DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 198 A regular meeting of the Dublin City Council was held on Tuesday, June 5, 2007, in the Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:03 p.m., by Mayor Lockhart. .. ROLL CALL PRESENT: Councilmembers Hildenbrand, Oravetz, Sbranti and Scholz, and Mayor Lockhart. ABSENT: None .. PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the Council, Staff and those present. .. REPORT ON CLOSED SESSION ACTION Mayor Lockhart advised that the no action was taken during Closed Session. .. ORAL COMMUNICATIONS Introduction of New Emplovees 7:04 p.m. 3.1 (700-10) Parks and Community Services Director, Diane Lowart introduced Intern, Danielle Warfield; Public Works Director Melissa Morton introduced Intern, Silas Toms; Fire Marshall Bonnie Terra introduced Darrell Jones, Deputy Fire Marshall. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 199 Proclamation recognizing the Dublin High School Cheer Competition Squad 7:08 p.m. 3.2 (610-50) Vm. Hildenbrand presented a proclamation to the Dublin High School Cheer Competition Squad. The team placed 2nd at the JAMZ Nationals Championship competition with a score of89.5. The Council recognized and congratulated the team. .. Dublin Pride Week Activities and Recognition Of Poster Contest Winners and Dublin Pride Partners 7:16 p.m. 3.3 (150-80) The City Council formally recognized the contributions made by various individuals and organizations making Dublin Pride week 2007 a successful community event The following Dublin Pride Partners involved in the 2007 Dublin Pride Week were recognized and presented with Certificates of Appreciation: Lorie Rohloff, Palo Alto Medical Foundation, Dublin/San Ramon Women's Club, Dublin Lions Club, Amador Valley Industries, Katie Colbert, Lindsey Wildlife Museum, Citilinks, Dublin Chamber of Commerce. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 200 Presentation from the Alameda County on the County-Wide Homeless Continuum of Care Councils (HMIS) 7: 33 p.m. 3.4 (430-20) Dublin Housing Authority John Lucero presented the Staff Report regarding the County- Wide Homeless Continuum of Care Council, and explained that this organization implemented a database to track homeless individuals and households that received housing and social services. Riley Wilkerson acting Alameda County Continuum Care Homeless Coordinator presented a report on the County-Wide Homeless Continuum of Care Councils (RIMS) and outlined the organization's accomplishments. The Council entered into a discussion regarding the 2009 survey and requested if the study would provide a more detailed analysis of those requiring services in the Tri-Valley. They also requested a cost breakdown on funding the more detailed portion of the study. .. Proclamation Declarinsz Affordable Housinsz Week 7:52 p.m.3.5 (610-50) Mayor Lockhart read a proclamation declaring June 1-10, 2007 "Affordable Housing Week." Jackie Rickman a representative from the Tri-Valley Housing Opportunity Center received the proclamation. .. 7:55 Mayor Lockhart called for a brief recess. The meeting reconvened at 7:58 p.m. with all Councilmembers present. .. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 201 Presentation by the Dublin Housing Division on Affordable Housinsz in Dublin 7:58 p.m. 3.6 (430-80) Dublin Housing Specialist John Lucero presented the departmental information program report to Council and provided insight to the accomplishments in providing affordable rental and homeownership housing. Christine Hearn thanked the Council for giving her the opportunity to be the first owner in the First Time Home Buyers program. The City Council received the Staff Report and presentation. .. Public Comments 8:10 p.m. 3.7 Mayor Lockhart introduced the students from the GATE program at Fallon Elementary School. The children were invited to present four different challenges they could resolve within the City of Dublin. The students presented their solutions with posters and speeches. Mr. Fred Norman, a Military Veteran requested a minute of silence at the beginning of each City Council Meeting in honor of those in the military that have lost their lives in Iraq. .. The agreement between the property owners involved would no longer require City participation. On motion of Cm. Oravetz, seconded by Cm. PUBLIC HEARINGS Public Hearing Amendment of Dublin Municipal Code Chapter 2.40 Relating to Unclaimed Property and Addition of Definition for the Term "County" to the Dublin Municipal Code Section .04.020 8:22 p.m. 6.1 (610-20) DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 204 Mayor Lockhart opened the public hearing. Administrative Analyst Amy Cunningham presented the Staff Report and advised that a comprehensive update of the Dublin Municipal Code (DMC) was currently underway. This would be the first review of Chapter 2.40 which established regulations relating to unclaimed property; clarifying procedures for retention and disposition of property whose ownership was unknown or unclaimed and that had been delivered to the City to be held and disposed of by the City. These proposed revisions provided clarification and ensured compliance with state law. Mayor Lockhart asked if there is an easier method