RECOMMENDATION:
PROJECT DESCRIPTION:
Background:
Lutheran Church of the Resurrection is located at 7557 Amador Valley Boulevard. The project site is
located on a quasi comer lot surrounded by commercial uses to the west and south, single-family
residential to the north, and Interstate 680 to the east. The project site is zoned Planned Development with
a General Plan Land Use Designation of Publici Semi-Public Facility.
The Applicant is requesting approval of a Conditional Use Permit (CUP) to increase the capacity of an
existing preschool from 48 children to 80 children and increase the existing infant care center from 24
children to 36 children. The overall proposed capacity increase is to provide infant care and preschool
facilities for 116 children rather than the existing 72 children maximum.
History:
A preschool has been a conditionally permitted use at the Lutheran Church of the Resurrection since 1973
and the child (infant) care center has been a conditionally permitted use since 1983. Over the years, the
number of children receiving care has grown. In 1986, a Conditional Use Permit was approved restricting
the number of preschool children to 48 and the number of children receiving care from the infant care
facility to 24. The preschool and infant care centers continue to be restricted to a maximum on-site
capacity of 72 children as established in 1986.

A Site Development Review (SDR) Waiver 07-009 approved on May 2, 2007, allows for installation of a
new door along the eastern side of the existing building where the proposed preschool expansion is to take
place.
ANAL YSIS:
Operating Characteristics:
Lutheran Church of the Resurrecticn operates an existing daycare center which includes an infant care
center and preschool. In accordance with the existing Conditional Use Permit, the infant care center has a
capacity of 24 children ranging in age from six weeks to two years. The preschool has an approved
capacity of 48 children ranging in age from two years to six years. The two programs run concurrently
Monday through Friday.
According to the California Department of Social Services, current licensing hours of operation are from
6:30 a.m. to 6:30 p.m. Monday thrcugh Friday However, based upon the Applicant's written statement
(Attachment 2) current hours of operation for the full-time preschool and infant care programs are 7 a.m.
to 6 p.m. Monday through Friday. 1he part-time preschool and infant care program hours of operation are
9 a.m. to 3:30 p.m. Monday through Friday. The aforementioned days and hours of operation are not
proposed to change.
The infant care center and presch)ol are currently staffed by a total of 26 full-time and part-time
employees. Once the facilities increase in capacity, three additional employees will be hired bringing the
total number of full-time and part-t me staffing to 29 employees; however, no more than 18 employees
will be on-site at a given time.
The increase in infant care and preschool facilities shall take place within an eXIstmg building. In
addition to the existing facilities, a storage room shall be converted into an additional preschool
classroom. No new construction to ex.pand the existing building is necessary.

Existing outdoor play areas are located along the western side of the project site. According to a
representative from the California Department of Social Services, the Church does not intend to expand
the existing outdoor play area, but rather obtain a waiver exempting them from expanding the play area by
limiting the number of children allowed outside at a given time.
Parking Analysis:
There are currently 88 existing parking stalls on-site; three of which are ADA accessible. As a condition
of approval one additional ADA accessible parking stall will be required. Once this additional ADA
accessible parking stall is established there will be a total of 87 parking stalls on-site; four of which will
be ADA accessible.
In 1982, the Lutheran Church of the Resurrection subdivided its property and received approval of a Site
Development Review for the development of a 36,600 square foot office building and 69-stall parking lot
located on the western one acre portion of the original three acre parcel. As a Condition of Approval, a
joint parking agreement was entered into in perpetuity to use the adjacent site for parking. This parking
agreement allows office building occupants the ability to utilize 58 parking stalls located on the Church's
property.
The Zoning Ordinance requires that daycare facilities provide one parking stall per employee, one parking
stall per company vehicle and one loading space for every five children at the facility. In accordance with
this code requirement, a total of 18 parking spaces would be required to accommodate the 18 preschool
and infant care center staff members employed on-site at a given time. Because the daycare facility does
not have any associated company vehicles the need to provide parking for company vehicles would not
apply.
In addition to the preschool and inf,mt care center, the Church has two administrative staff members that
work on-site daily. The Church also conducts two classes weekly. A bible study class consisting of eight
participants is conducted on Tuesday mornings from 9:30 a.m. to 11 a.m. and one confirmation class
conducted on Wednesdays after 3 p.m. consisting of two to ten students. Because the administrative staff
members are on-site regularly for extended periods of time, two parking stalls would be required in order
to support the Church's administrative office use. However, the bible class and confirmation class occur
for such short periods of time that they are considered incidental and therefore would not trigger the need
for inclusion in the parking calculation.
Based upon the aforementioned information, a total of 20 parking spaces would be required to support the
preschool and infant care center and the Church's daily administrative component. Because the parking
agreement allows the adjacent property to utilize 58 of the Church's 87 on-site parking spaces 29 parking
spaces remain available for the Church's use. Therefore, a surplus of9 parking spaces exists on-site.
The Zoning Ordinance requires one loading space per five children as opposed to parking spaces.
Because the hours of child care drop-off and pick-up are staggered throughout the day based upon part-
time versus full-time care, there is adequate area for the pick-up and drop-off of the children. Staff has
visited the site on several occasions to observe the child drop-off and pick-up and has not noticed
congestion arising from the activities. Parents tend to park their vehicles for a few minutes and either
carry their children to the building or hold their children's hand while they walk to the building. The drop-
off and pick-up times are staggered and short creating a high parking space turnover and therefore
sufficient space to accommodate an increase in use. There have been no complaints received by Staff
regarding congestion on-site. Existing on-site parking is adequate to support the proposed expansion of
the care facility.

