. Along with Mrs. Lin, this group accounts for over 90% of the
area.

One of the major property owners has exhibited some reluctance to be part of this
particular annexation, but we intend to have further conversations with him, along with
the four smaller property owners who we haven 't .had the opportunity to talk to yet.
This letter is in no way intended to warrant that property owners in the area other than
Jennifer Lin are supporting the annexation and prezoning; We feel, at this juncture, a
number of others are in accord, but they will be speaking for themselves at the hearings
that will be held on these matters. I simply want to make it clear that, as the
representatives of Jennifer Lin, we are requesting that you schedule a hearing for the
City Council to consider initiating a prezoning of the entire 1,529 acres at its meeting
of June 27, 1994.
Please let us know right away if you have any special questions or concerns.