for property to be claimed by the finder without a newspaper publication. No testimony was received by any member of the public relative to this issue. Mayor Lockhart closed the public hearing. On motion of, Vm. Hildenbrand seconded by Cm. Oravetz and by unanimous vote, the Council directed Staff to revise the ordinance establishing a Lost and Found for property turned in to City Staff, and that a notice could be published in the City website. These items would be held for four months then listed in the City's Web site Lost and Found. After 10 days of the Website publication, the item would be turned over to the finder if the property is not claimed. .. Public Hearing Adoption of Rates for Garbage Collection, Disposal, and Recycling Services Provided by Amador Valley Industries (A VI) and Establishinsz the 2007-2008 Annual Assessment 8:38 p.m. 6.2 (810-30) Mayor Lockhart opened public hearing. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 205 Administrative Analyst Roger Bradley presented the Staff Report and advised that the Agreement for solid waste services between the City and A VI required the City to adopt a rate schedule which was estimated to produce a specified revenue amount as identified in the Agreement. The City had also adopted an Ordinance, which required all parcels in the City to subscribe to weekly minimum garbage service. For residential properties that were serviced with individual containers, the City collected the annual cost of minimum service with the property tax bill. The Council would consider adopting two separate resolutions establishing the garbage rates effective July 1, 2007, and establishing the Fiscal Year 2007-2008 refuse related property tax assessment Mr. Gordon Galvan a representative of Amador Valley Industries explained that a bundled rate for commercial recycling services had not been included in the original RFP which means that A VI was not being compensated for the commercial recycling service. The City Council entered into a discussion regarding the initial bid process with regards to commercial recycle collection and the omission of a bundled rate. Assistant City Manager Joni Pattillo explained that the original contract was bid as a whole contract. Mayor Lockhart asked where the incentive would be for the commercial customer to recycle. Assistant City Manager Joni Pattillo suggested that as an alternative, Council approve the proposed rates, and over the next year Staff would work with A VI to resolve the bundled rate. Ms. Pattillo also explained that this would be the reopening of a contract which would be a considered a contract amendment. The Council requested that there be adequate incentives to the commercial recycler. Mayor Lockhart closed the public hearing On motion of, Cm. Oravetz seconded by Vm. Hildenbrand and by unanimous vote, the Council adopted DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 206 RESOLUTION NO. 78 - 07 AMENDING THE SCHEDULE OF SERVICE RATES FOR INTEGRATED SOLID WASTE SERVICES and RESOLUTION NO. 79 ~ 07 APPROVING AND ESTABLISHING THE COLLECTION OF MINIMUM RESIDENTIAL GARBAGE AND RECYCLING SERVICE FEES FOR FISCAL YEAR 2007-2008 and directed Staff to work with A VI for the next 6 months to review the commercial recycle bundled rate in the contract and also address incentives and measured benchmarks that would help to increase commercial recycling. .. 9:20 p.m. Mayor Lockhart called for a brief recess. UNFINISHED BUSINESS Affordable Housing Agreement for the First Phase of the Positano Development (247 Lots) Located in Fallon Villasze 9:30 p.m. 7.1 (430-80/600-30/450/30) Senior Planner Jeff Baker presented the Staff Report and advised that The City Council would review the revised affordable housing proposal by Braddock & Logan to address the Inclusionary Zoning Regulations for the 1,043 units, Positano development in Fallon Village, and reviewed the proposed Affordable Housing Agreement for the First Phase of the Positano development which consists of 247 units. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 207 Mayor Lockhart asked if parking would be a concern on the smaller lots with the second units. Mr. Baker explained that parking would be provided by a sufficient-sized driveway. The City Council entered into a brief discussion regarding the interior standards of these units. On motion of Cm. Sbranti, seconded by Vm. Hildenbrand and by unanimous vote, the City Council adopted RESOLUTION NO. 80 - 07 APPROVING AN AFFORDABLE HOUSING AGREEMENT FOR THE FIRST PHASE OF THE POSITANO PROJECT BETWEEN THE CITY OF DUBLIN AND DUBLIN RE INVESTORS, LLC, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT and direct Staff to prepare a minor administrative amendment to the Fallon Village Stage 1 and Stage 2 PD to allow secondary units on the 3,200 lots within the Positano development. .. NEW BUSINESS Request to Initiate a West Dublin BART Specific Plan Amendment Study to Increase the Residential Density at 6600 Golden Gate Drive, Commonly Referred to as the Windstar Proiect (APN 941-1500-046) 9:51 p.m. 8.1 (410-55) Senior Planner Erika Frasier presented the Staff Report and advised that the City Council would consider the initiation of a West Dublin BART Specific Plan Amendment for the DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5,2007 PAGE 208 Windstar project to determine whether a Specific Plan Amendment Study would be authorized to increase the residential density on the site. On motion ofVm. Hildenbrand, seconded by Cm. Scholz and by unanimous vote, the City Council adopted RESOLUTION NO. 81 - 07 APPROVING THE INITIATION OF A WEST DUBLIN BART SPECIFIC PLAN AMENDMENT STUDY FOR THE WINDSTAR PROJECT LOCATED AT 6600 GOLDEN GATE DRIVE (APN 941-1500-046) P A 06-009 . Resolution of Intention to Establish Right-of-Way Lines for the Extension of Scarlett Drive and the Iron Horse Trail between Dublin Boulevard and Douszhertv Road 10:00 p.m. 8.2 (820-90) Public Works Director Melissa Morton presented the Staff Report and advised that proposed right-of-way lines for Scarlett Drive and the Iron Horse Trail would establish a right-of-way alignment to accommodate the extension of Scarlett Drive and relocate and enhance a portion of the Iron Horse Trail. This roadway would provide a connection between Dougherty Road and. Dublin Boulevard within the former Southern Pacific Railroad Right-of-Way. On motion of Cm. Oravetz, seconded by Cm. Scholz and by unanimous vote, the Council adopted RESOLUTION NO. 82 - 07 INTENTION TO ESTABLISH RIGHT-OF-WAY LINES FOR SCARLETT DRIVE/IRON HORSE TRAIL BETWEEN DUBLIN BOULEVARD AND DOUGHERTY ROAD and set Public Hearing for June 19,2007 in the Council Chambers at 7:00 p.m. . DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5,2007 PAGE 209 Letter of Intent to Participate in the East Bay Regional Communications System (EBRCS) 10:08 p.m. 8.3 (600-40) Assistant City Manager Joni Pattillo presented the Staff Report and explained that this item proposed the City signing a Letter of Intent to participate in the East Bay Regional Communications System (EBRCS), and also allowed for a good faith payment of$10,800 signifying the City's intent to join the EBRCS. In the wake of past emergencies, there was regional interest in creating a radio system that would allow all of the jurisdictions in the East Bay to communicate during emergencies. It had been proposed that the EBRCS Joint Powers Authority be formed that would, in turn purchase, install, and oversee a new comprehensive radio system that would serve jurisdictions in Alameda County and Contra Costa County. Mayor Lockhart indicated that all cities in Contra Costa County have signed a Letter of Intent. This is a great program that would benefit all surrounding counties. On motion of Cm. Scholz, seconded by Cm. Sbranti and by unanimous vote, the Council approved the Letter of Intent to Participate in the East Bay Regional Communications System (EBRCS), and approve the Budget Change for $10,800 for a good faith payment. . OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to meetings attended at City expense (AD 1234) 10:20 p.m. City Manager Ambrose reported that Staff did not have any information to report. Cm. Scholz attended an Etiquette Tea at Dublin Elementary with 5th graders. She also reported that she did visit the new dog park which is very nice. She asked if a V-turn would be possible at Stagecoach Road, traveling west, and Amador Valley Blvd. She also reported that she was interviewed by the National Research Center on Parks and Recreation. Cm. Scholz requested that the Mayor end the meeting in a minute of silence for those that have lost their lives in Iraq. DUBLIN CITY COUNCIL MINUTES VOLUME 26 REGULAR MEETING June 5, 2007 PAGE 210 Public Works Director Melissa Morton replied that there is not enough turning radius to make a U-turn on Stagecoach Road. Ms. Morton said Staff would check into this and get back with an answer. Cm. Oravetz attended the LAFCO meeting and reported that Mayor Lockhart is the new chair. He reported that 15,000 hours were added to bus routes. Cm. Sbranti attended League of Cities "Legislative Lobby Day" the League advocated Eminent Domain reform. He hosted representatives from the City of Pittsburg, they toured the City and were impressed with the high quality plans and details in the city of Dublin. They commended the Community Development Department. He also attended the Tri- Valley Council dinner. Vm. Hildenbrand attended poetry night where 2nd and 3rd graders recited a poem. She also attended Senior Life Event at the Senior Center. She reported that she was honored by Alameda County Tobacco Control Coalition for the Second Hand Smoking Ordinance. She also attended the Tri-Valley Adolescent Health Initiative. At this meeting issues specific to the individual cities were addressed. Mayor Lockhart announced that she would be interviewing new members for the Youth Planning Board for the Tri-Valley Adolescent Health Initiative. The Council discussed Mr. Norman's request. The Council's consensus was to adjourn City Council meetings honoring the men and women in uniform and those that have sacrificed on behalf of our country Mayor Lockhart received an invitation "An Elegant Evening of Fashion, Wine and Music" that will benefit the Valley Children's Museum on Friday, June 29, 2007. . 10:35 p.m. Mayor Lockhart announced that Council would adjourn the meeting in honor of the U.S. Soldiers that have died in Iraq, and go into closed session.