Conditional Use Permit Required Findings:
In order for the Plarming Commission to approve a request for a Conditional Use Permit, the Plarming
Commission must make findings (Section 8.100.060 ofthe Dublin Zoning Ordinance) as shown on page 2
of the Resolution (Attachment I). With the addition of the proposed Conditions of Approval contained in
the Resolution, including the provision to limit the number of children on-site at a given time, limit the
hours of operation and the hours of outdoor play, the Conditional Use Permit findings, as required by the
Zoning Ordinance, can be made.
ENVIRONMENTAL REVIEW:
The project has been reviewed under the California Environmental Quality Act (CEQA), State CEQA
Guidelines and the Dublin Environmental Guidelines, and the project has been found to be Categorically
Exempt per CEQA Section 15301 (Minor alteration of existing facilities).
NOTICING:
In accordance with State Law, a public notice regarding this hearing was mailed to all property owners
and occupants within 300 feet of the proposed project. A public notice was also published in the Valley
Times and posted at several locations throughout the City. To date, the City has not received any
comments or objections from surrounding property owners or tenants regarding the project.
REVIEW BY APPLICABLE DEPARTMENT AND AGENCIES:
The proposed project has been reviewed by the Building Division, Public Works Department, Police
Services Department, and the Alameda County Fire Department. Conditions of Approval have been
included where applicable.
CONCLUSION:
This application has been reviewed by the applicable City departments and agencies, and their comments
have been incorporated into the Conditions of Approval for the project. The proposed project, as
conditioned, is consistent with the Dublin General Plan and Zoning District in which the project site is
located and will provide children with quality infant care and preschool facilities.
RECOMMENDATION:
Staff recommends that the Planning Commission: 1) Receive Staff presentation; 2) Open the public
hearing; 3) Take testimony from the Applicant and the public; 4) Close the public hearing and deliberate;
and 5) Adopt Resolution (Attachment 1) approving a Conditional Use Permit for the Lutheran Church of
the Resurrection to intensify an existing daycare center.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING A CONDITIONAL USE PERMIT TO INTENSIFY THE USE
OF AN EXISTING DAYCARE CENTER FROM 72 CHILDREN TO 116 CHILDREN
WITHIN AN EXISTING BUILDING LOCATED AT
7557 AMADOR VALLEY BOULEVARD (APN 941-0174-003)

WHEREAS, the Applicant, Lutheran Church of the Resurrection, has requested approval of a
Conditional Use Permit to intensify the use of an existing daycare to include the following: 1) increase the
number of preschool children receiving care from 48 to 80 on-site at a given time, and 2) to increase the
number of children receiving care from the infant care center from 24 to 36 on-site at a given time; and
WHEREAS, the proposal involves intensification of a preschool use established on the project
site in 1973 and a child care center established on the project site in 1983; and
WHEREAS, the proposed use will take place within an existing building; and
WHEREAS, the project site is located within the PD (Plarmed Development) Zoning District and
a daycare center is a permitted use with approval of a Conditional Use Permit by the Plarming
Commission; and
WHEREAS, a complete application for a Conditional Use Permit was submitted and is available
and on file in the Community Development Department; and
WHEREAS, the Applicant submitted project plans date stamped received by the Planning
Division on June 18, 2007, and a written description for the requested entitlement received by the
Planning Division on April 24, 2007, and
WHEREAS, the application has been reviewed in accordance with the proViSiOns of the
California Environmental Quality Act (CEQA) and this project was found to be exempt under the CEQA
Guidelines Section 15301; and
WHEREAS, the Planning Commission held a public hearing on said application on August 14,
2007; and
WHEREAS, proper notice of said public hearing was given in all respects as required by law; and
WHEREAS, a Staff Report was submitted recommending that the Planning Commission approve
a Conditional Use Permit subject to the findings contained herein to allow the intensification of a day care
center for up to 116 children at 7557 Amador Valley Boulevard; and
WHEREAS, the Planning Commission did hear and use independent judgment and considered all
said reports, recommendatio;:s, and testimony hereinabove set forth; and

