RECOMMENDATION: ~ Adopt the Resolution accepting improvements associated with
\;fI... Parcel Map 8524, Dublin Gateway Medical Center, Phase I.
FINANCIAL S~MENT: Triad Dublin Gateway, L. P., has provided a Maintenance Bond cash
security in the amount of $21,630.00 (US Bank Check No. 1064) to
replace the Performance and Labor and Materials Bonds cash
security that guaranteed the improvements. The Maintenance Bond
will guarantee against defects for one year. Improvements on
Glynnis Rose Drive (private street) will be maintained by the Koll
Center Development. Once these improvements have been accepted,
the City will incur landscaping maintenance costs along the Dublin
Boulevard and Tassajara Road frontages, which will be paid by the
Santa Rita Assessment District.
DESCRIPTION: Triad Dublin Gateway, L. P., recently completed site improvements
associated with Parcel Map 8524, Dublin Gateway Medical Center, Phase I (the proposed Phase 2 hospital
and parking garage will be constructed in the future). The project site is located at the southwest comer of
Tassajara Road and Dublin Boulevard. The work consisted of constructing left-turn lane improvements
on Glynnis Rose Drive, signing and striping, landscaping and an on-site parking lot. The construction was
governed by an Improvement Agreement executed on August 2, 2005, via City Council Resolution No.
161-05.

The developer and the contractor have completed the work governed by the agreement. Since the
improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of
the Public Works Director, it is appropriate for the improvements to now be accepted by the City for
permanent maintenance.
At the time the City and Triad Dublin Gateway, L. P., executed the Improvement Agreement for Phase 1
site improvements, the developer provided a Performance Bond and a Labor and Materials Bond cash
security, in the total amount of $86,520.00, to guarantee performance of the work. Now that the work is
complete, this bond may be released in accordance with the authority contained in ~66499.7 of the
Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work
for a one-year period following acceptance. The developer has provided a Maintenance Bond cash
security in the amount of $21,630.00, which is 25% of the original Performance Bond cash security, and
which is sufficient to guarantee the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting improvements for Parcel Map
8524, Dublin Gateway Medical Center, Phase I.

DUBLIN GATEWAY MEDICAL CENTER, PHASE I
(TRIAD DUBLIN GATEWAY, L. P.)
WHEREAS, the developer of Parcel Map 8524, filed November 23,2005, in Book 286 for Parcel
Maps .at Pages 38-41, previously entered into an Improvement Agreement with the City of Dublin to
improve said Parcel in accordance with plans and specifications on file with the Public Works Director,
said Parcel identified as follows:

WHEREAS, the Street Improvements associated with Parcel Map 8524 are complete in
accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction
of the Public Works Director; and
WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that
guaranteed the Improvements can be released, in accordance with the authority contained in ~66499. 7 of
the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1.
The improvements completed within said Parcel Map are hereby approved and accepted
subject to a one-year guarantee period; and
2.
The original Performance Bond cash security issued by Triad Dublin Gateway, L. P., for
improvements in the amount of $86,520.00 (East-West Bank Check No. 1005) be released;
and
3.
The original Labor and Material Bond cash security issued by Triad Dublin Gateway, L. P.,
for improvements in the amount of $86,520.00 (East-West Bank Check No. 1005) be
released; and
4.
The submitted Maintenance Bond cash security issued by Triad Dublin Gateway, L. P., in
the amount of $21,630.00 (US Bank Check No. 1064) be accepted as security for the
aforesaid one-year maintenance period, said period to commence on this date and terminate
on the 4th day of September, 2008.
