CONDI,TIONAL USE PERMIT to expand existing pre-school facilittes to include grades K-4, with installation of an additional building. in an R-l (Single Family Residence) District. located at 22502 Woodroe Avenue, east side. 850' north of the intersection with Sparks Way, Hayward. CONDITIONALLY APPROVED Mr. Flynn reviewed the application noting that it was continued from November 19, 1975. because the Fairview Community Club had not had ample opportunity to review the proposal or visit the facility. Correspondence was received this morning from the Fairview Community Club advising they have visited this facility and discussed the proposal with the applicants. They recommend that the permit be approved subject to the condition that the additional structure be brought up to Code and a time be established for completing renovation of the facility. Norma Dean replied that she cannot give a time as to when the renovation will be completed. The building will have to be moved before they can have a contractor tell them what has to be done and how long it will take. Mr. Flynn explained that it is the concern of the community club that the building will be sitting there for a long period of time. There are some very nice structures on the property now. They would not want this structure to detract from these facilities. He asked about improvements to the exterior of the structure. Mrs. Dean replied that the exterior will be re-roofed and painted. It will be landscaped. Mr. Flynn asked if it will have a tile roof like the others on the property. Mrs. Dean replied that it probably will not but it will be attractive. Mr. Flynn indicated that the basic permit for this use will expire in April. He felt this work should be finished by that time. Mrs. Dean agreed. There was no other testimony. Mr. Flynn confirmed the findings contained in the Pre-Hearing Analysis and approved the application subject to expiration concurrent with the basic permit effective April 17, 1976, and compliance with all applicable codes including those administered by the State Fire Marshall prior to occupancy. (Res. No. Z-2329) 2, KENNETH L. PIERCE - C-3043, CONDITIONAL USE PERMIT to continue CONDITIONALLY occupancy of a mobile home during reconstruction of a dwelling APPROVED in an A (Agriculture) District, located at 927 Happy Valley Road, south side, 1,100' west of the intersection with Sycamore Road, Pleasanton. Mr. Flynn reviewed the application noting a permit was issued for this purpose October 30, 1974, allowing use of a mobile home for the Ordinance maximum of one year. This is for a reconstruction, not complete building of a new single family dwelling. This application indicates that occupancy by the applicant commenced in August, 1975. Diane Pierce indicated that the mobile home was not placed on the property until August, 1975. Mr. Flynn asked how far along they are. Mrs. Pierce replied they have all services to the house. They have hired a contractor and are trying to refinance at this time. They are hoping to be done in the next six months. Minutes of Meeting - December 3. 1975 Page 2 2. KENNETH L. PIERCE - CONTINUED: FILE COpy Mr. Flynn indicated that temporary occupancy of the mobile home during the period of construction would be met if we tied it to initial occupancy. bearing in mind they are not responsible for the prior owner's actions. There was no additional testimony. Mr. Flynn approved the application subject to the condition that occupancy of the mobile home shall cease on or prior to August 31, 1976, or upon occupancy or final inspection of the permanent single family dwelling, whichever occurs first. HAYWARD AREA RECREATION AND PARK DISTRICT - C-3044, CONDITIONAL USE PERMIT to install a mobilehome as a caretaker residence in an R-I (Single-Family Residence) District, located at 18701 Hes- perian' Boulevard, west side, 190' south of the intersection with Bockman Road, San Lorenzo. CONDITIONALLY APPROVED Mr. Flynn reviewed the application noting there is an adverse staff report citing the mobilehome is incompatible with the character of the existing structures. Facilities could be provided in the existing mansion or carriage house. The recommendation is for disapproval. Wes Sakamoto indicated these facilities are being used by the Historical Society. Mr. Flynn asked why they cannot modify the tower, the carriage house or the museum structure to provide these quarters. Mr. Parry replied that it would be impractical to modify these structures. The fire alarm and burglar alarm will be wired into the trailer. The mobile- home will have a wood side. They will make it compatible. They will put in the pad and pay for that, but they have an offer from someone who will provide the mobilehome and live in it with his family. It could be five years before they will have funds to build a cottage or convert the carriage house. The use of this type of structure has proved itself in schools. Mr. Flynn indicated that school environments have a great track record for vandalism. They have come in with documents as to what happens to .' insurance and actual reduction in vandalism. Mr. Parry felt that what they do on this property should be up to H. A. R. D. and the Historical Society. There was no additional testimony. Mr. Flynn approved the application for a three year term subject to the conditions that an alarm system be connected to the mobilehome in accordance with recommendations of San Lorenzo Fire District, and prior to installation of the facility, there be submitted for approval the elevations of the proposed vehicle as well as any modification of the proposed location. No. 2-2331) OJ AMADOR VALLEY PROPERTIES - C-3042, V-6863, CONDITIONAL USE CONDITIONALLY PERMIT to permit operation of a nursery with exterior display APPROVED of plant materials and a concurrent VARIANCE to permit exterior display of landscaping materials and gardening supplies where only interior display is otherwise allowed in a C-l (Retail Business) District, located at Regional Street, west side, 220' south of the intersection with Amador