WHEREAS, the Plarming Commission has found that the proposed project is appropriate for the
subject site.
NOW, THEREFORE, BE IT RESOLVED that the Plarming Commission of the City of Dublin
does hereby make the following findings and determinations regarding said proposed Conditional Use
Permit.
A. The proposed intensification in use of the existing preschool and infant care center is compatible
with other land uses, transportation and service facilities in the vicinity because: 1) the preschool
and infant care center will continue to take place within an existing building; 2) the existing
outdoor play area will not be expanded nor the use intensified therefore noise generation is not
anticipated to increase; and 3) the pick-up and drop-off of children are staggered therefore there is
adequate parking to support the increase in the number of children from 72 to 116.
B. The proposed intensification in use of the existing preschool and infant care center will not
adversely affect the health or safety of persons residing or working in the vicinity or be
detrimental to the public health safety and welfare because: 1) the preschool and infant care center
will conform to all State and Federal standards; 2) the proposed use will comply with conditions of
approval as well as all applicable regulations contained within the Dublin Zoning Ordinance; 3) an
additional exterior exiting door shall be installed to be used in the event of an emergency; and 4)
the property shall be required to meet current ADA accessibility requirements.
C. The proposed intensification in use of the existing preschool and infant care center will not be
injurious to property or improvements in the neighborhood because: 1) the project will be located
within an existing building on a developed site well designed for the use; and 2) the project has
been conditioned to comply with all codes, regulations and requirements relating to the site
improvements.
D. There are adequate provisions for public access, water, sanitation, and public utilities and
services to ensure that the proposed intensification of the preschool and infant care center would
not be detrimental to the public health, safety and welfare because: 1) the project has been
reviewed by various City departments and agencies all of whom have commented that adequate
public services are available; and 2) conditions of approval have been incorporated into the project
to ensure that existing public services remain adequate for the site.
E. The subject site is physically suitable for the zoning, type, density and intensity of the proposed
intensification in use of the existing preschool and infant care center and related structure
because: 1) it is a developed site, generally flat in topography; and 2) the site has adequate parking
to serve the use.
F. The proposed intensification in use of the existing preschool and infant care center will not be
contrary to the specific intent clauses, development regulations or performance standards
established for the zoning district in which it is located because: 1) the use was established prior
to the current zoning designation; and 2) the project complies with all applicable portions of the
Dublin Zoning Ordinance.
G. The proposed intensification in use of the existing preschool and infant care center is consistent
with the Dublin General Plan because: the General Plan Land Use designation is PubiidSemi-
Public which specifically identifies daycare centers as an appropriate use.

BE IT FURTHER RESOLVED THAT THE Dublin Plarming Commission does hereby approve PA
06-062, Conditional Use Permit, to allow intensification of an existing daycare center for up to 116
children at 7557 Amador Valley Boulevard subject to the following Conditions of Approval:

PLANNING CONDITIONS
1. Approval. This Conditional Use Permit
approval for P A 06-062 IS to allow an
intensification of an existing daycare for the
Lutheran Church of the Resurrection at 7557
Amador Valley Blvd. This approval shall
generally conform to the Applicant's written
statement date stamped received by the Dublin
Planning Department on April 24, 2007 and
project plans date stamped received by the
Dublin Planning Department on June 18, 2007,
consisting of a cover sheet, site plan and floor
plan.
2. Permit Expiration. Construction or use shall
commence within one (1) year of Permit
approval or the Permit shall lapse and become
null and void. Commencement of construction
or use means the actual construction or use
pursuant to the Permit approval or
demonstrating substantial progress toward
commencing such construction or use. If there is
a dispute as to whether the Permit has expired,
the City may hold a noticed public hearing to
determine the matter. Such a determination may
be processed concurrently with revocation
proceedings in appropriate circumstances. If a
Permit expires, a new application must be made
and processed according to the requirements of
this Ordinance.

