AN ORDINANCE AMENDING CHAPTER 2 OF TITLE 8 OF THE ALAMEDA COUNTY ORDI-
NANCE CODE RELATING TO ZONING
The Board of Supervisors of the County of Alameda. State of California, do ordain as
follows:
SECTION ]
Chapter 2 of Title 8 of the Alameda County Ordinance Code is hereby amended in the
following rhanner:
A 17 acre site located or~Wineberry Way which in turn is located on the east side of Village
Parkway, approximatety 600 feet north of Davona Drive. Dublin. unincorporated Alameda
County; bearing County Assessor's Designation: t~'ap 941. Block 190. P~rcel 5 as shown on
the maps labelled "1384th Zoning Unit, Exhibit A, December 12, 1978, and Exhibit B, January
15. 1979/' on file with the Alameda County Planning Commission at 399 Elmhurst Street.
Hayward, California. is hereby rezoned Io the PD (Planned Development) District and the
Land Use and Development Plan labelled "1384th Zonlng Unit, Exhibit B (design drawings),
and C (general provisions) January 15, 1979." on file with the Alameda County Planning
Commission at 399 Elmh urst Street. Hayward. California. is adopted as the regulation for the
use, improvement and maintenance of the property within this District, A map of the unit is as

Th is Ordinance shall take effect and be in force thirty (30) days from and after the date of its
passage and beJ'ore the expiration of fifteen (15) days after its passage it shall be published
once with the names of the members voting for and against the same in The Inter-City
Express, a newspaper published in the said County of Alameda.

GENERAL PROVISIONS
The final map of Tract t~lg$ shall be filed with the County Recorder of Alameda County
prior to commencement of any improvements in '~he project, with the exception grading.
Prior to any grading, a detailed construction grading plan and soil erosion and sedimentation
ntrol lan re red by a Civil Engineer in accordance with maps and provisions of
approved by the Director of Public Works, Grading shall be completed in accordance
with this plan to the satisiaction of the Director of Public Works.
II grading is commenced prior to filing the final map, a surety or guarantee, as determined
suitable by the Board of Supervisors, shall be filed with the County o! Alameda to insure
restoration of the site to a stable and erosion resistant state if the project is terminated
pr ematur ely.
Prior to occupancy, project grading shall be completed in compliance ~vith recommendations
contained in the soil and geologic report, as approved by the Director of Public Works~
which is made a part of this approval~ and sha11 be done under the supervision of the
Project Soils Engineer or Civil Engineer who shall upon its completion submit a declaration
of such compliance to the Building Official and Director of Public Works.
Prior to final inspection and occupancy of each lot and unit or group of lots and units
in the project, the following shall be done:
a. Required landscaping shall be installed in compliance with the plans required in
Conditions of Approval, Tract ~lgg.
b. Provide evidence to the Building Official from the Pacific Gas and Electric Company
that the units meet p.G.&E.'s requirements of the "Energy Conservation Home
Program" 100 point rating.
c. The Project Architect or Civil Engineer shall provide a letter to the Building Official
stating that water conservant toilets, shower beads, faucets~ and automatic dis. hwashers
with low flow cycles have been installed in the units.
d. Utility meters shall be screened :[rom public view.
Prior to final inspection and occupancy of the last 10 units in the project, the Project
Civil Engineer shall provide a letter or letters to the Building Official stating that the
project, as built, complies with provisions o:[ this District. Said letter or letters shall
contain a report accompanied by a map indicating any authorized changes pursuant
to General Provision #7.
During the construction stage of the project~ changes in the provisions of the approved
Land Use and Development plan and beyond those required tander provisions contained
in Exhibit B, may be authorized through Zoning Approval to the following extent:
a. Grade: Grades may be changed in elevation to two feet.
b. Unit Type and Number of Bedrooms: Designated unit type, location, and number
of bedrooms may be changed for any other unit type illustrated on Exhibit B.
If the requirements of the approved plan are specified as minimum or mayJmum~ said
minimums or maximums shall not be exceeded. Any other change may be permitted
to the extent and in the manner specified under Section 8-31.18 of the Alameda County
Zoning Ordinance.

After the proiect has been completed, and sub]ect to observing any minimum and maximum
dimensions specified in the approved plan:
a. Improvements may be added or modified in the individually owned lots provided
that no rear yard be reduced below 20 feet deep, and no side yards or building
height reduced without obtaining Zoning Appr. oval.
b. plant materials, arbors, fences, paving materinis, and similar landscape features
may be added, replaced or deleted.
Any other changes may be permitted to the extent and in the manner specilied under
Section g-12.1 g of the Alameda County Zoning Ordinance.