Valley Boulevard, Dublin. Mr. Flynn advised there is a concurrent Site Development Review that will address itself to such things as public works type improvements including peripheral fencing. This site is within the area affected by the Dublin ~inutes of Meeting - December 3, 1975 Page 3 4. AMADOR VALLEY PROPERTIES - CONTINUED: Commercial Center Design Policy. The low profile sign proposed is in accordance with the Zoning Ordinance. Mr. Jack Weightman asked if approval of this Variance will also approve the Site Development Review plan as submitted. Mr. Flynn replied that is a separate administrative procedure, but there are no basic problems with the layout. At this point, it seems to be only a question of working out the sign to meet the intent of the Dublin Sign Policy. There was no other testimony. Mr. Flynn modified the findings contained in the Pre-Hearing Analysis to the affirmative and approved the application subject to any modifications or recommendations of concurrent Site Development Review S-547X. (Res. No. Z-2332, Z-2333) 5. CHAPEL OF THE CHIMES - C-3045, V-6869, CONDITIONAL USE PERMIT to allow expansion of an existing mausoleum structure by an addition 92' by 63' and a VARIANCE to allow side yard reduced from the required 10' to zero in an A (Agriculture) District, located at 32992 Mission Boulevard, 2l5' north of the intersection with Tamarack Drive. near Hayward. CONDITIONALLY APPROVED Mr. Flynn reviewed the application noting recommendations from the City of Hayward and the City of Union City. Union City recommends if approved. any roof top mechanical equipment be screened from view. the height of the expansion b~'comparable to that of additions #l and #2. that the exterior wall adjacent to property within Union City be of material and color be identical to that of addition #2. The City of Hayward sees no problem as the grade difference will negate any detrimental effect. Flood Control sees no problem as long as the roof gutters are directed to the paved area and runoff is not blocked from the adjacent easterly properties. Mr. Flynn confirmed the findings contained in the Pre-Hearing Analysis and approved the application subject to the conditions that the building permit be issued within one year, addition shall be of the same integral height as existing structure but elevation may be adjusted to accommodate existing grades, exterior elevations and color of addition shall match the existing structure. KARL LACHE - V-6845, VARIANCE to reduce rear yard from the required 20' to 7'6" to existing patio cover, and to l4'6" for additional patio cover in an R-l (Single Family Residence) District. located at 15733 Via Repressa. west side, opposite of the intersection with Corte Cenono, San Lorenzo. CONDITIONALLY APPROVED Mr. Flynn reviewed the application noting it was continued from prior hearings as applicant was not represented. Mr. James T. Woods felt they would have compensating space in that there is a 24' setback in the front. Minutes of Meeting - December 3. 1975 Page 4 6. KARL LACHE - CONTINUED: Mr. Flynn stated that a 22' setback is indicated. A yard variance would be considered favorably if it didn't reduce the yard to less than 10' and if there is compensating open space. The existing patio cover was built without benefit of a building permit. The new patio cover could be approved if the unlawful structure is removed. There was no additional testimony. Mr. Flynn approved the addition subject to the condition that prior to final inspection, the unlawful addition shall be removed. (Res. No. 2-2336) 7. CORINNE JEAN HOLROYD (OWNER) AND DOUGLAS S. AHBOLTIN (LESSEE) CONTINUED TO V-6848, VARIANCE to approve as a Building Site a parcel reduced JANUARY 7, 1976 from the required lOO acres to 4l,l25 sq. ft. in an A (Agriculture) District, located at 788 Laughlin Road. west side, 600' north of the intersection with Interstate 580. Livermore. Mr. Flynn indicated that this matte~ was continued to allow submission of additional documentation of the status of the other three similar size parcels in the immediate vicinity as to whether or not they would be lawful building sites without benefit of Variance. Mr. John Stamper that he purchased be able to build original people who houses. There were submitted a certified statement from Dr. Henry Devinich property on Laughlin Road with the understanding he would a lawful building. He purchased this property from the subdivided. The reason it was subdivided was to build houses constructed on parcels 9 and ll. Mr. Flynn asked when he purchased lot 9. Mr. Stamper replied 1956. He stated that he is trying to locate the daughter of the original owners. He felt that he can get the necessary documentation if given more time. There was no additional testimony. Mr. Flynn continued the application to January 7, 1976. for further hearing. 8. M. OPENSHAW" J. COOK AND P. BYNE (OWNER) AND MR. & MRS. DAVID CUTLER _ V-6860, VARIANCE to approve as a Building Site a lot with Effective Lot Frontage reduced from the required 186' (~median lot width) to 50', and area reduced from the required 5 acres to 3.69 acres in an R-l-L-B-E (Single Family Residence. Limited Agriculture uses, 5 acre minimum building site area) District, located at 2526 Bess Avenue north side, 1850' east of the intersection with Arroyo Road, Livermore. CONDITIONALLY APPROVED Mr. Flynn reviewed the application. He asked if the existing single family dwelling is to be removed and a new structure put in. Mr. David Cutler indicated the existing structure will be completely removed. He is planning to live in this house while the other is being built. Mr. Flynn indicated this would be possible as long as the existing dwelling is removed prior to final inspection or occupancy of the new structure. There was no additional testimony submitted. Mr. Flynn approved the application subject to the conditions that application for new construction shall be accompanied by a demolition permit for existing dwelling and existing dwelling shall be demolished prior to final inspection of new construction.