that any Conditions of Approval remain
adequate to assure that applicable findings of
approval will continue to be met, grant a time
extension of approval for a period not to exceed
six (6) months. All time extension requests shall
be noticed and a public hearing or public
meeting shall be held as required by the
particular Permit.
4. Effective Date. This Conditional Use Permit
approval shall become effective 10 days after the
date of approval by the Plarming Commission.
5. Fees. Applicant/Developer shall pay all
applicable fees in effect at the time of building
permit issuance, including, but not limited to,
Plarming fees, Building fees, Traffic Impact
Fees, TVTC fees, Dublin San Ramon Services
District fees, Public Facilities fees, Dublin
Unified School District School Impact fees, Fire
Facilities Impact fees, Alameda County Flood

Drainage and Water Connection fees; or any
other fee that may be adopted and applicable.
6. Annual Review. On an annual basis, this
Conditional Use Permit approval may be subject
to a reVIew by the Planning Manager to
determine compliance with the Conditions of
Approval.
7. Revocation of Permit. This permit shall be
revocable for cause in accordance with Dublin
Zoning Ordinance Section 8.96.020.1,
Revocation. Any violation of the terms and
conditions of this permit may be subject to the
issuance of a citation.
8. Minor amendments. Modifications or changes
to this Conditional Use Permit approval may be
considered and approved by the Community
Development Director, if the modifications or
changes proposed comply with Section
8.100.080, of the Zoning Ordinance.
9. Clarification to the Conditions of Approval.
In the event that there needs to be clarification to
the Conditions of Approval, the Director of
Community Development and the City Engineer
have the authority to clarify the intent of these
Conditions of Approval to the Developer

as stipulated in this Conditional Use Permit.
19. Use Capacity. A combination of the Infant Care PL On-going
Center and the Preschool Program shall serve a
maximum of 116 children at a given time. The
facility shall be used for day use only and not be
used as a 24-hour care facility nor shall it
accommodate any living or sleeping
arrangements.
20. Outdoor Activities. No outdoor activities shall PL On-going Planning

21. Property Maintenance. The Applic~t shall PL On-going DMC 5.64
maintain all building materials m good
condition, including canvas awnings and signs,
and shall keep the site clear of graffiti vandalism
on a regular and continuous basis.

for the building or gate will be placed in the box

37. Fire Extinguisher. Provide 2A10BC fire F Prior to Fire
extinguishers within 75 feet travel distance of occupancy
any portion of the space. An approved sign in
accordance with the Uniform Fire Code shall be
conspicuously posted above the extinguisher.

38. Addressing. Approved address numbers shall F Prior to Fire

minimum of five inches on commercial

Resurrection Lutheran Child Development Program
~tatement for Conditional Use Pennlt
Quality infant care, child care and preschool are important resources for families in our
community. Resurrection Lutheran Child Development Program offers full day and part
day care for infants and preschool age children. We operate on a non-discriminatory
basis without regard to race. color, religious background, national origin, or ancestry.
Children are enrolled on a first come first served basis.
Our infant program is licensed for a total capacity of 36 children ages 6 weeks to 2
years old. Our preschool program, which includes full day and part day, has a license
capacity of 64 children ages 2 years old to 6 years old. Our licensed hours of operation
are 6:30 am to 6:30 pm Monday through Friday. However, our current hours of
operation are 700 am to 6:00 pm Monday through Friday for the full day program, with
the part time preschool operating during the hours of 9:00 am to 3:30 pm Monday
through Friday. During our eleven hours per day of operation we employ a total of 26
full time and part time paid staff members, but a maximum of 18 employees are on site
at one time.
Our previous Conditional Use Pennit allowed 72 children in the facility at anyone time.
We plen to utilize our existing facility and serve the maximum children allowed by
Community Care Licensing, Department of Social Services, State of California This will
increase the usage to 116 children at anyone time.
We use the physical plant and parking lot of Resurrection Lutheran Church. We use the
facility during the week when the church is not using it. Parking is more than adequate
for our needs as arrival and departure times are staggered throughout the day and do
not create any significant change in traffic. As an outreach of Resurrection Lutheran
Church, we are providing an important community service and have waiting lists for our
