PERTINENT FACTS: History: April 2, 1975, Conditional Use Permit (C-2927) was approved on the subject property for a similar carnival, Aprif 17, through April 20, 1975. February 18, 1976, Conditional Use Permit (C-3066) was approved on the subject property for a similar carnival, March 10 through March 14, 1976. Physical Features: Applicant proposes to utilize a portion of the shopping center parking lot to conduct amusement rides. Adjacent Area: Adjoining properties contain similar business use. PLANNING CONSIDERATIONS: The proposed carnival operation would be located on business property at the perimeter of the parking area for the shopping center. There is direct access from Regional Street, a major thoroughfare. The proposed carnival would be isolated from nearby residential neighborhoods. Recommendations of the Health Department, Alameda County Sheriff and other agencies should be considered to determine possible detrimental effects. FINDINGS REQUIRED: Is the use required by the public need? Yes. Public need has been demonstrated by success of two earlier carnivals conducted on the site. Will the use be properly related to other land uses and transportation and service facilities in the vicinity? Yes. Carnival would be located in a business district and adjacent to a major thoroughfare. Will the use, if permitted, under all the circumstances and conditions of this particular case, materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood? No. Not detrimental if operated so as to not cause traffic congestion nor restricted parking for adjacent business uses. Will the use be contrary to the specific intent clauses or performance standards established for the District in which it is to be located? No. Not contrary as a temporary use in a business district. PRE-HEARING RECOMMENDATION: Approval, subject to recommendations of referral agencies. (County Health Department, County Sheriff, and Roads Division) and restoration of the site to original condition by March 14, 1977.
