AN ORDINANCE AMENDING CHAPTER 2 OF TITLE 8 OF THE ALAMEDA COUNTY ORDI-
NANCE CODE RELATING TO ZONING
The Board of Supervisors of the County of Alameda. State of California do ordain ag
follows:
SECTION I
' Chapter 2 of Title 8 of the Alameda County Ordinance Code is hereby amended in the
following manner:

GENERAL PROVISIONS
1423RD ZONING UNIT
The Final Map of Tract 4tit5 shall be flied with the County Recorder prior to
commencement of any improvements in the project area with the exception of
grading and improvements related thereto. Any modificat1ons to project design
approved by this reclassification action shah supercede design on the tentative
map and shall be considered as an approved modification of the tentative map.
Ali conditions of approval of Exhibit C, Tract ## t 5 pertaining to construction
activities~ grading~ drainage~ water quality, erosion and sedimentation control
and improvements related thereto are incorporated by reference as provisions
of this reclassification.
Prior to issuance of any Building Permit, a soil investigation conforming to re-
quirements of Chapter 29 of the Alameda County Building Code shall be approved
by the Building Official.
Prior to occupancy of any strdcture hereby authorized, a precise landscaping plan
prepared by the Project Landscape Architect based on the general landscape
proposals indicated on Exhibit B, l~23rd Zoning Unit shah receive Zoning Appro-
va]. Said plan shah include drought-resistant plant materials, an irrigation system~
long-term maintenance program for the homeowners association (including advice
on maintenance of drainage facilities), a lighting plan for common areas, signing,
unit identification and fencing details, and shah conform to provisions of the
erosion and sedimentation control plan required under conditions for Tract
All landscaping shall be maintained at the developer's expense until landscaping
has been fully installed and established. Transfer of maintenance responsibility
to the homeowners association shall not occur until requirements of this provision
and the landscaping plan are met.
The project shall comply with provisions g, 11, i2, and 13 of the Condominium
Guidelines adopted by the Planning Commission on February 20, 1979. Individual
water meters shall be installed adjacent to each unit.
Automatic garage door openers shah be installed as a standard feature in each
unit.
The following provisions shall be met~ and Zoning Approval certifying thereto
secured, prior to occupancy of any dwelling units in the project, unless another
time of compliance is specified below:
a. Provide evidence to the satisfaction of the Planning Director that provision
has been made for the ownership and maintenance of common areas.
Grading shah be completed in compliance with the recommendations con-
rained in the soil and geologic investigation report~ as approved by the Building
Official, which is made a part of this approval, and shall be done under the
supervision of the Project Soils Engineer or Project Civil Engineer who shall
upon its completion submit a declaration of such compliance.
Prior to occupancy of the last remaining ~ dwelling units in the project,
and in any event~ within one year after the occupancy of the first unit,
landscaping shall be done under the supervision of the Project Landscape
Architect, who shall upon completion submit a declaration of compliance
with approved plans.

~ letter or letters shall contain a report accompanied by a map indicating
// any authorized changes pursuant to General Provision 10.
e. Provide a letter from the Pacific Gas and Electric Company stating that
the proiect meets its requirements of the Premium "Energy Conservation
Home Program".
f. Provide a letter from the Project Architect or Civil Engineer stating that
water conservant toilets~ shower heads~ faucets and automatic dishwashers
with low flow cycles have been installed in the units.
g. Provide evidence to the Planning Director that utility meters and trash
recepticles are screened from public view.
h. Parking along the project access road shall be permitted in designated locations
only and the project road shall be so posted. No recreational vehicles, as
defined by Section 8-22.5i of the Alameda County Zoning Ordinance, or
trailer-hauled boats shall be parked or stored within the project. Vehicles
parked contrary to this provision and posted regulations shall be removed
by the homeowners association.
9. Prior to filing the Final Map, the developer shall provide evidence to the Planning
Director that requirements of Provision 8h and methods to enforce it are incor-
porated in the conditions~ covenants, and restrictions recorded for the proiect.
10. During the construction stage of the project, changes in the provisions of the
approved Land Use and Development Plan and beyond those required under pro-
visions contained in the Exhibit B~ may be authorized through Zoning Approval
to the following extent:
a. Grade: Grades on the construction grading plan may be changed a maximum
of 5 feet from those shown on the grading plan in Exhibit B.
b. Walkways: Alignment and material of walkways may be modified provided
that a system of walkways to give pedestrian access to all commonly used
open spaces is installed.
c. Dwelling and Patio Location: Dwelling units and patios may be shifted
laterally to five feet. Patios may be shifted from one side of a building
to another.
d. Plant Materials: One variety of plant materials may be substituted for
another of similar size and characteristics.
e. Landscape Features: Arbors, mounds, benches, fences, and other landscape
features may be added or modified in design, location and materials.
f. Accessway and Parking: Accessway and parking spaces may be shifted
laterally to ten feet. Carports may cover any approved parking spaces.
g. Unit Type and Number of Bedrooms: Designated unit type and number of
bedrooms may be changed for any other unit type illustrated on Exhibit
B.
If the requirements of the approved plan are specified as minimum or maximum~
said minimums or maximums shall not be exceeded. Any other change may be
permitted to the extent and in the manner specified under Section 8-31.18 of
the Alameda County Zoning Ordinance.
i [. After the project has been completed, and subject to observing any minimum
and maximum dimensions specified in the approved plan:
a. Improvements may be added or modified in the individually owned lots provided
that no deck/patio area is reduced below that shown on Exhibit B.

/ b. In the common areas, plant materials, arbors~ fences, paving materials,
and similar landscape features may be added, replaced or deleted.
/ c. Carports covering existing open parking spaces constructed m the same
manner as approved in the initial construction may be added.
d. Any construction, repair or replacement which would occur in the norma!
course of maintenance of the common areas as the project matures may
occur subiect to the securin§ of any permits or paying fees required by other
ordinance.
Any other changes may be permitted to the extent and in the manner specified
under Section ~-4P~I~ of the Alameda County Zoning Ordinance.
12. The proiect homeowners association shall submit to the Planning Director, and
keep up-to-date, the name, phone number, and mailing address of the official
representative of the homeowners association. This provision shall be made a
requirement of the proiect CC&R's.
